I got the welcome letter, where it said they would call in a 30 days or something. We never ehard from them, maybe they called but we were not home. My wife got her ssn and greencard. Should i call, or do it really matter since she already has a green card and ssn?



If she already has her green card I wouldn't worry about the welcome letter.

Probably, CO may not ask the updated I-864. But it is a good idea to prepare a new I-864 with the updated info by the U.S petitioner and provide to the beneficiary, just in case.

My husband (the US citizen) attended the interview with me and they did ask him if he was still employed with the same employer. I assume that if he wasn't they would have wanted to know if his financial situation had changed. Better to be prepared. Good luck!

As you can see from the link loto provided beneficiary's birth certificate is not required at this stage (but you will need it later for NVC) and the petitioner needs to provide proof of citizenship with either a birth certificate OR a copy of all pages of the US Citizen's passport.

On the back of our photos I (lightly) wrote our names and date of birth.

hey everyone,
u all must be wondering where did i go???
well,i was shocked :( we went to the montreal and the interview went really well. the officer was very nice but in the end she asked me if i ever overstay in US so i told her yes. she said that I need a waiver to get my visa. basically, my visa is approved now but i have to send a waiver to get the approval for my visa. she said when u get the approval for the waiver, just send us your passport and we will give u the visa. i dont have to go to montreal. the border officer wrote down in the system that i need a waiver to get the visa :( the worst thing is he didnt mention to us which he should by law. now i have to wait again :( hopefully i will get my waiver approval soon.

What do you think if you will send post to embassy that you want to reschdule your interview again and tell them the reason what the problem you get, I think they will contact you back soon, like my case i sent the post back to consulate here after they hold my case couples day they called me back, that 's really weird sometime technology will not work well as the post I don't understand sometime why they just do weird things like when we email them but they never email us back but when we sent post then next couples day they contacted back....

my husband filled the form about my case for senator and I also found an immigration lawyer. she told me that she will try to contact montreal embassy and will get a date ASAP. hope it works..will let you guys know about it.



I really hope it works out for you but I have never read of any cases where a lawyer has had any pull with Montreal at all. Let us know what happens. There are many filers waiting for Montreal that will be very interested in your lawyer's result!

Thanks for your replies. My stepdaughter is 7 years old now. Her father is not paying child support in the Dominican Republic. As far as US citizenship; he is not a US citizen, he is a green card holder. As such, the child does not automatically get admittance into the US. My wife does have full custody. I am planing to consult a lawyer, however I am hopeful that maybe someone experienced with this type of situation can shine enough light to perhaps keep me from having to hire a lawyer which can sometimes be very costly.

They were never married. They just lived together in Dominican Republic until the child was 1 year old. He then moved to the US and told my wife over the phone that they were braking up. The only legally binding decoument is the child's birth certificate were they are both declared as parents of the child.

It looks like your wife needs the legal permission from her ex for the child to immigrate to the U.S. Yes, you need to talk to a family and/or immigration attorney about the same.

When we got divorced, I had given the sole legal and physical custody of the child to my ex, based on her demand. So, she is now taking the child anywhere without my further permission. But I have visitation rights on him and I pay the child support as well.

Hello All -
I recently petitioned my wife and her daughter. I already received my NOA1. My wife and daughter are currently in the Dominican Republic. The father of my stepdaughter has resided in United States for the last 6 years. Before my marriage to my wife he would contact his daughter every 6 months or so. He has also never petitioned his daughter nor has been very involved in her life. As I understand; I will need his signature at some point in order the bring his daughter into the US. However; when he learned that I petitioned his (daughter who he has not seen in over a year). He immediately told my wife that was not going to allow any man to bring his daughter into the US and that he was not going to sign anything when the time comes. Neither my wife nor I would attempt to live in the US without the child and we are very worry that this will be in the way of our happiness. I actually care deeply about the child and find it very hard to believe that a father will behave in such a way, considering that if he does consent, his daughter will actually be closer to him and he will be able to see her a lot more often. Based on the above; can someone answer the following questions?
1- Is if a fact that his signature is required?
2- If it is required, at what point during the process is it required?
3- Considering that he resides in the US and the same city that his daughter will live in (meaning I am bringing his daughter closer to him, not taking her from him); is there a way that I can legally revoke the need of his signature? I say this because it is obvious to everyone involved that he is not concerned about the welfare of the child nor to be close to the child.

