I have a question, how much should be the poverty line of my husband for him to meet the requirements.

He has 2 kids but he is not married to the mothers... He only supports them in monthly basis.

HOW MUCH INCOME HE SHOULD HAVE? I talked to this lawyer from CALI and he told me that the income should be $21,200 per year - thats for 2 kids, me and my husband..

Do you think it is right?

I really have no idea about this stuffs...

Help me please.. thanks!

IR-1 / CR-1 Spouse Visa Process & Proceduresmy firtst RFE
we got the letter from uscis regarding RFE
they were asking about the birth certificate of my husband since it was released from the hospital. They want a copy release from the civil registrar. How long does it take for that to be release? And they were also asking about the passport of my husband since we never submitted the passport because it was revoked upto this time due to debt to child support. My question is, can we submit a photocopy of my husband's revoked passport? Since they know my husband's SSN - they just want to know if my husband is a USC

They were asking about the birth certificate of my husband since we submitted the birth certificate that was released from the hospital.
They want a copy release from the civil registrar.

Question 1: How long does it take for the birth cert to be release?

Question 2: Can we submit a photocopy of my husband's revoked passport? Since they know my husband's SSN - they just want to know if my husband is a USC.

Please help us since the due date is March 19, 2009... We have 2 weeks to go to get all these docs..

Many thanks!

No Len, it is not, and nor should it be. I have experience with this situation as I told you the first time this poster asked for advice and it does not necessarily follow that someone who is behind on child support is an irresponsible #######.

ah i see i seee.. yes his passport is not yet expired, i believe its until 2011. He was on his way to get his birth cert issued by the civil registrar and i think he will be getting it tomorrow.. we are just just totally nervous bcoz the due date is March 19 - we thought revoked passport is not allowed. We should have submit that before hand. I kept asking here before about it but mostly says that revoked passport might be a reason for denial of our visa thats why we only submit the birth cert from the hospital not from the registrar..

Thanks so much for this reply.

they need a certified copy of birth cert and a copy of passport.

I'm not sure how you expected to assure the US government that your husband is a USC if you did not include one of the approved documents as stated in the I-130 instructions. According to the instructions, a copy of the USC's birth certificate is OK, if said birth certificate is issued by a civil registrar, vital statistics office or other civil authority.
So to satisfy point one of your RFE, you should get that copy of your husband's BC from the civil registrar in the town/city where your husband was born.
Also, the copy of the revoked passport is OK, if said passport is not expired, as that the passport must not be expired in order to be used as proof of citizenship.

I am filing for CR1 to get my wife from the PI to Washington State. My dad is the co sponsor and I am wondering if my dad should use his original copies of his W2 and tax paper work. I know that this paper work is really important for even him to have and I was wondering do we need to send original or will copies do. I know the originals will be the best thing but are copies qualified for this? If anyone will please message me and let me know. If anyone is past this and can give some advice about their experience then hit me up please. Thanks for your help.

May all who are still waiting get great results.

I have some questions regarding this form 1864 since we got our NOA2..

I hope somoene can help us or give us any enlightenment about our questions.

My husband didn't meet the poverty guideline that's why we are going to use his dad as co sponsor. My husband is living with his parents at this time....

Here's the link so that at least you can check the form 1864 Sample Form

1. Part II of 1864 form: Should we put the address of the petitioner or the beneficiary's address?

2. Part 5. Sponsor's household size. What box should we check since the petitioner has 2 kids ( not married with the mother but he supports them)

3. Part 6 Number 24b Should we put the Name, relationship and current income of the co sponsor

4. Part 6 Number 24c Is this the total amount of the Petitioner and the Co Sponsor Total Household Income?

5. Part 6 Number 24d do we need to check the box since we have co sponsor?

6. Part 6 Number 24e Do we still need to check that box and put the name of the beneficiary?

Are all the documents should be original? What about the W7 and IRS forms, pay stabs.. Do we need to submit the original or just a photo copy?

