US Embassy and Consulate Discussion? about the I-134 form if you have been divorced with kids involved & child support!
Child support is one of those things you can use on documents if it helps you or leave it off if you choose to. I've come across this many times throughout the years.

I agree....if your salary is enough, leave it off.

You became an LPR based on marriage, right? So you had to have gone through the AOS process. They would have checked the dates on the divorce decree and caused problems at that time and not issued a green card.

Hmmmmm.....this makes sense. First thing I would do is track down a copy of the divorce decree. In Missouri, we have a Missouri Courts website where all you have to do is type in a name and it brings up all cases. I found my own divorce dispostion on there. Maybe you can use something like that to start.

I took the list of forms that is on the "Embassy info" page for France. I don't know if all of them will be needed (it might have change since it hasn't been updated for a year). I still think it's better to know how to file more files than what is needed. I won't spend any extra time trying to figure out how to file DS-156/DS-156K if I've already looked at DS-156, 156K, 157, etc. happy.gif

thank you

US Embassy and Consulate DiscussionQuestions about packet 3: DS-156, I-134, ...
I know we have a lot of time before CSC approves our petition, but it's better worrying too early than too late. So, I'm taking a look at the forms I'll have to file when the embassy in France will get our case. I've looked at the example forms there but I have several small questions. I know some of these questions might seem stupid and the forms are easy to fill out, but I prefer to fully understand everything.

About DS-157:
1) 7. Mother's full name: is it supposed to be her married name or maiden name? I remember on the G-325A, it was the maiden name, but here, they don't specify.
2) 12. Not including current employer, list your last two employers: my current job is my first job. Before that, the only experiences I've had were my two internship but the most recent internship was by my current employer (they hired me after the internship). Should I put both internships? only one?
3) 17. List all educational institutions you attend or have attended. Include vocational institutions but not elementary schools. I'm not sure what it means. What should be included? university? highschool? I'm not sure what they mean by "elementary schools" (my understanding of English is not perfect)

About DS-158:
4) Not a question about how to file, but I just wonder why they need all this information. Why would they need to know about my parents and sister and brother (and friends for question 7.), especially since they're staying in France. I'm just curious.

About DS-230:
5) 23. List below all educational institutions attended All the schools since I was born? even kindergarten?

I don't have questions about I-134 yet since my dear soon-to-be husband is the one who will have to deal with that. innocent.gif

Oh, the last one:

6) I know it's better if the forms are dated with a date close to the interview, but as some of you have probably done, we won't wait until uscis approves the I-129F to deal with the I-134 and get it notarized. so, how close do they have to be? or how much time before the interview would it actually be too long?

Thank you very much!

Cecile

yes I know, but from what I read, it's only effective if you take it before to be sexually active and it only protects from certain types of HPV. I might try it anyway.

US Embassy and Consulate DiscussionMedical exam - what about HPV?
My fiance (USC) has HPV - Human papillomavirus. He told me last year, a few weeks later I got tested, and they said I didn't have anything.
Since then he came to visit me, and I have not been tested since then. I'm planning on doing it soon (probably in a few weeks).

Now I'm kind of freaking out for the medical exam before the interview for K1 (I know, that's a little early since we sent the petition a month and a half ago). I've looked for other posts, and also other websites. there was a post that said that someone with herpes would not necessarily be denied, so I'm guessing it should be the same for HPV.

I found that list of "communicable disease of public health significance" on that website http://faq.visapro.c...-Exams-FAQ9.asp.

A ‘communicable disease of public health significance’ is defined in the HHS regulations that cover the required medical exam for immigration purposes and includes the following nine infectious medical conditions:

• Severe acute respiratory syndrome (SARS)
• Tuberculosis (TB)
• Leprosy
• Human immunodeficiency virus (HIV/AIDS)
• Syphilis (infectious state)
• Chancroid (STD, similar to syphilis and herpes)
• Gonorrhea
• Granuloma inguinale (STD, donovanosis)
• Lymphogranuloma (STD, chlamydia)

HPV is definitely not on it.

Here is what I'm thinking:
- I get the test, if they say I'm fine, then I ask my doctor to write me a letter stating that I don't have it. At the medical exam, I tell them that my fiance has it but that I don't (since it's probably better not to hide anything), and I show them this letter.
- if they say I have it, then I really don't know...

First, do you think HPV would be a big problem?
Do you think that the idea of a letter and telling the truth is right (ahah)?
What do we do if I have it too?

You have everything you need. You do not need a bank statement as he is over the 125% poverty line. The only original you might need from the USC is the divorce decree (if applicable). It doesn;t matter if you take copies or originals of letters - take a few - don't go overboard and carry a suitcase full! Good Luck

Thank you. No divorce decree since neither of us was previously married.
I think I'll take the original letters of what he sent me, and copies of the letters I sent him.