We don't have any control here. Chicago lockbox routes the petition depending upon the work load in the service centers.

reallyyy, wow, I did not know that. Also we have our engagement dvd and wedding dvd, so none of that will work. I mean I have all thepictures but when we went to different places we also had videos, and we saved those. So then I should just get those pictures printed and for the videos there is nothing I can do right? also you probably know this Loto,so I am gonna ask, I used one of my parents for the I-864 ,and she completed the I-864 A, and when my husband takes the copy to the interview, does my mom have to sign it again and then I can scan and email to muu husband, thanks Loto a lot for your help, I really do appreciate it.

Since your mom completed I-864A, I would assume she lives with you in the same address.

Consulate normally will have executed AOS (at the NVC stage) during the interview time. But you can have 1 more set with her original signature, just in case.

Hello again. So my question is really simple and it goes to those that already had an interview or that really know for sure. My husband has the interview in Nov 23, and I know that when he goes there the security will check him and the electronic devices are not allowed in the building. So if we are using some videos to show as proof of relationship instead of just pictures, then how does he get to show them when they dont allow him to carry the camera.Thank you.


Consulate will not watch video movies :star: Pictures, album etc - hard copy is enough for the visual depiction.

Not even picture CDs are allowed and they won't watch it.

Ok, I don't make that much money and I couldn't just pull the $355 out of thin air...So i tired for the Fee Waiver Request. I got my I-130 back today 10/12/10 Rejected because i don't qualify for the fee waiver request...i'm cool with that(a little pissed but) whatever...but now i want to resubmit(When I get the money together) Can i use the same documents they send back to me? Do i have to send the rejection notice with this time? Have any of you gone through this process and can give input? thank so much ~*Daria*~

The notice says that the case will be moved to NVC for further processing.

I called NVC today morning but of course it is not there yet.


Just wonderingshould I still contact my Congressman or Senator? Would their inquiries cause any delay for USCIS to send the approved I-130 to NVC?

You are absolutely fine with LPR & Citizenship status in the last 5 years. I had only 2.5 years citizenship status before our child was born. Before that I was also in LPR status. They just check the last 5 years 'physical presence' in the U.S, excluding the absence.

So what happened is that wife's I-130 got approved and moved to NVC when I was LPR. While waiting for NVC processing, we had a kid and since I was still LPR, the kid could use derivative status and no I-130 needed.

However this July I became USC, thus I had to file a separate I-130 for the kid.

Now wife's interview has been scheduled for October, but kid's I-130 still pending at USCIS - I have requested for expedited service, but received a letter saying I will be notified within 45 days...

Should we call the embassy to reschedule wife's interview and wait till kid's I-130 approved, or just go ahead do the interview twice: one for wife, and one for kid... :(

Will you be able to travel to your country now? If yes, go to the U.S consulate there and make the child as U.S citizen, by "Consulate Report of Birth Abroad" and apply child's U.S passport. Entire process should be done in a month time.

First of all I would like to thank you in advance for any help/guidance.

I am a US citizen, and I am going to get married soon outside India. The girl i am getting married is not US citizen. After getting married I will be filling for I 130.

Now, since she dont leave in US. I dont have any financial joint account or joint property. So other evidence we can subbmit is "Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship." and marriage certificate.

What other supporting documents can we subbmit?
Do I have to subbmit this documents along with I 130?
Can someone please explain the underlined sentance above in detail? as far as, how to obtain them?, what format they should be in? who can do them for us? etc.....
What other supporting documents are concidered proof of ongoing relationship?

I will really appreciate your help.

In India, I didn't have any restrictions and I didn't get any NOC (No Objection Certificate) from the local U.S Consulate.

There is no such expedite based on pregnancy. But you may try to expedite if you feel nobody is there to take care you.

Based on your timeline, your I-130 approval should be through in couple of weeks time, plus NVC another 1.5 to 2 months time, plus Interview another 1.5 to 2 months (based on the Consulate too) time.

I am really confused from your note :star: that you "just discovered" it and apart each other since last Nov! May be my math is wrong here :devil:
