Removing Conditions on Residency General DiscussionAugust 2009 I-751 filers
FWIW just got a text from USCIS saying my status had been updated - now it's showing online that they've ordered production of his card. Still weird that I got snail mail first!

Edited to add : email just came too showing card production ordered.

Honestly I was shocked. But I can say don't obsess over online status - we hadn't had a touch since the day after biometrics. It still shows 'initial review' status too.

Thank you both! It's actually official now that Mir is approved for her ROC. We got the approval notice in the mail today from the local office. What I found odd is that my daughter's AOS had been held up for the decision on my wife's ROC.

I believe that is the norm, as the child is essentially a 'derivative' green card holder.

I asked the officer how long it will take(removing of conditions) and will they do background check again. That's what he answered-depends of service center only, without name check.

I take that to mean he'd have to get something back from the service center after he interviewed you, and that a name check would not be done at that point. By the time you have an interview, the background checks have normally been done already.

I've NEVER heard, in all my years around immigration, of a background check not being done during each process (visa petition phase, AOS, removing conditions, citizenship).
TracyTNFemaleUnited Kingdom2009-10-16 08:02:00
Removing Conditions on Residency General DiscussionAugust 2009 I-751 filers
That's sort of why I questioned it. I've never heard anyone say that background checks are not done at this phase; quite the opposite, in fact. In fact, some folks whose removal of conditions has taken over a year have to have their fingerprints redone for another check.

Interesting. Then why bother w/ the fingerprints? I figured they would do them because your criminal record could have changed in the last 2 years.

Hmmm...well I must say it's worrying me a bit. I thought it was like AOS where most everyone had an interview.

That's not the case so much anymore, either. There are a lot of AOS' approved without interview as well (hubby's included back in 2007).

An interview just is not a sign that there is something wrong. At least not to me. It's simply an indication that while a large amt of applications are being approved these days without interview, there are still those that are being interviewed.

I wish we had more stats as to how they determine who is interviewed and who is not, but unfortunately we don't. I've often wondered if those not interviewed at AOS are then interviewed when removing conditions, but I can't find any scenarios to back this up.
TracyTNFemaleUnited Kingdom2009-10-14 14:05:00
Removing Conditions on Residency General DiscussionAugust 2009 I-751 filers
Interviews used to be the norm so it's not a huge deal if someone is interviewed.

ETA the local offices schedule the interviews so the appointment letter SHOULD come from the local office. The service center has no dog in that hunt - all they do is transfer the file there.

As far as I know, there are only 2 centers to submit I-751, either Vermont or California, and California deals with cases not only from California, but from many other states.

Peace everyone!

Yes - both service centers serve more than just the state they're physically located in - a common practice with USCIS for a while now, as it's not as if they have a service center in all 50 states! (Reading the instructions on the I 751 shows you the broad area that both centers cover.)

There isn't anything you can do. The time it takes to get bio appts can vary, mainly due to how fast/slow your local ASC is.

If I understand you correctly, yes, we went to the Philadelphia ASC, so maybe they are making the decision, not the Vermont CSC. Being "touched" the Monday after the Friday biometrics makes me think maybe Vermont has handed it off to the ASC.

Then again, who knows? Good luck and Godspeed to all,

What I'm saying are ASCs do not adjudicate petitions - local offices can, though. I wasn't sure if the Philadelphia local office and ASC are one and the same. If they are, then it's possible that it will ultimately be adjudicated there. If the office you went to is solely an ASC, then it will not be adjudicated there. Which then makes it even more interesting that the officer commented on a photo you had included in your I 751 package.

Had bio appt today - I was all geeked out and wanted to go 'back there' w/ hubby to see everything but no go. sad.gif Oh well - it was still interesting. We got there about 15 mins early and they let us right in. Were only about 4 other people in there and 2 technicians doing fingerprints.

I did find it interesting that there was a desk there solely for I 90s (there was a big I 90 sign above that desk). Go figure!

Eddie y Gabriela - that does make me wonder how much of the application the ASC's see. Weird! I wouldn't have thought they'd have access to much more than your
I 751 maybe, but certainly not the photos you sent as 'proof'. Bizarre!! Guess that proves ya never really know...!

ETA the service center will adjudicate if they approve you w/ out interview; if you are interviewed, your local office will be making the decision. I presume your ASC and local office are two different places, or are they the same - meaning do you live really close to the local office, so they just send you there for fingerprints - or were you actually at a separate ASC?

If they can remember Robin 3 years from now when he naturalizes then more power to them. The whole problem came about because they gave Luz and Robin different bio dates. A three hour drive each way and missed work for each appointment was the rub. I am glad they allowed it but it was amusing that they tried to make it look like they were doing us a big favor. There were only 2 other people in there at the time, it wasn't like they were swamped.

I didn't mean that they'd remember him - I was commenting on you saying that you wouldn't be in this situation again because you were removing conditions. You may be in that sitch again if you renew the 10 year GC/apply for natz for the both of them at the same time (and they again get diff bio dates).

Luz did her Biometrics today. As some of you may know, Robin got a Bio date of Sept 15. They did allow him to do his today and save us another 6 hour round trip. I found it amusing that they made it a point to tell him that this is the only time they would do this. The next time he would have to come on his appointment day. I didn't bother to tell the fool that this would be the last time he would need to do a biometrics since this is for removing conditions or point out that they would have to have the memory of an elephant to remember him. Oh well, all's well that ends well.

If you're planning to naturalize them - or just renew the 10 year GC - another round of bio.
