By default, you are your wife's sponsor, even if you don't meet the requirements on your own.

 

If your step-father is willing to be a joint sponsor, he would need to complete the I-864 also.  Your mother would fill out an I-864A to combine income with your step-father.

Getting AOS packet ready waiting on Sponsors' documents.

 

Next packet is IV packet.  Trying to get this items done.  When time comes to send the packet to NVC do I send the originals on the Mexican birth certificate and Marriage Certificate?

 

I already had them translated when I did the I-130 but the only gave this certification.

Certification by Translator:

 

I First Last Name, certify that I am fluent (conversant and written) in the English and Spanish languages, and that the above/attached document is an accurate translation of the document attached entitled BIRTH CERTIFICATE.

In the instructions from Cd Juarez Embassy it says:

 

Applicants with non-English or non-Spanish birth cetificates must submit a notarized translation with original.

 

I guess the "Certification by Translator"  is Ok to send with IV Packet?

 

You send originals and photocopies to the NVC.  As for translations, find out what document translation requirements are for the Consulate in Juarez.  Some Embassies and Consulates do not require translations if the language of the documents is in the official language of the country.

I am confuse In filling out I864 Part 5 my wife 1 on box number 1. I am 1 under yourself and then it say if you are married put 1 so that 3 total but we are only 2 ? Is there any help in the forum to answer questions in I864?

 

That section also states to not count anyone twice; put a 0 in for the "if you are married" box, you already counted your spouse.

I'm putting together my evidence and want to make sure I have everything covered.

 

My wife will submit:

Form I-864

letter stating that she did not file taxes because she was below the threshold 

 

My father-in-law will file:

Form I-864

photocopy of transcript for 2013

photocopy of Form W-2 and 1099 for 2013 Not needed when using transcripts

photocopy of recent pay stub

photocopy of birth certificate or passport (complete passport of just picture page?) Data page should be sufficient

 

Everything will be put together in one envelope. Her I864 and supporting doc will be paper clipped together and his I864 and supporting docs will be paper clipped together. Case number will be written on the top of each page. 

 

I'm filing the forms out online and will be printing them off. That fancy barcode isn't generating, which is good because I don't have my A number yet. I also will need to fill some parts of the form out later by hand. Will this be an issue? 

 

Is there anywhere on my wife's I864 that indicates that her father will be filing an I864 as well or is the fact that they are both sent in together enough?

The fact that he is submitting a form is sufficient enough.

 

Is there any real benefit for attaching copies of the 3 most recent tax years if my father in law is making over the threshold? Under what conditions would this actually make a difference?

In regards to the baby, will we need to bring in 2 I864 forms if the baby is born before the interview? Hers and her dads?

 

Your wife will need to redo her I-864, her dad will not.

 

A Consular Report of Birth Abroad for the baby will need to be obtained so it can be issued a US Passport.

Answers:

  • The unborn baby is not included in the household count.  If it is born prior to the interview, an updated I-864 reflecting the change in the household count will have to be brought to the interview.
  • Your will enter 0 in the married section, you were already counted.
  • Her dad is not included in her household count nor are any siblings.
  • Her dad needs to fill out an I-864, not an I-864A.  I-864A is for combining income and your wife has no income to combine with her dad.
  • Does her dad claim her or her siblings on his tax return?  If no, then his household count is him, his wife, and you.  Anyone else who is claimed on the tax return would then be included in the count.

No issue whatsoever.  The expiration date you see is the expiration of the comment period to the Office of Management and Budget.  The form itself does not expire.

I checked various Namibian consulate websites along with a government of Namibia website and saw nothing mentioning a "long-form marriage certificate". I realize it doesn't help much other than seconding Boiler's observation.

 

I've not been involved in filing an I-130. Is that term specifically used as a required document?

 

I'm sure more experienced members will chime in.

OP, no disrespect intended but I'm sure you'd agree that it's not healthy for her to simply "be doing nothing" while she's waiting. Would you be able to appeal to her to continue what she was doing, how she was conducting her life up to now and throughout this journey?

1) I would specifically clarify the income as "monthly" or "annual" in the letter.

2) Yes, taxable interest paid also becomes the income. 

3) To make it easier and clear for them,

    You might also want to point out specific sources of those incomes

    and provide evidence on balance and how long they will be paid into the future. 

 

4) Also, if $62,346 is paid annually as tax-exempt, even at 3% interest, that would be 

    more than $2,000,000 in asset balance.   Nice money, but make sure this is correct. 

5) You are referring to the Tax Transcript, so I assume you are attaching it with your letter?

This means you must have had sex with the person after the marriage took place.

 

"Consummated" in terms of US Immigration simply means spending a night together.  What you do during that night is your own business (FWIW, many will just assume that a couple will have done the dictionary definition of the word).

hello guys


- my wife (petitioner) is a student .she is not working , and she receives her check from the government for support every semester .so my questions regarding the affidavit of support are
1- does she allowed to sponsor me?
2-  she is not paying taxes because she is student , how she can prove that ? is there any extra form to fill ?or she just can write a statement saying the reason for not paying the taxes
3- i read that for co-sponsor ,we need to fill 2 forms one for her and one for co-sponsor, is it correct ?
4- which form of affidavit of support we need to fill?
5-regarding the co-sponsor , he/she  must be from the same state or doesnt matter ?
6-is there any sample how to fill this form

  1. She will need a Joint Sponsor (when referring to an I-864, Joint Sponsor is the proper term).
  2. She writes a statement stating that she was not required to file and why.
  3. Petitioner and Joint Sponsor both fill out an I-864.

  5. Doesn't matter where the Joint Sponsor resides, only that they meet or exceed the required threshold and that they are either a US Citizen or Green Card holder.

Make a copy of the spare certificate you currently have and send the spare and the copy of the spare to the NVC (or to your lawyer so they can send it off).  Document intake for spousal visa cases occurs at the NVC, not at the interview appointment.

If you marry in an overseas country, it will cost you about 2 years in time between the K-1 and waiting for the children to be born, getting married, and getting an I-130 approved..,.,.,about 12-16 months if you are lucky.

The other legal paperwork is way ovr my head,.,.,.,.,(Inappropriate comment removed - VJ Moderation).,.,.,get you NOA 2.,.,.,.bring your wif ena dchildren to the USA..,.,.,and things will be so much easier!

Abandon the K-1 will cost you 2 years!.,.,.,.,.as least!

There are some things that need to be cleared up here.  In another thread, you stated you received a case update indicating your petition had been approved and wanted to know what comes next in the process.  Now you are saying you received a request for evidence for passport style photographs.  Which is it, was your petition (the I-130 is a petition form, not an application form) approved or not????????

 

Also, if you are married, you cannot file for a K1 visa, that is only for unmarried couples.  Did you submit an I-129F after submitting the I-130?  If so, then that starts the K3 process but that avenue often dead-ends at the NVC because the NVC will administrative close the K3 process if they have an approved I-130 on-station.

Sending updated G-325A's at this point will probably be nothing more than an exercise in futility because its highly unlikely they would be matched with the file.  If you happen to receive an RFE (something you DON'T want), you can submit updated G-325A's then.

 

When the time comes to complete and submit the DS-260, the correct information can be inputted at that time.

Agree with NLR, "To be determined" is an appropriate response for the I-130.  Issues such as domicile and needing an actual address can be dealt with after the I-130 is submitted (but need to be worked out before the I-864 and DS-260 is submitted).
