There has been some anecdotal evidence that the consulate in London does not ask for financial information from the petitioner when someone else is the sponsor, but I do not recall seeing any reports on the issue from Australia or elsewhere.

Perhaps you can be the first? Prepare a sponsorship package, but have your finace submit only the sponsorship information from the other person who you have found to sponsor him. Have him keep your information in his back pocket unless and until it is asked for. Then let us know what happens.

We sent our petition in late March through the VSC, and it has been approved. My fiance just received a notice saying that the NVC has received our petition and is forwarding it to Vancouver. We had heard that Calgary is processing k1 visas now, so we had written down Calgary on the forms, since it's way closer to where I live. Is it not true that Calgary switched? Am I going to have to go through Vancouver instead?

There is no need to call or fax embassy about extentions of the noa2. They automaticly extend it past the 4 months. The manila embassy is the busiest in the world and this is routinely done, they realize it usually takes longer than 4 months and so automaticly extend it.

I concur with Jazzy's statement. There is no need to call or fax the embassy about extensions. When I called the 800 number for the embassy call center, I asked about the extension requirement for the petition I submitted for my fiancee, at the time, since the 4 months was near approaching. They told me that as long as the embassy has my petition, it will be extended by the embassy due to the backlog in the Philippines. Good luck.

As mentioned before regarding AR, it is probably standard operating procedure for consular officers, if there is any uncertainty, to verify the authenticity of documents by requesting the same documents from the Philippine Government in an attempt to prevent fraud.

Expediting the process of the U.S. Embassy requesting documents from the Philippine Government for verification would make everyone happier, but the politics between two governments is involved.

You do not need to keep calling the embassy, if you want to find out information about your case such as :

1) If your case has left the NVC
2) If your case has been received by the Embassy
3) If your SO's interview has been scheduled
4) If you want to find out if your visa has been approved

That is so much better. Now, your friend needs to get as much evidence of bona fide ongoing relationship together as possible and get it turned in. It is unfortunate the fiance was so unprepared to answer questions about his family. Since the petitioner isn't available to answer, we don't know what kind of evidence they might have available to turn in. Unfortunately, the Consular Officer didn't ask for anything specific.

Things like evidence of more than one visit, emails, chat logs, phone bills, letters, and cards spread over the length of the relationship are what most people would have available. I would also advise the USC to write a page or two describing the evolution of the relationship, sign it in front of a Notary and send that too. A fax copy would probably do. They should be certain they take this very seriously and give it their best possible effort because the next step is the white slip of death.

If he is there with her now, then copies of the passport pages that prove that, would help immensely.

It's going to be pretty difficult to help through a third party. The first thing we need to know is the color of the letter she was given and its wording. Does the letter request additional information or is it a notice of intent to deny and return the case to the USCIS in the US? I suspect it is the latter. If so, the road is difficult.

He just faxed me a copy of the letter (which is blue). It looks like they are asking for additional information:

"The Consulate General is unable to issue a visa to you because you have been found ineligible under the following section(s) of the U.S. Immigration and Nationality Act, as amended:

"Section 221 (g) of the Act prohibits the issuance of a visa to anyone who has failed to present the documents required in connection with the visa application, or who has failed to submit sufficient credible evidence to support the claimed petitionable relationship. The following remarks apply in your case.

"Based on the information ascertained through the visa interview and through documentary materials, consular officers do not believe that there is a bona fide fiance/spousal relationship between Petitioner and Beneficiary. If you have any other evidence to present which would convince a reasonable person that the relationship exists for a reason other than immigration, please submit it. Please label and itemize all materials submitted.

"Please turn in all requested items with this form at window B between 1pm and 3pm Monday-Friday.

