Not ALL. If you believe that the directions for Visa applications on this website are the ONLY correct and acceptable way to apply and actually ARGUE that someone's approved application is incorrect, you are obviously misguided.

No one got a Law Degree with a specialty in Immigration and an up-to-date practice by reading this website. Without that we are all "loose guided." No one wins an arguement in an immigration interview by saying "I read it on visajourney.com," but you may manage to find useful information in the experiences that others went through which can help you with your process. Or you can just chat and boost your thread count by posting witty little comments with no constructive input... Whatever floats your boat. There is plenty of misinformation to go along with the worthwhile valuable information on this site.

you need to understand that the Embassy can ask for anything they want. These are only guides.... The best information comes from the posters who actually experienced different circumstances.
The members of this forum are very supportive. Alot of people have waited far longer than you have. If you only waited 5 months for an approval from USCIS then consider yourself lucky. You still need to go through the NVC and then pass your interview. An approval from USCIS is not a visa approval. Its just the beginning.

You may think criticizing how we went through our process is helpful, but considering it was APPROVED it only shows ignorance of the system and the variation within. Websites like visajourney are loose guides to the process at best and you should not read into THEIR way like it is the only correct way. Learning one method does not make anyone an expert.

Regarding K3 not needing I-864, it is also on an INS page: When the K-3 visa holder applies for adjustment of status, he or she will adjust status as an immediate relative, and at that time will require a Form I-864. (link)
Again, arguing over if you think it is the correct form in an APPROVED application is completely silly.



you don't need the I-864 for your K-3 interview..... You will need it for the Adjustment of status.

There is a HUGE difference in your case. You had to deal with deportation. Marriage after deportation procedings begin will not help for adjustment of status. However, if there is no deportation, and the beneficiary is still in the U.S., neither work without authorizaton nor overstay can be used to deny adjustment of status based on marriage to a USC.

Other adverse factors (such as deportation procedings) can and will cause a denial for adjustment. You may be very upset regarding your individual circumstance with the deportation, but be careful about dispensing advice regarding others wanting to adjust status that do not have the same obstacle.

Actually, being married to an USC does factor into the "forgiveness" - in fact, only marriage to an USC gives you any chance for this.

She was almost yelling at us. I had to rephrase my statement to make her happy.

My suggestion would be to contact your local congressional office and ask them to inquire abouit your petitions. They have a direct contact at the USCIS. The operators at the USCIS are scripted. They have no information at all. Also, put in a service request at the USCIS. The processing times are posted on the USCIS website. It may not speed up the processing but you can at least get some answers as to why they are taking so long. It may attract attention to your petitions and they may start to process them due to your inquiry. WHO KNOWS !!! GOOD LUCK !!!

You don't have to register your marriage here in the US. As long as you have your marraige papers from the country you got married in, it is recognized. When I changed my name on my driver's license and my social security card, all I needed was my marriage license. My credit cards never asked for anything, they just changed my name over the phone.

if she applies for a visitors visa you will have to disclose your marriage. Even if she got a visa ( which is unlikely) she might be denied entry to the US. They are likely to think she has intentions of just staying in the US since she has a USC husband.

I don't know how soon you want to visit the US. It took 8 1/2 months for the USCIS to touch my petitions and approve them. Then another month to attend our interview.
Read the Guides on VJ and check out the processing times. I think they are down to 5 months now.

Don't get offended, but yes it is considered fraud, and you can have a hard time during your status adjustment.

I'm not sure 'STUPID' is an accurate word. watch what you say....
If you want to chance getting married and and then try to bypass the legal process.... more power to you..... IF you get denied entry on your B2 after you get married, you will have to explain the deniial in your interview..... You may not get denied, but I know a few couples who married and filed the proper papers and when they try to return to the US on the B2.... they got denied. It caused HUGE problems at their interview and caused more delays.

Im not sure if you think you have some bright idea that no one ever thought of......... But everyone on this forum is/has followed the LEGAL process and they are waiting or have waited however long it takes.

B2 Visa's are not that easy to get. B2 visa's are for tourism, NOT TO GET MARRIED.
I got married in Nov 2007. It took 5 months to get my marriage cert so I could file the I-130 and I-129F. It took the USCIS 8 1/2 months to review and approve our petitions. Another month to go through NVC and get the interview out of the way. We need to file waivers, so I am looking at another year of processing.

If you only have to wait 6 months for your petition to be approved, consider yourself lucky.
THink about all the people on this forum who are filing the correct way ( I-130, K1 or K3) and then they hear of someone who wants to get married on a tourist Visa and bypass all the USCIS garbage. People wait for months because that is the legal proceedure.

I call every day to the NVC and get nothing. It's almost a month now. Umm, I don't want to wait 90days. Should I send NVC my approval notice and a letter saying they never received my case? Maybe it can get to someone's hands.



