My Fiancee has no records of any vaccinations. She just had chicken pox 2 weeks ago and all bumps are gone now. Her medical is this week and now we are a little stressed due to the vaccination issue. Which shots does she have to get before she gets her visa?

Anyone have any advise for me?

This is a vent post.. just so you know of a bad experience with Delbros today.
x x x I hope you don't experience this kind of inconvenience. I have a big headache now.

Up to the last moment, you are kept in suspense ano? Just like in the movies ~ adventure, comedy, thriller, horror, suspense talaga itong visa process. But in the end, the fairy tale comes true. Kanta nga ni Snowhite, “someday my prince (ehe my visa) will come, lalalalalala.

Seriously speaking, what's going on with Delbros nowadays? There's a lot of complaints lately. Maybe it's time to collate data to document the complaints and then we can write the embassy about it.

Well, the delivery guy managed to find my address after all. He delivered our visas at 9:00p.m. last night--even if their website says they only deliver up to 5:00p.m.. I did talk to the supervisor yesterday. And yup, I am so very tempted to write Mr. Delgado (Delbros CEO) and the embassy about this. A collective documentation of complaints would even be better.

Now you make me feel like singing... I'm leaving on a jetplane... :star:
Nah.. believe me it's more like poetry reading when i sing...

And so! Visas delivered: 28 March/6 days/Cainta, Rizal.

Thanks again and congratulations guys. Everyone who goes through this process deserves a big one... the visa process is certainly not for the weak of heart.

oh yes, i'm dancing now   ,

This is a vent post.. just so you know of a bad experience with Delbros today.

The Delbros website gave me updates on our visas (K1 and K2).
Interview last March 22.. embassy released visas and received at their distribution center on March 26.. then both website and text informed me that shipment out for delivery by 8:30 a.m. yesterday, March 27. I had to stay home since nobody else will be home to receive, but no delivery.

Then today, March 28 I get a text very early in the morning that they are re-attempting to deliver today and that if delivery failed, a delay of one week will ensue... I didn't even know there was an attempt to deliver yesterday! And I thought.. if they were indeed unable to locate my address yesterday, how on earth could I expect them to reach my address today.. when they didn't even try to contact me through my cell phone number I indicated on the delbros form!? Well, they were supposedly around the area yesterday but just couldn't find my address!? I thought that was the reason for gettign contact numbers from clients. Duh.

And so I called the delbros direct line...left my cell phone number again.. and got an apology from the girl who answered.. saying that the delivery guy forgot to get my number yesterday. que horror. And then what, if I didnt' call this morning the delivery guy still would not have my number! aaaahhh

Ok.. that done.. I got the cell phone number of the delivery guy.. I won't sit around and waste another precious day and I just had to know at least the approximate time he will be around my area so I could work my sked around that. So I tried dialling the guy's number.. heard ringing.. then the unmistakable sound that you hear when you know the phone has been turned off. So rude.

Thank you for reading my vent. I hope you don't experience this kind of inconvenience.
I have a big headache now.

Question for those of you that have had an annullment in the Philippines. When filling out your DS-156, did you check "Divorced" or "Single (never married)"? Thanks.

Hi Skeeter,

I checked Single (never married).

Will she be questioned upon entry at SLE why she came before her scheduled appointment? She still need to present her appointment letter right?

They won't ask why she's early. She just needs her appointment letter with her. Oh, and tell her not to glue her pictures onto her forms... I was given trouble for pasting mine...

Okay cool  She is scheduled to fly on 04/16 but we will try to reschedule it a week before so she can have it done soon.

Another question folks...about placing the picture on DS-156? Can we paste her 2 x 2 picture now on the Form DS-156 or wait until she gets to the USE? And which forms again need to be validated by the bank for the payment of $100? Thanks! :help:

Coco Puff

I may be wrong but I think they want the photos stapled, not pasted.

Hi guys,

They want the photos pasted on the DS-156.

The DS-157 form is validated by the bank when you pay the visa fee. It may cause some confusion, since in the Packet 4 received by your fiancee, it says the DS-156 is the one validated. This is a mistake by the Embassy. I believe Sherrif Uling explained this very well in his very comprehensive KI guide you can find on his signature block. Check it out

Sending good thoughts and wishes to B&N who is right there on the stage now.. and to Judy of AlanluvsJudy tomorrow.