"WARNING: IF YOU FAIL TO TAKE THE ACTION REQUESTED OR FAIL TO PRESENT ADDITIONAL EVIDENCE SUFFICIENT TO OVERCOME YOUR VISA DENIAL UNDER SECTION 221(G) OF THE IMMIGRATION AND NATIONALITY ACT WITHIN ONE YEAR OF THE DATE OF YOUR INTERVIEW, SECTION 203(G) OF THE ACT REQUIRES THAT YOUR APPLICATION BE CANCELLED."

So I'm assuming she just has to show more evidence of the relationship and await another decision?

Hi,

I'm posting this for a friend of mine. He is engaged to a woman from Vietnam and has recently been going through the K1 Visa process. He'd filled out the I-129F petition and his fiance was scheduled to have an interview with the Consulate in Vietnam on July 19th. However, she was disapproved and received a rejection letter from the person conducting the interview.

According to him, "She was asked what my parents names were and she did not know, then they asked her my ex-wife's name and she did not know that either. The person doing the interview gave her a rejection letter."

Is there anything he can do to overturn this decision? Or would he have to file all over again?

Any advice or suggestions would be greatly appreciated. I have gone through the K1 Visa process myself with my husband who immigrated from New Zealand a few years ago, but I haven't had these sorts of problems and wasn't sure where else to ask.

You can go to CDJ before the packet arrives-just have to have all the forms filled out, which you can get online, and make sure they have received your case. We filled out all our forms ahead of time (well, our attorney did) but we still ended up receiving packet 3 before we went for the interview. In fact, I received 2 because I remember telling someone at the Consulate (maybe through e-mail that I hadn't received it so they sent out another one). My fiance in Mexico never received his packet 3.

That would be done through an Advisory Opinion with the Department of State, and considering they just denied ours for no good reason, I wouldn't recommend you waste your time with that...

Yeah, I was definitely mad when my fiance told me he had fessed up to that. But... I was the one who had prepared all the visa stuff and I sort of just filled him in on the details. I guess I forget to have the talk about "remember back when marijuana was your favorite college pastime? Let's pretend that never happened."

He told me that during the medical exam he had to take of all his clothes, and then the doctor left the room. He was left there facing signs that read "lying to this doctor is a federal crime" and things like that. So I guess he got intimidated/scared, and when the doctor came back and started asking him all kinds of questions he just said everything.

The worst part about this whole thing is that the next day, not only did they deny his visa, they took away his tourist visa!! He can't even enter the country! Anyway, I was accepeted to grad school here, so it looks like we'll be apart for the next two years. Ni modo...


Maria, the same exact thing happened to us. Javier had an incident where he had put some cocaine in his mouth and we got the 3 year castigo for it. Ours is up in August 2008. There's not much that can be done other than wait it out. We tried all the things we were supposed to try-Motion to Reconsider, even an Advisory Opinion with the Department of State (and we had a VERY good argument since Javier didn't actually use the cocaine). You might have an argument as well since the law DOES allow for one instance of "experimentation" within the past 3 years, it would all depend on what he actually told the doctor. I'm wondering-did he also have to go see the psychiatrist? That's what we had to do. It saddens me to read your post because it's practically identical to what I posted back in November when this happened to us. Javier too told me about those signs you mention which are very intimidating and I also didn't think to prepare him for this aspect of questioning. I'm glad it seems you've gotten a lot more good support than what I did when it happened to me-people told me things like he was stupid for putting the drugs in his mouth/stupid for telling the truth. I guess you have to walk in those shoes to really understand. Anyway, my recommendation again is that you just go ahead and wait out the castigo. Do what we did-get married in Mexico and file the I-130 so you won't be wasting your ban time, and by the time he gets his Visa it will be a green card, not just a Visa. I do not recommend filing the Advisory Opinion. It's a waste of time. Today, at almost September, we never heard a response about it. We just got married in Mexico last week. When you begin to realize that the word that best describes the Consulate in CDJ is "incompetence" this will all make sense to you. Their e-mail responses generally contain 0.0000001% of useful information so what you really need to get at is the essence of what they're actually saying. What I can get from the e-mails is:

1. They received the case.
2. They had already received it as of October 31.

Based on that, you're going to have to just be patient and come to your own conclusions of when Packet 3 will show up. One thing's for certain though-it will, in fact, show up.