I called the NVC everyday too. My papers took about 15 working days to get to NVC. It made me so mad because I was approved on the same day as 4 or 5 others that I friended here on VJ. All thier papers got to the NVC about 3 days after the approval. My papers took forever.. I swore they lost the papers or they blew off the mail truck. Once they got to the NVC, they were shipped to Costa Rica and I had my interview about 2 weeks later. It all moved soooo fast after that. Also remember that their automated system is not current. I called the NVC after I had my interview and the system still said they had no record of our case. Have faith..... your papers will get there. I KNOW how hard it is to wait.... But there isn't anything you can do... They move at a snails pace... And the holiday week is here. Probably half the staff took vacation this week. I was in your exact shoes this time last year. The holidays were murder..... so heartbreaking.

Hello,

I recently filed an I-130 for my wife who lives in Ontario, Canada. I am a little uncertain if I can travel out to see her while the case is still in it's initial review. I should think that I would be able to and my wife thinks the same, though I am just worried it might mess the application process up. I would really like to go and be with her this Valentine's Day. I was just wondering if anyone knew if it was acceptable for the petitioner to travel internationally while a case is pending, or if perhaps there was some document that would need to be approved first? Thank you for your time in reading this.



I traveled 10 times to Costa Rica while our papers were in process. The USC is able to travel.

He isn't behind the times. He just wants to cover all bases. He told me the K-3 gets processed with the I-130 and if the I-130 goes smoothly, the K-3 gets closed. He told me he has had a few cases where the I-130 got caught up and the K-3 got approved first. I sent him a message inquirering again about the I-130 processing time without the K-3.



IMO, it would appear your attorney is behind in the times; I say this because the attorney appears to be unfamiliar with current NVC policy which is when they have an approved I-130 on station, the I-129F that was filed to start the K3 path is administratively closed leaving only the I-130 active. An active I-130 would place the couple on the CR-1 visa path (IR-1 if married for 2 years or more).

How do you know for sure that the K-3 slows down the process? Whos to say they don't pair the two in the line with the I-130? My attorney said it is silly not to file both. I specifically asked him about the processing being slowed down because I read that several times on this site. I'm not paying him anything extra to file since the program they have populates the blanks for both petitions at the same time. He said he has had a few cases where the I-130 got caught up and the K-3 went through first. Yes... the fees are different and you do have to pay for the adjust ment when they come to the US, but some people aren't interested in fees, they just want to be with their spouse ASAP. When the I-130 gets approved, they just cancel the K-3.





Your lawyer is incorrect on a couple of issues:
- it can and often does slow down processing to also file for the K3, because it means the I-130 is being pulled out of line to be matched up with the I-129F
- It doesn't cost to file the K3 as such, but it costs more later on, even in the rare case where a K3 gets aproved (I have seen only one in the last 2 years), because the K3 cannot work for several months in the USA, and has to fiel and pay for Adjustment of Status.

I was just sitting with my immigration lawyer 2 days ago. He advised me to do the I-130 AND the K-3. He says they get processed together, but you never know if there will be a problem with the I-130, so he says it can't hurt to file both. It doesn't cost anything to file the K-3 and he says the K-3 doesn't slow anything down. They do still exist, but since they get processed together, it makes sense to go with the I-130.

Also, if you get married in Columbia you cannot file ANYTHING before you have the marriage cert. Filing in July will simply delay your case and be ultra expensive when you have to file everything again after the wedding

Just so you know.... You can't start the process without being married. For the K-3, you have to have a marriage certificate. Also, You can't file the K-3 without first filing the I-130. I just sat in an attorneys office yesterday for 3 hours. All my paperwork is finished, I just need to get married on Friday and give them the certificate when I get it. Then the paperwork gets sent in. Read the guides on this website. They are very easy to understand. It will really help you. You can also check the processing times to give you an idea of what kind of time frame you are facing.

Hi everyone! This is my first post, and probably the first of many in what is clearly going to be a stressful process. Here's some quick info to sum up our situation:

I'm an American citizen living in Spain with my fiancé who is Colombian (soon to be granted, and I mean it could be any day, Spanish citizenship). We'd desperately like to save any time we can in the visa process and not be apart for longer than we have to be. The options as I see them are: getting married in Colombia and then applying for the K-3 visa, or applying for the K-1, and getting hitched in the U.S. The man at the US consulate here in Madrid said that the K-3 would be faster, simpler, and less hoops to jump through-simply because we'd already be married.

So as of now, our plan is to get married in Colombia in September or October, but we'd like to start now or at the appropriate time with the visa process, so that after the wedding, she would essentially only go back to Spain for her interview and whatnot. Is this plausible? For example, could we send the I-129F in say July to get a jump start, then get married in September, and by that time, at least everything on the Stateside end of the visa process would be finished and we'd shave of a couple of months of the process before the wedding? Also, with her new Spanish citizenship, she may come to the States after the wedding and stay for the allotted 3 months with me while everything is getting processed her, and then she'd go back and do the medical check and interview and all that stuff.

Is it possible? Is there a better way? Or is the K-3 pretty speedy in general? If we end up only spending a month or 2 apart, it would be fantastic!

k3 are rarely granted.  File the I-130 for your son, delay at the NVC until his file can be met up with hers. 


