According to this article K3 seems to be unaffected by IMBRA. At the AILA-NY Chapter Meeting on June 5, 2006, Keith Canby, Adjudications Manager of the USCIS Vermont Service Center, was present.

Why do they need a new form (I-129F) for K3 when IMBRA releated questions/checks are NOT applicable to K3 spouse visas. They just need a new for K1 petitions, eventhough currently the same form is used for both K1 and K3.

I am not sure if I-130/CR1/AOS is affected by IMBRA. Even if it did, I am OK with it as my family will be here in the US with me and I can afford to wait a bit longer. I just pray that K3/K4 is not affected by this circus.

I dont really know if that is right but my husband and I both called USCIS and we were told that our petition will be approved within the next month, cause they are still processing March 5th. So 30 days to count down from he? Well if that wont work Im so screwed over here. I wont have a flat and I will be standing here in the rain with just a freaking suitcase and two chinchillas in their cage. Isnt that nice :blink: . Hope I can stay some time at a friend or sort of like this. Man I really hope that will work out. Im going kinda crazy with nothing moving back or forward.

Where did you get the "90 day" information? My I-130 has been at the Vermont Service Center well over 90 days with no word. If there is indeed a 90 day limit, mine is past due. They received mine on February 28, 2006.

I actually filed for K3. And on the NOA1 receipt of the I129f it is written " bla bla it usually takes us 60 to 90 days to process this kind of bla bla"

There I got it from and the reps just told me there is a freaking 30 day window after that as well :huh: . Well anyway still waiting, but at least our I130 got approved.

HI,

I dont see a reason, cos if my case is updated i get a Mail. I just try to relax cos as far as immigration goes there is nothing else I can do.

I prepared everything for the next steps (interview etc) and Im leaving my flat in two months and sending my pets over to my husbands at the end of the month as well.

I do check if the processing times change but that is all...what else is what I could do?
I called USCIS and they told me after the 90 day mark there is a 30 day window in which they can still approve our petition.

So Im not worried anymore. Sooner or later things will get moving and be sure, we will know first :)
Everything else is too much stress for me so Im settling down....nothing can be done, so why should I worry? Everything will work out just fine.

We filed I-129F March 3rd, 2006 :clock:

Ours was touched once on March 15th, 2006 <_<

I called two days ago, and they said it is being processed and we should hear from them within the next two weeks. (I think they are prompted to say that no matter what you ask) :P

Since our I-130 was aproved back in May, we are going for the CR-1 along with the K-3! :thumbs:



K3 visa touched 3 times, only because I had to change my address though I think. Last time 6/12

uhmmm.... :unsure: well I would say that is exactly what I do. Our I130 (CR1) also got approved first and we are waiting for our NOA2 for the K3, so we are moving along with both.....means we are actually taking the CR1 path but if the K3 will get approved soon we also move along with that....so whatever is faster is going to be taken :thumbs: at least in my case. Well of course not if there is not much difference between the interview dates. Then I would obviously take the CR1 route :lol:

After holding for a half hour, I spoke with Chris my friendly rep. My I-129f is at 89 days processing time. He told me that K3 applicants are not affected by IMBRA...only the K1 applicants. I basically asked if we were not affected, why the hold up? He responded with, "It's simply backlog ma'am. It has nothing to do with IMBRA." Then proceeded to tell me to call back Sept. 13 if I had not received a desicion.


Wow that sucks :( Why the hell would you have to wait till september???? :huh: Thats another 3 months?!!? And why the hell is the backlog on march 5th??? That is really strange. Maybe he screwed something up. Dont worry so much. Another lady told me a couple days ago that they are through the backlog and our I 129f should get approved latest within the next 30 days. So they are just rep's. Dont believe everything they say. My advice.

We are also waiting for the I129f to be approved....upon that day we will go ahead with the NVC process of our I130. I would still prefer to enter on the CR1....instead of the K3 but if the timedifference would be huge I would of course tkae the K3....no question:)

to be honest, I wouldnt try entering the US anymore. Since he was denied in the past...(this is listed in their records). I visited my husband also but we made it different. He sent off the petition for the I-130 on the day I arrived at the POE, so they dont have a record of it. We were also told by our embassy we would not be allowed to visit as soon as the petition is pending. So honestly I would rather wait than taking the risk. I was also considering visiting him again, but :no: no way Im trying it again. i think it is much more than luck to get through once. And they already gave me a taff time when i tried to enter before we even sent off the petition.