Having used drugs at anytime in your past can be a reason for denial... if you lie about it then that just makes it worse....


To the first statement-that's incorrect. The Foreign Affairs Manual states that you must be free from any drug use within the past 3 years only. Not your entire life.

As to the second statement-in some cases, I would say that's also incorrect. For example, if you had experimented once or twice or maybe used a few times many years ago, it's probably not worth mentioning, since I can tell you in that case honesty CAN make it worse. In this guy's case, however, he seems to have a problem and I'm with you in not recommending dishonesty in his case.


Sorry if you think my statement was incorrect.... what the manual says and what the CO does are not always the same thing.... there have been post on here and other boards where someone has said they had experimented with drugs years before and this has caused them to be denied and they are having to appeal.... you say "well if it was years ago its not worth mentioning" well I am sorry but if the CO is asking you "Have you ever taken drugs"? and you lie then you are committing fraud... ok so nobody is going to sit there and say "oh by the way I smoked a Joint 20 years ago" but if you are asked that is diffrent and my understanding is that most people are asked....


I'm well aware of that. We're one of the ones that happened to, and filed the Advisory Opinion based on that misinterpretation of a law which states the individual must be free from drug use for 3 years. The only place I know of where the physicians are actually making false judgments of drug addiction (such as in the case of experimentation during teenage years) is in CDJ, which caused the AILA to issue a Practice Advisory to the Center for Disease Control about the very subject. I have never heard of anyone, anywhere else being flat out denied a Visa for something they did way back when, although I can recall one story here on VJ where the individual had to provide further proof of their rehabilitation. Trust me, I have been so immersed in this stuff I could write a book about this law, and the law is that it's 3 years, not life. Anything else is a misinterpretation on the part of the CO and, to my knowledge, only happens in CDJ. Besides all that, I don't think (and I stated this as well) that someone with an ACTUAL ongoing drug problem should lie, and in fact, if this guy gets a Visa, and we didn't, I'll be pretty ticked.

I just applied for a K-1, but I am curious as to why K-3 applications appear to take so much longer (not to say K-1 process isn't long enough!) ...?

Presumably one of the great hurdles to get over for a K-1 is the sincerity of relationship, intent to marry, etc. etc. With a K-3, that's pretty much taken care of ... so why the extra hassle from USCIS?

Hello everybody!

It's been a while since I last asked for help, but I now have a problem that's really bugging me. My husband and I made copies of everything we sent in to the USCIS so far, which included the I-130 and the I-129F.
It now seems like we somehow managed to lose all the copies we made of the forms we sent in, as well as the I-130 Receipt Notice thing. We made those copies so I could have them for the interview, and now I'm a bit stressed out. How important do you think it is to bring copies to the interview? Or will the interviewer have copies of everything anyway?
Any help would be greatly appreciated - thank you!

Yes you will have to get a co-sponsor, they will fill out the same form that you do for the support and send it in with yours.

Once your fiance gets here and you are married then you will have to determine what your income is at that time to determine if you will need a co-sponsor or not when you file for Adjustment of Status.

I wrote my own letter on Gov't letter head and had my boss sign it and I have not had a problem thus far.


My co-sponsor has just about got the paperwork together for the interview, assuming it will happen someday soon. :clock: ...but I guess I have to get that NOA2 first. :huh:
But he said it would take some time, a month or two, for him to get an employer letter on letterhead stationery (he works for the government :lol:). He does have paycheck stubs for the last few months, and he's had the same job for years. Should I tell him to go ahead and try to get the employer letter, or will the paycheck stubs be enough? He definitely makes enough income.
Does anyone have any other suggestions for things the co-sponsor should submit? I've got I-134 form, 2005 tax return, paycheck stubs, bank statement.

