its your choice but sometimes NVC will take some time to process the emailed DS3032... Its better to send the hard copy bcoz at least when you call the NVC - they will inform you that they already received the hard copy... However it will take like 5 days..

Someone told me this:

If your dad is cosponsoring your wife then it is his income alone that has to be on the I-864A so you must SUBTRACT your mother's income from the total income reported on the 1040 and use that amount as your father's actual income or you will get an RFE.

I am asking a questions concerning my father's tax info on our AOS package. He filed jointly with my mother as married on their taxes. I am sure that there were lots of people in here who sent their papers in a well organized manner. It is just that they are NOT LUCKY as you are.. Or shall we say, they are JUST LUCKY to be stuck in a service center which works slower than the other one..

Perhaps, it would help USCIS workers to check the documents faster but the dates when to check it would be on the hands of the service center workers. Your original marriage contract should be submitted with the DS-230. don't send it with the AOS.

For your AOS, with regards to the tax return info:
Submit W-2 and Tax Transcripts for 2006 & 2007
Submit W-2, 1040, 1099s, W-7 and relevant proof for 2008.
And then include paystubs and employment letter if you have it.


What im trying to say is that i am going to submit the affidavit and notarized passport with signed by the judge for me to apply for ITIN not for AOS and DS230 hehe

Its ok to apply for an ITIN. When sending the AOS papers are you sending your 2008 tax returns? If so then you probably need to include copies of the W-7 application for the ITIN with your AOS papers.

Alternately, you can file as single, and ammend the tax return later.


My husband has his w2 and the 1040s for 2006, 2007, and 2008.

So we need to include the Tax transcript from 2006 to 2008? The lady from the IRS said that they will not yet release the Transcript for 2008.. wacko.gif

The bottom line: If you are looking to get your spouse into the United States as soon as possible then the K-3 visa is the way to go. However, if speed is not essential and if it is important that your spouse is a permanent resident from the moment he/she enters the US and will be able to work upon entry into the country, then the Immigrant (CR-1 and IR-1) visas are a better fit.

I would apply for the K3, just because they process the K3's faster than the CR1's. Then when they get approved, they approve both at the same time. If you want the CR1, you just ignore the K3 stuff from then on.

Or what we did was continue to follow both paths. K3 and CR1. This got my wife her CR1 interview about 6 weeks sooner than just following the CR1. She had her K3 interview scheduled for August 14th. Her CR1 was complete before that and the interview was changed to a CR1 interview. Wheile they scheduled her CR1 interview for September 23rd. So she has been here since August 19th on her CR1. As opposed to September 23rd if we had just followed the CR1.

And no, you do not need a lawyer. All of the information you need is here.

It took us 102 days from the Day I sent in the paperwork to the CR1 interview. But i admit, that is much faster than normal.

Thanks everyone for all the kind words! I'm so glad that I found this forum! I'm updating my time line right now, but my NOA1 was 12.10.08 and my NOA2 was 03.02.09.

My service center was CSC.

I will admit that I am very fortunate because I'm able to see my husband every weekend. He's only 1.5 hours away via car. It is definitely stressful and lonely during the week. It's also very scary at times because I work late and come home just before midnight. Just awhile ago, the police left a notice on my door step stating that a convicted rapist had moved in a block away. It is by law that they send out these notices, which is great and all, but also very scary. I literally run from my car to my house while holding my car panic button and bear spray in the other hand. wacko.gif BUT, this journey will end soon hopefully!

Anyhow, I couldn't believe the email that just came through 30 minutes ago. CRIS is my best friend right now! I still can't believe we got an approval in less than 90 days. Another colleague got his in less than 90 days as well. good.gif

If your fiancee is a UN-recognized refugee in Kenya, you should be able to get travel documents issued by the UN or the Kenyan government. Where are you in the visa process? I would suggest contacting the embassy in Kenya where she will be interviewing and asking their advice. The US is not new to the idea of refugees without papers and as you are applying for a different type of visa they may have special information for you.