I hope you can really help us about these questions..

1. beneficiary's address

2. Assuming the beneficiary is the wife of the petitioner, and she doesn't have any children:

a - 1, b - 1, d - 2 (If he claims his two children as dependents on his tax return. Otherwise, "d" should be blank.)
g - 1 (For the co-sponsor, if s/he is a household member of the petitioner.)

3. Yes, but only if the co-sponsor is a member of the petitioner's household.

4. Yes, but only if the co-sponsor is a member of the petitioner's household.

5. Yes, but only if the co-sponsor is a member of the petitioner's household.

6. No, unless you included the immigrant's (beneficiary's) current income on this form. (Which you'd include in 24b, too.)

The signatures should be originals - photocopied signatures may get RFE's. However, supporting documentation like W7, IRS stuff, etc need only be photocopies. The NVC doesn't require originals for the supporting documents.

Make sure you have the co-sponsor, if they are a member of the petitioner's household, fill out and sign form I-864A. Additionally, the petitioner will have to sign I-864A on Part 2, number 13.

Let me know if you have any more questions!

Uhm, we are kinda confused... We got 4 answers from this same questions.. The other answers is in my inbox which is different from your answers. Most of your answer together with Maxonline are most likely the same...

My questions is

You and Maxonline and the other answers are all the same but the other guy told me to PUT NO since he said that the co sponsor will be filling up a 1864A FORM...

WHAT'S THE REAL ANSWER? WE NEED SO MUCH HELP FROM THIS.... crying.gif

Actually my friends told me that i should get NBI Clearance and Police Clearance.. NBI Clearance is good for one year which i already have.. But the police clearance is depends on what city i have lived here in the Phils. I lived in Pasig for 26 yrs of my life - so i have to request one at the City Hall. However the validity is only good for 30 days.

My plan is to renew it on April and May and then on June (hopefully my interview would be on that month) - at least i have an update police clearance...)

As long as they don't write a expiry date it should be fine. Check this: http://travel.state....ocity_3650.html

Police records

Available and reasonably reliable. Philippine-born immigrant visa applicants 16 years and over are required to furnish certificates issued by the National Bureau of Investigation (NBI). The green NBI certificate annotated for travel abroad is the correct certificate. Other colors are for local use only. Foreign-born applicants who have resided in the Philippines for six months or more may be issued NBI clearances upon application either in person or by mail. Applicants should send requests for certificates together with certified checks or money orders for the fees and postage to the Philippine National Bureau of Investigation, Taft Avenue, Metro Manila, Philippines. The NBI has its own fingerprint charts and personal data forms that it will send to the requesting applicant for execution. Most applicants abroad find it more expeditious to have a relative or friend in the Philippines assist them in obtaining their certificates from the NBI. The applicant may also submit a copy of a prior NBI clearance to facilitate the processing of a new clearance. Posts are advised that not all arrests and convictions occurring outside of Manila are reported to the NBI. The Philippine criminal records database is not foolproof, and can be open to manipulation. Manila and major Philippine cities have computerized records. Fee: 150.00 pesos. Philippine Embassies abroad can assist Filipinos in obtaining NBI police clearances.

I've already read this but here in the Phils - it depends on the city where you have lived... In my city, the validity is only 30 days.. I have no choice but to get another one (to avoid RFE from the consul).. But thanks for the time to read. good.gif

I inquired last 2 weeks ago at the city hall regarding the police clearance. The lady told me that they only have Police Clearance that is valid for 30 days only.

Now, i'm wondering if i am going to submit my police clearance together with the DS-230 documents this March - Do i need to get another new police clearance if my interview date is already assigned (let's say my interview is on June 2009)...

Can someone tell me where can i get a police clearance that has 60 days of validity..I am from Pasig City... unsure.gif

Cheers!

The validity date carries no meaning in the eyes of the Consulate. They are only concerned the issue date.

yes Sir.. i should've get one now... then another one on April and May...

thanks sir
