Did your husband filed also i 130?

you can't file the K-3 unless you already filed the I-130. You need the NOA1 when filing the K-3.

 

 

K-3's weren't really being processed a little while back ( they were joinung them with the I-130) because the I-130's were only taking 6 months, but NOW... the processing times for the I-130 are posted at 12 months or more ( 16.6 months)  so my lawyer advised me to file the K-3 the other day.  The K-3 was introduced years back to shorten the wait while the I-130's were taking a very long time....   I think it applies now

To file a K-3 does the petitioner has to be in the US ???  With no clear answers or accurate processing times I think the best option we are left with is to file for k-3 ...  Anyone has more details about this process ???  For what I understand the processing time is about 5-6 months (better than the year estimate that we have for the I-30)  that cost more and that in order to complete the whole process (receive the green card) may take longer at the end are basically the cons but, I personally don't care to wait 2 years or pay more for the green card if I'm already in the States, I'm honestly anxious, desperate and willing to do whatever necessary to get out of this country and go back to the States .. I'm starting to feel that I'm no longer stressed out but sinking into depression cray5ol.gif cray5ol.gif cray5ol.gif  If anyone knows anything about this K-3 please!!  please !!!!!!!!!!!!!!!!!!!!!!  HELP      

no, you don't have to be in the US to file.. Go ahead and file... I just filed this week and my I-130 is at 6 months (TODAY) . I am not willing to wait a ridiculous YEAR for our

 petition to be approved.  My main goal is to be together, once he is here, I DON'T CARE ABOUT THE EXTRA COST !!

NEXT IN LINE??  In my world, first come first serve.....  right? no matter how many people start processing cases, you would think they would go by PD... Were you ever able to confirm if you're at a field office or the NBC? Suddenly being at a field office is looking pretty good, if they honestly expect to clear the backlogs there in the next couple of weeks. It seems incredible based on the volume at some places (e.g., NYC), but I'm crossing my fingers for you and all the other Jan-April filers all the same!

I was told several times that my file was NOT transferredd. Even the Ombudsman's office told me I am still at the MSC.

 

The April 29 file that was approved last week or so  reported that her approval came from the field office. She was not aware it was there until her approval.  So I am wondering if they are handing out lies to avoid the flood of calls if they confirm a transfer.

its not really a priority date for I-130's.  Priority dates are used for the limitied visas.  ( per the Senator's advocate)

It is the date the USCIS receives your file. 

and it seems they don't process according to that date anyway... it could have something to do with how fast the background checks come back and if there are underlying issues they need to straighten out before it gets placed in the  dusty vault.  So maybe they are all mixed in the boxes. 


PD? what is that? how do I know what my  PD (whatever that is) is????

It isn't a secret. And k3s are no longer issued because the timeline for the cr1 is not years and years like it used to be, the timeline is the same. The k3 was used when it took years for the cr1 to be issued, now it only takes months. Before stirring the pot, know the facts.

K-3s were issued in 2009 when the  I-130s were taking about 11 months..  NOT YEARS...   And I am not sure which planet you live on, but the I-130's here on Earth are taking a very long time. not just months these days.    Don't hammer these guys for stirring the pot.... It seems like you took on that job... 

 

My attorney pulled me back in his office to file the K-3 6 months after I filed my I-130 because he received word that they would be re-starting the K-3 processing due to long I-130 processing backlogs.  Lawyers just don't make up that kind of #######. and no, he didn't charge anything extra and it was more time consuming on his part...  he also pulled every one of his other clients who had a pending I-130 and filed the K-3.

 

 Also, the Ombudsman's office told me they see K-3 approvals all the time.. Know YOUR facts. 

 

And for all of you who say the K-3 is obsolete... Ok, then explain why it is still offered on the USCIS website ( for free) and why they still post processing times?   Why clog the system with a file you never intend to process?  Just something to think about.  and just because there aren't  that many stats on K-3s here on VJ doesn't mean they don't exist....   smh

Wow,  Stirring the pot?  No just asking for a K3, that should be an option for us but is not.  K3's are set up to process in 30 days. I see your timeline (got thru to interview in 220 days) so I can understand why you would think this is a matter of months for everyone.  But alot of us are now waiting 11 months (or more) just for a NOA2 on the I-130.  Then the NVC which is slowing down alot now.  But then again, you sound like you got it all figured out so tell me how long is it taking for a CR1-IR-1 today?

