Thank you very much! So concerning the co-sponsor, it can be a family member, correct? Would they count our combined incomes, or use the family member who makes more as a guideline? I was thinking of using my brother, but he works part-time and goes to school at the moment. I could also use my parents, I suppose. Would they be counted towards the household size? For instance, even though my parents live somewhere else in town and I asked them to do an affidavit of support would they be counted towards the household size? I think I only made 14k working part-time for the past three years, but the jobs I've been interviewed for make well over the requirement. I'll definitely get a letter from my employer confirming my salary when I am ready to apply though.

We were originally going to do this through the fiancé route, but marrying before he leaves seems to be the better option (he can work faster, he can wait to adjust status).

Yes, since your income is less than povertylines, you can make co/joint sponsors with your parents. They will also be counted in your household, then it will make 4.

If you intend to marry and pursue visa, CR1 path is best for you.

my home country is Pakistan, and I mention in the DS230 that I stayed in 2 different cities but provided just one PC and got cleared from NVC. Now in interview call letter then mention that all PCs received.....

In the NVC checklist, they ask PC of every city where I live in my home country. I submitted jst one and cleared from NVC. now I am not sure whether they'll ask for the other PC or not!!!!!..In interview call letter, they didn't mention to bring that certificate. just mention one that bring all the missing documents......

In case they ask during the interview about PC and I unable to provide the PC that time then what would be the consequence???????????

I submitted only one police certificate of my country of birth, but NVC initially asked to submit PC for all locations where I lived. I stayed in 2 different locations. I got clearance from NVC and now got interview call n have interview this Friday, but my police certificate miss-placed coz of posting/courier company error. Still don't know when will I get the document.

NVC didn't mention to bring the 2nd police certificate at the time of interview but for safe side I made one. I have a photocopy of that certificate. so just wanna ask what to do? if they ask then what would be the best response??????

yes her passport does have maiden name but she was planing to get it changed cause it will expire soon i think. So is best if get another pasport and leave maiden name on it im not sure it this will cause problem with visa when she gets ready to come and also when I resubmit this do you think i should make a new cover letter in regards to fixed issues?


There is no documentary evidence that USCIS will accept it or not if you correct the primary name now, since they already issued a 'Notice of Action' with the maiden name.

However, I'll pull the opinion of any other person who had similar situation like you, but corrected and was successful until approval.

Yes.

Otherwise, at some point later, they will send RFE saying name in the form does not match with the marriage certificate name.

Put married name under 'other names used'. Keep her maiden name as the primary name. I hope her passport has maiden name as well. Don't change it.

no the only thing i got was I-797c notice of action for rejection the only thing listed was the address mistake they did not say anything about the name being wrong even though i submited marriage liscense and she using our married name I now notice more mistakes I want to fix all of them and just redo all the I-130 but I dont know if it will cause a problem being that they give receipt number for our case that has her with the maiden name. Will I need to fill another form to correct that mistake also?


If you have used 'maiden name' as the name of the beneficiary in the form and 'married name' as other names used, your marriage certificate and other names match.

They have advised to correct only address at this time. So only do that part, to be safer.

I-864 is Affidavit of Support package. Why do you need birth certificate with this package?

You need IRS tax transcripts, employment letter, paystubs etc. with this package.

So right now I am really REALLY upset! :angry: we sent originals papers for everything but seems the people in the NVC consider my birth and married certificates are "copies" ok... here is the thing, RENIEC the office in Peru that provides this documents dont give you "originals", they provide you a "certified copy" that is exactly like the original in some cases the birth certificate is a scaned printed of the original itself.... they dont give anything else no special paper NOTHING so this is! a certified copy with teh stamp and signature in the back....no more, but the NVC office wants an original that doesnt said in the back "this is a certicate copy identical to the original" what can I do now??.... we just sent an email explaining the laws and all that but can avoid feeling crappy cause ths only mean more delays... Based on your timeline, I think you submitted your originals to USCIS in response to your RFE.

If yes, please read below:
USCIS is supposed to return your originals back if the original documents submission is part of RFE request - as per I-130 instruction. Since you are dealing with bureaucratic department, they 'might' forget it as well. You can call USCIS to return your originals and submit the completed form G-884 to request it back.

Ok, I can send them notarized translation, but when we had consultation with lawyer (my husband wanted to use him for process), the lawyer said USCIS do not need notorized translation.
So, I think we've made right decision do not use lawyer.. :thumbs:

If you don't want to send originals to NVC, you can send them 'Certified True Copy' + one set photocopy of the documents. Then you can produce the originals at the interview.

