Hi Everybody:

just to update you on my case. My case was transferred to SF Valley regional office and as soon as i got the letter from them i book an info pass online to go downtown and find out whats going on and when will be the interview. encouraged by Loto i shook off the unesiness and birocracy fobia and just went there by myself. as i arrived they made me wait few hours in room 101 and was watching cnn and play w my iphone. so they call me to the window around noon and tell me what alredy states the letter ive got. i tell them ill be leaving the country and i dont want to miss my interview and been waiting and so on..

so they make a phone call and lady says you want to upstairs now? i say sure why not. i want another 2 hours there and was alredy afternoon had to call work to take whole day off. then an officer comes out and i go in and gee raise the hard swear tell nothing but truth and i was in the middle of interview..

was not pleasant in any way. many questions dated like years ago go and forth some things i could even remember anymore clearly. why it was quite intense and exhausting they didn't really cross any lines and be insulting in anyway. the problem was apparently that i got married to quckly after the divorce was told at the end and my I-1330 got approved. ill never forget that day. was almost 4pm, didnt eat the whole day was sent home in the mid of the day to get more evidence etc..


anyway, case was sent to NVC god bless. i am traveling to phils on 10/08 hope i can finish NVC part by then. shouldnt be a problem we have the original docs and i have a job taxes are paid.

I told you right, it will be an additional questioning and not to worry. Glad you passed it!

Even I married 3 months after my previous final divorce date. And we didn't have any issues or any additional questioning last time.

after reading this topic slowly make sense. time between marriage and divorce was very short and we speak two completely different native languages so i guess that also raised suspicion. My family couldn't attend the wedding because tickets were very expensive and my sister had two toddlers at home at the time.

LOTO: all of my paperwork before the divorce was trashed including my other belongings. I was basically left with my wallet and bicycle, so i don't have much of my paperwork available except of the green card copy and N-400 application.

Maybe the best is just go to interview alone and explain the whole thing. My question that remains is: if my I-130 gets denied can i still appeal after that? I just can't imagine what will i do if somethings go wrong , since I cant change any of the facts and my new I-130 would be pretty much the same. I cant imagine life without my wife, so there must be a way out of this even if my I-130 gets denied for some reason.

Based on all your statements in this thread, I feel that this interview is just to clarify some basic stuff in I-130 petition. So, I feel you will not have any problem with it. They just can NOT deny your I-130. There is always way to fight with the USCIS if I-130 denial happens except the denial that conflict with the National security, beneficiary/petitioner's serious criminal convictions, Serious bad record with FBI etc.

Restraining order is not an issue. I am 100% sure on it.

Hi Loto,

for the first 3 questions answer is no. I was legally separated even divorced before legally remarried.

all these questions about divorce and date of new marriage I was already asked on citizenship interview they seemed to have no problem with it and my naturalization certificate says married.I am not so sure what is illegal marriage i guess you meant illegal as getting married before getting divorced or so. I am quite sure that did not happen as i had to submit the divorce summons as i applied for the marriage licence. NSO in Philippines were pretty nosy and they verified everything couple of times.

therefore I don't think there is any issues with legality. I am very meticulous when it comes to legal documents as i had to deal with a lot bureaucracy trough my life. I have no clue what they want from me that they don't know already.

Some more questions:
1) Did you include the copy of your divorce decree while sending the I-130 petition?
2) Is this the first time your current wife getting married? If no, did you include the copy of her divorce decree and was that divoce legal?
3) What all the documents you included in I-130 to prove the marital relationship with you and your wife?

As Penguin pointed out, petitioner will be interviewed if there is any criminal issue. But in your case you are sure that it was not the case. However, review with them. They will most probably have a copy of all your background checks done. Answer them truthfully and if you are sure there is no adverse issues in your case, this interview will be just fine.

I filed an I-130 on February 14th 2010 for my wife and patiently waited and kept checking every day. Today on Friday the 13th the case was finaly updated from initial review. now it says:

Testing and Interview

Your case has been transferred to a local office and an interview will be scheduled. You will be sent a notice advising you of the date and time of your interview. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

I am really confused now i believed that interview will be with my wife at the embassy. The did not requested any additional evidence, so i am not sure what they need from me. I never heard of petitioner having an interview. has anybody else experienced the same?

