IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNewark (EWR) POE Review

Sorry I'm posting this here, I could not get the link to work on the actual POE Reviews section (kept asking me that I needed to be registered but I was already logged in - can somebody move it to the right section please?)

My POE was June 24. I noticed when I was checking in in Santo Domingo (SDQ) that a couple of other people were traveling with their IV packets as well. So I thought: well, I won't be alone at least.

The one hiccup on our trip was that we couldn't land in EWR for a while because there were thunderstorms and they had stopped all inbound flights. We didn't have enough fuel to circle around in Newark so we had to go to Baltimore to fuel up. Depending on how things went in Newark the pilot said we might have to do Customs there (how? who the hell knows...that was not an international airport)...in the end, just fuel, Baltimore cannot process people coming from an international flight, back to Newark we went after about an hour of fueling up and waiting.

We got to EWR, there were just two lines: visitors and US Citizens/Residents line. So I went to the Visitors line and my husband went to the US Citizens line. I went to Window 10 right away (there was no one in line - we arrived around 5 pm or so), and handed my passport and IV packet to the CBP officer. He was friendly, not overly so but not an a-hole. He called for an escort but since no one came after about 15 seconds he took me to the elevator himself. He said they just needed to take my fingerprint. Another 3 people who were going to secondary inspection joined us in the elevator.

I had been in secondary inspection before once (while on my student visa) so the room wasn't surprising. It's rather big, a few booths for the CBP officers and quite a few chairs. It's to the side of baggage claim. They called two people ahead of me. When I was called, I was asked to sign in two sides of a form, then to put my right index on a pad. I thought it was one of those digital pads, but it was an actual ink pad! So the officer asked me to put my fingerprints on two slots of the same form, gave me a piece of paper towel to clean my finger, and sent me off. No questions at all from anyone.

That was it. Easiest thing ever.

Thanks for the info !   My husband will be coming through Newark.  Nice to know that they don't waste time.  One thing though.... I think the both of you could have gone through the resident/citizen line.  At least that is what my attorney told us !!

Congrats and welcome to the US !

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsWaiting for NOA2 since Feb,2013

Just wondering,   Is there anyone out there with any experience with the local Philadelphia office?  Any info?  Are they processing slow too?  I filed in April and I haven't heard anything about being transferred. Given our situation, I think I'm stuck at NBC... That could be good, that could be bad.  cray5ol.gif

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsCan published volume for field offices be trusted?

Having randomly sampled a few field offices to check their current volume on the USCIS website, every one of them turns up with 0 petitions awaiting customer action. The national number given awaiting customer action is 6,199 -- out of over 250,000 pending! I can't really believe that's accurate. Is the volume report otherwise pretty trustworthy, though?

Just curious...

Where can I find this information?  I want to check on the Philadelphia office.

I thought the USCIS check status site was the only site to check.. and the field offices don't even list the I-130's.

Thanks in advance.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsProcessing times for i-130 and K-3 applications as National Benefits Center

Thank you for the information.  My husband likes to leave the pot unstirred for fear that he will complicate and slow matters.  Patience is something that is difficult for me.  I am a doer.  I will learn here to relax and hopefully be as fortunate as you and it only be 4 months!  I would love to start the New Year together.  Fingers crossed.  I-129F and I-130 both filed.  Receipt dates of May 31, but change in status from accepted to in process June 4, and May 13 with change in status on June 14.  I don't care about the cost or hassle of where I may have to go for interview....we just want to be together.  We have known each other since grade school and in a relationship for nearly 3 years.  It is time to be together!!!  Thanks again!

Did you file the K-3 as soon as you received the NOA1 for the I-130? The status changes could be them joining both files together.  That is a good sign. At least you know they aren't lost...

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsProcessing times for i-130 and K-3 applications as National Benefits Center

just found this on the internet....sounds like the application may be processed at MSC.  Hoping that we will be able to spend my birthday in November together, or Christmas and as a last hope New Year's under the same roof!

Will definetly keep posting what we find out! :-)

http://www.uscis.gov/USCIS/Outreach/Notes%20from%20Previous%20Engagements/2012/November%202012/NBC-AILA-11-30-12.pdf

from that link:

August 15, 2012 - CSC and the Vermont Service Center began shipping stand-alone Immediate Relative I-130 petitions to NBC. NBC ships I-130?s to the field bi-weekly based on jurisdiction (ZIP code). There are two exceptions to the petitions sent to the field: those that are foreign filers, and expedite requests. Once NBC is staffed for this workload in 2013, we will assume jurisdiction of the stand-alone Immediate Relative I-130 petitions

who knows, if that info is still valid...  Nothing is ever updated on the USCIS website. They change the date it was posted, but thats about it.

How many K-1 filers  take the high road after they get to the US????  I'd have to bet quite a few.... Those of us who already got married and made the commitment are getting the short end of the stick IMO.   I'm sure marriage fraud is sky high.... But why do we have to pay for all that??  I get so stressed over this wait.

