Removing Conditions on Residency General DiscussionI-751 early October 2013 filers transferred from VT to CA. Any approvals or RFE yet?

Just curious and a bit antsy even though it's only been three months since it was transferred to California.

Anyone with a transfer case got RFEs or an approval?

Thank you. Good luck.

Removing Conditions on Residency General DiscussionI-751 October 2013 Filers

While I am not part of the above roster of I 751 October filers I wanted to share the fact I am one of them (filed on Oct 9 at VSC and got case transferred on Nov 22). Last night- March 5th- I received an e-mail saying conditions were removed and today I got in the mail the letter with Congratulations saying card is in production.

The only problem with this last letter was the fact my given names did not appear anywhere in full like on the past NOAs, only my first name initial and last name in the mailing tab. I called and spoke with an officer to make sure my name will appear in full on the GC. He checked the records but pretty much said wait and see. Good luck to everyone. Looks like CSC is moving at a great pace with the Vermont files.

Removing Conditions on Residency General DiscussionQuestion about I-751 part 4.

There is someone on another forum who got denied her citizenship application because she did not list the kids from a previous marriage/relationship.  http://www.worldlawdirect.com/forum/naturalization-citizenship/18537-n-400-denied-need-advice-2.html

Now the question about children is different on N400 as it clearly asks to mention if the child is: biological child, stepchild, or legally adopted.

The I-751 just says lists "all your children" but encourages you to add an extra paper if necessary...so you can do that if in doubt.

If there's one important lesson I learned  - and still learning - thanks to VJ is that it doesn't hurt to disclose everything in advance.

still no stinkin' case number - on day 18 and the guy at NVC said that with all the weather related closings that it will likely put it back another week - arghhhh!

I hear you Collie.  So frustrating to have to wait again after waiting so long for an approval.  We have similar timelines. Our i-130 was approved on Jan 8/14 and received on Jan 20/14.  Hope we hear something soon, good luck!

Newbie, we are all in the same boat.

Most people have had their I-130 transferred and received the same or similar notice.  The processing time once transferred is 30-60 days.  My paperwork was transferred to Nebraska on Nov 16th, filed on March 29th, and I expect to hear a response no later then January 16th. I would realistically expect your response to be by February 10th according to your timeline above.

Its hard to believe that the governments offices are diligently working away around the holidays.  Best of luck to you.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsWhere am I? after CR1/I-130 filing, so confused

We have a similar date. My Noa1 was May 10.  MSC is The national benefits center. If you fill in your timeline it gives you an estimated time for when your case can be adjudicated.  Right now mine is saying between November 28 - December 12 as possible time to get NOA2.

Sorry where do you go to fill this in to get the timeline estimate?

What are the first 3 letters on your NOA1?  That will indicate where your petition was sent to.

Hi Ryan, is this the number you are referring to?  Preference Classification: 201 B INA SPOUSE OF USC or MSC139***** number?  I dont see any other number on the Form I-797C Notice of Action.

Thank you guys

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsWhere am I? after CR1/I-130 filing, so confused

Hi guys, i read through many of the threads and discussion but still very confused in term of where my file is at and how to get a ballpark status.

I am us citizen, and filed for CR1 / I-130 spouse visa for my wife on May 13 2013 and received NOA1 about  a week later.  This is where it gets confusing, my case file starts with MSC and the status has been stuck in "Initial Review" per below:

"On May 13, 2013, we received this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you"

1) I mailed in the application from jersey city, NJ.  How do i tell which service center my application went to (NOA1 does not have that info).  It seems a lot people can easily tell what service center their application is at, how do you guys find this out?

2) Is there anyway to get a ball park estimate how much longer the wait will be?  we waited about 4 months so far without a single update or notification.  It has been very difficult on us as I have to stay in the US due to my job, and she cannot come here until this visa is completed so we were separated soon after our wedding.

Any info you guys can provide will be greatly appreciated.

IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports2014 NVC Filing Process for CR-1 Spouse Visa

The ENROLL is different for China and for Canada.  You do not ENROLL if you have a country that has mandatory EP.

There are two wiki's for these countries.  One is by Saylin for Canada and the other is by Ryan_H for China.

Hi, this is for china. Do you know if it has mandatory EP?  i can't find any info.

I did see Ryan_H's wiki:  http://www.visajourn...onic_Processing

But it is a little confusing, the wiki said to wait until after DS-3032 email then email to NVCElectronic@state.gov and attach the signed DS-3032 along with other info. But then a little down in the speed bump section, it mentioned not to use the DS-3032 form that was in the kit sent to you.

Sorry i am a bit confused. Any help will be appreciated.

Actually this form is now DS-260. Mailing is no longer an option. You have to fill it online and submit it, when it becomes available.

thanks, seems i can't edit my original post anymore to change it though.

IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports2014 NVC Filing Process for CR-1 Spouse Visa

Electronic processing is only available to select countries.  90% of the world cannot use it.

When calling the NVC you do not need to press any numbers to speak to someone.  There is no automation period.  It's if busy, it means all the lines are busy and call back.

Hi, assume i am in one of those countries that have electronic processing, how/when/where do I opt in? The only info I found is from years ago when it first went live and noone was sure how it works and some said it may even delay your processing if done at the wrong time. Thanks

IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports2014 NVC Filing Process for CR-1 Spouse Visa

Hi, this is my attempt to create a simple and updated NVC workflow. Having read through many guides and threads, it is very confusing as a lot of the information is outdated.

Below is what I have so far, would appreciate of those with knowledge to fill in the blanks and let me know if any step is missing/wrong. I will also fill in the blanks myself as my case progresses.

End of USCIS:

1) NOA2 approved -> Post decision activity status indicating the application has been forward to NVC

Start of NVC

2) Get NVC Case # and IIN (Invoice Identification Number)

  • Call NVC every 2 days (603) 334-0700  Option 1, to speak with a live person(no automated system)
  • Provide USCIS receipt # and ask for NVC case # and Invoice Identification Number (spell it out over the phone).
  • NVC will tell you 1 of 3 things:
    • Not received - meaning they have nothing yet from USCIS. Hang up.
    • Received package but not processed - meaning they received the delivery from USCIS but have not scanned into the system and has no case #.  Hang up
    • Received and scanned - meaning they have the case# and IIN. You then provide them the both petitioner/beneficiary name and birthday to get the info

3) Login to https://ceac.state.gov/IV/Login.aspx  with the info obtained from step 2 above and complete DS-261 Choice of Agent

4) Opt in for Electronic Track for all steps going forward. <-- This is the part i am really confused, how do you do that exactly? Many articles stated to send emails with exact subject to NVC but those are all from 2005. Does anyone know how the process works now?

5) At this point, the workflow splits into 2 separate parallel tracks. Note the requirement list for each form below is well defined so i wont bother list them out.

5A) Pay fee and petitioner complete I-864 Affidavit of Support <-- From my understanding even though you chose Electronic Track, this CANNOT be filed online and MUST be submitted via regular paper mail. Is this correct? Any detail will be appreciated.

5B) Pay fee and beneficiary complete DS-230 Immigrant Visa application. From my understanding this can be submitted directly online and no need to mail it in.

6) NVC review all info submitted in step 5 and send to US embassy of the beneficiary country to start the embassy process.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsWaiting for my interview at the Buenos Aires embassy - for how long?

Hi everyone,

I started this (very long process) of getting the spouse visa in November 2012 from Argentina (me and my husband both live here, he is a US citizen).

A week ago, I got this email:

The National Visa Center has received all documentation necessary to complete pre-processing
of your case. As soon as an interview date has been scheduled, the applicant, petitioner
and attorney (if applicable) will be notified.

The applicant should NOT make any travel arrangements, sell property, or give up employment
until the US Embassy or Consulate General has issued a visa.

The US Embassy or Consulate General may require additional documentation at the time of
the interview. Additional documentation requirements if applicable can be referenced at
the following URL: http://travel.state..../info_3742.html

Sincerely,

Director
National Visa Center"

How long does it take to get my interview /typically)? What are the nexts steps..

thank you so much in advanced.

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsNVC Filers - March 2014

That's not my wiki, it's Darnell's. Looking at the history date, it hasn't been updated since August 2013, so no, it's not up to date.

1. DS-3032 = DS-261, DS-230 = DS-260

2. Yes, I believe this is still recommended.

Added!

Yes, send it all. Everything that was sent to the IRS should be sent to NVC.

You can't bring original tax returns anywhere as those were sent to the IRS. The only ones you can possibly bring are copies wink.png

It's up to you if you include additional evidence in the IV package or not. This is typically only recommended for MENA countries though.

Added... for now. Please create a timeline or I'll remove you.

Updated.

And yes, it's taking quite awhile to assign case numbers. If you looked at the spreadsheet, you can see this for yourself.

That's not enough information to tell you if you need a joint sponsor or not. Are you currently working? If so, are you above the poverty line for your household size?

Since you quoted INSIDE a quote, this didn't show above, but you mentioned your service center was CSC, not NBC. I'd like to point to both your profile and timeline that both show NBC as your service center. Please update if California was indeed the correct location.

Saylin,  Am a medical physician by proffession and my 11 & 12 tax returns were way over the poverty guidelines ...

though i have not been working since past one year - so would i be needing a joint sponsor for my spouse.