It is not illegal to come to the US on a tourist visa, get married and adjust status while here. It happens all the time. My wife and I did it, there is a section on this board dedicated to it. My wife (then girlfriend) came here on a 2 month visit for the summer, she had all intentions of going back to Canada after her visit was over. I proposed to her two weeks before she left. She decided to stay, we got married a few months later and adjusted her status without her ever leaving. Perfectly legal.

 

The only time it would be considered fraud is if you misrepresented yourself to an immigration official upon entry. If you enter the US on a tourist visa with the preconceived intent of marrying and adjusting status, then it is considered fraud. However intent alone is still not enough to deny AOS, there has to be proof of misrepresentation provided by USCIS to deny any AOS application on a tourist visa.

I know tons of people who have done it that way, unfortunately some of them got one over on immigration because it was only for a greencard.   I hate when that happens because the rest of us pay the price.   But no, its not illegal to marry on a B2 visa

This sort of thing was discussed here in the  past, it comes up every single time one group/type of petition moves ahead at whatever center they are in, and the rest go wild laying the blame. In the wrong place. It's human nature I suppose, to want to lay blame, and somehow punish those speedier filers for 'holding up genuine' petitioners, and feeling as though They are the reason there's no movement in their own type of petition.. There was actually a request at one stage, that people who had been approved should not be allowed to post  in excited terms that they had the Visa, because it upset the ones still waiting. Luckily that nonsense came to nothing.

 

No one is rubbing your face in it, and I can think of no reason why should K1's  empathy to a group now demanding they be moved to the bottom of some imaginary list because being married is way more important, more superior. Respect is earned. You don't get that by your status in a group of people all standing in separate lines. If reading about other visa petitions makes you angry, then don't read them. Stop doing the maths about how long.fast it took them. Stop comparing your individual petitions to any and all.

Anyone who'd been around longer than five minutes would know that.   5 years ago for one thing, and no, the K1's in the day weren't running around bashing all the married people who were ahead of them. They had actual helpful threads, threads with information and spreadsheets, numbers to call. Not just pointless moaning,blaming, and bashing. That's not in the spirit of VJ. We are here to help each other.

FYI.... we aren't talking about 5 years ago.... We are talking about "right now" the present time..... 

 

This thread topic is "what's wrong with the USCIS?"  and since nobody really knows the TRUE reason and since this is a public forum and since it isn't any kind of progress report thread...  People can say whatever they like and voice whatever opinion they have.  And if they want to point fingers.. then they are free to do so.   Feel free to bite back.. but  you can't take away opinions....

Yes, because I just sit there and bash K-1s personally, as if it's their fault. I never did any such thing. Stop putting words in my mouth and accusing me of things I didn't do, as I told a previous poster. I'm making points about the process and how it's unfair to I-130s at the moment, not saying that it's the fault of K-1s personally, as if they're intending to do us harm, that CR/IR-1s are backlogged.

 

Like I said in my previous post, whereas other backlogs seemed to be addressed and rectified, it doesn't appear that there is any end in sight to this current one with I-130s. They don't appear to be doing anything about it and don't seem to want to make it better. That's not BLAMING K-1s for the debacle, it's pointing out something I'm observing as a matter of raw numbers.

In a way it is permission. I have hardly any vacation and if my fiancé had the same we wouldn't be able to get married for 6-12 months after we decided to get married, then we file for a visa? Or we can take the option the government provides of getting a visa first then get married, thus filing immediately. But I didn't know that option was a lesser one and because we didn't get married first our relationship is lesser and we deserve to wait. When things get rough, it shows how people really are. I don't really care about spousal visas because I didn't pick that and if all I'll see if insults towards the other path of getting married and living with your partner then I'm done.

