Well where are you in the NVC process? With CR1, there is no adjustment of status.

I also sent in my paperwok the end of April to CSC. And both petitions were approved and both forwarded to NVC. This seems to be the normal thing for CSC lately.

I am currently following both routes. Today I sent my final papers, DS-230, to NVC. My wife has her medical next Friday for her K3. I expect that my CR1 will be complete in a week or two, before my K3 interview. Then I can change the interview from a K3 to a CR1.

It should help you speed things up because you filed for K3, because it looks like the K3's are being approved faster than the stand alone CR1's. And when the CSC approves the I-129F, they approve the I-130 at the same time.

I wouldn't worry too much. Ours was accepted about a week after it was sent. So you should know soon. Just keep calling the NVC to hear the status. But I do not think it will be a big problem.

Notice the "in process" at the end for IV Bill. Anyone else experienced this? I have been using James' shortcuts and they work great. My phone status is: "errors on your form and letter sent". I called and the letter is just for the $400 IV bill not paid even though i did pay it and they took the money. If they say they don't have it, what can I do?



Just give it a couple more days. It does work.

No you do not send in originals. It specifically says to send in copies!!! And no they do not need to be notorized or anything.

No, it would not have anything to do with the coversheet. When they say the checklist is entered into the system, it means that they received the response to an RFE. That is what they call the response for the RFE, A checklist.

And I would suggest, not just copies of the forms. You should print extras and have original signatures, just in case.

I had an RFE on my AOS. They said they could not determine that my signature was original. Which it was. So I had to send in another. This time signing in blue ink. If this was something that my wife needed to sign, it would have slowed things down alot. So I would suggest, especially if it is something that your SO needs to sign, have original copies. Also, something else I did was to have my wife sign a blank copy of the DS-230. Just in case there was some issue with the information. I could fill the rest out and it was already signed.

Yes, this is the way their message works. Mine says the same thing. If you talked to someone and they said that they had your paperwork and it had not been reviewd yet, you are OK.

They explained that it is the DS-230 that is missing, because it has not been reviewed yet.

And if there is an RFE, the letter only takes about 4 days to arrive from the NVC. My RFE for my I-864EZ got to me pretty fast.

When I tried getting it from the travel.gov site, it sent me to the USCIS site. Are you sure it was the I-864 and not the I-864A or I-864EZ? Also, did you have a co-sponsor?
It could well be that you sent them in in a different order and they are trying to figure things out. I would give it a couple of days.

Well, this morning I did my usual routine. I woke up and got a cup of coffee. Then got the phone and called the NVC. But this time it said, "YOUR CASE WAS COMPLETE ON JULY 16" kicking.gif kicking.gif kicking.gif kicking.gif

Now, my question is this:

Does anyone know when the send the file to the embassy? Do they wait until they schedule the interview, or will they send it now before they schedule the interview? And yes, I know there are some cases where for some reason they get stuck at the NVC.

When I asked this to the person at the NVC, she just kept saying that the file would be there before the interview. And that they would not be scheduling interviews until the second week of August for September.

I need it to be sent to the embassy because I was following both routes, K3 and CR1. And we are in the same boat for both paths now, waiting to hear when the interview is. In Buenos Aires, from reading the timelines of others that went through Buenos Aires, the interview is usually about 2 weeks after they notify you of the interview date. So I am still thinking that I have a chance at an interview the end of July. So I could just get the K3 interview changed the the CR1 interview. But I need the file for the CR1 sent down to Buenos Aires to be able to do that. But, if they wait to send the file to the embassy until after they schedule the interview, it will slow me down.

No, the DS-230 does not need to be notarized, but it does need to be the original, so no he cannot send it to you by fax. But you can get it fillid out and signed by him the next time you are together. Or do it by mail now, so you are prepared.

According to the I-864 instructions, your income or assets are all that matters; there's no information that suggests US sourced income is a requirement for non-resident citizens. However, you should continue filing your US taxes (keeping in mind the foreign income exemption), voting by absentee, and so on, to demonstrate that "You intend in good faith to reestablish your domicile inthe United States no later than the date of the intending immigrant's admission or adjustment of status."

Just make sure you retain proof of your Japanese income.

If you and your spouse have a good relationship with your family in the US, you could certainly file with a co-sponsor if your income and assets don't meet the bar.

