Oh yes - thanks for correcting my error! I failed to realize the OP had submitted a waiver (despite the title saying so, LOL!!!). So yes, it would be approx. 5 years after the 'permanent resident since' date on the green card. That link I gave above is helpful - it has a worksheet to help make sure when you will be eligible.

You can apply for citizenship 3 years from the 'permanent resident since....' date on your conditional green card. If you just got approved for removing conditions, it shouldn't be another two years until you can apply.

Would your landlord not just write an affidavit/letter stating when you moved in and that you've been living there the whole time - but there is no formal lease arrangement? Explain to him why you need it - as proof of a legitimate marriage to assist in your 10 year green card. If he's going to 'impose new conditions' for that, then he's a jerk. LOL.

Paying utility bills out of the same account doesn't show them that you live at the same address. I'd send a copy of the gas bill (which is in your name) from the time you established it in your name, one from maybe a year ago, and one that is recent. Do the same for another utility which is in your wife's name.

Hi friends. who has the burden of proof, us or Immigration? Say if after I sent them additional evidences and they are still not convinced, will that mean I will get deported in spite of the fact that we are a happily married couple, living a normal day to day life? I hope there are some out there in this forum who have experienced that scenario. Thanks everybody!


The burden of proof is ALWAYS on the applicant.

USCIS would issue a notice of intent to deny (NOID) but they would not deport you. The NOID simply starts that ball rolling.

Can I send them photos of our wedding, and other pictures from the start of marriage. The dates are embossed on the photos. I can send them some of the pictures we showed the IO during our interview for the CR green card. Also I plan to send this year's tax return. I have sent them our auto mortgage in the initial package and I will now send the auto title but the car was only acquired Dec/09.

I sent them my pay slip that shows our place of residence. Maybe I can also send them my driver's license showing the same address, also my wife's. thanks for your comments.


You can send the photos, but really, photos are just secondary evidence. They really prove nothing in the way of sharing a life and/or a home together. The tax return for the year and auto information are fine too - but if they're specifically looking for info towards the beginning of the marriage, it may not help much in that sense. The driver's licenses do show both your addresses and are a good thing to send too.

Is there a reason you cannot send (or are reluctant to send) the other things folks here have suggested - lease, mortgage information, maybe even some utility bills (we submitted some in both names)?

I understand your frustration - and a lot of things were going on at the time in your personal life where this took a back burner. But it is still his responsibility to maintain his permanent residency - regardless of what they do (or don't do) with illegal immigrants. There are few things GC holders must to do maintain their legal status in this country, and removing conditions is one of them (for those who are initially issued 2 year GCs). I didn't think that was too much to ask to keep my husband here.

Taking advice from 'the guy' at USCIS is always a potential disaster. The tier 1 operators just read from scripts and know little to nothing about actual immigration issues/processes and procedures. Unless you went to a tier 2 operator or an Infopass appointment.

Either way - I would at least have a consultation with an immigration attorney before I did anything.

ETA when you mentioned a letter in the first post, I thought you were referring to the letter some folks receive reminding them to remove conditions.

No it doesn't say he is in removal proceedings, just that he never filed and his status has been revoked. He does hold some responsibility too, but he has been so busy trying to keep the money coming in to pay the medical bills, and helping me, that I'm sure he never even realized.
Just found all my bils, my discharge papers from the mental health center, my paperwork for my disability hearing that is coming in January, letters from our insurance company and such. Going to make copies and send all that as well.


Didn't realize the letter you received said his status has been revoked! (You should have said so in your first post!) You have GOT to get yourselves legal representation now - this falls outside the realm of what most VJers can help you with. Catholic Charities can provide immigration legal assistance at little to no cost - google it. They may well tell you to file now anyway but there are likely a whole host of landmines awaiting you - as now you're fighting his revoked status with possible removal in the off.

He is not divorced from her yet. He was afraid to file for divorce since you can't be in proceedings when you file the I-751. Papers have been drawn up and lawyer is mailing them to her on Tuesday. I think she will sign. Takes 31 days from the date of her signature to receive final decree. We would marry then. The abuse waiver didn't seem like it would be difficult, because it is the truth and he provided proof. Apparently he was not abused enough.

You can, in fact, file the I 751 when the divorce is pending. USCIS will then issue an RFE for the final divorce documents, and give the person 87 days in which to respond. In 99% of cases, this would be enough time for you to have the final papers in hand. I would have gone that route before I went down the abuse route (particularly if you had enough evidence that the two of them had an otherwise legitimate marriage), but what's done is done.

