Removing Conditions on Residency General DiscussionLifting of Conditions in Residency - do I need AOS?
Hello!

I am about to apply for my permanent residency / request for the conditions of residency to be lifted before my 2nd anniversary on Oct 7, 2012. I am checking at the USCIS website and I found out that I only need to fill up one form - the I-751 and attach all supporting documents within the first 90 days before 2nd anniversary. I thought the whole time I need to present an AOS and show documents for income requirement and stuff like that. I searched the whole VISA JOURNEY website and other immigration forums but I did not find anything about showing AOS. I just want to ask here and confirm with those who have gone through this process - Can you verify for me that I do not need to submit an AOS form and provide documentation of income requirements?

I finally got my approval for ROC last April 11 and I got my new 10 year IR1 GC today in the mail, wootwoot! my 2 year condition ended Oct 10, 2012 and I filed last July 10, 2012 at the VT center. It may have taken more than 8 months but I am just glad that I was not issued an RFE, it went by real smoothly.

Thank you so much to all you great folks here at Visa Journey who helped help countercheck all the documents that I submitted last July 2012 and for all the guidance and great information on how to go through this process with ease.

All the best for those who are filing and those waiting for their approval as well! :)

I got my 10 year IR 1 GC yesterday in the mail April 18, 2013. I filed last July 10, 2013! :)

Thanks to visajourney for all the great information, the process is so smooth and easy (although it took a long time to get the approval).

By the way, my timeline is updated but I am not sure how to place my name on the list below. Can someone help me please? :)

Currently, we are processing our petition and waiting for the NOA2. I put the US General Consulate in Abu Dhabi UAE to process my visa application once the petition is approved as I am presently residing and working here. My concern is that when I get the approval of my visa, I want to go home to the Philippines to see my family and will start my journey from there going to the USA (i.e. Philippines to USA). Can I do that or do I have to return to UAE and will start my journey?

Another thing, can I start my vaccination even if there's no assurance when our petition gets approve? Will physicians entertain mw even without any doctor's appointment? I'm asking this because I've read that vaccinations are needed for AOS processing. Is this correct?

I highly appreciate your feedback/s if there's such rule like that.

Hi! This is also my dilemma right now. Going home to PI and then travel from PI to US once visa is approved. Knowing PI airport regulations/staffs being so strict, im afraid there will be problem going out of PI. As to the vaccinations, my family can't find any of my vaccination history so im planning to have a blood titer test here before the approval or the medical just to check all the immunizations i received. In that case, i can present a history or proof to the medical examiner that i received or that i am immune to the vaccines required.

I agree, SLEC should do something about the way they get things done. They should also upgrade to a more spacious building.

Considering the payment they charge for each applicant, they should be able to provide above average service.

I was so stressed out when me, my husband and our 3 kids went there last year. They have no numerical queing system so you've got to listen very carefully if you don't want to miss your turn.

I was the one who spoke with the doctor for our 2 kids, while my husband and our eldest son went to another room for the physical exam.

On the other hand, the staff and doctors were nice to my kids.

As far as I know, it is the Embassy's responsibility to print out the visa, attach it to the passport and mail it to the beneficiary.

Okay. I had interview this morning. Everything went good. They kept my fiance' visa. The lady lady was nice, but gave us a paper stayting that we are in mandatory AP. I would think its an approval.


Not yet. After AP, they will determine if you're approved or not.

My mom is the one applying for visa. I think its k-2? Its a spouse,me and 2 minors. And I was given a form for the military that when I arrived in the US, I should immediately email it to the post office.

PNR Management is an accounting firm which manage the accounts on Sela Health Care which the attorney applied for a working certificate for my mom.

My mom didn't applied for a working visa on PNR Management, my mom applied for a working visa named Sela Health Care which the one distributing the salaries is PNR Management.


You know who PNR Management is. Why didn't your mom explain this to the consul?

There's no fee to pay at the embassy.

 

After your wife receives her visa and the visa packet, you should pay the new immigrant fee of $165 BEFORE she flies to the US.  Instructions on how to pay will be included in the visa packet.

So,  from what i read elsewhere this has happened to other people.  The process is something like this...

 

1. The first application is made,  Your fiancee can upfront provide this info, if there was really a 1st K1 filed on her behalf.

2. The couple breaks up,  the fiancee does not turn up for the interview  This one too.

3. The petitioner does not withdraw the application.  

4. Time passes,

5. The 2nd petitioner applies for the original beneficiary,  

6.  The application is approved by USCIS,  sent to the embassy

7.  The Embassy denies the application stating 221(g)+Other "Multiple petitions",  Once you have the answer to #1, you can address this.

8.  The embassy returns the application to the USCIS district director that approved the most recent petition

9.  The original petition is reevaluated and denied

10. The new petition is approved and sent back to the embassy.

You are well aware of our red flags . Wouldn't providing such evidence be beneficial in our case ? To bolster the bona fied relationship ? I understand it's best not to say anything unless asked . I get that , but I do not want to sit there and take a possible denial without the chance to show more . If we can tell by the way the CO acts and says things , perhaps then I can just submit the extra evidence . I just want to know we will have that chance to provide such evidence before a denial is issued .

 

Red flags or not, my advice is the same.  You can bring whatever and how much evidence you see fit.  If you want a smooth interview go with the consul's flow.  Don't jump ahead coz you don't want to piss the consul off.  Acting like a guilty criminal (when you're not) is going to raise unnecessary suspicions to you and your fiancee.  Just keep a cool and level head.

Are you thinking NBI? That's not true of the CENOMAR, my fiancée received hers the same day. She's never filed for one before. She had to return three days after requesting her NBI clearance.


Of course, I'm talking about CENOMAR, dude. Mine took a few days. At least 2 days. It has been a while. I tried getting mine in Macapagal Blvd. perhaps getting it from the main office is quicker.

that's what we are planning to do too, to call back after 5 days, so on monday or tuesday we will try to attempt to schedule an interview for me, and geez! our last names also starts with S so lets hope that they are working on a FIFO basis and not in alphabetical order smile.gif
