If she's not gonna do it, she's not. I doubt there's any "self-adjust" from a K-3. The entire premise of the K-3 is to allow the spouse to enter the U.S. and then Adjust their Status to that of a LPR.

Consult two lawyers. One for immigration. One for child rights/divorce. Good luck.

I should've said "while not always corelated." You're right, it is related, almost all the time. But there are a few abberations, for example, Bill Gates. College drop-out but still massively wealthy.

Most of us date within our economic/educational peers. Because that is who we surround ourselves with. Peers in college or colleagues at work, for example. A Harvard graduate is not likely to date a high school drop-out. Not saying it can never happen, but not likely to happen.

Wow, fun read!

A couple of points. Not directed towards anyone in special, just my thoughts.

1) We're all inclined/hardwired/tend to find some physical attribute appealing. Some men prefer Asian physical features. Some women prefer tall guys. Some guys like big boobs, some want small boobs. Some women like black men. Gentlemen prefer blondes, at least that's what they say. That's just what they find attractive. When I met my boyfriend (now husband) in junior year, my list of ideal qualities a potential boyfriend must possess had considerably dwindled due to previous bad dating experiences -- tall, funny and not emotionally abusive. It also helped that he has one hot booty. And is banging in bed. I also find redheads to be extremely attractive. Call me weird if you will. We're now both recent college graduates, quite poor but we still make each other laugh, watch LOST and eat chicken curry and samosas.

2) I really think by the time one files K1 visa, they and their SO should be 100% ready and convinced that this what they want and they are willing to go through with it. The K-1 is not meant to be a wife shopping pass. "Let's bring her over and see if she fits." Of course, circumstances can and do change but I can't imagine going through this hell several times over just for the fun of it.

3) Economics and education while not corelated, do end up impacting our choices when it comes our SOs. If a wealthy woman spends her time vacationing in Bali and playing tennis at the country club, her group of acquaintances is not likely to include the restaurant busboy or janitor, now is it?

4) For a lot of people from developing countries, a salary of $18,000 represents a lot of money. It's only when they get to the U.S. do they realize just how high the cost of living is compared to their home countries. A lot of people are also desperate to get out of their situations and are willing to say and do anything to get what they want. That doesn't mean they will tell USCIS that it's for money or for a GC. Of course, it's for love.

I had more, but lost track of my thoughts.

I believe you will have to overcome the Adam Walsh Act, which is not impossible but it is an uphill task. I'm sure others more knowledgeable will be able to guide you in the right direction.

K-1 has one specific condition attached. Simply put -- marry within the stipuated 90 days or leave the U.S.

From what I understand, one can only adjust their status based on their K1 visa if they married the original petitioner.

Which doesn't apply in this case. And the question of overstays being 'forgiven' doesn't come into play here.

Since she did NOT marry Bob as she was required under law to do so, she had no basis to adjust her status from a K1. Which means she has been living there illegally for the last 3 years, once her I-94 date expired. I'm not going to give you advice about how to circumvent immigration law because your fiancee has already been doing that (and it is a violation of the VJ TOS to do so) and forgive me, but currently I'm touchy about the topic of illegal immigrants considering my husband and I and just about everybody else on this site are doing things legally.

So your options are: Get married. She moves back to China. You file CR1. It will be denied and she will be given a 10 year ban. Then you can file a waiver. If it's accepted, well and good. If not, you can move to China or another third country. Which isn't as easy as it sounds.

I doubt you will be able to marry in the U.S. and then adjust her status based on an I-130 and I-1485 petition. She will most likely be deported.

Also, this is my personal opinion -- but I'd be wary of someone claiming abuse on a K-1.

I'm sorry but I have a hard time believing that your parents arrived on a tourist visa and you were unaware/ignorant of the AOS procedures/forms and YET you were able to get ALL the numerous required documents assembled in 20 freakin' days without any prior intent.

Having said that, I hope it works out for you and your parents. Keep us posted. Maybe a lawyer will be able to help.

If this is allowed, then why do people file for IR5 (?) -- why not just adjust from B2?

Ok, to summarize.

All K-1 entrants PLEASE get married within the 90 day stipulation to save yourselves a world of trouble. Go down to the courthouse and sign a few papers at the very least. Will cost you $40 if you can't afford a big wedding due to financial constraints or time.

If you get married outside the 90 day period, DO NOT FORGET to concurrently file a I-130 AND the I485.

I'm not certain about the I94. I just thought it was a stamp of legal entry, i.e. not EWI. I never noticed it had a date on it.

I would prepare a waiver package just in case. But I think the immigration judge's letter will carry a great deal of weight.

OP, please let us know how the case is progressing. I hope, for your sake, everything gets worked out.

You can file through DCF since you both are living in Pakistan. Have a strong hardship waiver package ready because the case will be denied at the interview stage.

Your case is far too complicated to proceed without an attorney.

Does he have a 10-year ban or a lifetime ban? The problem is that he not only violated his student visa regulations, he also ignored a voluntary departure order.

Firstly, I believe the K-3 is now administratively closed after 02/01. So you will have to stick with the I-130/CR-1.