I think you also muddied the waters by injecting yourself into the case and going to the interview (which it sounds like you did). You had nothing to do with their divorce, but you certainly put the question in the officer's mind by being there. The only way I would have shown my face is if I had married him - and even at that, I would have still consulted with an attorney before doing so. But again - what's done is done.

I'm curious how this attorney thinks a new I 751 is the right course of action. Is there a new basis on which to file the new I 751 (meaning new evidence to further prove the abuse claim)?

In the mean time if u haven't already .......go make an info pass and get a temp. I -551 that will allow work and travel. Thing is you're required to submit back/front view of card that is current which will be taken back eventually by uscis.

Thanks another question. How do one make the tabs stay on the actaul docs? I apply tabs on a stack of evidence at the bottom but it keeps dropping off. Do you put paper clip over the tabs as well? I didnt use binders.



Naah No need for tabs (probably mini sticky notes). You can write the #s etc on the bottom of the documents on the same sheet. For example I sent my Mom's Marriage Certificate as requested on a seperate petition and the photo copy has no room at the bottom SO i wrote the case # on the Side of the paper where there's always a white part when a photo copy if made or paper gets printed.

thanks guys for your concern but we have decided to get a replacement card. My husband is a perfectionist and wants to take no chance. Since he works in the computer industry and they deal a lot with H1 Visas.. he has to use his green card to show his residency.
As for my sister in law... i think taking her to immigration is an extreme step. she already feels so guilty.
Hopefully the process will go faster.



I would efile... Its more convenient and yes some what quicker. I believe payment has to be made with a check right a
Before form its submitted. The advantage of efile are ....

-You'll get a receipt number right away.
-You and make an info pass with the print out at the first open date and get the passport stamp necessary for travel.

A definate yes to your question about paying the full fee.... If u are filing the I-9 nm to replace it or the docs to remove conditions.

Dont be Stresssed okay.. Let let the other family member/s pay for it.. heck that's what I'd do.. :bonk:

Ok.. you are not required to mail the card back.. No. Yes you will be required to pay the Full Fee. NOO you do not need to send ANY ofthe Adjustment of Status PAPERWORK... As for biometric I'm certain that you will be required to pay it again.. One person abve said that the biometris are Good for 15 months.. now that maybe true but this is a "totally" different case... So exapmple if you had fied for a replacement green card and it takes them 14 months to appove the case then NO a nother fingerprint is not required..

USCIS mailed me a freen card back in 2006 and I thought i was never received however someone in my house got the mail and did not tell me.. and yes i was required to refile and to pay the fees again.. GOOOOD things is .. it goes much quicker..

How does one replace a damaged green card?

what is the process? and how long does it take?
my husband's green card got badly damaged. it is bent and in bad condition.
we barely received the letter and the green card came out damaged.
we received the card at our mailing address and the individual who was holding it for us did not take good care of it.
So the card was delivered in perfect shape but got damaged due to neglect on a family member's part.
please help......



Sorry to know of this... but to replace the damaged card he should file the I-90 cost is $370.00 and takes 3-5 months to be received. He can file the form online by clicking below

He will be required to set up a username and password.

You need to file an I-90 form (get it at the USCIS website) and check the box that says card has been damaged. I don't remember whether or not there is a fee for the replacement but you should file all of the info you need on the form as well as the address and any supporting information you need to send in with your application. Yes there will be a fee of $370.00 because the card was received in good condition and the OP said the family member did not take good care of the mail once received from the Postal Serv.

My greencard expires on Feb 1 2011. My 90-day window will be opening shortly. My husband & I plan on going to my home country in early January for 3 weeks. I urge you to send the package off to USCIS on Monday, November 1, 2010. Biometricts are usually done about 1 to 1 1/2 months after the the case #s are assigned. The process is currenty taking 6 months to be completed.. so Bios could be later... What i can say is though that you can call to change the Biometrics (date) if you get a RFE... you would have least 30 days to respond.

If I thought it was going to be this big of a battle, we probably wouldn't have come here. I would have just become a Mexican citizen and only came to the U.S. to visit. Unfortunately, since coming back to the U.S., I've got myself a big fat piece of debt. If I ever pay it off, I'm going back to Mexico for sure.



Sometimes we get wrapped up that we end up in debt... starting to think it's part of the american lifestyle. I recommend that you do as Vanessa says .. it's important that you pay the necessary fees to remove the conditions... EVEN if the GC was in your hand.. the ROC fees must be paid.


You can always file for bankruptcy if you think you're that behind.... seek a financial advisor if necessary.