Correct. Copies to USCIS. But if the document is not in English, USCIS needs the notarized translation of the original.

melbar, your best bet is make her as Choice of Agent in DS-3032. Then you can mail your 'original' or 'certified true copies' with one full set photocopies to her, so that she can forward them to NVC.

As soon as your case is transferred to NVC, let your wife call NVC live operator and provide both your emails ids so that you can email your DS-3032 making her as COA.

what??? I have never ever heard that. Why would it have to be NOT notarized? All my documents had to be notarized in order for the official translator to translate them. This is a translator that was provided by the Consulate website...what does having it notarized have to do with the acceptance of it?


Translation of the document has to be notarized.

But the certified copy is not. It is actually issued by the agency who issued the original document. They will put their seal, sign etc.

My wife and I were wed in the Ukraine in early March. We've been living together in various locations including a brief two month stay in Germany. We recently decided that we'd like to go back to the States.

Now, we prepared the entire I-130 packet and shipped it off to Moscow's USCIS by the recommendation of an immigration attorney. Mistake #1.

They're returning it now and we're looking at where we need to submit it.

Technically, I have not been living in the Ukraine continuously for the past six months. I also haven't been back to the States since my wedding.

We are desperately hoping to submit the I-130 to Kiev, I have a three (3) year visa to the Ukraine. Will this be enough to please the Consulate?
Does anyone have prior experience with this consulate? What can I expect?

If not, which USCIS center am I to send the packet to?

If you stay in Ukraine for 6 months from now and have domicile in the U.S, you can file DCF (Direct Consular Filing at the Consulate) over there.

Otherwise, return to the U.S and send your I-130 petition to Chicago Lock box, they will re-direct it to the appropriate Service Center here.

If the Gross Amount on the most recent Pay Stub does not YET exceed the 125% requirement, how will the Consulate react to this.

In other words, if a Employement Letter states your income is above the 125% requirement, but your most recent Pay Stub is still shy of the 125% requirement what action will the Consulate take in this situation ?


Then they will go back to the previous years tax returns. Past and Present earning potentials both are equally important.

Employment letter might show annual income based on the projection until the end of the year.

It's my understanding that once a co-sponsor agrees to sign, she is locked in for 10 years, or whatever the length of the GC is. I'm sure this kinds of circumstances happen all the time, anyone with experience?


MIL's contractual obligation will be over when:
1) You work and earn 40 credits (normally 10 years)
2) You become USC
3) You die
4) You abandon your GC

Your divorce will not end up MIL's contractual obligation.

Thanks, canadian_wife. I'm not planning on staying 180 days, probably just 4 months or so if I can until the I-130 has been approved. And then I'll return.
At the border, should I mention I have an I-130 pending or only if they ask?

I called up Customs and Border Protection and talked with a woman on the phone. After explaining my situation, she suggested I don't visit at all while it's pending since I don't have any strong ties to Canada. I don't wish to spend $600 on a plane ticket just to be denied entry again at the airport. But I don't want to be apart from my husband for so many months. I'm not sure what I should do.



You must always answer their questions honestly but keep it short and to the point. Having your NOA1 with you may help as it indicates you are following the legal process to move to the US. However, without any other ties it may not be enough to convince the border official you do intend to return to Canada. The bottom line is there are never any guarantees. Your entry is always at the discretion of the border official. With a $600 ticket on the line you might not want to risk it.

We also submitted filled out the I130 & G325a in her married name even though all her official documents were in her maiden name. During the time we were waiting for NOA2, we changed her names on the relevant documents.

We actually filled in both our G325As with the box stating "Status as Permanent Resident" checked off and had no issues at all! As I interpreted it both forms are being submitted with reference to the same petition so they should match. I should note we submitted out petition prior to discovering VJ. Most posts on VJ will recommend checking other and marking I-130 but we had no problems with the way we filled ours in.

Was going over the G325A form and noticed this little question at the bottom of the form: This form is being submitted for a.)naturalization, b.) status as permanent resident, or c.)other (specify). I know it's C, but just what should I put? IR1/CR1 visa? Immigration?

I was going to ask another dumb question, but can't remember what it was. Will edit with it if I think of it. :P Hah, I thought of it. Or if not specifically it, at least another question: For those of you who submitted pictures, did you write on the back of the photos of date and what it was, or type it up and tape it to the back, or what? Did you send them in protective sheets or loose?

Does anyone know how far back Montreal interviews are running. Our I-130 was aproved June 19th. We still are waiting to here for a date on interview. Seems Montreal is very slow.