A confident smile and faith in your relationship will pull you through the gauntlet just fine
Give us the good news when you come back from the embassy!

Hi! guys,

I planned to have my early medical this 10-11th of April. I dont have my packet 4 yet. the person my fiance talked to said it was sent already last 14th of this month but i dont have it yet.

Im goin to manila on the 5th of April to see my fiance and would be staying there after my medical exam is done.

In case i wont be getting my packet 4 yet next week, can i still go and have my medical exam without the appointment letter? if yes, what documents should i bring in place of the appointment letter? i have my ID pictures and passport already. only the appointment letter is my problem.

thanks in advance for your promt answers.

Im May batch too, and like you im waiting for the packet 4 to arrived. I want to have an early medical appointment just like you. But then Im also confused it its ok if u dont have that pre-appointment letter but as i see, we need it in order to have our medical, its a requirement together with pictures and passport. When i called St Lukes, she told me as long as u have that appointment letter, need to be photocopied u can have your medical early of your schedule, for it is first come, first serve basis. Hope we get this letter anytime soon. I really want to have my medical too asap so i'll be at ease, lol!

Hi joemaria,

If you have the medical exam and interview sked already and want to take the med exam ahead of schedule, but don't have Packet 4 (with the required appointment letter) yet ... you can call St. Luke's and request them to get your Packet 4 from the embassy, and inform them of the date you want to pick it up. They do that. One day before your requested date, better to call St. Luke's to confirm if your Packet is there.

If they confirm your packet is there, you can just then tell the guard that you're there to pick up your Packet and they will let you in. And you can actually start on your medical the same day.

Good luck!

My baby says she has no records of her vaccinations. Does this mean she will have to have them at her medical?

Hi Dave,

Fleur's old vaccination records (as in her "baby book") would help St Luke's in determining which shots to give her, but this is not really required. They have a reference chart to determine which vaccines are appropriate for her age. She will also be interviewed by a panel physician, i.e. asked to show marks if she says she had chicken pox already. (I am sure I had chicken pox just 2 years ago. but since I wasn't able to show a mark, I was given Varicella anyway. I was told this is an Embassy directive: No mark= varicella shot.)

She will also be asked if she wants the shots taken here.. or in the States. We are given this choice since vaccines aren't really a requirement for entry on a K1 Visa. However, since the shots are already included in the medical exam fee ($95), it is practical to get them here.. save you a few dollars.

After she's done with the whole med exam and vaccinations, Fleur will be given the vaccination record of her shots given at St. Luke's, and instructions on the xray negative (that she will need to bring both to the US). The vaccination record will state which vaccines she had.. which ones need a second shot.. and that she will have to get the TD (tetanus-diptheria) vaccine in the States since it's not available here.

Hope this helps.

oh. and I have to add... heed the Sheriff's post about the new regulation regarding cellphones!
There was a girl who also had her appointment at the embassy today. She had her cellphone with her, and sure enough, the guards called her attention even before she could enter the building. She said she has no one with her and thus nobody to hold her cellphone while inside the embassy premises. She asked the guard if he could hold her phone for her (for some cash), the guard said, "are you insulting me?" She was directed to vacate the embassy premises immediately and come back without the cellphone. I didn't see her come back though. Well, I was a little pissed off when she cut me on the queue to enter the embassy (small thing really), but I truly felt sorry for her.

I also saw a guy who had to go BPI in TM Kalaw. He hasn't paid the visa fee yet.

VJ is truly a big help. Can't give thanks enough.

Congratulations to Sheriff & Mrs. Uling on the successful AOS interview!

Hey PW, so nice to see you're back! and i'm sure you're re-invigorated and ready for another bout with the consul soon in April. this time to get the visa! Happy reunion soon.. yay for PW! Thanks to you too and to Roy for the good wishes. And Roy, I'm so sorry to hear about what happened to your Dad, I hope he recovers soon. My fiance's dad is not in a very good condition himself, and for us to visit him in Chapala, Mexico seems not at all feasible in the near future. That makes it all the more difficult.

