You'll get an extension letter once they've initially processed your application, so just take that with you when you travel in January. As far as the evidence goes, if it is not enough, they'll issue an RFE and ask you for more.

BTW my husband is not on the loan docs for our house - which I bought before I met him. I was told we'd have to basically refinance to do that -- crazy!! But I had a quit claim deed drawn up to include him and sent that in (along w/ the property tax bills showing both our names).

FYI I don't think you need your marriage certificate or passport copies. Don't suppose they can hurt, though.

That'd be my understanding - either Homeland Security or USCIS. Personally I'd do Homeland Security, as the forms themselves still say that. I assume USCIS would be ok or they wouldn't have said so, but I'm one of those 'error on the side of caution' people. smile.gif

The real answer I am seeking for is if staying in marriage gets more credit or is more guaranteed to get approved than divorcee given both marriages were entered into in good faith.

Or perhaps I should rephrase my question as follow: Given the USCIS adjudicator DOES BELIEVE the divorcee entered the marriage in good faith and no fault and it is the other spouse who wants to divorce, the application still might be denied while applicant staying in the marriage will definitely get approved. Is it correct? Which means, for a divorced applicant, there is more risk? Requirements for divorced applicant are not necessary and sufficent condition to be get approved, in another words, even if you satisfy the requirements, they can still deny you without explanation? Very frustrated since I was advised by many ppl that it is very difficult for a divorced applicant to be approved.


'Gets more credit'? Well, they are both valid reason for removing conditions (either jointly or with the caveat that the marriage has ended but was entered into in good faith).

In either case, the adjudicator must believe that the marriage - whether it is still ongoing or has ended - is a valid one. I suppose there is more risk for a divorced applicant in the sense that they may need more documentation of a valid marriage than someone still married. But divorced applicants are approved all the time - I don't see where it's THAT much riskier than applying jointly if all is as it seems.

It sounds to me like you have a good basis to establish that the marriage was entered into in good faith. However, no one here can predict how a USCIS adjudicator will see your case, or what factors they take into account when deciding whether to approve or deny. The only thing you can do is provide what proof you have and be ready to either provide more if asked, or answer questions truthfully at the interview (if you have one).

There is nothing that precludes your wife from getting her 10 year green card so long as both of you entered the marriage in good faith - even if you are divorced when she applies. Perhaps if she reads some of what is provided here and on USCIS' site, she'll feel better about it. Staying in an unhappy marriage just to appease USCIS is absurd.

Does he have proof? if he has proof he should call ICE (info listed at the bottom of each page). If he doesn't have proof there's nothing he can do. She can remove conditions without him (get the 10 year card) as long as she is divorced from him and can prove that their marriage was legit. Stuff like joint accounts etc. If she can't do it that way she will try and accuse him of abuse and get the card based on abuse.

... and then they still have your birth dates, current/previous address/es, full names, SOCIAL SECURITY AND ALIEN NUMBERS, and other solid information that may be used to create their own bank accounts online, apply for lines of credit... or just SELL IT...! hiding an acct. number ain't nothing. post man could just loose your card intentionally - put one through stress, more spending, SELL IT ... just what ever. listen you just got to trust in the the employees's integrity.

extremerecluse - you or your husband can apply for and receive unemployment benefits if eligible. it will NOT affect the removal of conditions when it is time... a co-sponsor can easily fix this issue.

LIFESJOURNEY - you're right about too much info. I'm still a little confused with regards to the permanent resident though. What about the affadavit of support and not claiming benefits etc... and being a public charge? I was under the impression that I was not allowed to claim ANY public assistance.


I told you previously that IT (unemployment) is not a means tested benefit.. it's more like insurance. .. it has no effect on the Affidavit of Support.

L...? Permanent Resident? Do you mean me? I thought that was a big no, no? Especially as I haven't started work within the United States yet either? We want to make sure we're doing everything correctly and following the law. I don't want to claim things that I am not permitted to because of my status.

LPR = Legal Permanent Resident
Employment can ONLY be given to those individuals who has worked and paid into the insurance/benefit. If the LPR has never worked won't get any benefit. But yes.. they qualify for that too.

Hi there everyone,

This is my first time in the removing conditions forum (me being the the permanent resident). I was granted permanent resident status in september so I have a while to go before removing conditions yet.

However, in January, my husband (the USC) got fired unexpectedly from his job. We have been on the job search together since then and although several promising leads have come up, they have all fallen through. We are both feeling very depressed about the whole situation but we somehow managed to come up with the money for our rent and bills last month. This month we are really struggling and don't think we will be able to make it this time.

I just wanted to ask if anyone knows if my husband is allowed to claim unemployment benefit? I know that as the permanent resident, I would not be able to, but would he? It's all very confusing because I thought they granted me permanent resident status based on his job and his income that would support me? We don't want to hinder my application for removing conditions in 18 months time but we are really worried and don't know which way to turn now.

Advice is very much appreciated! Thank you.



Yes the US Citizen can file for Unemployment benefits - it's a type of insurance available to those who worked so take advantage of it. Unemployment is not means tested government benefits.

you can file the AR11 online. you can notify USCIS of the US Citizen's mew address online via the same link/portal but he form I865 should still be sent in.

Vett.. how your fren dem full a issues so..? Dis is like the 3rd time this year you popping out with a question. All she needs to do is to file the paper work. Honestly I dont see her having a problem she needs to file the I-751 with the supporting evidence Birth Cert. or any child/ren born to the marriage, sworn affidavits by 2 or more people who knew her prior to or after her conditional status was granted.

Hello Munchy as long as your are.. or were married they will need to have a copy of the marriage or divorce certificate (original or certified). IF you have a conditional green card then adjustment of status was already approved... so to life the conditions if filing jointly then yes.. if having the requirement waived then yes.

My husband's conditional greencard expires in four days. We already filed the I-751 and received the NOA stating it is extended for a year but my question is this: He is currently looking for work and I am worried that an employer might not be comfortable hiring somebody with an expired green card...anybody have experience with this?

The letter is kind of vague...I thought it would say something like "this letter allows work and travel until...blah blah blah"

And what about traveling? I can just see the immigration people in Jamaica not letting him on the plane because his greencard is expired!


personal experience with travelling to Jamaica with not an expired but a lost Green. The process is simple unless he is taking the plan from one of those back of the bush places. The letter allow for the extension of the status and with the letter he can make an appointment at the nearest office and get a stamp in his passport which will service as temp. evidence which would allow international travel. Work would be the same process.

The kicker to this situation is that I have suspected my husband of infidelity and the past 3 times that I've gone back home on the weekend, the same girl is there with him! I am contemplating divorcing him and filing my I-751 individually. The only thing is that I don't know if I can get the divorce finalized by November.
