IR-1 / CR-1 Spouse Visa Process & Proceduresquestion !!!!!!!

hi everyone. I just discovered i am pregnant :(:) kind of sad cus I am not with my husband and happy of course. so It's confusing lol
I just want to know it this will change the process, I mean if it will take longer which I am afraid... we married in November 7th las year and have been apart since then :( as most of you :(. I am waiting for my NOA2 right now. can you send me links or just answer to me. Thanx in adavance :)

Mary,

There is no such expedite based on pregnancy. But you may try to expedite if you feel nobody is there to take care you.

Based on your timeline, your I-130 approval should be through in couple of weeks time, plus NVC another 1.5 to 2 months time, plus Interview another 1.5 to 2 months (based on the Consulate too) time.

I am really confused from your note :star: that you "just discovered" it and apart each other since last Nov! May be my math is wrong here

Does anybody know where can I set up my e-mail for my case and receive all the forms in my e-mail account?

Thanks.

ok so if I write it in English and write what she has to say, then she can sign in and get it notarized in my country, will my husband be questioned if his mom knows english or not?
in my country i mean in albania, you know her country of residence

I don't think so. If CO asks it tell that it was explained to her.

You can have someone that is fluent translate it, and have them state, "I certify that I am fluent in both languages", and sign the translation.

In fact, my mother does not know English. I prepared one for her in English (explained it to her), she signed it and get it notarized.

hello Loto,
So I am including affidavits from third parties ,and Iyu am thinking to include my mother in-law and my dad. My question is: How long does the paper have to be, and what do they have to include in the paper when they write it so they know what to write. Alsoo does it have too handwritten or typed. And you said that if I get them notarized that would be better right? That is all, thanks a lot for answering my questions.

IR-1 / CR-1 Spouse Visa Process & Proceduresproof of relationship

hello everyone,
I have a question about the documents that are needed during the interview as evidence that we are marreid for real. So far I have pictures of engagement, pictures of both families together and videos and pictures that were taken in all the activities that we had together, like going to beach, visiting relatives, etc, also I want to include affidavits from people that know of our relationship, and I wanted to know how long does that have to be and what can they write on it. I have emails and phone records, with that I want to use the stamps from my passport that I visited my husband back in my country. This is all I have so far, and obviously the marriage certificate. I dont know if these will be enough for my husband to present at the interview, but I wanted to ask what are some of the questions that they ask during the interview. Any help from someone that has gone through the process would be appreciated, thanks.

Those are good. But, if possible, get couple of affidavits (then notarize it) prepared by third parties who attended your marriage ceremony.

I just tried the expedite, but got denied. Expedite denial does not affect the underlying I-130 petition.

IR-1 / CR-1 Spouse Visa Process & ProceduresConfused to no end....please help????

Hi all......well the situation is this and any info would be greatly appreciated.
*Hubby is US citizen, myself Australian citizen.
*Married feb 2007 (3.5 yrs married)
*Turned in GC as advised by USCIS before renewal date.(bad advice)I had to return to australia for family matters.
*Need to re-apply with I-130

My questions are.....1) Once the I-130 is approved, do i need to medical etc in sydney?
2) Is the visa issues immediately as i thought i read that this particular petition is unlimited (special category). Is this correct?
3) When i travel back to the US on this visa i will be granted unconditional 10 yr GC as have been married for over 3 yrs (USCIS informed)?
4) Is there any other forms i need to file with this petition (besides the request for expidite)?

Thankyou so much and any information would be greatly appreciated as right now i need to get home to hubby and right now i have no status within the USA.If i had of known the advice given to me was not only bad but horrendous, i would never have sent my GC back.

Have a great day all and beware......If you are given advice, always get a second opinion....learnt a hard lesson.

Ellen

Ellen,

We are also in the same situation as you. My wife surrendered her GC due to her long absence in the U.S.

My questions are.....
1) Once the I-130 is approved, do i need to medical etc in sydney?
Yes, before the Consulate interview and after getting the visa interview appointment letter

2) Is the visa issues immediately as i thought i read that this particular petition is unlimited (special category). Is this correct?
Yes, for IR1 there is no numerical limit on visa#.

3) When i travel back to the US on this visa i will be granted unconditional 10 yr GC as have been married for over 3 yrs (USCIS informed)?
That's correct, it is IR1 unconditional green card

4) Is there any other forms i need to file with this petition (besides the request for expidite)?
You need to start the I-130 process all over again. Here is the process - http://www.visajourney.com/wiki/index.php/EZGuideSpouse

Currently, CSC takes 5 to 6 months for just I-130 approval and VSC around 3 months.

