I was always expecting to recieve those emails during the day so I was shocked to see first thing in the morning. You dont need to tell consulate anything regarding K3 on your CR1 interview. i just checked your time line, you got both 129 & 130 approved same time ? since my i 130 is still pending, how much longer is CR1 vs K3 ? where do i get the nvc case # ? do i have to call them or is there any page ? i couldnt find any Thanks a lot ! K-3 Spouse Visa Process & Procedures	In AOS, forgot I-130 for daughter	After reading all of the information on VJ about the K3/K4 vs. IR/CR processes I feel like such an idiot . My wife and daughter could have easily come in on CRs because my wife's I-130 was approved before she got her K3, but I didn't understand the options at the time and didn't discover VJ until it was too late. Now I've screwed up again. Somehow, despite having included it in my notes, I neglected to file an I-130 for our 10 year old daughter when we submitted the I-485s to Adjust Status. The form sent to my daughter from USCIS states: "In order to process your application further, submit evidence that an immigrant visa petition has been filed on your behalf. Such evidence includes a copy of the I-797 NOA on Form I-129F .., Form I-130 ... "...Submit evidence of an I-130 filed on your behalf either before Form I-485 was filed or at the same time Form I-485 was filed. If you do not have Form I-130 filed on your behalf, you may withdraw Form I-485... Note that per Title 8... any I-130 .. filed after this I-485 application was received .. will not make you eligible for adjustment of status with this Form I-485." The notice says we have 87 days to respond. QUESTIONS: I don't understand why one of the forms of "evidence that an immigrant visa petition has been filed on your behalf" is "a copy of the I-797 NOA on Form I-129F" if we need to file an I-130. It looks like we need to abandon my daughter's I-485 and re-file it with an I-130 application for her. The wording suggests that this is the only way to proceed, but in reality I've found that such situations often have workarounds. Does anyone know of a way around this? If we do abandon this I-485 for her, do we forfeit the $600 filing fee? Will they send us back her I-485 packet so we can use it again, or do we have to build a new one from scratch? (Most notably the I-693 Medical Exam.) If my wife's K3 adjusts --such that she is no longer in K3 status-- while our daughter's I-485 is still being processed, will that invalidate her K4 status since it is a derivative of the K3? If so, then what? Should we abandon BOTH I-485s (and possibly forfeit the $1610 in fees) and re-submit them together? Is there a way to pause my wife's I-485 while we're getting my daughter's back on track? Both visas (K3 and K4) expire in February. I'm a bit worried we won't get all of this straightened out before they expire. Anyone out there heard of a case like this? Any suggestions would be most welcome. Once the automated message said that your case was completed at the NVC, did your husband call the NVC to find out when the interview was? Or did he call the Department of State? Did he talk to a live person or was it automated as well? I'm still confused about how they let you know when the interview date is. Thanks Erica! Diana when you are done with nvc you are done with em Your Embassy send you a check list about 2 or 3 weeks after case complete at nvc- you tick to say you have the police certificate /birth cert etc etc and have arranged the medical then they send packet 4 which is the interview date the medical can be weird so no booze night before etc as they do a blood test and they are still pilgrims you know and very puritan about things. I will get totally ratted and buy some cannabis when i get home after ! (its a joke folks) Drugs...the reason we're in the middle of an IR-1 case right now instead of happily married with one on the way...don't even get me started! I guess I should clarify-we are actually married...the happily was the key word. I passed the K1 medical and had a skinful of lager the night before (sat in tiny room in london alone) so the medical aint that bad.. but i am abstaining 48 hours before this one.. I wouldn't like to be too happily married - i bet the years go by fast and boring coz nothing happens and you dont appreciate the nice times if its all nice... one needs some contrast... When I get better after a nasty cold I feel absolutely wonderful Beware the 3 rings of marriage the engagement ring the wedding ring the bore-ring ! Ok now I'm getting started lol! My husband's drug tests were clean of course, as he hasn't used any drugs since he experimented with cocaine as a teenager about 3 or 4 times, he doesn't even smoke and rarely drinks. But about 3 months before our K-1 interview he had stuck his finger into a baggie and licked his finger to taste what was inside of it, as he has seen police officers in Mexico do to identify a substance (which to me is stupid but whatever I don't make the rules) that some guys would have eventually tried to sell to his younger siblings. For that reason he is a drug addict according to the Mexican corrupt panel physician and their rent-a-psychiatrist. So we have spent the past 2 years (1 more to go) getting Javier drug tested every few months, psychologically evaluated and "treated" for his drug problem, getting married, and filing the I-130 so when all is said and done, we'll be walking out with a 10 year green card and those #### won't get anymore of our money. As for me, well, they generated the IV fee bill on the 16th and so far we haven't received it. Don't even ask me about the I-864. No clue whatsoever. See I thought I was all clever and had figured out the NVC-they generate it on Monday, mail it out on Tuesday, it'll get to me by Saturday....but no. Therefore I am still waiting to receive the bill 11 days later. Not like I'm looking forward to paying it anything, but I always worry about things getting lost. The coversheet isn't in the generated instructions (well, at least not how our files are - the generated instructions are a pdf, so you wouldn't be able to edit them to change the barcode and case number). The I-864 coversheet has its own link in post 5 of this thread (James' shortcuts) about 4 paragraphs down from where you were trying to download the NVC generated instructions. Look for the bold text that says I-864 coversheet. It sounds like that's what you want. I did the name change thing (as I posted earlier) just now with that link and it worked fine for me. girl37, good catch on the instructions. It looks like these are the ones that we've been expecting for a little while now. Note how they say they were modified May 2006 and they only require 1 year of tax returns. K-3 Spouse Visa Process & Procedures	other options if he is in the army?	Hi out there, I just got a link to this fantastic site. It is great to have all the information on one site. My husband and I tried to get information so hard but it seemed like everybody tells a different story :s. However. I am German and I just got married to my husband last week in Germany. One day after the marriage he had to leave to get to his new base in Maryland. That was great . Well so it is not that long, but I already miss him so terribly. I intend to join him over there but there are so many problems. First of all a soldier's wife told me she also got married in Germany and it would be possible that he get his PCS orders amended and add me. So I could join him within a few weeks. But I really dont know if she is right. I keep in contact with my husband's 1SGT. She told me that it might be possible as well, but I have no idea if I just need the passport and his amended orders. This soldiers wife told me that I may apply for my visa in Maryland as soon as I get there. Today I got a new email from the 1SGT and she told me I will need a visa and I may apply. So what? At all Im just confused because many things didnt work out like we thought they would. It is frustrating to stuck in Germany and not be able to do anything.
