That is wonderful. I look forward to the same ease when Andre goes next year, here, in St. Louis.

Can I ask where you went for the interview? Was it the Federal Building?

No, you can't vote until you are a citizen.

Don't know where you got the 10 years from, though. 3 years.

Hi - I'm sorry, I missed ur responses.

I'm sorry if I wrote something that gave you the wrong idea. He didn't overstay his visa - he went back home, set an appointment & was denied. Ok, I'm going to take your advise and figure out how we want to handle this. I've been reading but am sooo confused by the cr-2, fiance visa vs marriage visa, etc. And I'm sorry that you all have had to deal with this too. What a crock!

Thank you, again, for your assistance. And please pardon my ignorance. You said "Besides you're in good hands with JG." "

What is JB?

Not JB.....JG.....that's me!

Well, the only issue seems to be whether or not he can come to the US and visit.

If they intend to marry and live in Jamaica together, she doesn't really even have to apply for any kind of visa for him. Except whatever SHE has to apply for to be able to live in JA...visa or citizenship.

Where did it say he overstayed a visa? I think I missed that.

She is right about the long process. If you were to file a marriage visa, you will have to prove your ability to sponsor him in the US. That may prove a big problem if you up and move to Jamaica.

I don't remember reading that either. My advice, the both of you need to really sit down and talk this out to figure out what's the best route to take. Do a little research and remember we're here to help, if we can. Have a good weekend. Besides you're in good hands with JG.

Now, see, this is why I really love this girl!!!!

From your lips to God's ears, Tre!

A CR-1 is a visa to immigrate to the US. Check the guides tab on top of this page for more information.

There is probably a small chance for him to file for a visitor visa after you have married and lived together in JA for a while. Assets, a job(s), owning property, etc. as proof. It would not be in time for a honeymoon, though.

But, again, I think they are probably going to deny cause they will think he will never come back. Not the intent of a visitor visa.

Yes, he went to the Embassy and told them he would be going to his honeymoon in the US

Sorry; but that was a big mistake. The visitor visa is issued with the express intent that someone will return to their home country. No matter what you say at this point, they are not going to believe that is going to happen.

Like I said, for him to come to the US now.....with you marrying in Jamaica.....you will have to file a CR1 after you marry.

You could file a K-1 right now; but then not be able to marry in JA.

Did he then go to the embassy to reapply and told them he would either be visiting his fiance on it or going on his honeymoon to the US?

After you marry, you can apply for a CR1 for him. I don't see any other way around it.

They see him as marrying and immigrating no matter what you say to them at this point.

OK, here's my huge problem:

Right now I have a 10 year green card.
I will meet the requirements to apply for citizenship on July (2008).
Hubby was offered a job in Canada and he is really excited about it, he REALLY wants to take this job. And they want him there ASAP.
We have no kids.
We don't own a house (that's why we need this job in Canada, to actually be able to buy a house)
Dad in law said we can use his house as a permanent residency while we are in Canada.
If everything goes well with hubby's new job we will be out of the US for 2 or 3 years..

How big is my problem and how can it be fixed? is it smart to wait until August , apply for citizenship, move to Canada and then come back for the interview or whatever? will they hold it against me that I am living in another country ?, should I get an immigration lawyer and will it make any difference whatsoever if I do?. please, whatever info you guys can give me I will really appreciate it. Thank you so much.

Have your husband take the job. You stay here while he lives there and then move when your citizenship is done. Also, you can visit him, just don't stay out of the country too long.

This is exactly what I was thinking.

US Citizenship General DiscussionN400 question-have you ever been detained by a law enforcement officer?
QUOTE (kmineo @ May 29 2008, 07:57 AM) <{POST_SNAPBACK}>
This topic is quite funny. I would answer no with no reserverations. It is clear that the intent of the question is to see whether you have been arrested or question in a serious crime. I don't think seatbelt or even getting a speeding ticket is what it is looking for. I sometimes wish the application reveiwer would read this board and respond to some of these. I am sure they would get a chuckle. You are detain by an officer everytime you enter the country as mention before. Surely they don't want to list an explanation for that. If you are a witness to a crime, you might be detained and asked questions. What would any of that have to do with your immigration process. Sometimes, you do have to think logically for these applications, The US government is strict but not that strict. They don't expect everybody to be a lawyer to fill out the app.

So my opinion is use your common sense on things like this. But if you are worried you can list it on there. It won't due any harm (except take a bit longer to go through your app) and it might actually make the guys back there laugh. You have to remember the people reviewing the application are people too, who eat, sleep, and yes sometimes laugh. I doubt they will care about a warning about a seatbelt.

I agree with this completely.

Some people are way too literal about everything.

US Citizenship General DiscussionN400 question-have you ever been detained by a law enforcement officer?
You can say no to that question.

For us, we had an incident. I am getting a police record check. Whatever shows up in the records, I am writing on the form. If it doesn't say anything, which is what I think will happen, I am not saying a word.

I've used my online bank statements for our K-1, our AOS, and now our soon to file LOC petitions. I've had no issues.

I think they are pretty used to this by now.

QUOTE (Staashi @ Sep 5 2008, 10:15 AM) <{POST_SNAPBACK}>
Just one thing to know...the prep for the N-400 is very easy. It is very different from the Removing Conditions phase - you will not need any pictures or affidavits.

You will need to send a copy of PR card front/back, 2 passport photos and the check to DHS.

In addition to that, you will need these four items:

Evidence that your spouse has been a U.S. citizen for the last three years:
Birth certificate (if your spouse never lost citizenship since birth), or Naturalization Certificate, or
Certificate of Citizenship, or The inside of the front cover and signature page of your spouse's current U.S. passport, or Form FS-240, "Report of Birth Abroad of a Citizen of the United States of America," and

Your current marriage certificate, and

Proof of termination of all prior marriages of your spouse - divorce decree(s), annulment(s), or death certificate(s); and

Documents referring to you and your spouse: Tax returns, bank accounts, leases, mortgages, or birth certificates of children, or Internal Revenue Service (IRS) - certified copies of the income tax forms that you both filed for the past three years, or an IRS tax return transcript for the last three years.

Good luck to everyone! It can be done. good.gif

I'll just be glad when all the paperwork is done forever. Seems like it just takes over your life.

It's not a big deal at that point cause you should have the 10 year green card in hand by then.

I think it's a bigger deal when lifting conditions, which does not concern you in the CR1.

There is no rush since you already have your 10 year green card and lots of time to file for whatever comes next.
