As many have said, it's far better to bring material and not need it than to not bring material and be asked for it. Furthermore, bringing the material may very well add to the interviewee's confidence and convey a better impression.

Thailand is a tough embassy. People who need not fight their way through there should perhaps be less dismissive of the idea of thorough preparation, which includes bringing documentation.

While many of us have not been asked to show any evidence it is totally consulate and perhaps even interviewing-officer dependent. I would not advise anyone to bring less evidence simply based on my experience at the Montreal consulate. I read numerous reviews prior to our interview indicating evidence was not asked for but I still brought two folders worth!

You do not need to use your husband's name unless you wish to. There is no requirement that a wife must take her husband's name for the filing of the CR1. It is your choice and either your maiden name or married name is acceptable. Keep in mind, however, that your visa will be issued in the name on your passport.

Unless you are a Canadian citizen or a canadian resident, you cannot 'live' in Canada. You may visit for up to 6 months at a time, giving entrance by Canadian CBP. However, constant crossing from Canada to US by a US citizen may raise flags

Well the i 864 is off and the assignment of me on the ds3032 is done. We are now working on the ds 230....very confusing to me.

Hello,

I plan to send in an I-130 petition for my wife from the UK to get her Green Card. She is planning to change her passport and other documents to reflect her new married name. Should I wait to submit the I-130 and G-325a until she changes her documentation? Should she wait to change her documentation until the application process is completed? Or does it not really matter? I just do not want her petition or visa application to be delayed because the names on her documents and on the petition/application are not consistent.

She can use married name in the applications and maiden name in "Other names used" and submit the application. You don't have to include her (beneficiary) passport copy now. Meanwhile you can renew her passport and other docs with the married name.

Lawyer will not make any slow down. But most of them are 'reactive' and paper based preference guys. In NVC, online methods are faster than paper methods.

The caseworker emailed me last july last week that they submitted already docs to NVC..my question is how long will it takes our docs to NVC? the caseworker told me that she will just give me update as soon as NVC contact them..but how about they will not be contacted by NVC? what can u suggest? thanks..

You mentioned you have NOA2 of your I-130, right? If yes, that's the approval. USCIS will forward your case to NVC in 1 to 2 weeks time. You may use the lawyer, if he/she is efficient. Or if you are confident with the NVC shortcut (LingChe) that you can do yourself, you can avoid the lawyer.

NOA2 of I-130 means it is approved and visa# is ready for your beneficiary (you were LPR petitioner).

Hi guys! I'm new to this thread, and I'm not familiar with the I-130. I filed my husband's petition last year, priority date Dec. 17, 2009. Yesterday I received the Approval Notice (yey!), NOA2???. I also checked the Visa Bulletin, and it says the cut-off date for September 2010 is Jan. 1, 2010, and that they are current. Can someone explain this to me?
If the petitioner is LPR, the visa number is not available immediately. Priority date of I-130 has to be current to become visa# available.

I'm also in the process of doing my Naturalization, hoping that after I become a citizen, I could upgrade the petition. But with the approval and cut-off dates, do you think upgrading the petition would still matter?
No need to upgrade I-130 petitioner since you already have I-130 NOA2.

What should I expect after the approval? I don't really know the steps of the I-130. What happens after this? How long do you think it will take before my husband could get here?
USCIS will transfer your case to NVC. Follow Lingche NVC shortcut to proceed in faster way. Typically 1 to 2 months to finish NVC and another 1 to 2 months for Consulate Interview.

lets hope so and hopefully no RFE. EVenthough i have typed up all the letters and started gathering proofs based on the 4 page RFE people are getting. I dont want to give that news to my wife


One of the reasons to get RFE to prove their relationship is based on the country where "the degree of fraud of the relation" is "relatively high". It is not because of the fact that one didn't submit lot of chats, phone history etc.

Last time, I submitted only marriage certificate as primary evidence and 2 affidavits from my parents as secondary evidence, that's all and had no RFE.

Having said this, lot of additional evidences' submission is always good.

I would say so. You will have to try for many USCIS reps, some may be rude and useless and some may be nice to talk to. Never say about NOA1 date. Always mention "Filing Date".

