Really? 2 months....that would be fine by me.

I still have some debts to pay off and although I don't want to be away from him longer than i have to at least that means I would still have some time to work and make some more money to save and pay off those bills.

I guess if its 2 months and I sent all my paperwork in by august that I would have an interview in somewhere in oct.
Thats not so bad.

keep in mind the above poster isnt going through Vancouver or Montreal.so time wise things could be different. A zillion posts on Cdns visiting while undergoing the POE process, and the majority never have a problem, just tell the truth and don't tell your life story, and ties to canada. best of luck

CanadaHow much is the taxi from YUL - Montreal airport to d/t Montreal?
Here is the link to your unwanted shuttle, lol http://www.admtl.com...t/_aerobus.aspx

Lot cheaper and probably not that much slower than ur taxi!! The shuttle dropys u off at the train stattion, then u catch a FREE shuttle to msot downtown hotels. Not sure the hours that shuttle runs. It is cheaper to book a round trip!

I'll say again, ask over at www.roadtocanada.com There are folks there MUCH more experienced with the intricacies of Canadian Immigration and visitor records. Most of them have gone thru it already. Canuck Abroad is for Canadians travelling elsehwhere in the world, and Visa Journey is for people immigrating to the US, not Canada.

Just a suggestion. wink.gif

I did that already- my last post was the response I had gotten on RoadToCanada for the same question. Seems I'm getting even more responses on the topic here on VJ than I am over there! Why not take advantage of the extra knowledge just to be sure! Thanks,

Probably in reality, Most canucks could just come to the USA with INTENT and just say! But of course one just isn't going to tell the POE dude or at the AOS interview that you had the intent of staying all along. As long as you stick to your story, your probably good to go. Personally I care more about how the Capitals are going to fair against the penguins than other people life, lol When my life is perfect and boring, I wil worry about others, lol that aint going to happen. Looks like I'm getting in trouble with the thought police.

Lets try this scenario: I have NO intentions of moving to the US. We LOVE Canada. But we just sold our house and want to spend the summer traveling around the US visiting old friends and family before we buy our next house (in Canada) and settle into a new life (in Canada). Its still OK to do that, right?

Now, suppose our outlook changes while on our journey. We stumble across a great opportunity and decide to stay. What are the options for us? By the way we have a child who has dual citizenship. Must I return immediately to Canada and file for visa's etc or can I LEGALLY do it from the US.

BTW flames9 my friend may be wrong but she built a hugely successful business dealing with Canada/US immigration for many years. You yourself stated that that was the advice you received from legal council. Seems like a reasonable question in light of these professional opinions.

I received that free info on a 10 minute consult while I was in the USA visiting. You on the other hand are in Canada with the Intention of moving to the USA--you can play the "Intention" game all you want, its NOT us that you have to convince. And yes more than likely it would work, but it may not!! Keep in mind if you decide to just stay in the USA and AOS, u wont be allowed to leave (well u can leave the USA, but most likely wont be allowed back in) until you have completed AOS or get AP.

No clue on the time frame on DCF, check out the DCF forum. The time line for Mtl is a bit slow, but has been picking up and the DCF track should be faster than going the regular cr-1 or ir-1 route.

CanadaTrouble Ahead???
well ur immigration friend is wrong!! Soem immigration attorney's do say to do that!! I had a free consult with 1 while I was visiting in the USA and thats what she told me to do as well. That is legal if one had NO intention of staying in the USA while they were visiting. Your case is different as ur in Canada, now with the intent of moving to the USA

Since the American spouse is a resident of Canada as well, you are able to Direct consular file (DCF),and that is normally much faster!! There is a DCF forum on Visajourney so give that a look
http://www.visajourn...hp?showforum=82 and there is a CANADA sticky at the top of the page!! Best of luck!!

yes, obvisoisly, lol I was referring to the highlighted portion in ur previous post.

But that doesn't make sense, because obviously this woman didn't get stopped at POE. Why confuse the issue, when there is plenty of confusion to go around in this case?