Congratulations too to Wes and Shiela! Here's to a very short AR and visa in hand soon. I also advocate early medical. To those in line, please please take this advice, you couldn't go wrong. Except maybe for those coming from the provinces which would mean an extra trip to Manila ... still one can't discount the benefit of not stressing over time issues in case something comes up in the xray or other tests, and breathing easy with time enough to concentrate on the interview.

Well. today has been a very exciting day to say the least :)
Aside from the questions asked by the consul to clarify/verify what's on the documents submitted... the consul asked me if anybody ever told me that I look like Martha Stewart! :o and then asked if i can cook! double :o :o !!
Nice chit chat. Even put my paranoid, nervous wreck of a daughter at ease and had her smiling throughout the interview! His last words to me (without my asking) were, "I am satisfied with your documents, and I'm approving your visa application... I wish you luck and happiness." That felt good.

Now if only they will release the visa soon, huh?
Next! .... nervously check delbros website ........

Happy but still with bated breathe,

For those of you who experienced or know for sure, does it matter if a girl is on her period during the time of her medical?

According to St Lukes it matters. Go early.

What if it happens you still have it during the scheduled appointment or the period arrive unexpectedly during the time you are there at St. Lukes? What are the consequences? My fiancee is worried so as I. Need opinion from experts :)

Hi cocopuff,

With your interview on April 25th, your fiancee's medical exam should be scheduled around April 18th, right?. She can go earlier than that.... 2 weeks to a month before April 18th should be ok. She can just time it so that the St. Luke's visit doesn't fall during her monthly cycle.

Good luck!

Thanks Mike and everyone for the encouragement.

Yea, I totally beileve everything you said. But its hard not to want to do it myself. Kinda a "God helps those who help themselves" kinda thing.

I tend to over indulge and then....worry... then try to fix things. And I felt I had done everything required. So I just sort of ran out of gas when this happened.

Now I'm studying....again trying to learn exactly what being a public charge is and exactly how long it will take for Lorna to become a US citizen so I can give facts to whomever I ask to be co-sponsor.

But its hard right now cuz I'm so drained.... Gods in control and I know His will will be done.
I feel bad for Lorna just hanging there in Limbo....waiting for her new life to begin.... that hurts.
Take care my friends,
Mike

This is so disheartening. I can only imagine the hurt you're going through now, but difficult as it is you have to be strong and be good to yourself and Lorna. I'm with Kuya Alan (alanluvsjudy).... this is a hurdle.. not a wall. You can make it happen, Mike.

And I have questions for those who got an annulment and was approved. Did you use your maiden name? or your former married name? Did you get your NBI clearance in your maiden name? married name?

I am using my maiden name now, and have my NBI clearance with my maiden name. However, since I used my former married name for 17 years of my adult life, logic tells me the embassy "might" ask for a clearance with the former married name. How did you do it? Can I even get 2 NBI clearances?

Thanks again guys.

Gen

Hi Gen,

Those are questions worth asking the embassy by calling them up and they should be able to give you a definitive answer. I would also recommend going to the NBI offices with the same question. If it is like it is in the states, a person's file is kept together with notations of any aliases or other names used - but those name variations would be indicated on the file itself.

As far as using your maiden name - here in the states, a woman has to actually go through and legally change her last name back to her maiden name.

Sorry if I didn't really answer your questions but hopefully you can get some reliable answers from the embassy and NBI. :star:

Thanks for taking the time to reply, Steven! I am definitely calling the embassy and NBI tomorrow morning, Monday.

My reverting back to my maiden name goes with the legality of the annulment. My old passport was in my former married name, but I was able to get a new one recently in my maiden name without any problem... just showed my annulment papers issued by the court, and the old passport in which they punched holes in (cancelled). And for Gary (Starprog). even if your case is the other way around (change from maiden name to married name), just so you know... I was also asked to present the CFO certificate.

Thanks again... and a happy & safe trip for Jinky and Job!

By the way, for those who are granted the visa, you may file for refund of Pag-Ibig contributions and just show your visa to support your claim, plus some forms they need yu to fill up.....around one week processing...wow, some additional source of hidden wealth which I learned from my friends at Pag-Ibig.

Hope to have been of help.

Maria

Hi Maria. Thanks for the tip! Got more than 15 years worth of PAGIBIG contributions to refund.. yay! When I inquired, I was given the impression that I would have to wait till after adjustment of status to qualify for a refund since I'm on K1 ...and what they want to see is a "permanent" or immigrant visa. Were you able to file for a refund? Please tell me you did, :D.

And wow you guys look good in the fotos! Thanks Luzy and Steven for posting. Still kicking myself for not crashing the party :P

Congratulations and bon voyage all around... lots of happy happy VJ couples reuniting. Here's hoping and praying that all future interviewees will be just as fortunate.

And yay for PW! Enjoy your tryst with your therapist ;) Anybody take on the special title of "List Caretaker" of the Manila Embassy Interview thread yet? I would gladly take on the honorable task if there are no violent reactions :P ... but then of course I could only take on the list-updating role and not the part of "walking K1 encyclopedia" that PW is!

And on to my long post for today :) .....

Daughter and I were at St Luke's last Thursday and yesterday, Friday. All went good the first day... got my shots and vaccine record, and they got my passport the second day. However, they won't give my 19-year old the vaccines (she was to have MMR and HepaB), because of hives. She has been having these rashes for a year now... consulted with a private doctor, was put on a restricted diet (no processed food no mangoes no sea food), used unscented soap, shampoo and lotion, maintained dust free environment (at least as carefully as we can), and still we're not sure what triggers the hives. Sometimes the rashes are there.. sometimes not. Doc said "maybe" its the weather. Anyways, the darn rashes chose to show up yesterday, and so they won't give her the shots. All who underwent vaccination were given a piece of paper where the side effects of the immunization are listed i.e. rashes, difficulty of breathing, etc. And the doc and nurses at st.luke's were afraid my daughter would experience these bad side effects. So, will have to get her prescription anti-histamine and make sure she doesn't have the rashes when we come back for shots next week.

All the while I was thanking VJ for the heads up on taking for the medical earlier than scheduled. Thank you thank you! They did ask when our interview is.

And I have questions for those who got an annulment and was approved. Did you use your maiden name? or your former married name? Did you get your NBI clearance in your maiden name? married name?

K-3 Spouse Visa Process & Procedures130 approved...what happened to the 129???
QUOTE (sydkym @ May 4 2008, 03:14 PM) <{POST_SNAPBACK}>
Looking at the timelines of other K-3 petitioners, almost everyone has their 130 and 129 approved together. Why have we only heard about the 130? Don´t we need the 129 to continue with the K-3 process? It´s the whole point of doing a K-3 visa, to make the process go faster?

Others who have had their 130 approved first, what happened next? Did your 129 come through soon after, or not? I´m afraid moving on without the 129 will only slow things down, right?

Hi, our I-130 was approved last May 7, 2008 and received the hard copy NOA2 on the 12th of May, while the I-129F is still pending (???). According to the Lawyer of my husband, just wait for the I-129F to be approved sometimes on June 2008. Please keep me posted of the developments of your case. Thanks!

Based on my observations here if not all, almost all K3 petition got approved the same day/date. Anyone outthere can interpret whats goin on with this? Vermont was the one handling our Case.

Hi Hbunch,

First of all congratulations!!

I disagree that almost all K-3 petitions get approved the same day/date. This may be true (in the majority of the cases but not always) for California, if we can base ourselves on the VJ timelines.
But you are at Vermont. And look at the timelines: while in 2007, simultaneous approvals of both I129F and I130 can be found for VSC, it seems that ever since January 2008, they have stopped doing this.
In the VJ timelines, you'll find two I-129F approvals for K-3 (in one case this approval closely follows the I-130 approval; in the other case the I-129F was approved months after the I-130 was approved). I do not know if these numbers can really tell us something about VSC and K-3.

Frankly I am clueless about what'll happen with the I-129F's for K-3 visas in future, at VSC. I truly hope we will start seeing some more of these approvals again soon.

On the plusside, quite a few Feb-march K-3 filers have gotten multiple touches on their I-129F in April. If this petition really is dead in the water, then why waste time doing something with it?

Also on the plusside, check out the very recent threads about NVC-processing. The immigrant visa path seems to be going much faster in latest weeks, at least at NVC level (look for Lotofpatience's excellent posts outlining how you can try to get through it as fast as possible).

This is your call. Do you want to wait for approval of I-129F anyway (at this time it's unknown when/if that will come) or/and do you want to proceed on the visa immigrant path?

Good luck

Hi Catt,

Thanks much for giving all these informations as you stated above. However my hubby will call Vermont or NVC tomorrow 14th of May to verify the pending status of our I-129F. Our Lawyer did advised us to wait for another week or two for the I-129F. In case there is no action/s, i guess we will be opted to do the CR1 path. This whole process is a nerve wracking and the waiting period is totally INSANE!!! (#######!!!)

QUOTE( @ May 13 2008, 07:44 AM) FROM: 000

Vermont has had a pattern of sending your I 130 to NVC now based on the reason that they were both approved at the same time. It is something that no one really understands right now but you can still go the K3 visa route, it only takes a litle more effort and contact with NVC. Most likely you will be getting your NOA2 for your I 129f in the next few days but again it seems as if Vermont has decided to make your I 129f of no use now. You really should call them (USCIS) and make sure that they will forward your I 129f to NVC so that you can continue the K3 route if that is what you want, but the CR1 is the better way to go. It cost less money and gets you away from USCIS for another 2 years.

Hi. thank you for this advised. Today my husband called the National Visa Center in Vermont and the lady there told him that they did a background investigation on the petitioner and the process was given ADVANCED PRIORITY NOW because of my husband's military and Law enforcement background, he was once work for US Government. FBI sent the USCIS his background investigation already and everything is okay. We are now waiting and anticipating for the approval of our I-129F, the lady from Vermont made sure to him that anytime soon we will receive it within this month. It is fair enough that USCIS/NVC was very keen on tracking and investigating every petitions and different types of case/s they received for the safety and security purposes. I guess I-129F still significant for K3 to get approval of both petitions: I-130 & I-129F.

K-3 Spouse Visa Process & ProceduresCan bankruptcy effect processing of K3 visa for my wife to bring her here?
QUOTE (John Mickevich @ Apr 20 2008, 10:50 PM) <{POST_SNAPBACK}>
huh.gif I have horrible debt. I live in California USA. I have a wonderful wife in the Philippines. I am about to file K3 visa however, Today I was served a summons that I am being sued by Citibank for a past debt. Last week i was served summons from another USA Bank. This is the second time and the amount could reach over 80,000$ in which i can not pay off. Either between my wife and I we pay this debt until we are 70 years old or declare bankruptcy. I have only a few weeks to reply.

Really i have two questions.

1. Can Bankruptcy interfere with the K3 and or keep my wife from coming to USA

2. If I do not have a bank account (they will take money out of my account leaving me in the red making me owe more) can that interfere with AF of support? Can i still bring my wife here with NO bank account?

I NEED HELP! yes.gif

If anyone can answer these 2 questions for me that would be a great help..

thanks,

Filing bankcruptcy now in USA is very common since we all know that the country is under recession(???). Anyhow, it will not affect your K3 petition just make sure you can produce the affidavit of support beyond the poverty line. Goodluck!

Hello fellow VJ'ers, After more than 13 months of consistent chatting and huge phone bills due to very long conversations (landlines & Smart Postpaid), buying PLDT Budget Cards / phone cards from U.S., sending emails/ cards/ gifts/ Western Union receipts and so on I established a genuine relationship with this wonderful man who is now my husband. When his work & time finally allowed him to come and visit me here in Philippines & stayed 1 month, he asked me to marry him over the phone(actually many times LOL!) and we got married during the first visit, simply because we both fell in love with each other before meeting in person. Soon we will be having our interview, so my question is this: Will this affect our k3 visa interview in a negative way because we got married during his first visit? Or do I need to ask my Husband to be with me during the Interview just to prove to the consul that our marriage is indeed genuine?

Thank u in advance, cause I really need ur opinions on this matter!

hbunch

Hi hbunch,

Im done with that.
we were in the same situation, first visit and got married. Actually i was being asked by the consul who have interviewed me about why i married him the first visit and when we started our communication. I have had a very strict consul, all they care was the marriage is genuine and not fake. And not the times of visits.