I think that CBP officer told you that so it would make HIS job easier ;)

My wife has visited me in the US twice.......no problems yet. Maybe one day , when she does come again, she`ll get questioned more etc......but so far, she has visited twice with no problems.

Every once in a while you`ll read a post that describes a bad experience and that they were denied entry, but as a whole, from what I have seen on this forum so far, the odds are greater that you will get in, than be denied entry.

To me and my wife.....it was worth taking that chance to be able to see each other.

Sometimes you just have to roll the dice and take your chances. :thumbs:


Well to specify it...I visited my hubby once as well, but now our immigration visa is approved and I wont have a flat and work in Germany anymore....so are you still thinking that the CBP officer just told me that because he wants to make his work easier? :blink: I doubt it. But that is a different case. :huh: wow i didnt expect that to become such an interesting discussion. Today that I slept one night over that whole issue again I have some different thoughts about it.
I think paying that fee is not the worst thing (since we spend so much money on other things after that). I dont think one can blame anyone.....well. As already mentioned before USCIS believes probably they are moving along really fast (compared to other things) I mean what are 6 months to them? Nothing. And I dont wanna know how many petitions they have to process! We here on VJ are just a very small amount. And honestly if you could travel on a K3 to the US and already having the CR1 at the NVC....would you complain about the fees because you then decide ah well we are doing AOS in the US instead? It is everyones own choice to take the K3 route. I actually consider it just as a lucky option if you get the K3 fast and BEFORE the CR1.

And I do think it is a very good thing that the american government reforms the immigration law. Sure we are stucked in that process now (at least a part of us) but if they would do it later there would be other people in that situation. So it really doesnt matter when they pass a law or reform a bill. It always affects people and their pending applications.

Getting 'touched' means that someone updated the USCIS online status date. The NVC does not have an online status system to update, you don't get 'touched' at the NVC.

With regard to I-129f petitions, the NVC receives the approved petitions from the SCs, assigns a DoS case number, orders up the security checks, and sends them on to the appropriate consulate. Typically in and out within a week. By the time you get your notice that the NVC has received the approved petition it's generally gone already, sometimes it was gone before the notice was sent.

Don't know about the National Visa Center, Isabel, only USCIS. You seem to be chugging along nicely and have good reason to crack a bottle of champagne. To keep yourself distracted, why not start taking side bets on which one of your applications will get the visa quicker?

There are advantages, because the foreign spouse will be a legal permanent resident right away and eligible to work. Look, there would have been waiting no matter what, because entering on K3 means waiting for the greencard. So it's six of one, half a dozen of the other.

There's no sense being mad about what we can't control. We have to be like Buddhists and have no expectations, which are the source of disappointment and misery. We can look at the silver lining, which is this: I married a great guy who loves me, we're on the visa train, and there will be a point at which we're together again, and turkeys can stay frozen for months.

hi guys,

I agree with Jersey girl. Relax. They sent out the IMBRA RFE's, is that nothing? :hehe: I decided to celebrate that :innocent:. Sure, these are all small steps but better than no steps at all. And considering the fact, that some of us already received their RFE's per mail and returned it (two days ago??), how can you expect that they already work on that? Give them at least a week or two to sort things out. Remember there are only humans working on these cases, no gods.
So try to relax; as Jersey girl said before, things will move on eventually. I really dont think it is a matter of if it is fair or not that K1's are getting approved.

I also have these bad days when nothing seems to make sense and everything is just ###### up. But the next day comes up for sure.

My husband is a Ghanaian citizen who works and currently resides outside Ghana. He is currently in Cyprus right now playing football. ( I allso posted this question in the Regional forums too just to cover my bases)


When it comes time for him do his medical exam for the K3 visa, can he do the medical exam in Cyprus or will it have to be in Ghana, which means he will have to fly home just to do the medical examination?

My other question once he gets the medical examination done, is he give the results to give to embassy or is it sent straight to the embassy?
