:innocent: Bueno señores, felices días para ustedes. Yo soy nuevita, no entiendo ni J de inglés, soy de la ciudad de Bucaramaga, Santander Colombia. Y pues ando en esto de la visa k1... mi novio es de Florida EU, y estamos esperando respuesta de la aprobación (NOA2).

Mi pregunta es la siguiente: (Hipótesis) Cuando yo veo en la página de inmigración donde nos dan a consultar el estado del caso, aparece que mi caso ya esta en el consulado colombiano en Bogotá, yo puedo bajar el paquete 3 y llenarlo y enviarlo al otro día? Ej: llega al consulado el 29/05/07 y yo bajo el paquete 3 el 30/05/07 lo lleno y lo envio por fax. O tengo que esperar que el paquete me llegue? Es que he visto varios casos asi, donde al otro día envian las formas. :blink:

Hey everyone! Hope your all making progress in your cases... i Just stumbled upon something today... and i feel like kicking myself so hard... no one and i mean NO ONE has ever told me about a k-3 visa.. when i went to the local USCIS office... and told them i wanted to bring my husband here... they ofcourse told me about the Ir-1 process... and i was just reading about k-3... and its seems its so much easier and a FASTER way to bring my husband here??? Is it just my misunderstanding.. or is it true?? Im so confused.. and i feel so stupid... its been 1 year and 3 months since we applied, and his interview in in JULY 25, 2007... i mean i dont know, from what i read k-3 sounds easier and faster... anyone has any insight on this to make me feel less stupid and guilty... :help:


Hey, there - it sounds like K-3 might have brought your husband a little faster to the States, but the process isn't necessarily easier - he would have had to apply for adjustment of status while in the USA, and in the end you might have spent a lot more time (and definitely more money) by the time he got his work authorization card, social security number, medical exams, etc.. People arriving with a K-3 visa can't work for the first few months (or more, if USCIS messes things up) and some have a hard time getting a drivers license, bank accounts, etc., because they're in a sort of immigration no-man's land until they adjust status. By getting the IR-1 Visa, he essentially arrives in the USA with all that work DONE, his Greencard should get mailed to him reasonably quickly, and he is legally allowed to work the day he arrives (although a lot of employers prefer to wait until he has his Social Security number). So, feel better - the way you've done things, he'll arrive in the USA ready to live and prosper and done with (most of the) immigration hassles! :)

I asked a similar question about listing house as asset but have ruled that out since i still owe a lot and the value has decreased. Listing the condo is optional if you dont care to have it evaluated as an asset, correct?

The only way we could get family approval was for me to move here to Indonesia so her family could get to know me well enough for their blessing. I just purchased my return ticket to the US last night and when i woke up this morning i had an email that my 129F was approved. My return is not until august so who knows if i'll be back in time to have a job. My old company may hire me back but the economy has declined since I left and its a little unclear.

I'm now getting more concerned about the 134, my dad is going to cosponsor but he doesnt have a lot of income, he does have a house (paid off) a few cars and savings.

I have a decent amount of money left to me from my mom when she passed away (part savings, part in stocks - too bad for me). I also have some 401k savings (is this usable?) What would i need this to add up to, i've seen a lot of people say 3x the assets, but i read in the 134 faq on this site its 5x.

Now the question is, what can i list under the section for "Personal Property"? I have a ridiculous amount of electronics since i was collecting to build a recording studio for the last 10 years, as well as musical instruments, high end stereo equipment/computers, furniture etc. Is any of this valid? I sold my car before moving here to Indonesia since it was already old and i planned to replace it when i returned. And...if this stuff is usable how do you list it? Ballpark figures, do you need a list of the items and receipts (which i probably dont have)?

I also made pretty good money (as a software developer) for the past 3 years, do they even care when they see these as "potential" to get a good job again?

It has a warning so better dont open it coz only the immigration officer is authorized to open it.



Yes, I understand, she will not attempt to open the package but my question still remain the same. One of the documents attached to the envelope is asking her to verifiy her visa information. Should there be another document attached whereas she can verify if her visa information is correct?

My fiance and I (sponsor) are going through K1 process, and she just had her last week. She just received 221g stating that they need transcripts from schools she attended while she had F-1 visa. My question is, will she being "out of status" for a brief time prevent her from getting the visa once we submit the transcript?
She had to drop a class in mid-semester due to health reason (making her out of status). She then found out that she was out of status, and decided to leave US and renter (reinspection) to a different program. She was permitted back to US, and after that she remained in a good stading for a year.
Will they deny her visa for a brief time that she was out of status?
Should we just submit the transcript like they ask? Or should we write an letter explaining the situation?
I'm so nervous because we are so close to getting reunited.

My Canadian Fiance and I were shocked to find that our NOA2 was approved in 11 days. As I am sure anyone on this site can relate, this entire process greatly impacts your ability to plan for future events/ vacations/ and travel. I was hoping some of you more experienced VJ'ers could give me some advise.

Our original "plan" was to submit K1, and during the "avg processing wait" we would enjoy the holidays together in the US, and go on a family cruise in March 2010. My finance is now expecting her Packet 3 to be delivered any day now, and has delayed her US travel plans until she gets it.

So my questions:
1. Is there anything in Packet 3 that should keep my Candain Fiance in Canada (for the next month) such as the physical date? Does she schedule her own physical, does the embassy schedule it? or dose she get that in Packet 4?

