Normally, NVC will hold on to the case for one year.  If one year has passed and no response or any type of correspondence was made by the beneficiary or petitioner, the case will be considered expired.

 

Your uncle or mother will have to call or email NVC.  Be sure to have the USCIS receipt number or NVC case number on-hand.

I submitted my I-130 packet on 11/25/2013. If I submit the DS-260 supporting documents with the same passport-style photographs of my wife that I submitted with the I-130 within the next week, will I have any problems? I' ll be very close to the 6-month limit and by the time someone actually reviews the documents, it may be longer than 6 months.

 

You don't have to send new passport-style photos to USCIS.  The ones you submitted is still acceptable even though you might get approval 6 months or more from date of filing.

 

The civil documents will be needed later on during the NVC stage, no need to mail it to USCIS.

ITIN is not a requirement for the visa.

Review of AOS and IV package can take anywhere from 20-30 business days.  It depends on the person handling your case.  Some get it done before the 20-business day mark while others take longer.

Hmmm, sounds to me like you're doing adjustment of status based on marriage since the beneficiary is currently residing in the US???   If so, why deal with NVC?

 

Anyway, if you're doing consular processing, then YES the beneficiary needs to obtain police clearances from every country he has lived in since reaching age 16.

Hi everyone, can somebody help me with this. Does NVC gives priority to relatives of citizens as compared to the spouse of LPR while scheduling the interview? Because my case got completed on 24th June, my priority date is current and I am just waiting for interview letter, people from my consulate having cc date of 30th June got the interview date but I have not heard anything yet. If anybody has some clue please update.

 

Immediate relatives of US citizens gets priority because they are not bound by the Visa Bulletin/visa quotas.  A visa number is always available for IR/CR categories.

 

Spouses of LPRs (F2A) after case completion will have to wait for their priority dates to be current in the Visa Bulletin in order to get an interview schedule.  The VB for F2A is at a stand still for months now since priority dates retrogressed to 01MAY2012.

The petitioner and joint sponsor must do the necessary corrections on the AOS forms.  Your wife must send the AOS package to you.

It seems to me that your case is already complete.  You can expect an interview letter some time in the last week of December OR first week of January.  Your interview will be in February 2014.

It's usually valid for 6 months. Best to look at your ontended embassy/consulate's website for their list of affiliated medical facilities. Call them up and they should know long an exam result is valid for. Take that into account, okay? Hope it helps.

We inquired from NVC through email re: process of expediting for military-related reasons. They gave us the info and said we need to send it to NVCInquiry@state.gov with the subject "ATTN: Supervisor Sue, NVC Case No *********"

 

It's been 11 days! :( We never received even an acceptance email. 

 

I called tonight (morning for NVC) and the person said I sent it to the wrong e-mail. It was supposed to be NVCExpedite (or nvcexpedite?) @state.gov. ARRRRGGGH.

 

I tried searching about this everywhere (Google, this forum, other forums)... Nothing shows up. Is this email address even true? :(

 

They gave us the wrong information when we first inquired re: expedite!

K-3 Spouse Visa Process & ProceduresWhat has happen to my interview
I had this idea that maybe it is my kids surname that affects the releasing of the visa.. My kids surname is different from mine as they uses their father's name although we are not legally married. In their birth certificate their father put the date and place of marriage even though no ceremonies happen. He did this for the kids to use his surname as before the civil code don’t allow to use the father’s name if the parents are not legally married. I bring the original birth certificates of the 2 kids with me should they want a proof, though the Consul did not ask for it and I am willing to explain why did this happen. I gave my CENOMAR that I get from the NSO to prove i was never married.


hi, i myself gone through K1 process and have kids(4 actually) which are K2 derivatives. all my kids used their father's surname, even have a date and place of marriage which didn't occur on their birth certificates. just a fictitious marriage for the purpose of registering the kids. during our interview the CO didn't even asked me about it nor didn't brought up anything about the kids. the kids were present during the interview. i supported my documents with a latest CENOMAR, but we did already had one included when my fiance filed the petition. the interview went fine and got approved right away. but that time we don't have that documents verification yet.

so i guess there's no connection with the kids why you still have the visa yet. did they asked you to pay DELBROS after the interview?

are you not going to bring the kids over here? sounds like a personal question, just curious smile.gif

I know there are some more detailed threads that aussiewench will probably offer, but to let you know the process at the NVC is essentially that they assign your petition a new case number and run a handful of security checks before forwarding it to the consulate/embassy of the beneficiary. Unless there are any serious hits returned by the security checks this is generally a very short stop (commonly no more than a couple weeks, though frequently only a few days). Should for some reason there be a name match on the security checks, the case can be put into Administrative Processing which can take a considerable length of time. However, you can likely expect that your petition will be finished at the NVC and on its way to the consulate/embassy soon. Good luck!

this is my understanding too... but to diffierentiate the security/name checks done...
on the service center level the petitioner is the one being checked (i.e. the IMBRA questionnaire)... while on the NVC level, it is the beneficiary being checked.

I'm sure the more experienced VJ'ers can help.

Background security checks are conducted on both the beneficiary and the petitioner at service center level. This has always happened even pre-IMBRA. Background/security checks can also be conducted on anyone connected to the petition....even a lawyer. IMBRA is just an added component.

Not a K-1 topic, sounds like a K-3 topic...

Also this is the norm, you have no choice.. NVC will close the I-129F and move on with I-130 for a CR-1 or IR-1 Spouse visa...

Forget the K-3, improved processing at USCIS and NVC have eliminated it.

USCIS WILL pull the I-130 from the queue and then tie the I-130 and I-129F together and approve on same date, then NVC WILL close the I-129F and proceed on with the CR-1.

Filing an I-129F will only slow the process down when they pull the I-130 out of the queue to combine the two petitions.

K-3 served only one function, it was derived at a time when I-130 was taking years to get approved, however now since I-130 is approved at same time as I-129F the function of K-3 (Entry to USA and WAITING for I-130 approval) no longer exists, so NVC kills the K-3 in favor of the superior CR-1 or IR-1 visa.

NVC WILL CANCEL the K-3 if they receive the two petitions from USCIS together.

If anticipating a K-4 for an accompanying step child and did not file an I-130 for the step child, you will have a problem when NVC kills the K-3, if this is the case, it would be best to file an I-130 for step child now with a cover letter explaining the parent's case along with a copy of parent's I-130 NOA1 receipt letter attached.
