Does anyone know how far back Montreal interviews are running. Our I-130 was aproved June 19th. We still are waiting to here for a date on interview. Seems Montreal is very slow.

Hi guys and gals. I just received the package from my Peruvian wife containing the documents necessary for me to submit the i130 petition for alien relative. I read here:

that it is no longer necessary to submit the beneficiaries birth certificate or passport. Could someone please verify this for me? She sent me a copy of her DNI (national identity card) and a copy of the first page of her passport (Photo, biographic info etc). Somehow I have a feeling that I should need more than this.

I do have all other documentation necessary and am confident in them.

My other question is, and maybe this was answered here before but Im having a little trouble finding the info (If its all over the internet I apologize in advance) about our marriage certificate. I was thinking it would be something nice and fancy and official looking, but its not. Its just a plain piece of paper with all the necessary info, a stamp and a signature. The above link says I need to have this "certified". What does this mean? Does it mean I need to have it notarized and then legalized by the secretary of state of my state of residence, as I did with a few documents that were necessary to get married?

Beneficiary does not need to send birth certificate or passport with the I-130 petition but will need them for NVC.

Marriage certificate needs to be : " in the form of original documents issued by a competent authority, or certified copies bearing the appropriate seal or stamp of the issuing authority."
Ours wasn't anything fancy either :)

My aunt works for the US gov't and she has inner ties with some pretty high up congressmen officials. She had one of there secretaries do some personal inquires on what is the hold up on me and my wives petition. Here is the email response.

Following our conversation this morning I made an ?unofficial? inquiry on behalf of your nephew and learned there does not seem to be any type of problem with this petition; it is just a matter of time. I followed that inquiry up with an official one, which it is likely to take a few days before I receive a response. I will let you know if I learn anything definitive, but at this point I would expect this petition to be approved in the very near future.

Focusing on the bolded parts, from the information she gathered. March/April petitions are going to be start being approved at a rapid rate VERY shortly. Most likely will be a push this week and the week after the American Holdiay Labor day. I hope this lifts some spirits. Many of us have been waiting longer than 5 months. if you're currently married enter 1, then persons you're not sponsoring in this affidavit also enter 1, and enter 1 from line 10.
It adds up to 3, but shouldn't it be only 2 people? :hehe:

My wife entered the US from China in December 2009 and according to USCIS they sent out her permanent resident card in Feb 2010, but they had a typo on our address so she never received it. But when we filed for a new I-90 stating that we never received the card, they denied the application after 4 months. They said that since no card was ever returned to them as undelivered, they rejected the application. We think the post office either lost it or just delivered to the wrong address and someone just tossed it out.

What can we do now? Can we reapply using the I-90 and this time say it was lost? Would the USCIS consider the application knowing that previously we filed it as never received? Also can my wife get her I-551 stamp renewed in the mean time in order to use that as a temporary evidence of permanent residency? Please help!!

couldnt agree more - i painstakingly put my case # on every doc. you can get labels and stick them on the right hand top corner of each page. for originals, i put a cellophane colorless tape on the original 1st, then put the label on the tape; that way the label can be peeled off. you can use a label maker for this, or just get print labels, but yes, it is an absolute MUST for cases just like this! hope it is just the original that they need (ie you sent in copies instead of the original) and that they didnt lose the original! :thumbs: that would not be good...

I completely agree with you, Bob! NVC has good history of losing documents. Better write your NVC Case# on top right of every page including the application forms.

Paste a sticky note with NVC Case# on the originals OR write with a Pencil, since these originals are needed in future for some other purpose. It will be difficult to erase any ink writing.

Okay, if I am understanding everything correctly myself, fellow VJers please correct me if I am wrong...The only person(s) you need to list on the form are the Petitioner (you-because you are now the beneficiary's relative) and any children of the Beneficiary (your current wife) and/or children you may have had together.

Even though your child lives with your Ex in Russia, he/she would still be considered your current wife's stepchild, but that child would not be listed on the form since the natural mother is someone else (your Ex).

today is a great day.it's my wife's 27th birthday(usc petitioner).tried to sign in to department of state's payment site & i was elated to see my login failed.so i immediately called nvc & to my surprise our case is complete.what a coincidence huh?we submitted all our documents on august 4 2010.based on recent nvc timelines i thought we'd be looking at a 2 month wait for case completion.now we just wait for the interview letter.does anyone have any idea how long this will take?any chance of october interview?thanks to all vj users...you guys have been great!!!!