I wasn't referring to the op. You stated "A lot of people here will tell you that you can't adjust status if you had intent to immigrate when you entered the US, but that is not the case" So I stated, when u get to the POE, tell them that you have no visa, and that you intend on staying in the usa" And see what happens. And if you do an AOS interview, again say, I had the intention all along of staying in the USA, even though I had no visa" lol Who knows, they may still approve ya, bu todds on they will not. At My Naturalization interview, the interviewer and I chatted a fair bit about Canadians, lol

One has to worry about themselves, no one else does, lol But the advice given on VJ (not off topic forum, lol) is usually bang on, but yes a quick consult with an attorney does not hurt. We used one (hadn't found VJ) and was a ttl waste of $$, but oh well, not a big deal

A couple of things - I think you need to spend some time reading the guides to get a basic understanding of the immigration process. You may need to hire an attorney for a few hours consultation to get help on the legal issues, but you don't need to pay $5000 to get the attorney to fill out your paperwork for you. That is not money well spent. You can get tons of great help here on how to navigate the process and how to fill out forms. First you need to educate yourself to know what questions to ask though. It's very complicated.

And as a caveat, people are very knowledgeable here about the administrative process, but when it comes to the legal issues you shouldn't rely on comments here. That's what you should consult a lawyer for. If you educate yourself about the issues, you can then consult a lawyer, get all your questions answered in an hour, and pay less than $300. For eg. even if you entered the US with the intention to marry, that in itself is not a bar to adjusting status. A lot of people here will tell you that you can't adjust status if you had intent to immigrate when you entered the US, but that is not the case. If you have no other adverse factors in your adjustment application, such as criminal records, preconceived intent is not a bar to adjusting status. If you want to remain in the US while your visa is being processed, that is the option you should pick (if you have no other adverse factors).

If thats the case, next time one comes across without any type of visa, just tell the POE dude that your moving to the USA to stay and see what happens, lol yes, one should never fully rely on immigration boards.

THANKS EVERYONE FOR THE ADVICE so its april almost may now i havent done anything i was going to hire a lawyer here in californa but they are wanting to charge 5000 for the fees and i havent saved enough yet. anyhow i finally been doing a lot of research and is going to do the k3 visa the only thing is we are starting the paper work now but my stay for 6 months is almost up in a couple days what should i do? also we are planning to file for a i 30 first should i go back to canada while hes doing this and if i do i am scared they might not let me back to the usa. i wanted to come back to canada within the 6 months but everyones been telling me not to come back or i cant reenter back into the usa????

Wow, you waited for 6 months, you could have been over half way done by now if you had submitted stuff earlier. Where in Canada do you live? k3 and cr-1 are running pretty close timewise, which makes mores sense to do the cr-1, as it is the "better" visa for most, and it does cost less. But if your in Western canada, the k3 may be a bit more faster, as k3's goto Vancouver. (ALL cr-1 got Montreal, simple as that, lol). And since ur inthe USA and I imagine you had NO INTENTION of staying, but out of the blue you have decided to stay, you could stay and do adjust of status (AOS)

You can file now! Many of us traveled to the USA while the visa process was ongoing and we had no problems. There is a new thread about these travels almost weekly in the Canadian forum, lol Yes no one can gaurentee you that you won't be denied, but majority have no problems visiting the USA. Ensure you have ties to Canada, plus since I'm high on coffee, my FREE personal advice, lol

1) Always tell the TRUTH. never lie to the POE officer
2) Be confident in ur replies
3)keep ur response short and to the point, dont tell ur life story!!
4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!
5)pack light! No job resumes with you
6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)
7) Always be polite, being rude isnt going to get ya anywhere, and could make things worse!!
8) have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didnt lie! Refer to #1

Best of luck

yes, you can simply call or email them. I belive I called and explained that I wanted to transfer so much $$$. I kept my transactions below $10,000,lol you don't have to, but I was told by a bank manager that sums over $10,000 are tracked by the FBI, who knows, lol

The increase I believe was pretty quick, if not immediate!
Flames9_RNMaleCanada2009-04-11 18:56:00
CanadaAbout the Canuck Clearinghouse Thread...
Found 1 of my CH posts:

1) fill out the online application https://online.custo...l...&branch=154 (as u can see their is a"s" after the "http" thus you know it is a secure link)

-One has to send in proof of ID, 1 or 2, I do not recall, I sent in 2. To send in 1 can either mail it in, fax it in or scan and email in through their secure server, which is what I did.