Shape

Thanks Shape, My husband will come to Philippines again. He wanted to be with us during the interview just to prove the marriage and our relationship indeed genuine. However, now that we're actually in the same situation (surprised!) i would love to know about ur detailed interview experience, in case the presence of my husband is no longer necessary so we can save money and time from his job too. By the way, when it comes to evidence i would say that we have a very strong documentations to support our relationship. Thanks girl. Salute to the FILIPINAS!!! (LOL) Take care.

Hbunch,

what i've posted in my topic about my interview experience were already detailed. Depends on which consul you will be interviewed. I brought almost 7 kilos proofs and evidences of our relationship and my relationship with my husband's families (parents, grandma, aunts, uncles, cousins, brothers, friends), but the pre-screener nor the consul never asked me about to show any of them, only the pictures that they have looked at. (picture of me and my husband with my family and his family) and the pre-screener said thats enough already.

Depends on cases. But it's better to be prepared in case they ask you some particular proofs or evidences.

Hi there Shape,

First, CONGRATULATIONS!!! YOU PASSED IT WITH FLYING COLORS. Yes i did read your interview experience already, u made me laughed actually coz im trying to imagine the 7 kls weight u've been carrying since 6:30 am until the time when ur done with the interview thing. I guess the pre-screener and the consul were satisfied already by the documents you presented to them. Besides, given the fact that your husband is a military it gives a BIG PLUS in your interview too, i noticed fellow AMERICANS have high respect and salute the American soldiers who devoted their lives to protect & fight for the country. Thanks for the advised, im now gathering all the data's of my supporting documents. TC!

Depends on many circumstances including but not limited to your ability to produce evidence of a bonafide relationship post marriage.

Yes, totality of circumstances. You don't mention whether there have been subsequent visits, frequency, how many etc. Marriage on the first visit is not a disqualifier.

Thank u so much for your time. There is no subsequent visit yet after the marriage though tentatively he is planning to come back on July 2008. We got lots of evidence about our relationship/marriage, as i've mentioned in my post, we have hundreds of pictures from diff. places Luzon & Visayas. We're married with the Traditional Catholic Church Wedding at my province with at least 200 guests invited. What do u think, pushbrk? thanks again.

I think if he visits again and you get the opportunity to show the evidence, your chances are excellent. In any event, the fact you married on the first visit is of little consequence.

Hello pushbrk,

I have a question to ask you. Our I-130 was approved last May 7, 2008 and my husband received the hardcopy NOA2 on the 12th May. Based on my observations of other K3 process, they usually got the same day the approval notice of their filed I-130 & I-129F. We are wondering why we didnt receive our I-129F since our I-130 was approved already. It seems that ur one of the few who can give me a concrete answer about my queries. Thank you.

I would expect both petitions were approved. Does the NOA2 you received indicate the petition is being sent to NVC? Vermont is being strange on K3's lately, so it's hard to know what has happened or will happen.

Today my husband called the National Visa Center in Vermont and the lady there told him that they did a background investigation on the petitioner and the process was given ADVANCED PRIORITY NOW because of my husband's military and Law enforcement background. He was once work for US Government. FBI sent the USCIS his background investigation already and everything is okay. We are now waiting and anticipating for the approval of our I-129F, the lady from Vermont made sure to him that anytime soon we will receive it within this month. It is fair enough that USCIS/NVC was very keen on tracking and investigating every petitions and different types of case/s they received for security and safety purposes. I guess I-129F still significant for K3 to get approval of both petitions: I-130 & I-129F. FYI-thanks

Maybe you should work on your evidences of bonafide relationship a little more carefully... get affidavits from your friends and family, maybe get a joint bank account or some sort of financial bond..

Please be advised, as of April 4, 2008 our office has revised our guidelines for communication between the National Visa Center and the public. We are now required to verify case information each time we receive an inquiry.

The reply I received from them was this:

QUOTE
ood day,

Your inquiry has been received at the National Visa Center (NVC).

This petition is now eligible for further processing. The petitioner, beneficiary, and/or attorney of record will receive further instructions regarding the processing of this petition.

Regards,

ksb

And then they e-mailed me again with the results of the inquiry:

QUOTE
Good day,

Your inquiry has been received at the National Visa Center (NVC). The NVC has completed its processing of the visa petition you mentioned in your letter and has forwarded the petition to the assigned US Embassy/Consulate General for further processing.