I don't have anything to hide but i am a bit nervous. I hope they wont grill me there with some details from years ago and deny us for something silly. Should be calm or should i get some legal help? I just cant afford this application to get denied because is been years since we live this separate lives. I became a citizen in January this year. Anybody knows any beneficiary that had an interview.


I don't think you need to worry about. This is very rare to interview the petitioner, probably this might include your biometrics (finger print) as well. I think it is just to ensure the validity of your petition. Take your entire file of all immigration papers that you have since coming to the U.S.

That sounds really nice...but he still have 11 months to go before he leave afghanistan....What can we do?


If you get I-130 expedited say in 2 months, there are other processes to complete - NVC another 2 months, Consulate interview another 2 months. Visa will be normally valid upto 6 months. So, you may request to give a max. validity of 6 months for the visa at the time of interview based on miliary duty of your husband.

Me and my husband is just really confused.He is in the US military and currently deployed in Afghanistan.We're already talking about applying my visa while he's there so that when he gets out of deployment,hopefully I can be in the States with him.He is going to file for the I-130,but then we dont know what address he's going to put there.After his 2 weeks vacation here before he got deployed he was stationed in Ft. Polk Louisiana,when he left for deployment he gave up his apartment and put his stuff in a storage facility.Now,we want to know what address we should put there since he's deployed.Please help...Any suggestions or advice will help us....

If he has any other address where he can show it as domicile, you can use it. Otherwise write ''Please see attached" and write an explanation in a separate sheet about your situation.

I-129F is not needed, it is for K-3 visa. Now K3 and IR1/CR1 take same time.

Don't forget to expedite your I-130 based on 'Active Military'. You may be approved in 2 months time.

1) Sleep at least 8 hours
2) Exercise daily at least 1 hour
3) Listen to good music

3. The Process
If you want to change your address online and/or file a Form AR-11 using our Online Change of Address Notification tool, you will need to have certain information available. Please have the following information available before you begin:

• Your receipt notice or other notice we sent you showing your receipt number (if you have a pending case with USCIS);
• Your new address;
• Your old address;
• If you have filed a petition for a family member, the names and biographical information for that person

Q1: Even if my famliy has interview this month (I130 approved & NVC process done), is the case still considered "Pending" with USCIS & therefor I should use the Receipt# which has some status for example it has status at this point as "Post Decision Activity" ?

Since you (Petitioner) have executed I-864 AOS, you need to file I-865 for change of address

Q2: The Online Change of Address require you to select a form with Receipt#, will that be form I-130 in my case, correct?

Now onwards you (petitioner) need not to file AR-11, only I-865. Beneficiary, after reaching the U.S will file AR-11 for any change of address.

Can you please provide more details, how it can be done. I did registered my email address for notification emails and will change the address before visiting my husband outside of USA. How to confirm that change in address was effective for IR1/CR1 visa to relative's place? Can i change the address while waiting on NOA2? or do i have to change after receiving NOA2? If I am visiting my husband i might not be working, is it ok?

You can change the address at any time during your move. Call USCIS customer service representative to do it.
For the year 2010, is your gross income so far above the poverty line for your household? If yes, there is no issue not to work the remaining of 2010.

We did this exact thing. My husband had all correspondence sent to his parents because he was in the process of moving. You can change the address online and it will only take a minute.
Ideally, the only thing you will recieve in the mail is the NOA2 and as soon as you get to the NVC stage, you should give them your email addresses so they will send everything via email anyway.

Hello everyone,,,I am not sure if this is the right thread for this question or not, so please advise if not. Basically my sister came to US on immigration visa and has a valid green card. Unfortunately due to an emergency she has to live for India in 3 days and may have to stay there more than 12 months. I understand that she has to file for I-131 to get a re-entry permit. However, one of the things it mentions is that you have to get her fingerprinting done. Now since she will be leaving in 3 days, it is probably not enough. is there any way around this? any other tips/suggestions please help us out...thanks for your help in advance....

Finally it is sorted out, thanks to GOD. They accepted $404 payement for IV. You should pay the latest generated IV payment, and as one VJ memember suggested to me, if you have already paid the $400 you pay the difference, or required to pay the difference when your documents arrive here. Meanwhile I have already sent my documents for IV long ago...filled and signed on June 18, after the first IV payment generated...Do I have to change this form, but the form is still recent one??

If it has been 2 weeks after online payment and still shows 'NOT PAID', it is an issue.