The nbc hired more people to help process? Maybe we will see more than one vjer get processed in a week. Its absolutely infuriating to see the last vj noa2 was 8/2. I keep praying we will see noa2 by the end of summer. When I first applied I looked around, so many people were approved in 3 months +- 1 month. I feel like my application caused a fatal error in their system with this processing speed.

I feel the exact same way.  INFURIATING is mild compared to how I feel though.   Read the April Filer thread.   We have a theory about what happened to our files  HAHA

My NOA1 states Lee's Summit MO as the address.  The Kansas Office is the office they are using because of the overflow of petitions.  At least that is what I read a few weeks back.  I also read this morning that someone from the MAY filer thread contacted their senator and the response was that the NBC has hired more people to process the files.  If Philly isn't busy, I'd be more than happy to be transferred there.

Hello,

Did call them since then? Was it transfered to Philly?

No, I haven't called since because it seems whenever I call I am annoying someone by asking about my case.   It makes me so angry. I did contact Senator Bob Casey's office about 2 weeks ago.  I am waiting to hear something back. I was told it could take about 30 days to get a response.  ( why it would take 30 days for a friggin' repsonse... I have no idea)

When I hear something I will post it.  I don't expect it to be anything different than  " your file is still within normal processing times"

Just spoke to a level 2 customer service person at the USCIS. He was very nice.  He said it is not noted in my case whether it was transferred or not but explained that if my file gets transferred, its not PHYSICALLY transferred.  He said the processing time is 6 months no matter where the file is and who is processing it  and in most cases it will get transferred to the field office if more information is needed ( if  you ever had another case with the USCIS, spouse, parents, children etc... and other things)   I had a previous K-3 case but I withdrew it before he ever got here.   It was cancelled over 2 years ago. He told me mine will most likely goto the Philadelphia field office.

I mentioned the faster processing times  ( that I saw online)  he told me not to believe a word I read online... it is all false and hugely inaccurate...

Well, I just let him talk.  I spent alot of time on VJ years back and all the info I got from here was VERY accurate and helped me so much.   I wanted to rip into him about only giving me generic info   but I know its just his job....

I'm going to sit here and just hope we get an approval before 6 months.   The information line to the USCIS is ridiculously useless.

my wife went personally there and a lady told her tht they r processing December files right now and we r feb filler so we have to wait 1-2 mnths more for the approval. and we ask for the finger print interview so she replied it is not compalsory  if we want further information about the US petitioner then we inform you bt in your case we dont want .....i dont know how much time now they will take i

Because whn i called on the USCIS office one of the caller told me tht it does take 6 mnths for the whole process for I-129F ..... nw already 3 mnths finished
i m worried !!!!

The reps that answer the phones at the USCIS are scripted.  Almost like they say 6 months to get the callers off thier backs.  It could take longer and it could be shorter.  It all depends on your personal circumstances and the person who was assigned your case and I am sure there are other factors too..   There is a holiday coming up at the end of this month, and one in July.  Who knows if they will speed up the process to kick out some approvals before the holiday . And we all know how it feels to come back from a 3 day weekend...( HAHAHHAA)

IR-1 / CR-1 Spouse Visa Case Filing and Progress Reportsis there any approvals lately as for CR1 from NBC

I called to day to find out what I could. Talked to a tier 2 person and asked about my pending I130. He told me that it can take from 6 months to a years just for the application approval. So I asked why is it that some approvals are happing with 3 months?, he says " oh no thats not happening". I told him that there are some cases that I know about and it has happened and Im just trying to get some answers about processing times for NBC. His response was...." I told you six months to a year and have a good day" and he hung up. Really? That was so professional!! I see it this way, we are dealing with some freaking clowns that is treating us like we are asking for something for free. This is not cool at all, but I shall call back tomorrow and hopefully get somebody that has knowledge and professionalism.

They always say 6 months to a year to Cover their Butts.  I also mentioned that I know of some cases that have been approved pretty quick... some in 3 months.  He actually laughed at me and told me I am totally wrong and stated it never happens like that. He also told me not to believe ANYTHING I read on the internet.  They read off a script and they DO act like we are asking for something for free... I think its ridiculous how long we ALL have to wait and the price we pay. Don't get me started on the immigration reform they are trying to pass.   GOOD LUCK TO ALL....

Oh one more thing I was also told by this same person that NBC is also transferring files to CSC.

Makes me assume they have no idea what they are doing....

I was told by the 2nd tier CSR at the USCIS that the file doesn't actually get physically  transferred. So.... I am assuming they just have adjudicators assigned to different localtions under the same roof.

BUT I am not stupid  enough to think the guy was telling me the truth either.  If anyone has more info, please share.

It does seem like the approvals have slowed down and is very frustrating since the NBC was supposed to be faster.

I would not go so far as to say "most people" or even "70% of people on here" got their NOA2 in 3 months.

