While you're "still" married is a very gooood chance most definitely than being divorced since that is the "true" reason the conditional residence was granted.

Honestly, I am quite confused as to why your wife is divorcing you IF she is giving you 6 months to get it together? That makes no sense to me. A separation, sure, but divorce is pretty final in my opinion.

Are you SURE she isn't yanking your chain?

With that being said, STOP driving, and I agree you should voluntarily enter some kind of rehab or alcohol cessation program.



the divorce is finalised on november 9th

Hello everyone,

My husband and I may be in the strange situation of moving back to his home country of Italy after the removal of conditions next fall. There is also the remote possibility that we will have a long distance marriage for a while, with him living in Italy and me living here. This would be because of a convergence of family/work/financial needs.

So...what happens then? I'm assuming that you can't be a permanent resident of the U.S. without residing in the U.S. What becomes of his status should this come to pass?

I was wondering if it is a required fo file my taxes jointly with my husband or can we file as married filling separately? Can that effect my application if we file married filling separately? That's not the only evidence of a bona fide marriage and is definitely possible to do it without that.

If you are a u.s. Citizen you are not required to notify uscis/immigration of your new address... This will come when you submit any applications to them.


Anyone who is a permanent resident MUST notify uscis within 10 days of the move which is part of the responsibility of the alien. This can be done online or sending in the completed form. The form is called AR-RR (Alien change of address). You will nit be notified that the case/address was updated but know that they'll do it

Removing Conditions on Residency General DiscussionROC / Waiver / Not Divorced
I'm preparing to file the I-751 (Petition to Remove Conditions on Residence). My husband and I separated the end of March 2010, and are currently in the process of the court dates to obtain our Divorce. The first court date is this Friday where they will set our matter for trial (unfortunately, I'm not sure how long that will be).

My 2-year GC expires Feb 23/2012. I know that I MUST file before this date and am hoping that I will have the divorce certificate by then, but I might not.

I believe that under the "Basis for Petition" I am able to check (d) "I entered into the marriage in good faith, but the marriage was terminated through divorce or annulment." - and include an explanation that I am waiting for the divorce certificate. I understand that they will issue an RFE for the divorce certificate.

The evidence that I plan to submit is as follows:

- joint bank accounts from Suntrust (every 4 months up until termination)
- Copy of lease at apartment with both names on the lease
- Insurance for car showing each other as joint drivers/insured on each others' vehicle
- AAA Cards – joint membership
- Copies of drivers license showing same address
- Tax Return transcripts 2009 & 2010
- Copy of airline tickets from trip to Las Vegas
- Letters from 2-3 friends outlining their experience with us as a couple

Should I include in my cover letter information about the pending divorce? My husband had claimed bankruptcy so we have no joint debt or credit cards and none of the utilities could be put in his name because of his terrible credit. I think I should include that also on my cover letter?

Since I am filing "alone", is the I-751 the only document that I need to submit? I keep reading about the WAIVER but can't seem to locate any document in addition to the 751 which I would fill out.

Any advice or suggestions are welcome.

If you haven't heard anything yet, I would give them a call. Mostly just to "nudge" your case for a touch. I was surprised to see that we had gotten a RFE but then oh well. Someone had mentioned the 3 pillars that they are looking for and I am thinking because I didn't outline it in the listing of the cover letter is why we got it. Even though I don't have my hubby on my mortgage, I thought I presented enough evidence with showing all of our forms state the same address for the both of us. I mean, driver's license, bank accounts, auto insurance, life and health ins etc....
This time I wrote out a letter specifying why he wasn't on the mortgage, and again added more bills with both of our names and addresses on there. Hopefully this will fullfill what they are wanting. If not, then I don't know what else to submit. :unsure:


And_Sam, what are the 3 pillars that you mentioned? I've got my US cell on hold at the moment. .. do you think if I put my Canadian cell # down in the interim that they would use that for texting? I'm just holding everything in abeyance right now. It's not overly stressful, but definitely something that is on my mind.

Unfortunately it is not the norm to see the RFE on the website. It could easily come in the mail without any kind of notifications. Also, as you filed on your own, are you aware that there is a chance for you to be called for an interview?


I'm aware that I could be called in, and if that's the case and I'm away then I'll either have to request that it be rescheduled or withdraw my application. Unfortunately, that's the reality of my situation at the moment. I'm afraid that the RFE may have been lost in the mail and I'm just not sure what to do or when exactly I should trigger any kind of an inquiry.

Hey everyone ... just curious if the RFE shows up on the USCIS site? I'm away (actually out of the USA) for the next 3 months and am temporarily having my mail forwarded. I'm keeping an eye on it on the web site in case the person I'm having it forwarded to somehow misses it and I can nudge them to scan it to me. My case is based on divorce and so I think that I'll likely be one of the last ones to get any kind of notification. However, before I left there was a HUGE mix up from the post office and some of my mail got lost- literally. Any suggestions would be greatly appreciated.

The EAC number doesn't work... to be honest I'm a little concerned about this. I had tried to add my case in March and thought possibly that it was just late being logged into the system. Now, 6 months later this is raising a red flag for me.

Should I contact them or just wait it out? I suppose that I could wait and once the VSC filers start getting theirs back address it if I still don't have any communication.

I did want to remove my conditions so that i would have a 10 year visa so i could live back in USA, but my chances of that are so slim its unreal (marriage broke down, no tax returns, no evidence, it was a legit marriage but we separated so soon after getting the visa).


Just to be nitpicky, but there's no such thing as a 10 year visa. 10 year green card, yes.

Well, you're supposed to have your status updated with them for withholding purposes and such anyway (would have to look that up again to understand it more clearly) - which is why you go again when you are a citizen.

But it's also a convenience thing - wouldn't you rather not have to explain that to an employer when you present your SSN card to them? If they see that, they may think you're not authorized to work without further documentation (i.e. an EAD card), which as we all know is not necessary for GC holders.

Getting your new card has nothing to do with when your current card expires. It takes as long as it takes, and as Otto und Karin explained, you have an extension letter now should you need it.

Did they ask you for original TAX returns forms. I don't know if such a thing even exist because what I have from my previous Tax returns is a paper which was provided to me by my accountant and it looks like a copy of what he did on-line. Is this a requirement to sent original Tax return?if yes how can you get such a thing? How does it look like? I read I-751 instruction and what they asked was copies!?


There is no such thing really. The best you can send them is a tax transcript, which you can get for free from the IRS.

If you send a copy of what your accountant submitted, you'd also need to submit any supporting documents as well (W2s, 1099s, etc).

I agree with Otto und Karin's assessment of what you sent and what they want. Read the guide here again and try to include as many of those documents as you can. Having utility bills in both your names (or one in yours and one in hubby's) showing the same address proves that you both live there. I think if you come at the RFE from the 'proving we live in the same house' mindframe, you'll be fine.

Even resending some of what you already have sent along with new evidence may not hurt - we can't be sure but what they may have lost things too.

ETA I would blank out your A # and case number on that PDF. I'm probably paranoid, but I wouldn't want the wide world to have that information, particularly A #.

As far as USCIS is concerned, at this juncture - Maribel is your legal name. That's what's on your 2 year green card. . It also seems that Maribel is your legal name in other aspects (SS card and other forms of ID). As such, qaia would fall under the 'other names used' category when filling out forms for USCIS.

Are you saying you want to change it so that qaia will be what is on your 10 year green card? If so, you would have to show them a legal reason for that change - which I believe you would have to go to court to do. You can't just change your legal name because you want to - that change has to be documented.

Have no idea what you mean by avoiding fees. Avoiding whose fees - USCIS?