Yes Looks like that's how it is. On my NOA1, it says Received date: March 26th, 2010. Priority date: BLANK. Notice Date: April 2nd, 2010.
So the lady said wait till September 2nd and then call as you are still within the processing time.

Can someone else confirm this? If its false, I want to call them back.

Hey guys just a quick update. I just heard from USCIS agent that my I-130 got approved today. Looks like they are starting to process April applications. My date was April 2nd. I checked the Status on USCIS.GOV site but it still says "Intial Review". I am thinking it might take few days for them to update.

I received my NOA1 on April 8th and still heard nothing. Am hoping its going to be within the next week or two, its so frustrating with all this waiting around. Does anybody know roughly how long we may be waiting for the rest of the stages to be completed after its come through? I feel like its never going to happen at the moment :(

When submitting evidence that she was not legally bound when we married can I just send a copy of the death certificate from her late husband, or will I need to submit the divorce decree from the first marriage and the death certificate of the other?

I think I'll be under her sponsorship until May 2011 (3 years after I got my first green card). My question is: can I be a co-sponsor if I am a sponsored permanent resident myself?

You don't have to submit all these to VFS. Show the appointment letter, passport and any checklist received from NVC/Consulate.

It is a good idea to send all the set of I-130, I-864, DS-230 photocopies to the beneficiary, just in case.

Good Question... Now I am confused a bit. My wife and I were married in Colombia... Will I still need to have all here documents here in the US for NVC processing or will they send everything to the US Embassy in Colombia where we will gather and bring my wifes documents to the interview?


Marriage in any other country is immaterial. If you have filed I-130 with USCIS, you need to submit all originals to NVC and they will forward it to the Consulate of the beneficiary for the interview.

If one is DCF (eligibility is needed) filer, they will file I-130 with the Consulate and appear for interview. No NVC role here.

I'm a bit confused now. My wife is in the process of filling out her I-864 form. But whats next for us? I have paid both the AOS and IV bill. Once my wife has completed the sponsor form what do we do? We havent recieved our instruction packet yet but she has called the NVC for authrization. I am the beneficiary living abroad. From what I understood she only sends the I-864 to the NVC and I prepare my DS 230 and supporting documents for the interview at my local consulate?

Since you paid AOS fee (assuming online payment), check status is 'PAID' or not. If paid, print barcode sheet and send it with all required documents and I-864 to NVC.

Hi,

In my Appointment Letter, it says: "The applicant must bring the correct size and number of photographs to the visa interview. They must measure 2"x2" on a white background."

It does not say how many. I was planning on taking probably 5 passport size photos. Please advise if you know how many photos do they ask for at the consulate? Also are these Regular Front face passport style photos or is this the one (immigration style) where you have to get it from the sides with one of the ears showing?

Most consulates will ask 2, but some will ask 4. So, 5 is good.

Side face showing was an old format. USCIS changed it long time back. Now all photo must be frontal view.

for NVC you usually do not need translations since it's going back the country of origin.

we had translations for everything regardless to be safe.


This may be true, for the countries which has only one language and that's the official language.

NVC guideline says: ""Note: All documents not in English or in the official language of the country in which the interview takes place MUST be accompanied by a certified translation into English. Translations must be certified by a competent translator and sworn to before a Notary Public."

But, the country like India has 30+ languages. Official language is Hindi. So, it is safer to get translated documents into English for the country like India. Since I had all English originals, I cannot comment more on this. But, people who have or have not faced any issues on this, will give more information.

can you please tell some things about I-864 Affidavit of Support Form :


1. Who needs that form after it is filled out by me ? Me (petitioner) or my wife (currently in europe)?

No. She can take a copy of it just in case. So, you need to take 2 full set copies.
First full set copy + originals to NVC. Second full set copy to your beneficiary.

2. After reading guide i understand they send I 864 to my wife?? So she needs to send it back to me by mail ,right? or i can download it from net and then send it to her after filling it out?
I-864 is "completely" petitioner's form to complete and sign.

4. I worked in 2007,2008 and 2009 and made good money. In my bank account i have over 100.000$. But last 4 months im without job. Will that be enough? Or i will need co-sponsor?
You should be all set. Include all available paystubs in 2010 if you wish.