Hello folks,

We are waiting for our NOA2 on CR1 visa. In the meanwhile, we're looking into what to expect once the Petition is approved and sent to the NVC. We have found different versions of how the process goes after the application is at the NVC. According to VJ CR1/IR1 flowchart (http://www.visajourn...wchart_v1-2.pdf), the DS 230 package will be sent to the applicant (alien who will receive the immigrant visa). And to my understanding the applicant will fill out the forms and send them all out to the embassy/consulate including the civil documents (birth certificate, police reports, medical examination, marriage certificate etc).

However, on the NVC websites (http://travel.state..../info_3190.html), (http://travel.state..../info_3734.html), these two links suggest that all civil documents originals must be sent to the NVC since the NVC collect and schedule interview for certain embassies/consulates around the world.

My questions is for those of you who have gone through this process:

1. Did you have to send your spouse civil documents to the NVC or to the Embassy?

Let's gather all opinions here. Here is my feedback :star: and our interview was in India.

We sent to NVC and NVC forwarded to the Consulate

We sent ALL originals (except beneficiary's passport) and 1 set photocopy of all originals to NVC. There 'may be' chances for NVC to lose the documents.

Hi Fellow Travelers,

We are (hopefully) on the cusp of receiving our NOA-2, and are now preparing our DS-230, DS-3032 and I-864. My spouse is in Japan, with me in California.

I would like to know advantages/disadvantages for me to be her Agent (on the DS-3032 form). Some thoughts we had is my agency may speed up the process for our mailings and forms. It may ensure the accuracy of the forms, since her English is not fluent. We also wonder if she should send all her various documents for this stage to me to send in to NVC, in terms of speeding things up and understanding things. Also, does agency mean that I can sign for her as well. We can do a lot of this by email/scan/skype alternatively.

Kev, you (petitioner) becoming the choice of agent will speed up the communication between you guys and NVC.

You can NOT sign any of her document and luckily there is only one DS-230. She can email DS-3032 to NVC electing you as COA.

I-864 is entirely completed by you.

Get all beneficiary's original documents such as PCC, Birth Certificate etc. in advance.

Tammy, you are good to go then. But note that 2010 poverty line guide is not yet published. Every year, they will increase the threshold, watch it out. If you have some other assets such as bank balance, home etc., it would be helpful.

Hello all...I have read alot on the income requirements and at first I was thinking I would need a joint sponser...I am having a very hard time getting one so I am here to ask questions if I can just do it myself...

Ok this is my story...I was involved in a very bad car accident in July of 2001 that has permantly disabled me (but I don't let it slow me down) I won't go into details about my injuries but I am unable to work full-time so I get Social Security Disability but not SSI it is SSA classified as retirement benefits. I also recieve what I was told survivors benefits for my son (who is 11yrs old) which is in his name but I am the represenative payee and goes by his SS number but paid to me..for example it says (To Tammy ***** For My Sons name)...I also recieve child support from my sons father and I work part time(about 3hours a day) 9 months out of the year for a school...

I was told by the Social Security Office that I would not lose my benefits because I am married now..As long as I am disabled I will still recieve it...

But my questions is can I use what I get from SS from my son? and on the I-864 where do I put this info as income from SS and child support..Or do I have to attach an explanation...I have a very good paper trail that shows I have recieved this including child support...

Your son must be at least 18 years old to include his income as household member. You need to include your son also in the household.

You can show all other income in I-864, sum (part-time income, child support, just your SS disability income) it up for an year and enter in Part6, Item# 23.

I filed in April 2010 for my husband, received NOA1 and interested to know which date is currently being processing inorder to receive NOA2.

When i searched, i could only find 5 months processing time, for 1-130 petition for IR1/CR1 visa petition but not the exact date of current processing.

Can someone please let me know the link, if they are aware of.

So what is the process after my I-130 is approved. I just found out by phone that it was Approved. No hard copy of NOA2 yet and USCIS status site still says "Initial review". So few questions comes to mind :

1. How long after approval will I get my NOA 2 or the status iste will be updated
2. How long after NOA2 will I hear from NVC, are they going to send me separate mail?

I call NVC and got the case number. I send an email to NVC with my wife and I email and othere contact information. It been 5 days now and nothing.
What can do to speed up the process

Me, my wife and daughter arrived Dulles Airport on July 28th 2010. Since this time my 7 year old daughter received a welcome letter dated 8-13-2010 and she received her Green card yesterday. As for my immigrating wife she has received not even a welcome letter even though they both processed in together! Does anyone have a number I can call and talk to a real person to see why my wife has not received a welcome letter?

I got the birth certificate last month after completing necessary requirements of its registration in Gram Panchayat(village authority) as my Birth certificate was not registered at the time of birth. Is that okay too?

It is just wordings that "this record has been extracted from the birth registrar's records" - something like that.
