Vehicle and property are not required.. Or is you dont have any you might want to invest for this petition..naah you dont. Such items are optional if teh income meets the requirement.

the three year prior tax transcript thingy really depends on the embassy,i suggest you read up in your regional section ( the subforum for england ) and talk to some members to see if they were required 3 years prior or if its common for your embassy to ask for it

Should he bring a arrest record from the US as well as the police certificate from Jamaica to his interview?

know what.. odds are.. the same interviewer might be the one who conducts the interview since he/she is familiar with the case - maybe. The the consulate may have 1 or 2 people doing interviews.

My fiance had his interview yesterday which took about 30 minutes.

Letter was given to him, 221g and handwritten "not convinced of genuine relationship, need more proof".
Yet, she did not accept his cards to me, all the hundreds pages of emails / chats / detailed phone records,that are proof of the continuous relationship, she refused them when he took them out to give to her, all 10 pounds of it. She said she had enough.
She never even looked at the continuous relationship evidence,only the previous emails/chats/phone records submitted to USCIS. If she has enough then why ask for proof to "convince her of a genuine relationship ? " She said she believes we chat, talk and email everyday but she needs more proof.
Over a hundred photos including the engagement party and photos of the ring on my hand.
Boarding passes, hotel reservations and billing receipts, market receipts. He asked her what else can we show you and she said anything.


She subtracted our age difference on a piece of paper which is 29years and said again, convince me. I assume she may have a problem with it.


age is a huge factor - yes. talking 10 pounds if info is useless.. no time to spend all day reviewing one case. provide financial mingling .. like property.. insurances and the listed beneficiary.. affidavits (sworn).

My dad is our co sponsor for our k-1...he is very concerned about his social security number being on everything and having it going through the mail system and customs...so can I black out his social except for the last for digits on everything to give him some peace of mind or does it have to be on there... :help:


tell him he's worried about the wrong thing... i'm certain that the information he's worried about can be obtained.. it's on the forms that went t from USCIS to the NVC and to Jamaica.. You can black it out except the last for but know it's ever been reported an issue just a concern.

I think they need an original signature. The forms themself don't matter.

I resigned the copies and didn't have a problem.

lol you know nothing about American Taxes.. so why are you stressing.. trust your husband's solution to what is needed. The pay stub that were used to file the return will also be needed. etc.

On average the package is ready about 7 days after the interview. You could have requested the package be picked up. To make changes you will need to contact DHL as no one here has every asked to change the delivery type (as i've seen) so maybe that would be your feedback for us.

Security Checks... helps to give a more positive ID of the person and I love it.. it's to controll these people and sort out any criminals who might be in the system already.. - yes.!

They'll ask about the qualifying relationship and questions to determine if she is admissible to the U.S. pursuant to INA 212.

I don't know if it will be a problem or not, but my fiance WAS asked at his interview in London (last week) if I had met his family. Its really up to the consular officer as to whether or not its a 'problem'.

Just have your fiance tell the truth (that you were planning on it this summer but the passport fiasco struck) - that's all you can really do. Though I've not heard of anyone (in London, anyway) being denied for such a reason.

At least two of the questions you asked are on the example form (22 and 32) where it seems your situation is exactly the same as the example. So I'm not sure why that wasn't clear to you when you read the examples.

The other ones are pretty much common sense. Of course circumstances can change - so answer the question as truthfully as possible at this moment in time.

Whether you're trying to bring someone to the US or not, you as a US citizen need to file taxes. Period. For now, a co-sponsor will do.


And not just that, but some consulates require an I 134 from the USC fiance even if they have a cosponsor.

We don't know the country of the OP's fiance/e (unless I'm missing it somehow) to say whether or not their consulate will want that.

That's what I was going to say - why not have them all redone? My fiance had both the tetnus shot and MMR for no charge at his GP. They wrote out his record on the spot, which he then took to the visa medical.

Despite the fact that they're not REQUIRED prior to coming to the states, many consulates basically prefer that you do (and suggest as much). London is sort of the same way. It was easier for my fiance to get his from his GP for free instead of waiting until he got here (or having them rip him off for them at the visa medical).

So if you can get them before hand with little trouble (or at a small cost), I would.

The common line here at VJ is that there is no reason to consult with an attorney if one has a straight-forward, un-complicated case.

You knew that your case had a possible issue, yet you chose to make an assumption rather than have a consultation with an attorney to find out? The outcome might well have been the same, but you would have been ready for it and prepared in advance to take the next step of applying for a waiver rather than reeling in shock.

I would still consider getting the help of a competant immigration attorney, particularly if they are wrong about the 10 year (vs. 3 year) ban.

the problem with that was that we did consult a lawyer-- hired one, filled out all of his paperwork and when we consulted him on our case 3 months later he had not even submitted our paperwork! He did not give us a reason to doubt our case even though we gave him all the information :unsure:
In hindsight perhaps we should have gotten another lawyer..


Truthfully, there isn't anything a lawyer can do unless and until you received the denial - except possibly begin preparing the paperwork for the inevitable waiver. Granted, if he did not mention to you that he forsaw any issues, then he probably wasn't very competant (at least not in the area of immigration).

No offense, if you break the laws then you have to live with the consequences. You're lucky that you have the possibility to use a waiver, but generally speaking this is what everybody deserves for staying illegally.


Yes but in all honesty it is a little crappy when I overstayed to be with my future husband!! We have our secure relationship and now we cannot set up a future together in the US!! We will be married for god sake.. to be honest I think that it is BS.. The only thing that I did was fall in love! I have no convictions or character flaws and there are no hard and fast rules when it comes to love!

ALL of us here want to be with our future spouses as much as possible, and we are fortunate to be able to use the VWP to do that. My fiance and I knew we eventually wanted to live here, so we were very careful to learn the rules and what NOT to do so that we wouldn't jeopardize our future plans.

All I 'did' was fall in love, too, but I still knew that we'd ultimately have to live by someone else's rules (namely the US government) if we wanted our future as we'd envisioned it. The government's rules aren't about love - meaning there ARE rules that must be followed in order to settle here together as husband and wife.

I DO feel bad for you, but with all due respect, I'm not sure what this has to do with the rules, and whether or not they have taken 'love' into account. It has more to do with the fact that you did not follow them (knowingly or not).

The only thing you can do now is try and fix what has been done - and if it cannot be fixed, make a life somewhere else for the next several years.

If your overstay was less than a year, then it should not be a 10 year bar.

10 years it the penalty for overstay of 1 year or more. 180 days to a year is 3 year bar, if you overstayed by 90 days this should not warrent such a bar.

You may have to file I-601 to get a waiver.



yes but i started counting my overstay AFTER the 90 days that I was there i.e. I entered the states on 7 nov 2002 and exited 3 feb 2004.
Because Irish people r intitled to a 90 day holiday visa I assumed that my overstay started after that?? i.e. 91 days in US would be 1 day of over staying?

So you were in the US for a total of 453 days, then (if I've worked it out properly).... which is an overstay of 363 days. So surely that should be a 3-year ban, not a 10-year one.... I think?! Did you manage to prove to the CO the exact dates you were in the US - I remember you saying before that you didn't have any evidence of when you entered & left the country. Sounds like they think you had over a year of overstay...?


I thought if it was under a year, it was a 3 year bar; 10 year bar for a year or more. But, seeing as the OP is 2 days shy of a year, they may not be giving her the benefit of the doubt.

In this case, it may be beneficial to have the help of an immigration attorney when preparing the waiver.
