Ur options:

1) get the USA citizen to contact their congress person and have them inquire for you. Should be a real easy thing for them to do. And they like easy!!

2) email Mtl daily with ur case # in the subject line!! maybe send it from a different email, ie hotmail, as maybe its getting caught up in the server

On eis damned if ya do, and damned if ya dont!! One could get to the POE with ur passport with the visa in it, and say, I don't want to activate it, and the POE officer can say, too bad, even with the Mtl consulates top dudes approval in the computer. Most likely either way, one should have no problems. When you return you passport, write a very nice note, and state the date you plan on traveling to the USA. Being nice and polite can only work in ones favor. As we have learned the workers at the consulate and very capable of reading,lol

Also, I asked about having to activate the visa right away because I said I normally I go down to visit my fiance for Thanksgiving. I told her I was not planning on moving there permanently until Dec 27th.... and she said well I can give you back your passport now and you can use it cross the border normally as you would do and when you return back to Canada, send your passport back to us and we will put the visa inside and send it back in your envelope. So that is what I did, so I now have my passport to go visit my fiance one last time before I move for good after Christmas. She said that it was risky to try and cross the border with the K1 visa and not have it activated, so she said this was the best way.

Well that's interesting advice because the Consular Deputy told me the opposite.


Others have done it that way as well... just be advised that they dont always mail you back the passport/visa ASAP

That is AWESOME info! Thanks for that! I was asking them that at my RBC branch yesterday, but they weren't too sure. They said the two banks are completely unrelated...which struck me as very odd.

I'll be living in D.C., which is an hour and a half from the closest RBC branch in Richmond, but I think it'll be worth it to drive down there and set up my account, then just maintain everything online as usual. My wife and I have a joint account, so if it happens that I receive any checks, I can put them in that and just transfer them over.

"cash is king" depends!! My parents gave me a bunch of cash a few yrs ago. they Went to their bank--bank of Montreal--and stated here is Cdn $$$ how much american $$$$ is this?? Bank gave them the amount. They called me, I Logged on to CH to check the rate. CH was better. Moral of the story, each situation is different, and one should do their research,lol. if ur transferring smal amounts of $$, probably not a big deal, larger amounts it is definitely worth it to do ur research. I feel safer doing it through CH,then carrying large wads of cash with me.

I have a USAA acct in the USA and a Presidents choice acct in Canada, and on avg it takes 3 or 4 BUSINESS days to complete a transaction. I have chatted with CH staff a few times and they have been great, even chatted hockey with 1 for a bit. They will even walk you step by step through the process, which is very easy.

yep CH!! and yes one can send from USA to Canada, done that many times!! Been using them since 2005 and never a problem. They may start ur trading limit low, but I called them up and they raised it. Very easy people to deal with, I ran by their office many times when I resided in Victoria! They recently got bought out by Western Union,but I havent noticed any changes

If after 10-14 BUSINESS days no SSN card (assuming u checked off the box on the ds-230), head to ur local SSN office and ask about it, AND be prepared to file again! Either of these is a totally viable option. A friend of min did the option your lawyer suggested. She went down to "visit" and got married and stayed. If your husband can afford to support you while your lawyer adjusts the paperwork, it could be around 6 months. I did second option, I went down for a visit, and then got married at a courthouse. I have since returned home to Canada...the wait outside the US for us is now about a year. I can still work, so that is good for me. As a Canadian you can go visit your husband you just need to bring lots of documents with you to prove that you will return to the country. I did this at Christmas and it went just fine.

What you choose depends on your finances, and how long you can wait to be together permanently.

no that is illegal!! going to the USA on a visit and knowingly stay is illegal. and yes many do it and they probably get away with it. One just has to play dumb!! But if you don;'t agree, once ur at the interview just say "yes i came to the USA with no visa and I knowingly stayed" and see what happens,lol

I truly do not care if people do it that way or not, I say go for it, as ur chance are slim of getting caught. BUT if one does, well one has only themselves to blame!


One can goto the USA, get married,then leave! Thats what we did! On one of my visits, we got married, then started the CR-1 visa paperwork and returned to Canada!! Did I mention that to the USA POE officer when i was going down?? NO, as he NEVER asked,lol See my free advice below on visiting,lol

On a visit to the USA, my then GF (now wife) went for a free consult with an immigration lawyer! She said just stay in the USA and adjust of status (AOS) but I could not as I was in the CDn air force. She said well when ur out of the Air Force, come for a visit and then AOS!! What it all comes down to is your INTENTION!!!!! if you KNOWINGLY come to the USA with the purpose of STAYING that is illegal, simple as that! If one comes to the USA with the plans just to visit and out of the blue one decides to stay that is fine!

And yes there are some (many) that knowingly come to the USA with the purpose of staying and juts play dumb! And for some (many) it probably works out ok. But if ur found to break the rules, your probably screwed, you have less recourse this way! And yes in your case, you will soon know the rules! You have to make the decision to do it the legal way which is longer or risk it!!

If one decides to risk it and AOS, well one can't leave the USA until you complete a certain part of the process! Well leaving isn't the problem--its getting back into the USA! That means if a loved one gets sick/dies, you can't go back! And one can't work as well! Maybe a bit drastic,lol but thats the way it is.

During the visa process, one CAN stil visit. majority of us did, and majority of us had NO problems! it is up to the Port of Entry (POE) guard! Bring strong ties to Canada ie letter from employer, lease agreement, return airfare,et etc! and yes they can still deny you entry with strong ties!

I'm certainly going to ask about it when I'm there. I figure I've got some compelling reasons for them to do so.

I can leave literally the day after I get my passport back. All I have to do is fill my car with boxes that are already packed, numbered and itemized...and VROOM. I'm on the road.

I just noticed the other day that I'll be passing within ten miles of Deadwood, South Dakota. My wife and I both LOVED that HBO show, so I figure I'll make a brief detour for a souvenir or two. :P


Thats really not compelling reasons,lol! I would say u have tickets to the capitals game on such a date and that requires for pick up of visa at 1500!! LOL

Well, it comes down to residency requirements. Having a job in Canada is a major sign of "residency" in Canada, regardless of where one lives. Likewise, having PR status and a home in the U.S. is a major sign of "residency" in America, regardless of where one works. Reconciling the two can be very tricky. I believe Trailmix commented at length awhile ago on residency issues vis-a-vis taxes in each country. Maybe she'll chip in here too...



there is a few members that live in the USA, and still commute every day to Canada to work! One is even a Border guard in Canada!!

No1 can say if you will have a problem or not! it ALL depends on the port of entry (POE) officer! And how strong of ties (evidence) to Canada you can provide them!