IR-1 / CR-1 Spouse Visa Process & ProceduresIncome HELPPPPPPP!!!!!

This is my problem, i am self employed and had a business that I closed which ad losses that are carrying over from previous years. I am thinking of having my brother co-sponsor which he lives in another state. On my income taxes it shows a negative income of -18,000. When my co-sponsor submits his last 3 years of tax returns does he have to make enough to bring my negative income to atleast a positive number plus the poverty level of 20k+/- or do they just consider his income and ignore mines?

IR-1 / CR-1 Spouse Visa Process & ProceduresPersistance Pays

I am SO glad I listened to advice given on Visa Journey saying to call NVC often and not to listen to everything they tell you.

Our NOA2 was approved on 09/22. After several calls (it sure is nice to be able to talk to someone isn't it?!) we found out that NVC received it on the 28th but it wasn't in the system. We were told to call back in a week to give email addresses. I called yesterday and was told to call back at the end of October or beginning of Nov because "it usually takes us 6-8 weeks to get your case into the system". I expressed my confusion at how another operator had told us to call back in a week, and this lady said well you can TRY but I am telling you the usual timeframe.

I called today anyway, and sure enough we now have a case number! I am sure glad I did, since now they have our email addresses (the operator asked for them) and now they will email us the invoice etc rather than snail mail.

Celebrating the little steps! And sending hope and encouragement to all the others out there who are missing their spouses. IT WILL ALL BE WORTH IT IN THE END!

IR-1 / CR-1 Spouse Visa Process & ProceduresDefinition of Maiden name in husbands g-325a

So my husband is filling out the G-325a (biographic information) and it asks for his current wife's name and says to put her maiden name.

My question is this... My maiden name from birth is "Jones" and then i changed it to "Smith" when i was married years ago. Then I divorced and kept my "Smith". Now I am married to my husband and I am not changing my last name until after he's moved down here. So when he fills out his wife's name, using her maiden name... is he using my name from birth? or my name as it is now (my first husbands last name)?

Thanks!

Maiden name is the name at birth.

IS, since I had provided my email id to NVC (during that time I didn't give her email id), NVC had emailed me the appointment letter with the details. I emailed to her. Then she printed it out and produced to the physician and the Consulate.

IR-1 / CR-1 Spouse Visa Process & ProceduresAOC DS-3032 entered into NVC system??

OK, So I emailed our DS-3032 form on October 5th. I called NVC today and the lady told me that it was entered into the System today. My Packet IV bill is still not generated. First she told me it would take 1-2 days for it to be approved. So I asked her if I can pay my packet IV bill on lets say Monday or Tuesday of next week? Then she immediately changed her statement and said I could take 1-2 weeks to be approved.

So just want to ask people here from their experience that how long it takes for IV bill to be generated after DS-3032 is entered into system. What happens after it is entered into system? Does someone actually enters DS-3032 into the system and then someone else goes and takes a look at it to approve it?

Thanks,
Gaga

Loto,

Thanks for the information.

Darnell, Yes, I did check the links that you have provided. The information that caliguy77 has, is similar in receiving the letter for the interview at local office, but my spouse hasn't ever come to USA.

I hope i receive the letter before my abroad trip that I am planning on soon.

Thanks,

Tina,

This interview is with the petitioner, not for the beneficiary. Beneficiary interview in your case will be at the Consulate in India.

Tanvee,

Then you don't have to worry about anything. It will be a casual chat about you, him and the relationship. If they found some wrong information in the application, they want to correct it as well. That's why I asked to take the entire file when you go there.

Important:- Take excessive evidences of your marital relationship. Everything that you can think of.

IR-1 / CR-1 Spouse Visa Process & ProceduresIR1/CR1 visa - Testing and Interview case status

Hello All,

I received a I-797C in the postal mail. It stated that 'Preliminary processing of the my application or petition has been completed and it has been transferred to the USCIS office in the City, State. That office will notify when they schedule an interview on the application or petition. Any further inquiries should be made to that office.'

The City, State is the place I reside currently in USA and the letter didn't specify any information more than that.

When it says "application or petition has been completed". Does it mean that my case is approved?

Can someone please let me know if they received something as above and appreciate if you can provide any information that is helpful.

Thanks in advance.

Tanvee.

Now it is more clear. They want to interview the U.S petitioner at the local office before this I-130 petition approval.