2. What are the repercusions of "delaying" the Packet 3 return, by simply holding on to it for 30 days before returning it so that we can enjoy xmas and new years, then send it back to the emabassy when she returns to Canada soon after new years?

3. Can I delay the Packet 3 or the interview process long enough so that I can "push" the interview until after March 2010 (assuming its about Dec 2009 when she recieves packet 3) and be able to take our mexican cruise without dealing with the Advance Parole process, which we will probably not have time to complete in this small window anyway.

Any insight or thoughts would be great. Thanks in advanced.

Based on Current timelines for Montreal...this may not be as bad as you think. If you return packet 3 just after the new year (that's in about 6 weeks), you should be looking at a March or April interview. Traveling across the boarder with a pending Visa application, was never an issue for me...most CBP's are satisfied to see that you guys did it the right way. I never had any problems. If you should happen to be scheduled for an interview prior to your cruise, you can email Montreal and ask for it to be rescheduled for the next month...if they do reschedule you, just be prepared, as it could put you back to May or even June...if you guys are ok with this...then you should be fine.

I say just let the process ride, and see where you end up. I had my interview scheduled for April 2009, and when we inquired for a reschedule, we were told it could be May or June.

I would just try and submit the Packet 3 after the new year....

Thanks poprocks. Thats exactly what i was hoping to hear. Ill let everyone know how it turns out. She actually received packet 3 today (thanksgiving 09). We plan on submitting after the new year and hope that the interview is in April. If not we will cancel the cruise and do it another time.

I did check theworknumber.com with the DoD account, and I could not find an immigration verification "option". No suprise. So I went to the DoD human resourses department and they wrote me a letter with the I-134 requirements and signed it. They didn't seem to know what I meant by "company stationary", so they printed the DoD logo and address on the letterhead on thick colored paper. Phone #s and contacts were listed and signed by HR. If this sounds like a flag / or not legit enough to anyone let me know.

So i guess for future reference, I suggest that DoD employees go to HR rather than even mess with the online verification known as the workplace.com

Hello to all,, I have been reading on here for over a year. My problem and question is my fiancee petition has been denied and is being sent back to USCIS. And of course the reason is non bona relationship, At her interview that was very short she was given a blue paper, this stated that they wanted a statement from me as to how we met, when we met, where we met, etc, etc. I wrote a letter of statement in full detail to what they had asked for, my mother wrote a letter for her, though they have never met face to face, but have talked many times on the computer. My dear had prepared very well for this and took much information to the interview with her. On her chat records was questioned why I would talk with her in non native english,, She is chinese and I speak to her in very short sentences and more of the way she speaks and this really helps her to understand. To me this was the red flag that the VO could not understand and the reason this was denied. This has broken her heart and mine and now I am just trying to figure all this out. I am going to do my best to have this case sent back to Guangzhou and am really looking for some input and encouragement. Anyone that can help me , I am new here and just asking for a little advice, thanks

Yes, I know of 3 cases in which this has happened.

The time for turn-around from 'denial' to '2nd interview date' was 6 months, 10 months, and 11 months, respectively.

2 outcomes were 'approval' - 1 outcome 'not a bonafied relationship'.

I'm afraid this hypothetical question and any answer are unlikely to be meaningful as each case is different. However, if there's reason to doubt whether a relationship is genuine, USCIS reafirming it does not, in and of itself remove those doubt, nor does it guarantee a different outcome the second time around.

Having used drugs at anytime in your past can be a reason for denial... if you lie about it then that just makes it worse....


To the first statement-that's incorrect. The Foreign Affairs Manual states that you must be free from any drug use within the past 3 years only. Not your entire life.

As to the second statement-in some cases, I would say that's also incorrect. For example, if you had experimented once or twice or maybe used a few times many years ago, it's probably not worth mentioning, since I can tell you in that case honesty CAN make it worse. In this guy's case, however, he seems to have a problem and I'm with you in not recommending dishonesty in his case.

Hi!

Yes, you can get all the police certificates early, at least the local one. David had the letter from the Embassy when he went to get the national ones in Lima. But, I'm fairly sure that you can go without the letter to get the other 2. This is a fairly common thing there, I'm sure.

You have to wait to make the doctor appt; you've got to have the letter.

The RENIEC office was something that I hadn't anticipated until we started dealing with it. Ours is barely going to be ready in time for our interview. David went this week to deal with this and had to pay extra to have it expedited! So, yes, do this now too!

Gringita actually talked about the other 2 certs (Lima ones); that you'd need the letter from the Embassy to the get the national ones. It's in one of the links above.

Speaking of RENIEC... does anyone know if there are two different versions of the birth certificate: one national and one international? Now I'm worried that he may have gotten the wrong one!!!

Do you know if you can get the certificado antecedentes judiciales early, without the letter or form from the embassy? Seeing that a few of you have had to show up to the interview without this certificate, because there was not enough time to obtain it, I am wondering if my so can start getting that relatively soon by just going to the Aramburu office?

How long does it take to legalize the birth certificate at the RENIEC office?

Yes, you can get all the police certificates early, at least the local one. David had the letter from the Embassy when he went to get the national ones in Lima. But, I'm fairly sure that you can go without the letter to get the other 2. This is a fairly common thing there, I'm sure.

You have to wait to make the doctor appt; you've got to have the letter.

The RENIEC office was something that I hadn't anticipated until we started dealing with it. Ours is barely going to be ready in time for our interview. David went this week to deal with this and had to pay extra to have it expedited! So, yes, do this now too!
