I have a nice amount of materials for the secondary evidence of marriage part for the I-130. I plan on including a table of contents part at the beginning of the secondary evidence part. How would I write that on the actual cover letter? I wrote, "Secondary evidence of Bonafide Marriage with a Table of Contents for the Evidence."

Is this ok or should I omit the table of contents for the secondary evidence (it is at least 30 pages)?


You can put "Secondary evidence of the marital relationship" after the main list.

Anyway, you need another copy of all those since USCIS may not be returning all those.

Yes. Then you need to send these copies to your beneficiary while attending the interview. This is not mandatory, purely optional if NVC misplaces any docs.

Photocopies should be fine. But write NVC Case# on top of every page of entire AOS package except the barcode sheet and cover letter.

can you guys tell me if pay stubs (or copies of it) are required to be submitted? because if i have an employment certification letter from our HR dept. and the last 3 years of my tax transcript, would those not be enough to prove my annual income? because each post i read regarding AOS, everyone has consistenly said submit pay stub.

Law has been passed NOT to submit employment letter and paystubs, as per the Adjudicator's manaul.

The reason why people are providing it - It would be helpful for them to overcome the poverty line based on current situation where their last years transcripts as NOT so strong.

Yes, you can, if needed. If your brother i/law can do the level needed, I would not bother with another sponsor.

No matter if you didn't file a tax return, you still have to fill out the 864. You will provide a statement stating why you didn't do US taxes and reference the IRS instruction that allows that. Not working is a good reason.

You as petitioner are the primary sponsor regardless of income. You complete an I-864. If you have never been required to file a tax return then you will submit a statement to that effect. If you should have filed taxes and did not, then you will need to take care of any filings.

The husband's assets may be able to be used. They would be considered at a 5:1 ratio if they are located outside the US.

A brother in law does qualify as a household member and cannot use an I-864A. The BIL will complete an I-864 of his own and supply all the necessary documents.

I have my interview on Sept 29...yayyy!!!. My husband is the US citizen and I am Canadian. We both live in Canada right now. The company I work for is giving me the opportunity to continue to work for them after I move. We haven't worked out the details yet, whether I will continue on salary or be paid as a contractor. My question is, will this help me out at the interview? As it shows I will have continued income, and can I claim it as part of the proof of support forms? Or will it hurt me as it is a Canadian company? If it will help, I am sure I can get a letter from my boss explaining that I will continue to work for them. We are planning on using assets as my husband does not have a job in the states yet.

Yes, you can show your income if it continues even after the U.S immigration. You need the documentation of it.

One fifth of the assets of the beneficiary will be counted.
One third of the assets of the petitioner will be counted if the petitioner is USC.

Just a have a few quick questions about the G352A biographic form:

1. If the address of my wife is Gulshani-e-iqbal, karachi, Pakistan, so will the city be Gulshan-e-Iqbal or will it be Karachi? What about province/state?

2. Also I am going to have my wife sign it back in Pakistan and return it, so how may copies do you guys recommend that I get from her? How many copies of the passport style photos should I request?
One page of G-325A signed and One passport photo of your wife (beneficiary). However take 1 extra set signed and 1 extra photo, just in case.

3. If my wife has been a student the whole time, do you I write down it as "unemployed (student)" under the employment box? What would I state as the start date?
You can put "NONE" and no date.

Ok, for the Affidavit of Support--I know that you have to meet or exceed 125% of the poverty line, and I also believe that you have to send in tax transcripts for the last 3 years. Do you have to have met the minimum income (or assets) FOR the last three years? I met it for 2009, and I will for 2010...but I didn't for 2008. Will that be a problem?

I know couple staffs in the USCIS. They told me: "Buddy, you are testing us by sending your I-130 again for the same beneficiary. You know we had approved it 2 years back in 3.5 months time. Now your old file is under Mar/Apr 2010 filers and they piled up lot of sxxx. Without cleaning them up, we can't open your old file" :-)

BTW, Thanks Milena for your wishes! The wishes of a lady (except my wife) who is far away from her husband, sometimes becomes true :-)

Loto, it's an instruction letter that says I have four months from the approval date to schedule an interview for the K3 with them... It doesn't have a set date on it... :(


Milena, Then you don't have to worry on K3. When NVC completes your process, CR1 interview will be scheduled meanwhile. Nonetheless, you need to be in touch with them to close K3. Why don't you email to the Consulate about IV and AOS payments or other proof showing that CR1 is in process?

Then you are lucky. Apply her passport with her married name.

Without her passport copy, you can send the I-130 package. So, use her married name as primary. Her maiden name under "Other names used".

I had entered all those details in the I-130 that was filed in this July.

Hope this would take care the previous I-864 execution. Also, my wife had surrendered her previous GC in the foreign consulate. I hope it will have in the USCIS system as well.

Only CSC and VSC handle them. And Nebraska too does not process I-130. But if there are any transfer, they might handle.

Sorry OBX, IMO I think in this case Q39 would be the husband (Petitioner). Yes the form is about the Beneficiary (in this case his wife), but on the form, Q36 would list the wife's name & Q39 would be the Petitioner (husband). In the example forms, although it is an old form, it has the same format (Q26 & Q29). VJ Example Form DS-230

The DS-230 is all about the non-US spouse. So in this case the "Petitioner" would be your wife. That is how I filled in my DS-230 and had no problem.

I ended up sending the I-130 back in with the province in Canada added to Question 2 in Part C. I also added extra N/As just to be sure in Questions 14, 20, and 22. My application fee check just cleared, so either one of those was the the issue or the person who reviewed the file the first time was smoking crack. Either way, now we get to wait 5-6 months for the I-130 to be processed!!!!

I answered all my address questions the same way you did JF_CIC. I have not gotten any RFE's yet on it. (keep fingers crossed)
If you search the topic of question #21 it seems like basically any answer works from all the recommendations of people who have all ready been processed.
I disagree though in theory that visiting and staying in a hotel is the same as living with someone. That though is just my un-USCIS opinion.



I agree, I put NONE as the answer to where we last lived together and had no issue at all. Visiting or staying a week in a hotel on your honeymoon does not constitute living together IMO.

There seem to have been quite a few RFEs lately regarding section "C". Hopefully filers that have resolved the problem will post their outcomes which will help others facing this dilemma.

New G325-A is only one page form. You have to send only G-325A (what so ever of pages it will be as per new form).

Yes, previously it was 4 pages......but not anymore.....we all sent 1 page G-325A.