2) They will call you to verify it is you setting up the account, (at the pre-arranged time on the application form) Ask a few very basic questions and answer any questions you have. Then they will state when you acct will be activated. I was activated only a few hours later, but can take up to 2 days I believe!!

As well somewhere along the line you have to send in your Canadian bank account info and your American banking info. I sent my stuff in through their secure email (require a scanner then) it may take a day or two to get the account verified

To make a "trade" it is very basic and as I said before you can back out if you don't like the exchange rate given, or hit reset and it may or may not change. What ya can do, is see the rate, then get on the phone and cal ur bank, and see what they will offer you, keep in mind some (not all) banks will charge you a fee to cash a Cdn cheque!

to make a trade steps. (it has changed in the last while)

1)log on!

2) click on CREATE TRANSACTION
3) they ask two questions, which will probably a NO
4) Now ur going to select ur currency. ur either going from US $$ to Cdn $$ OR CDn $ to US $ the following is completed on the same page:

a) Specify the amount you want to trade. Right now(7:25 pm)) Exchange Rate:1 USD = 1.1980 CAD and if I wanted to see if the rate has changed, i would click on QUOTE!!! it used to be reset, but they have changed their website in the past few months. The rate they have quoted you is good for 40 seconds.

cool.gif select your payment, which should be DEBIT MY ACCOUNT (its free) and then your bank account

c)payment method. For FREE it should be EFT/ACH (electronic fund transfer),want it quicker, select wire, but their is a fee

d) select recipient and account.

Your accounts will already be there, as those are the accounts you provided to CH

The rate I was talking about is on the bottom of that page. It is very easy, and like I stated, if ya have any probs they have a free 1 800# to call and they will walk you through the process, they are great, their customer service is top notch. I transferred my RRSP $$ with them, which was a nice sum, well could have been a lot more if the cdn $$ wasn't so crappy way back then, lol and it went through flawlessly.

Soon heading back to Canada (vancouver) to take an Alaskan cruise, so wil be transferring money back to my CDN account, so it comes in handy.

CanadaAbout the Canuck Clearinghouse Thread...
I need to find that link--as I gave step by step instructions on how to do it! It is very easy, pretty much no different then signing up for any other account, just follow thier instructions. You have to send in prrof of ID a photo copy of 2 pieces of ID (maybe it is 3??) u can either mail it in, fax it in, scan and secure email it in! Plus you have to mail in your banks info the same way! I will look in a bit for that post, but its not difficult to do! i walked by their main office in downtown Victoria many times! Staff is super professional, even managed to chat hockey on 1 call! takes a few days to set up. Once ur all set up a transaction takes between 3-4 business days to go through. if ya go Electronically (EFT) it is FREE. They do offer a wire service which is faster, but costs $$. And when ur making a transaction, its almost like ur in vegas! As you can see the rate they are going to give you, so you can either 1) accept it 2) say nope and cancel it or 3) hit the reset button (which is by the rate) and the rate may go up, down or stay the same, lol! Its not a huge change, but depending on how much $$ ur transferring it can make a difference. So even after ur done, ur always asking urself, should I have waited? lol Never had 1 problem with them! back in February, i added another account to be associated with CH, so you have to send them the info--then they have to verify info with the bank---they send them a fax requesting info. But it was taking awhile, so CH said, lets do a 3 way call with ur bank! CH set it up, and fixed the problem. They went totally out of their way and paid the long dist charges, lol they rock!!

Sorry my reply wasnt up to ur high standard, lol. I should have added on many many sentences. I have a question...how many months after you got the K1 visa can you wait to enter in USA?
Thanks for your help
Jo

6 months. What some have done is gone to the interview, and then had Mtl(vancouver) wait in issuing the visa. When they are ready, they have mailed their passport to the proper consulate to issue the visa. But keep in mind, that doesn't happen overnight, lol Soemtimes takes a few weeks.
