She said it was easy, relax, be honest, and all will be fine.
They asked about me, my favorite color, what she liked about me, how we met. And how often we talk.
Then looked at a couple pictures, e-mails and that was it. 15 minutes.

The length of the K-1 depends on which office your spouse files in. Vermont seems to be the quickest. Mine took 104 days.
The way the visa works, upon approval, you ahve 90 days to marry.Good luck

For spouse and step children, one I-130 for each intending immigrant. K3/K4 is no longer a viable option. You'll read hundreds of references to it on various sites including USCIS's site. You only need to read one notice on the Dept. of State site to understand K3 and K4 or no longer viable. They haven't saved more than a few weeks time at best, for over three years anyway, regardless of anything you read indicating otherwise.

Ok i hope someone can help me. I was married on May 15th to an Australian. In Australia. She still lives there and I live in the states. She wants to come here and I want her here as fast as possible. She has 2 children daughter 17 and son 15. daughter will be staying in Australia while son will be coming with her. we had been planning on going the K3/K4 route as we started planning all this 2 years ago. from what I'm now reading in this thread I should not apply for K3/K4 but follow the IR/CR track insted...is this correct. we have no worry about the extra money for change of status or going through the SSN/ right to work process. But I want to get her here with me as soon as passable with out unneeded delays. All the sites I look at still talk about a K3 but then I see this info that it is dead or obsolete or what ever. I would like to just get advice on how I should proceed.

2nd question though off topic, do I fill out an I-130 for both her and her son?

Dear Dr. Gonzalez:

I am one of many United States Citizens perplexed by the extensive delays
in the processing of K-1 and K-3 visas at USCIS all service centers.

When I began this process, I was pleased to find that our application would
be processed through the service centers quickly and efficiently. Since
April onward of this year, this has not been the case.

We are members of an on-line community who share information and
experiences related to the immigration of our loved ones. We have been closely
following the changes that USCIS has undergone, including a substantial
rate increase in the fees associated with processing of applications and
petitions. While we understand the need for fee increases and some
restructuring at USCIS (training, hiring additional staff, prioritizing the
processing of applications, etc.) to create a more efficient and customer
friendly organization/agency, there are several issues of concern shared by
many of us that we would like addressed as soon as possible. It is obvious
to us that especially since April 2007, things at USCIS appear to have
gotten worse instead of better. For example, at the Vermont Service Center,
the average time for our community members to get their K1 VISA NOA 2 has
gone from less than 30 days in May 2007 to over 100 days now.

Some of our concerns include:

1.) Significant delays in the processing of petitions. Many of us who filed
in May through the date of this letter are noticing that an extremely small
number of petitions have been processed/approved. Many of our community
members are close to the 120 day mark (At CSC, past the 6-month quoted
timeframe) in waiting for a decision on our petition. Some of us are
receiving RFE’s long after NOA 1, thereby re-starting the clock.
2.) Many of our members have not received a notice of receipt (NOA 1), even
though the On-line Case Status confirms the receipt of our applications.
3.) Information provided by your agency’s out-sourced call center employees
is often misleading, incorrect or incomplete.
4.) We feel it is entirely inappropriate to prioritize WORK visa
applications over Family-Based, Non-Immigrant Petitions.

Dr. Gonzalez, we understand that Immigration Benefits are a privilege and
not a right, but as a United States citizens, we deserve accurate
information AND the opportunity to have our concerns addressed by
knowledgeable officials who can give us FACTS (not in-accurate time
estimates and scripted misinformation designed to appease nervous and sad
callers). We also understand the need for security checks, as we are aware
of our national security issues, but we do not believe this is the source
of the most recent delays. Only the truth and some swift action on the part
of USCIS can alleviate some of the stress associated with this process. Our
lives, along with our loved ones abroad, are on hold and we have no idea
when this first part of the immigration process will conclude.

The wait for a petition to reach NVC, then the appropriate Embassy and,
finally, the attendance of the beneficiary at scheduled interview can add
an additional 3 – 12 months to an already excruciatingly slow process. The
USCIS needs to set a reasonable goal of 90 days and/or have expedited
processing available for K1/K3 VISA applicants.

The strain of this process (both financial and emotional) is taking a
serious toll on the health and well-being of many US law abiding citizen’s
who are trying to follow the laws to bring their loved ones to the US by
legal means. Our frustration level with USCIS' inability or unwillingness
to ease/improve this process is reaching a critical point.

We, as a collective, have some expectations which include:
1.) A formal response to our concerns,
2.) Improved processing time for petitions, we believe the USCIS goal
timeframe of 6 months to process a K1/3 VISA at the service centers is
inadequate for our needs. As with any company, if the 90-day standard
cannot be met with good management and talented professionals, then the
organization should increase staff or streamline processes,
3.) Accurate and detailed information from your customer service
representatives and,
4,) The immediate issue of NOA1 hardcopy receipts for all received
petitions.

We respectfully request your immediate involvement to drastically improve
this process.

Thank you very much for your time in reading our letter and we sincerely
hope you can initiate immediate and long lasting improvements in this
aspect of USCIS.

Gah. No more using the term DCF, because filing at a USCIS center that's located abroad is NOT the same! Everytime I read someone saying "I'm doing DCF," it makes me go, "WHERE? HOW!?" And then I realize what they mean is filing at a USCIS center abroad :( I'd do that, but I have to be a resident of Finland and that paper work takes 3 months to get through, plus I wouldn't be able to work in Finland :( So that stinks :(



Sorry! Didn't mean to make you sad. You're right - the two do get terribly confused, but after a hasty re-read of this thread I don't think anyone here is confusing them; when we say DCF, we really do mean DCF --- vs., for instance, Rome USCIS. We're holding out the hope that DCF will come back soon and calculating that into our various-scenario time-games. :)

So let me get this straight....if by some chance DCF comes back, I would be filing for a CR-1, if I went the DCF route correct? And if DCF doesn't come back, I am planning to file in Rome....would that be CR-1 also? Not K3? How long does the CR-1 take if filed in the US? I am just trying to minimize the time apart. We are currently living together, but come May I need to head back to the states!

You and I are pretty much in the same boat. If you can file your I-130 petition outside of the USA through DCF or Rome, your husband should get a CR-1 visa pretty quickly. Way faster than through a USA USCIS office, anyway. I don't think that K-3 ever even gets adjucated outside the USA, so only consider it if you have to first file your I-130 in the USA, too.

Well, I haven't actually experienced it, but from what I've read, even though K-3 technically lets you work, etc., you still need to apply for temporary work cards, go through adjustment of status (money and forms and LOTS of time) and people seem to have a long wait to get their final Greencard. With IR1/CR1, you've already done most of that work while abroad, which, depending on the country, probably makes it go a lot faster. When you arrive in the US, a IR1/CR1 visa in your passport allows you to work immediately and IF things go smoothly, your Social Security card and Greencard arrive in the mail within a month. Makes setting up jobs, drivers licenses, bank accounts, etc., a lot easier. Someone please tell me if I have this really wrong. I know some CR1/IR-1 arrivals have had their share of snafus, but it seems to generally go a lot faster than the arrival/setting-up a life in the USA experiences of K-3's.