Also include a copy of the NOA1 (and/or NOA2) of your wife's file so the USCIS can meet up the two files if possible. 


yesterday I just filed a K-3 after my lawyer called and suggested it. I am an April filer for the I-130. ( already 6 months in)  I was told they will re-start processing the k-3's. Processing time is posted at 5 months.

My K-3 is being sent to the TSC.  With the estimated 16 month processing time for the I-130's, he said it makes sense to file the K-3 and see what happens.  

 

The reason the K-3's were rarely granted is because for a while there, they were getting processed at the same time with the I-130's. Then the K-3 got cancelled.

 With the huge delay at the NBC, hopefully the K-3 processing will pick up . It looks like they will get processed way before the I-130s.

There are a lot of folks here on VJ that are quick to give mis-information. Stating K3 is obsolete, your I-130 will be pulled and you'll loose your place in line etc. Fact is the K3 IS valid..just go on the USCIS website and look. And the whole bit about pulling your I-130 and placing it at the back of the line is non sense too. If that was the case then every time you went for Infopass or made a call wouldn't they do the same thing? This is a good website to share info, share experiences, give reviews etc. But it seems that its also a good place to get mis-guided by VJ rumors. I say if you want to know something official, than get your info from someone official. Can anyone show me on the USCIS official site where it says K3 is obsolete? Can anyone show where USCIS states that my I-130 will be pulled and put in the back of the line for filing a K3? Nope... Anyway good luck on whatever visa you decide to file! smile.png

I was told this afternoon that they are re-starting the K3. My lawyer asked me to come in and sign the papers so they can submit it tomorrow. I am an April filer.  He said processing time is 5 months.  I guess its like starting over because I am just at the 6 month mark with my I-130. He thinks its worth it to file now.  So here we go....

The online status will stay "initial review" until you are approved. We don't get the luxury of being updated every step of the way. AFTER your file is approved, it will goto NVC.

The NVC does not process the K-3. It only assigns a case number and then ships it to the Embassy. Then the embassy takes it from there.  Try and see if you can talk to a person at the NVC because it is possible that they already shipped your file to the embassy.   I did a K3 back in 2008. It only took a week and a half for the file to get to the embassy. Then I called the embassy the next day  and they were kind enough to email the packet so we could get started on the medical stuff.  I had my interview within a few weeks after their receipt of the file.   Don't settle for one answer.. call a few times if you have to.   There is a way they used to track the file on its way to the embassy via DHL... I forget how they used to do it... Do a search on VJ... I'm sure you will find it.

hi guys we have filed our i 130 at 1st may bbut unfortunatly still no news and almost ppls saying that ll take over a year ..so we are thinking to apply for K3 visa ..i want to know what kinda documents we need to apply for K3?

any kinda help ll be highly appriciated

This may seem like a basic question that I should already know the answer to, but I have not seen the information that I need anywhere. I am a US citizen and I married a foreign woman and we are getting ready to fill out all of the paperwork to file a petition for the spousal visa. The very first thing that the G-325A form asks for is FAMILY NAME... okay, but are they asking for just her maiden name or her new married family name? I know that it matters and that if I put the wrong one in they will return the application. Can someone please clarify this for me, I would greatly appreciate it! Thanks.

For me, it was about making everything match and to create the least amount of confusion for the USCIS.  I am the USC. I decided not to change my name until this is all over.  I wanted all my docs to match.  For me to change my name here in the US is a huge pain in the A$$. License, passport, social security number . I want to continue to travel, so I decided to avoid all that for now. 

 

IMHO, If she wants to change her name, do it before you file so all your docs match.

Your K3 will be approved but it will be cancelled when it hits the NVC.   NVC process is taking about 4-5 months now... Every interview letter is different. It depends on what you sent to the NVC and what the embassy specifically asks for.   It could be W2's or an original divorce decree for the petitioner. It could be original police certificate with translation even though you already sent one to the NVC.  it really depends.  You should get your NVC documents ready while you wait for your I-130 approval.   Go check out the NVC July filers thread ad read the first post by Saylin.  Read the NVC WIKI 10 times. It will answer most of your questions.  If you don't understand something, post a question.   Saylin's  is the immigration queen.  She follows the thread

Start the process now and hope for the best. The k3 will get canceled once it gets the nvc. Expect 6 months at uscis, 4 months at the nvc and then another month and a half to get to your interview. Add a few weeks inbetween for transit. Many tried to expedite due to pregnancy but since pregnancy is not a reason to expedite....Their requests were denied. Im thinking by the time you get to the nvc, your wife may be too close to delivery to travel anyway. Good luck. Read the nvc wiki so you know what you're facing and do not mail your original documents to the uscis. You will waste time trying to obtain the documents again when you need to send them to the nvc.

UPDATE:

Got my NOA2 e-mail notice TODAY!!! Waiting for the mail!!! It's been approved, no RFE's, now we can focus on paying the fees and getting an interview set up!!

your file will get sent to the NVC.  Processing there is 4-6 months. Then another 6 weeks for your interview.

Follow the OCTOBER NVC thread and read all the links in the very first post. Especially the NVC WIKI.