Any further inquiries should be directed to the assigned US Embassy or Consulate General.

So we're on our way to the conslate now, woo!
NVC was so fast, and they reply when you ask, I love them ...

Well, we decided to send the I-129F before the increase....so we ended up paying for both the I-130 and I-129F. And our I-130 was approved before the I-129F, so we were lucky that our I-129F was not cancelled. Huummm....maybe it was because we payed the fee for the I-129F....well, who knows, USCIS never follows the same procedures with everyone.

Best of luck.

You're right YGandMAT. I remember your case, You guys were just about a week ahead of us and paid for the I-129.

I was late in filing for my I-129 and ended up not having to pay for my I129.

In our cases, the 129 fee or none fee determined our K3 and CR1 cases respectively.

Our case was in Vermont too. I-130 was approved last May 7, 2008, I-129F still pending (we received notice fee has been waived). We are still waiting for the I-129F to be approved. What is the best remedy/option for this now? im totally confused with this situation. Is vermont will still pursue our I-129F? Thanks

This is really unacceptable. What more can I do? other than wait.
My lawyer has no answers. Each time my congressman calls, they say it is with an officer who still needs to make a decision.(which i guess is good)
How f$%#ing long does it take to make a decision, especially for those couples waiting this long.

I'm saddened even more when I'm seeing all of these VJ members being approved when they filed LONG after me.
I guess I should be happy for you guys, which I am, but it hurts. It really hurts.

K-3 Spouse Visa Process & ProceduresATTENTION K3 FILERS VERMONT / CSC
Our I-130 was approved last May 07, 2008, while I-129F is still pending. I read lots of post in this forum why only the I130 was approved and not the I-129F. My husband called USCIS/NVC/VSC to clarify the status of our I-129F. Luckily we got the same answers that its on process and not cancelled at all. Aside from that, i kept on surfing and wanted to know the exact reason why some of our fellow VJ'ers didnt get any developments with their K3 I-129F after I-130 was approved. THE ANSWER IS: its a matter of citizenship between A NATURAL BORN USA CITIZEN and US RESIDENTS.

The USCIS has implemented change of process because most K3-3 beneficiaries apply for lawful permanent residence by filing Form-148, Applicaton to REGISTER PERMANENT RESIDENCE or ADJUST STATUS, following their arrival in the United States, as opposed to using their approved Form I-130 petition to apply for an immigrant visa abroad. By retaining the approved Form I-130 petition at the NRC, USCIS will reduce unnecessary file movement and eliminate applicable costs and fees associated with immigrant visa processing.

If the beneficiary should later elect to consular process instead of applying for adjustment of status, Form I-1824, Application for Action on Approved Application or Petition, must be filed with the USCIS office that approved Form I-130. Upon favorable action on Form I-1824, USCIS will send Form I-130 to the NVC.

This Internal transfer of work does not alter the existing filing instructions for any of the forms. Accordingly, USCIS customers who file Forms I-130, I-129F (K3-spouses of U.S. citizens only), and I-485 should continue to follow the current filing instructions on these forms. Customers affected by this transfer will receive a receipt notice from the NBC notifying them of the location to which their Form I-129F has been transferred.

So, to those US NATURAL BORN CITIZEN spouses still waiting for the pending I-129F just wait and it will come soon. While to US RESIDENT, u may be opted to route CR1 or IR1. For more detailed information click this link:

Hi HBUNCH -- I understand your confusion because I was thinking it over quite a bit - but then, once I learned about the online payment system for the NVC, I figured it would be as fast as the K3 process and my wife would have a greencard when she got here! (Considering I have no idea when my I-129F will be approved, it may potentially be a shorter process!) ...

The latest update is that my AOS fee status changed to PAID on the payment website today so I printed out the barcode cover letter. I also called NVC and they had it updated in their system that it's PAID!

I mailed off my AOS packet this evening via USPS Priority Mail!

Feel free to ask me any other questions, although I've learned most of what I know about CR-1's new "fast" process from lotofpatience's thread on the topic!

Also have a look at my timeline to see if that helps clarify things ...