Well my husband who is the USC received the RFE about a week ago and mailed it back to them by normal take your bloody mail!! I was so mad at him for this doesnt he understand thats another week we are going to apart?? I feel like I am not his priority .. there are so many USc on here that are doing everything in their power to get other halves with them in the USa ASAP!! My husband hasnt even bothered to look at the NVC flow chart I sent him and is just relying on me to tell him what to do. He also said on the phone last night that its expensive to mail priority/overnight.. that makes me feel like I am not important enough for him to fork out a mear $15.. ok so he is not working but volunteering for the blinking park service ( which I was not ahppy about in the first place) and now hes complaining we dont have alot of money... HELLO You bloody decided you wanted to volunteer not me!! Its his fault not mine.
I just feel totally let down by him.. all I want him to do is get the forms back the quickest possible way.. is that too much to ask??
Also he said he has got another copy of the same RFE.. has this happned to anyone else? Evidently the USCIS have not as yet recieved the RFE he sent out on friday!!

I have those days as well. Sometimes it is just not worth to just get out of bed.
My hubby did the same thing with the RFE. It took him over a week to send it off, although the letter carrier takes it out of our letter box right in front of the house. But it is not because Im not worth it...it is just...that he is busy all day and then he forgets. Im sure your hubby feels the same way about it. My hubby also sent it regular mail. No priority or so. We already sent documents between countries for over $140...and that is just a huge amount of money. One delivery from USA to GERMANY costs (within 2 days) $44. It is just insane. And since nothing is moving along with the K3's anyway...dont worry so much.
But I understand that you are mad. I was mad as well :P. But I was mad because it costs so much. :angry:

Ok; here are some questions I am confused about:
1) Do K3 applicants go through same medical exam as CR1s?
2) What, if any, role does NVC plays in K3 cases? How long it takes at NVC?
3) Does anyone has a list of doctors in Pakistan who do immigration medical? If yes, then please email that to me at shaikhg2@yahoo.com, please include doctors' phone and email contact, if available.
4) Do they refuse to do medical for a women who is expecting? What if she is already in 4th or 5th month into it and sensitive stage has passed?
5) According to DOS K3 applicants don't need I-864, rather they need I-134. Can both be taken to embassy?
6) What does a police certificate contain? (name? passport#? date of birth? etc?)

1) yes
2)...depends on every case though. For approved K3 applications NVC just issues a case number. If they dont do any more security checks they will forward your K3 to the embassy. Usually within 2-4 weeks

4)I dont see a reason why they wouldnt do a medical on her
5) Actually I would prepare both. For K3 they usually take take the I134 for CR1 the I864
6) Name of course, DOB, if you have any criminal records. Im not sure about the passport # but I dont think so---someone plz correct me if I am wrong

BTW try looking at your embassy's website for the list of doctors. Maybe it is listed there.

Also you just applied back in May....We applied back in February...so I would appreciate if you wouldnt judge so fast ;) You have 3 more months to go before you are able to compare your case with mine

K-3 Spouse Visa Process & ProceduresNo approved status on website no NOA2 but got letter from NVC?

So everyone should add following to their daily routine:
1) Call 1-800-375-5283 twice to hear case status for both I-130 and I-129F.
2) Check online portfolio three times a day.
3) Call NVC line, 1-603-334-0700, everyday to check if they miracoulously have recieved petition.
4) And always pray, pray and pray.
I am not kidding. These should be done, given this case!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!


I never did that and I also got approved. I think it just involves more emotions. So adding those calls to daily routine isnt what I would do.

Try to relax, even though it is hard :thumbs:

hey you both...I dont see the reason for you both to wait for the K3 either. As soon as the CR1 case reaches the embassy you get an interview appointment. And with the K3...it still has to go through NVC and then to the embassy for further processing. We abandoned K3 when our I130 (out of an miracle) got transferred to the embassy for processing.
Just doesnt make sense.