However, I am filing the W-7 with an embassy-notarized copy of my wife's passport. For a non-resident spouse, you have the option of a "married filing separately" or "married filing jointly", but you shouldn't file as single. There are some cases where you can file as unmarried or married/separate+head of household, according to some very convoluted wording in the IRS pubs.

I am enclosing a statement signed and dated by both of us:


We, the undersigned, qualify to elect resident alien status for YYYY on the grounds that we married on August 6, 2007. YYYY is expected to enter the United States as a resident alien in 2008.
XXXX is a US-Born U.S. Citizen. YYYY was a non-resident alien as of December 31, 2007, pending immigration approval.
Worldwide income has been declared on our 1040 per the conditions of this election.
This statement is enclosed per the instructions in IRS Publication 519, 2007 edition, page 10, section, “Nonresident Spouse Treated as a Resident.”

In this case, I filed a form 2555ez and declared all non-US income, which was exempt because of my wife's non-resident status in 2007 and because it was under $85,700.


You'll probably get a more financially advantageous tax result by filing jointly, but if you don't have time to get her signature on your 1040 and the signed statement, you can file married filing separately.

They charge 3000-4000 yen for this, I think.

Someone elsewhere on this forum said a foreign notary wasn't accepted in their case, so I asked my wife to go to the consulate, which is accustomed to this process.

My wife has a K-3 interview next week, and we expect to have no problems with the interview, so she'll likely have a visa within a couple of weeks.

However, due to some personal and work commitments, she's planning to delay entry to the US for a couple of months to mid-July. Coincidentally, we just got the Affidavit of Support Bill and Immigrant Visa Bill for the CR-1 process, because both were sent to NVC (lucky, I guess).

If we went ahead and started paid the CR-1 fees now, there's a possibility that she could get an interview scheduled at the Tokyo Embassy by mid-July anyway, and if not, it still seems that it would be faster than adjustment of status. If we went the Adjustment-of-Status route, the Employment Authorization Document wouldn't likely be processed until mid-October if she enters mid-July.

Even if it took longer than mid-July for the CR-1 interview to be arranged, she could travel to Seattle at that time and return to Japan for the interview. Since one month's pay in our field (software) would more than pay for an airline ticket back to Japan, it would seem financially advantageous to proceed with this route, even if it took until, say, September to get an interview.

Does it make sense to go this route? Are there any hiccups, legal or logistical, that might complicate this, rather than doing the conventional adjustment of status?

After I've paid the Immigrant Visa bill, does the DS-230 go to my spouse, the CR-1 applicant, in Tokyo? Or will I receive it at my address?

It was obvious in the K-3 case, but a little unclear to me now.

I paid the Affidavit of Support fee online along with the Immigrant Visa bill yesterday. It shows up as "paid" today. I presume this means I can go ahead and file the I-864 with the cover sheet that the online payment system generates, yes?

You can send the DS-230i and I-864 together, or separately, as long as the bar codes are enclosed in each envelope.

However, if they don't arrive at NVC on the same day, you may later get a spurious notification that some of your documents are incomplete. The notification is sent automatically to your agent.

I'm In the same boat as you. Our 129F and I130 both touched 4/13 and when I called they said call back at end of the month we still processing Sept petitions. The person who answered was in Indiana was as our case is in CSC.

I want to bring in my wife into the USA for a short visit. Is there any way that i can sponser her to come into the country for 30 - 60 days. She is from the Philippines. Or did this go by wayside after 9/11. We also have a I-130 in work at the start of the process. Will I have to wait until she gets the VISA? : helpsmilie.gif

You can call the IRS and request a transcript of your taxes. You can also ask them how to obtain W2's. There is a fee for copying the W2's. Look up IRS on the internet for their number.

It's a big chance to take just to prove you were above the rules. The correct way to to do and the consequences of immigration fraud have already been stated. I have a friend in Calif who met a girl online and she came down from Canada. They married in 2 weeks. This happened back in July. She just passed her 6 month limit to be here, and was telling me all smug like how she did all this and applied for her I130 just like some of her other relatives have done. She even asked me why I don't do like her!!! Well when she heard about the rules and visa, and the words IMMIGRATION FRAUD. Now she is walking around a scared mess, knowing full well if the CO pays attention to the fact that they married a mere two weeks after arrival, she is looking at a ban. Those of us who chose to follow the rules get punished with additonal waits and bureaucratic mess by those of you who break the rules.