Check out Igor's list and you'll see that most people who got their NOA2 recently waited for an average of 6 months.

Those who got approved in 3 months usually received expedited service; whether they have compelling reasons or the USCs are active military.

My lawyer is pretty confident that the USCIS will  be on track with that 6 month time frame....  I would believe him if I didn't know about this site...  and remember... the VJers are only a speck compared to all the OTHER filers at the USCIS

The USCIS is stating a 12 month wait.   Some get approved in 3 months, some go 18 months. It is all over the place.

Change your profile to reflect I-130...  it shows Adjustment of Status ( pending)

IR-1 / CR-1 Spouse Visa Case Filing and Progress Reportsincreased delays between NOA1 and NOA2??

The files are not always sent to the local field offices... Alot of people on VJ are dead set on handing out that info...it is a possibility  but its not always the case.  My attorney told me that files WERE being sent to the field offices if they needed extra work. Not all cases get transferred there. ( and I'm not saying he knows everything)

They are opening that new service center in Kansas..   Everything goes to the NBC, then they will determine what to do with the files...

( I think they are training the new hires to adjudicate cases... but that is just my opinion)

Most people who call and speak to a tier 2 rep are getting 12 month processing time now.  My lawyer insists that the USCIS is still on track with the 6 month processing time.   so, with that said.... it is what it is. It takes a long time and there really is no rhyme or reason.  When I filed back in 2008, I waited 10 months for a K-3 approval which was suppsoed to be much faster back then... Well, it wasn't and I did everything I could to get an expedite and I called the senators office regularly.

My suggestion;  make an inquiry with your congressional office. it doesn't do much ( you'll get a form letter stating a 12 month processing time) but its better than sitting around doing nothing while you wait.  Hang out here and read the threads and fill out your timeline.  You'll be able to see the approvals for the month you file.  As long as everyone comes back and fills in their timeline, the info will be more accurate

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Glitch causes HUGE El Salvador Backlog

That is indeed, unfortunate for you. I also just found out through, http://cliniclegal.org/about-us, that the waiver process was changed this past summer. Apparently waivers were process at the foreign consular offices, but starting June 6, 2012, they'll be process by the Nebraska Service Center. The only draw back is that it'll take six months to review a waiver. Nonetheless, a friend of my fiancee said they take roughly 3 months to get it done.

If you like to read more on immigration issues or legal procedures and immigration law, this website has a wealth of information. enjoy and good luck.

The waivers used to goto Honduras before the NSC. It was about a year processing  before and now it is posted at 4 months.

Hello how do we contact our congressman to expedite or help find location of case.

find out who your local office is and call them ( google it). They will send you a release form to fill out along with an expedite request.   Send it back as soon as you can and they will inquire about your case .

A July 2013 filer here.  Didn't notice the address on the NOA1 receipt until saw this post.  Figured it was MSC so just NBC center.  Mine has the Kansas address so I guess it will be processed at the new place when operational...

I read a few other posts where the more recent filers were sent to the Kansas Service Center already. Or right off the bat.

so I think April, May and possibly June are somewhere in LIMBO LAND.  That sux !

I am a April Filer, so the question remains unanswered:

whether my file will be transferred to local office or

will it be adjudicated by NBC or

will it be transferred to the new kansas office?

I have the same questions.  Our timelines are really close.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsTheory: Where is my file located? (NBC or Local Field Office).

my only saving grace at this point is that I am an April filer.  Maybe ..... hopefully the first to be processed at the new center. ( at least one of the first)  March, April and May.   although I think the newer files are already being transferred to Kansas..

The system is so broken

Do you get the impression from April filers that they're at NBC-Missouri? Has anyone reported a move to a field office on that thread? I'm pretty curious, because you're right, we Q3 (April-June) filers are really up in the air. It feels like we could end up anywhere, which is awful. I'm hoping hard that my letter from Kansas means Boston will never touch my case, because I'm sure it's a bottomless pit there. It is absolutely crazy to me that they can't offer this most basic level of transparency in telling us where our files are located. As a USC I'm actually ashamed of my government, and I can't help but think what a fantastic impression it must be making on my husband, who is changing his life to be here with me. Is this really the best our country can do? I can't believe we have any immigrants left after they see what kind of bureaucratic nightmare the process is.

I agree...  Ashammed is being nice..   Embarrassed is more like it.. and THAT is even  being nice.   Have you checked out how fast the K-1's are getting approved?  Wouldln't you think the married couples would have a priority?    Its all so frustrating.

I have an immigration lawyer.  When I asked him where my file might be, his answer was that they WERE sending files to the field offices if they needed more info or if they wanted an interview. He said I need to hold tight. He doesn't think my file is going to the field office. ( my guess is that we are already in 4.5 months) He insists that the USCIS will stay on track and he swears by the 6 month time frame. Now... if I didn't know about VJ I would have no choice but to agree and believe... BUT everyone here on this site knows that is a bunch of boloney.
