The I-551 stamp in your passport IS a green card. I would argue with the bank that you have all rights to work and live here with that stamp. The 2016 date is the expiration of your green card - you'll need to renew it before then.

 

The stamp in the OP's passport is a standard CBP entry stamp with applicable information written in.  It is that stamp combined with the visa itself that acts as a temporary green card until the actual card is in hand, not the stamp by itself.  CBP is no longer placing special I-551 stamps in passports of immigrant visa holders.

I do not have items E-H though. All my wife and I have is pictures but it looks like that won't suffice for the petition process. I'm actually kind of worried about the later stages of this visa process. My wife and I don't even have any evidence of online chats.

 

How many trips have you taken together?  How many times have you visited?  Do you have boarding passes, passport entry and exit stamps?  Receipts?  Think outside the box.  The only thing USCIS truly requires from you is a copy of the marriage certificate, anything else is evidence to support your case, you have what you have and don't have what you don't have.

Hi, there a couple of things on the I-130 that I find kind of ambiguous. I'd really appreciate if anyone could help clear things up for me because I'm not sure who to ask.
I'm not 100% sure weather all 5 things listed or just 1 of the 5 things listed are necessary to provide. After number 4, I see it says "or" so I'm guessing this implies it's necessary to provide documents 1-3 and 4 or 5.  I was not born in the U.S. so I guess I would have to provide documents 2-3 and 4 or 5. Is all of this correct? I'm not very sure and am nervous about not having everything I should have.

I also want to ensure that I'm reading this part of the instructions correctly. After E, F, G, H, and I, I see it says "or" so again I'm guessing that this implies it's necessary to provide documents A-D and one of E-I. Is this correct?

 

A,C, and D are required; B is only required if it's applicable.  Only need one of E-I, most couples will not have E-H so the focus is usually on items covered under I.  If you have E-H, then throw it in if you wise, otherwise, don't worry about such items.

Remember, you are only to send a photocopy of your marriage certificate with the I-130.
 
Don't use a highlighter on the copy, it will be scanned at some point and using a highlighter has been known to make the highlighted text appear redacted.

PS. Oh yeah, there is no section that my USC wife will take my last name...is this a problem?

 
No, however, if she is going to use your name, she may need to do a legal name change through the local court of jurisdiction where she lives.

I found this site after I sent my plug to USCIS( actually it is on its way to a friends so they can put the money order for feeding the pkg). In reading the checklist on the site I realize I made some mistakes. One I did not include a cover letter or index of contents. Two I only included my biographical page of my U.S. Passport, not all pages as the check list here says. How does my entire passport ( visa stamps) help prove I'm a US citizen. Doesn't the biographical page do that? I also included the 864. That can easily be redone I would think, or is USCIS going to get upset? Should I have my friend just return the entire package an start anew? Any advice would be appreciated.


I only send my biographical page too. It will show your nationality I believe on that page. mine got approved without any problem. and for form 864, you do not need to send with I130, they don't need it at all. the NVC need the 864, but that's after your I130 gets approved.

Send the AOS package when you are ready to do so; the NVC will keep a case active for 1 year from the date of last contact by the petitioner or beneficiary.

Employment letter is not required, paystubs are sufficient.

Reread the wiki, you need to be proactive when dealing with the NVC instead of waiting for them to contact you.  If you wait for the NVC to contact you, then you will be needlessly waiting for a long time.

It is possible and it is allowed.

 

When referring to an I-864, joint sponsor is the proper term, not co-sponsor.

I believe  you can just call to begin the process to request the Expedite. They will then ask for or tell you how submit your proof... I think you will need to speak with a tier 2 rep. It does sound like you have really solid grounds for the expedite and approval.

Tier 2 rep doesn't apply at the NVC.  The OP can speak to an operator to place the request, if they get nowhere with the operator, they can speak to a supervisor.

It sounds like you have grounds to request an expedite based on their error (not changing your petition category from LPR to US Citizen after you informed them).  You have nothing to lose by making such a request.

 

You have the evidence that the letter was received despite their claim, only you can decide if you want to make the expedite request and submit the evidence along with the request.

Don't bother, evidence of pregnancy (doctor reports, sonograms, etc.) is only evidence that you are expecting a child and has not bearing on the process.

I was thinking about doing 3 or so affidavits from family and friends saying our marriage is real and about staying here, but do they need to be notarized? I read on a lot of different websites that people did not notarize their affidavits and were fine. They did not receive a RFE or anything. I wasn't going to get mine notarized.

 

Affidavits do not need to be notarized.  Furthermore, they are not required and carry little to zero weight in the overall evaluation of a file.  Focus on evidence of time spent together in-person, that is and always will be your strongest evidence.

The I-864 specifically states that relatives that are on another visa petition are not to be listed on part 3 (i.e. only derivative beneficiaries go in that section).

 

When you fill out the I-864 for your wife, you don't list your son in part 3 but you DO count him in part 5.

 

When you fill out the I-864 for your son, you don't list your wife in part 3 but you DO count her in part 5.

 

Your household count is 3 (you, your wife, your son) on both I-864 forms.

I wanted to state my case. Im living in the US and my wife and kid are in El Salvador. I havent started the I-130 process yet as I just moved back to the US (Had be out of the country for the last 20 years). I was reviewing this thread and Im not sure if this has been asked but:

 

If my wife and son (1year old) applied for a B2 visa just to come visit me for the holiday, would it be best to apply first for the I-130 or after the request has been submitted?

Doesn't matter.  Their ties to their country are weakened by you being in the US.  An active I-130 would weaken their ties to their country further.

 

My lawyer was one of those who said right off the bat its not possible in any way...

Lawyer is incorrect, it is possible.  However, in order for them to receive tourist visas, they must show evidence of strong ties to El Salvador.  As I just stated, having a US Citizen relative weakens those ties.  They can apply but there is a high degree of probability that they will not be granted tourist visas based on inability to overcome presumption of immigrant intent.

 

Aslo what is the current wait time for the I-130 if I just started it next month? Im confused, I have dfferent versions from different lawyers.. some say 6 mo. other 9 or more.

Expect to wait 10-12 months from filing an I-130 to the time an interview takes place and count your blessings if your timeframe is less than those figures.

 

 The reason I cant visit is I just started a job.

Now the stamp he gets when he lands (POE) will be his temp green card stamp that's good for a  year.

 

To clarify this for the OP, the stamp is nothing more than a standard CBP entry stamp.  It is the entry stamp combined with the visa itself that acts as a temporary green card valid for one year.

Answers, part I:

  • A retired individual can be a joint sponsor.
  • The would have to provide documentation of their income and/or assets.
  • If the house is his primary home, it cannot be used as an asset on the I-864.

 

Answers part II:

  • There can only be one joint sponsor, that will either be your family friend or your father.
  • If elect to have your father act as a joint sponsor instead of a household member, then you will not be combining income.