US Embassy and Consulate DiscussionChecklist of what my US fiance needs to send me for K1 interview
Hello everybody
We received NOA2 for our K1 visa a few days ago and my US fiance has started gathering everything he has to send me for the next steps. We have most of the information we need (thanks to the guides and everyone here), but I'd like to make sure we're not forgetting anything.

Here is our checklist.

financial information:
- I-134, notarized and signed
- copies of last 3 pay stubs (at least)
- last 3 years tax transcripts that he requested from IRS
- letter from current employer

other documents:
- copies of NOA1 and NOA2
- new intent of marrying letter
- copy of package I-129F

new proofs:
- the letters that I have sent to him since January
- detailed phone bills (he sent me a few text messages)

1) Am I missing anything?

2) Do we need a letter from his bank stating how much money he put on his account the past year? He makes above 125% of the federal poverty line for a household of 2, so we won't talk about assets in the I-134 form. Only his salary. I read that the letter from the bank is only if we include assets, but I'd like to make sure.

3) In the I-129F package, he sent a copy of his birth certificate and of his passport. Do I need to have the originals with me at the interview?

4) For the old proofs included with previous package (photos, copies of boarding passes, ...): do I need the originals?

5) For the new proofs of relationship: do they have to be the originals or photocopies?

I just received packet 3, and on the DS-2001 (notification of applicant readiness) they ask for the address where I want to receive the appointment letter.
We are June 12, my plan right now is that I will be living in Paris until the middle of July and then back to my parents' house to spend some time with them, until I leave for the USA.
Should I write down my address in Paris or my parents' address? I'd say my parents' address just in case it takes more than a month, but I'd like someone else's opinion.

If I were you, I would try not to move until you receive those packets.

Oh I didn't know that... then yes I'm definitely going to hope I receive the packets before I leave, and if I don't, I'll stay longer in Paris (and have my family come tongue.gif) until I get them. Just to make sure. Or I'll ask a friend to come and pick up my mail for me.

I guess I'm just going to hope that I receive both packet 3 and 4 before I leave! that way no trouble with the post office. If not... I guess your idea is the safest one.
I believe I'm the one writing down the address on the envelope for the visa (after interview) so that should not be a problem.

Yes I will be moving to St. Louis smile.gif

US Embassy and Consulate DiscussionWhat happens if the beneficiary moves out?
Hello

One more question... we got our NOA2 last week (May 13th). I am planning on working until mid July and then go back to my parents' house until my departure to the USA. By that time, I will hopefully have received packet 3 and sent it back to the embassy in Paris, and maybe (but this is only a maybe) received packet 4. From the timelines of people who went through Paris embassy, packet 4 is received usually 2 months after NOA2, sometimes more. And usually the interview date is 3 months after NOA2.

I think that what I will do is ask the post office to forward my mail to my parents' address, that way I can get what the embassy sends me. Or should I contact the embassy and tell them that my address has "changed" so they will mail everything directly at my parents' address? maybe when I receive packet 3 I can tell them to change the address and to send packet 4 at my parents' house? What do you think I should do?

I believe that for the K-type Visa the requirement is at the 100% of the poverty line not 125%. Hope this helps.

Depends on the consulate.

Yes I heard it depends on the consulate. We may write a letter as you did, ZeeNusah. The reason his income was low last year is that he came to France to be with me.
So you don't think we need a co-sponsor?

US Embassy and Consulate DiscussionI-134 - current income OK but previous incomes below 125% of poverty line
My interview for the K1 visa is in 2 weeks. We have gathered all the paperwork we need several weeks ago and I just realized this morning that on his tax transcripts for the past 3 years, on two of them the income is less than 125% of poverty line (but more than poverty line).
His current income is above 125%.
I have read that what matters is that the current income is above 125%, which is the case here, but I am worried about these two years with lower income. Is it a big problem or am I worrying for nothing?
Should we try to get a co-sponsor? it is going to be hard to do so in 2 weeks, but if you people believe that without a co-sponsor we'll be denied, then we'll definitely do our best to find one.
I also read that someone wrote a letter explaining why the previous incomes were lower (because they went to the foreign fiance country for a while). Should we do that?

US Embassy and Consulate DiscussionPublication des Bans in France
I'm planning to do the publication des bans. My local consulate is Chicago so it may be different, but they say it can be done 20 days before the wedding day if both spouses live in the USA. I will send them everything as soon as I arrive to the USA, and we will get married around 3 weeks later.
Bryan will try to add me to his car insurance before I arrive and will ask them to send us an attestation, where it will show that we live at the same address. If he can't do that, we will probably do what Caro06 did: he will write a letter stating that I arrived on the K1 visa and now live with him, but that my name hasn't been added on our bills yet, therefore we don't have proof of residency yet. and we will hope that it will be enough!

For your fiance address, what address did you use on the paperwork for the visa? do you know where you will live once you get there?