Don't get panic! Sometimes they do it and it should be so easy.

Questions - Did your petitioner have any criminal offenses in the past - arrest, charges, conviction etc.? Any name check issues in the past such as Naturalization etc.?

IR-1 / CR-1 Spouse Visa Process & ProceduresTo much evidence

It depends on what country are you in. There are a lot of fraud in some countries thus these people from those countries have to send in (a little more) supporting documents.

There are some people who only have to send the bare minimum & they will be fine. But for some countries that bare minimum WILL NOT surpass.

Just because it worked for you (you only had to send in the bare minimum) doesn't mean that it will work for someone/everyone else.

Remember there are required documents (no matter what country you are in) that are needed.

The best thing is to know where your/your spouse country stand & what "extra", if any, that you may have to send.

If, for any reason, that you have to send in some (more) supporting documents, then you do not have to send a truckload of support evidence - save that for the interview. It would be better if you send a few supporting documents/pages from various sources (chat, chat log, email, telephone, letters, pictures etc) and very important - organize & outline your evidence/package. Remember organization is key, I don't think that anyone at USCIS want to go thru a huge application looking for a particular document (s).

With my application, in addition to the cover pages, I had a summary/log at the beginning of each evidence, so it was very easy for anyone to find any document that they wanted.

Glad you were approved at USCIS. I wouldn't take the chance of using just a marriage certificate as the only proof of a "bonafide" marriage at our interview. It looks very clear to me from the instructions that there has to be secondary evidence to collaborate what the marriage certificate claims.

Yes you are absolutely right.

USCIS will give hard time to certain countries where the immigration fraud is relatively higher. That's why all these secondary evidences of the marriage relationship are required.

My 2 secondary evidences were:
1) 2 notarized affidavits from my parents
2) Our daughter's birth certificate

Also, we plan to back-load more evidences at the interview time.

IR-1 / CR-1 Spouse Visa Process & ProceduresReceived IIN & AOS Package

I just opened my email & saw that there were 2 emails from NVC.

1). DS-3032 package to my wife ( I was cc on it).
2). AOS Package (my wife was cc on it ).

When I called on the Oct. 13th to get the NVC case number, the lady ask for & took my wife's email address (without me first asking her to take it), then she read mine to me without me even giving it to her.

Yesterday afternoon I call to verify that they have the correct email addresses (follow up) - they were correct.
Then last night I email the DS-3032 to them via my wife's email address & I also included the signed DS-3032 as an attachment.

Now this morning, I received the two emails from NVC - both were sent very late last night. The AOS bill was sent first, then an hour later the DS-3032 was sent.

I am traveling right now (work related) & I will pay the AOS bill when I get back next weekend. I logged onto the EPP to see if I can make the pay online/to see if the AOS bill in already available & it is. So first thing when I return next weekend is make that payment.

OP, Both the above posters are correct in your case.

More scrutiny is needed for an immigrant from "certain" countries.

Bring all the proof that you have to show the valid marriage relationship. Commingling the financial matters with the sponsor would have some upper edge for you.

If you or sponsor have any previous divorce, better take the "legal" documents of the "legal termination" of the prior marriage.

What do you mean Loto? The petitioner/US citizen, at least in my case is allowed to go in with me..I've read past interviews where they'll stick both of you in a booth, ask you both questions, and then separate questions. IT's not required, but I think it speaks VOLUMES if the petitioner and beneficiary are there. The Montreal consulate..where I"ll be going allows my wife, US citizen, to accompany me into the consulate.

IR-1 / CR-1 Spouse Visa Process & ProceduresMarriage Cert Translation. IV package!

Is this going to be a problem. the spelling is slightly screwed on the translation of the marriage certificate of my wife father's first name.

and on ds. 230 we going to write the name. Its only "one" letter. Jamal is spelled Jumal? is that a problem? or we should redo the marriage translation over?

another problem thats gona create, is that my wife then, going to show the new translation, which would be different from the one that was originally sent with the petition i-130. is the embassy gona make an issue of that?

What do you guys suggest?

If you can get a new translation, get it with the correct name.

I-130 submitted translation and this new translation convey the same facts, then it is good to go.

we are at the ds230 stage of our applcation. the original i-130 documents that was submitted to NVC and USCIS was with fathers name only.

do you guys think stick with the same document? or try to get the one with both parents name? is this a mandatory requirement?

Dept. of State guideline says both parents names must be listed. In your case, since both parents names are known, I think you should get a new BC with both her parents names.