 


NO, its not giving permission to get married. You are able to marry whoever you want, whenever you want. The government has NO SAY over that.  The K1 is a visa to enter the country because you want to get  married here. The government does have a say over that.

You are more than welcome to fly over to Brazil and get married there or whatever  vacation spot you choose .    THEY ARE NOT GIVING YOU PERMISSION TO GET MARRIED.  The visa is to enter the country only with a stipulation that you get married within a given time or go home.      People on this forum are very sensitive to the processing times and those who jump on and say things like " I don't really care about spousal visas because I didn't pick that"    If you're done, then be done. I personally am exhausted from reading your posts.

 

Married is Married.. Those of us who already made  that commitment are suffering with these long processing times.  Nothing anyone can say can change my mind about Married vs. Fiance.  In my opinion, being married speaks volumes about the intent.  You cannot compare a 3 month wait for a couple who is not even married yet to a 10-16 month wait for a couple who already got married and are trying to hold their life together . 

 

It is the USCIS that is to blame for the backlog and the poor planning .  I don't care about the cost, I just want to be with my husband. These are months and months we can never ever get back.  I am sure most people here would be glad to pay an extra $1000 to adjust status if they would just allow their spouse to enter while waiting for their approvals.   The K3 was supposed to be the answer for that, but what's the point if they are taking just as long to approve those too?

I just bought the magicjack. It doesn't go to Costa Rica but I can use my phone cards and not use my cell minutes when I call before 9pm. The sound quality is good. I would do vonage except my husband can't get broadband internet where he is from in Costa Rica. He can get a dial up service but it is a super slow connection. I heard they don't really rely on phone cards anyway. But who else would I be calling? I have the phone cards and I have my verizon bill showing the call made to the access number. I also buy calling cards online and save the receipts in my outlook folder. Also have the records of me calling the access number.
My cell also shows his calls to me.
I wonder if I can call Costa Rica with majicjack DIRECTLY? The calling cards end up being anywhere from 2.6 cents to 5 cents per minute because I call a cell line. HMMM I need to look that up.

OK, this week will tell us if the "touches" have anything to do with the approval times. Vj is only a small amount of the people who filed at VSC. There were a gazillion others who were probably got touched on or around 10/2.

hmmmmm belovedbyme had a touch at the same time I did..... hmmmmmm maybe this means they are working on a cretain "BOX" of files.....

Hi guys !
I only requested my cases to be expedited. I have to send them proof of my daughter's condition. I have 20 days to send it to them. I have the hospital sending me all of her summary letters from all of her visits. They should be here tomorrow.
Then once they get the proof, then I will find out if they will expedite it. Had I known you could request expediting over the phone I woould have done it months ago...

Anyway, I'll keep ya posted.

My attorney said if they approve the expedite, it should move really fast... One would hope !!!

I hope everyone gets approved by tomorrow ! Waiting is horrible.

BTW....
my attorney told me today that the I-130 and the I-129F's are now being processed by the same adjudicator. They will get approved at the same time.
I am assuning that once they have both files, they combine them. That could be the reason for all the touches in October. Maybe they were combining our petitions. Just a guess tho.. rolleyes.gif idea9dv.gif

HEy guys !
I spoke to my attorney today and he was telling me he is expecting an approval for us any day now. He has another client that was approved 12-31-08 with an NOA1 of June 25th ( I think that is the date he gave me)
I also called USCIS today . I requested to be expedited. Was told I would hear something within 5 days... 2 hours later I received an e-mail requesting documentation. I couldn't believe it. So now I am going crazy trying to get the documentation they requested. I have 20 days but I don't intend on waiting that long to send in what they need.

When my husband called me about an hour ago, I told him I had some news. He asked me if he gets to come home tomorrow !!! HA HA . We are all tired of waiting.
I have a longer journey ahead of me because we have to file an I-601 when we have the interview. I heard it can take another 8 months to get that approved. Hopefully we can expedite that paperwork too. With expedited processing, I have read that approvals have come through in about 2 months. HA wishful thinking.