I do not think that the USA ask for travel insurance for people coming /transiting to /from the USA. But there are some country that did ask for it a few years back - I am not sure if that is still the case. Someone can correct me on that.

Personally, whenever I travel, I always get travel insurance especially if there are stopovers. I always travel on the same airline or alliances. I have had too many friends & co-workers who have gone who have had "mishaps" with delays, canceled flights, miss flights, lost luggage, etc, & didn't had any travel insurance to cover them & were getting the "run around" from that particular airline.

I pay the extra for travel insurance because I want to have that extra "piece of mind" when I travel - not fighting with airlines when something happens.


Good one thekfc! I buy tickets using my bank's credit card and I think I am automatically protected by upto $500K in travel insurance.

we are in egypt
and she spend already the 6 months
if we talk with the counsaler about the position he will care or he will not care about it


File DCF in Egypt, much faster than filing in the U.S. You are qualified based on her (petitioner) stay of 6 months in Egypt.

Did your wife file DCF in U.S Consulate, Egypt and went to the U.S after it?

If yes, in couple of months, your I-130 in the Consulate will be approved and can get the interview.

Hi All!

NVC just completed our case and we're waiting for an interview date. I am 24 weeks pregnant due on November 26. I'm worried about the medical exam because I haven't had the Tdap vaccine, I think I've had the MMR and I'm exempt from the Varicella one. We have quite a few concerns:

1) How do we speed up the interview? We would prefer to be interviewed by mid-October at most because it's difficult to fly (to Montreal)while pregnant.

2) The panel physician's website here in Vancouver says that the Tdap vaccine is required as it is not contraindicated for pregnancy. But my husband, who's a US doctor is completely against me having it while pregnant. Does this mean that I cannot have my medical completed? And then no interview and no visa before baby is born?

3)We were planning to have the baby born in Vancouver (as it might be too late for me to get medical coverage in the US). Supposing we get the visa before the baby is born, do I need to do any paperwork regarding the baby before making my US entry?

I don't know about your first 2 questions. Let me answer the 3rd one.

Since you have palnned to give birth in Canada, your child will be Canadian citizen by birth. If your husband is U.S citizen and have been 'physically' in the U.S for the last 5 years excluding the short trips, he can transmit his USC to the child in Canadian U.S consulate by completing 'Consular Report of Birth' and getting baby's U.S Passport. Normally, this process is faster like 1 month or so, but check with Canadian consulate about their timeframe. Once the baby has the U.S passport, you both can enter the U.S.

Nope.

Example:- If you want certified copy of your birth certificate, go to the birth registrar's office where your birth certificate is issued and get a certified copy. It will have their sign and seal and further notarization is not needed.

Similarly, all other certified copies from the respective agencies.

Art, you can contact USCIS as well, but standard message will be "You have filed your I-130 on this date. Our processing time is 5 months for such a petition. So, call us back after that time frame" (F)

Best way to track is join to your month's filers club here in VJ and see the progress.

Hi all,

Regarding the Police Clearance Certificate (PCC) which our spouse need to secure from her/his homeland. Is PCC pertained to the country where he/she lived for more than 6 months or is it the different cities, towns etc in the country where he/she lived. For eg, my wife lived in New Delhi, Hyderabad, and Bangalore for more than 6 months....but she has never lived in any other country (than India) for more than 6 months. Does that mean, she needs to get only 1 PCC of her records of the current residence (Bangalore) or does she have to get PCC one from Delhi and one from Hyd as well? That makes 3 PCCs no doubt a herculean task :(

I know things have been very weird in 2010, but I'm just curious how I wound up way out west. Not a crisis, but anybody else had this happen. BTW, they received this in August, but I guess I'm really in the September group. Is that the way it works?

You do not need to use your husband's name unless you wish to. There is no requirement that a wife must take her husband's name for the filing of the CR1. It is your choice and either your maiden name or married name is acceptable. Keep in mind, however, that your visa will be issued in the name on your passport.

I have a nice amount of materials for the secondary evidence of marriage part for the I-130. I plan on including a table of contents part at the beginning of the secondary evidence part. How would I write that on the actual cover letter? I wrote, "Secondary evidence of Bonafide Marriage with a Table of Contents for the Evidence."

Is this ok or should I omit the table of contents for the secondary evidence (it is at least 30 pages)?


You can put "Secondary evidence of the marital relationship" after the main list.

Anyway, you need another copy of all those since USCIS may not be returning all those.
