Hi everyone,
I've just sent my application I-751 and shortly i received the receipt and the 1 year extension...honestly I've been strugling to find a job and I've been offered a seasonal job in London well paid from April to November.

I was planning on leaving after my biometrics apointment and then come back in November with some savings...

Can I do that,is there any form that I need to fill or leaving permit of some sort??

Removing Conditions on Residency General DiscussionFirst trip abroad after Green Card

My step daughter received her green card in Nov 2010 and then returned to University the same week after she received it. She is now coming home (back to the USA) for 3 weeks in February before returning to complete the school year.
I have a few questions.
What form should she be filling out on the plane?
What line should she use at POE? She is arriving alone without a US citizen with her. I think she should use the US citizen line but I'm not 100% certain.
What questions do you think they will ask her at POE?
Any other tips or things I should be aware of are welcome.

1. She should fill out the BLUE/LIGHT BLUE CUSTOMS DECLARATION FORM (CBP 6059B)
2. She can use the US RESIDENT or US CITIZEN LINE (which ever is short-er)
3. They will ask her maybe: where do you work (if working, ) school you attend? were did you travel to? or similar

** i dont see anything else to worry about She's only been gone for 2 months** My parents got to the USA on 12/19/2010 and they left on 1/2/2011 and the Greencards got in the mail today... and they will not be back in the USA until about June 2011 just prior to the 6 months... for them they may be asked why they are away do long

Should not have any effects on removing his conditions. Now might have some weight to if he should apply for citizenship. Basically he didn't get the lash for the drunk/walking then was found drunk/sleeping... In the parked car. Its not BS from a country thats not kind to latinos.... Its called public intoxication... He should study the law to avoid ongoing issues with the law... Sorry to hear of the unfortunate...

Hey Everyone,

If I send in my ROC application in and it requires an RFE(divorce decree), which will be sent first by USCIS the NOA or 1 year extension, or the RFE? Or will will I only get the NOA once I turn in the RFE required documents? Please help guys I am soo confused.



I was say IF the case was accepted then NOA1.. if not then you will get a rejection letter. IF accepted you will NOA1 then RFE

my I- 751 application is still pending, 1 year extension letter also expired, yesterday I got i 551 stamp on my passport. there is difference between A# on my extension letter and i 551 stamp . i got 8 digits of A# on my passport stamp, 0 is missing. any ideas?


They'll often times write the A# not including the "0".. A-Number is 7 - 9 numbers which depends on when your card was issued.. yours should be 9 numbers to be consistent with the current uscis issuance. IF the A-Number on your "original card" has fewer then 9 numbers then to put a zero before the first number to equal 9#s.

We had been for FP-bio prints on jan 14 but the online case status doesn't display the case updates or 'touch'

Anyone in same boat

Did my finger print at a ASC on 2/14/2011 and the case was not updated on line or touched. The next update was an "interview " letter that i am now waiting for. Nothing to worry about.

it seems like vsc is very slow . i was checking uscis timeline and it said they are working on applications filed 6 months before. i just wanted to know if it is more than 6 months since you have filed , can we file for any service request ? thanks .

Posted Image yes the conditional residence is awarded to those who were married less than two years on the date of the adjustment of status. This is mentioned on the I-130's instruction guide. It is also advised for those persons/spouses who were approved at the consulate and have less then 6 months prior to their 2 year anniversary to WAIT until that time has passed. The Immigration Officer at the Border may not have noticed and SO the applicant / alien can kindly tell the officer so they can submit the request as IR1

The same exact thing happened to us. 2 different dates (April 27th and then again May 11th) stating that a new card had been ordered and a third date (May 18th) stating that it had been approved. I finally called and got an immigration officer on the phone yesterday at USCIS and was told that the actual card was mailed on the date when we got the approval notice which was May 18th. We will see if it comes in the mail in the next couple of days...

That's bizarre! I will say though that the receipt number on my NOA1 and my biometrics notice were different - makes no sense to me. I bet you the second NOA receipt number will work if you sign up with it online. Apparently most folks' NOA1 receipt numbers won't work online but the bio one will. It's as if they've issued your bio receipt number early or something. ???

Actually you don't have to wait anymore for the divorce to be final before you file. You can file when you're separated - they will later issue an RFE for the divorce documentation.

But I guess you better be sure first that you are indeed going to divorce. Otherwise, you'll have to file as married and show documentation that you still are married (and entered into the marriage in good faith).

Yes - the point of the change (if I'm understanding it correctly) is so that people can still file to remove their conditions in the appropriate time frame rather than being late to file while they wait on the divorce process. Even at that, the RFE for the divorce decree is to have a time frame of 87 days on it so that the applicant will have sufficient time to have the document in hand (combined with the time they've already waited to get the RFE).

You could get an RFE - depends what the adjudicator is looking for.

Get tax transcripts from the IRS - easier than finding your forms, W2s, etc. and is USCIS' preferred method.

They're not necessary, but I think it 'greases the wheels' (so to speak) just a bit. It's what they prefer (and suggest, I believe). If you send in the form from your tax prep person, you must also include all the supporting documentation - all W2s, 1099s, etc. Honestly I just think the transcripts are easier.

Shouldn't matter as long as you are both on the return. But you'll need to know which spouse was listed first on the return (and that spouse's social security number). I believe that's how they pull it up.

You're right - it isn't fraud in the eyes of the USCIS, per se. It is what it is - a delayed filing which does leave you open to deportation, whether you like it or not.

As was mentioned, you may well get a kind case adjudicator, in which case, all this worrying and ruminating is for naught.

If you don't get a kind adjudicator, though, you need to be prepared for what might happen. That could include ICE showing up on your doorstep, or being called to a hearing. Either one of those scenarios could be helped by seeking counsel from a qualified immigration attorney.

I'm really not sure what else needs to be kicked around in this thread until you know which course of action is going to befall you.

Bank statements - I sent all pages. Utilities - I only sent the relevant pages (showing what is owed and the name/addressee). I sent bank statements from the time my husband got on my bank accounts (prior to him having a green card), a few in the middle of our marriage and a few recent ones. Utilities - I think I sent more recent ones of those (both in my name and in his).

I'm not sure why you can't find bigger Acco fasteners. I just bought mine at Office Max. Just try another office supply store or Google it - you should be able to order some online.

You don't HAVE to use the Acco fasteners by the way. In fact, if you've already hole punched all the papers in the side, I'm not sure I'd bother. Yes, USCIS will assemble it from a top hole punch but I'd let them do it. There's really no sense in stressing over how it is organized. I've yet to see a case denied or RFE'd because of how it was put together.

From the USCIS letter sent with the approval of the original green card, "Your new card will expire two years from when you become a permanent resident. By law your resident status is conditional, and you must apply to remove those conditions before your card expires. We receommend you apply several months before your card expires." No mention of any interaction from them.

From the '"Welcome to the United States" pamphlet, "You need to know what forms to fill out and how to meet important deadlines, and what activities you should avoid if you want to become a US citizen later."

We got a letter prior to the 90 day mark, too - whoop dee doo. Many other people don't receive such a letter. Bottom line is it's your status and your responsibility - it's not the USCIS' responsibility to be your babysitter.


"Becky" is Rebeccajo - see post #32, where she clearly quotes that they are supposed to remind you, but they get away scotch-free if they "forget." You should probably read the whole thread before jumping down someone's throat for correcting you.
