Hello,

When the consulate says that we need to provide police certificates obtained from all localities that we have resided in for 6 months or more since the age of 16, does this mean I need to provide a certificate from every town I've lived in? I've always lived in Ontario, but I have moved from one town to another. I'm not sure how literal to take this.

Any help anyone can provide is greatly appreciated.

Hi, i have a couple questions that i hope my VJ family can help me with ..... ok, my cosponsor (My brother)makes about $36,000 a year , which is more than the 125% needed..... he works for a company and isn't self employed......Does he need to list assets and give W2s and tax returns for 3 years if he makes that amount??......he is real nervous about sending his financial info and his SSN in the mail(afraid it will fall into the wrong hands before it reaches it final destination). you know ,lost in the mail....... I already have his letter of employment from him on a company letter head.... any input will be appreciated ......I think i already know the answer but, i want to double check and not have any surprises on our interview day ...you know "Better safe than sorry"

My fiance had his interview on October 30th. After the interview they gave him a letter stating the case is temporarily refused for further administrative processing. There is a minimum of 6 weeks wait and no maximum wait time. His passport was returned to him.

Has anyone else had this happen? We are wondering if this is the common letter that most people get. Also wondering about how long it may take from now until approval and what is the next step for us? Is there any way to speed the process up?

If anyone has advise on this we would greatly appreciate your help.

My fiance's interview was November 31. His blue letter said to wait between 6 weeks and forever. We have not heard anything yet other than it is still pending for administrative processing. We email them alot to check on it and I have contacted my representative in Washington DC to see if they can help, but no luck so far. My fiance is a young man so the check is taking longer. Oh, I have heard that if you are approved they keep the passport at the interview. If they give it back to you no matter what they tell you you are not approved. It seems that they tell everyone that they will get a call in about 6 weeks asking for the passport, but it doesn't mean anything. Keep us updated. Hope your process goes faster than ours is.

Does anyone know what the time frame is to get an interview in London once you've received your NOA2? The only information that I have seen on their website says nonimmigrant visa interviews are being scheduled into October. I'm just wondering if that timeframe is the same for the I-130 immigrant visa processing.

That is a rule at some of the other US Embassy's already. You may want to check the link below for guidlelines or give them a call before your interview date to verify.

The night of this post I emailed my husband and told him that I had tried to call the NVC but was having trouble getting through. The man that he is and knowing me...he knew that I would not give up trying. When he got up the next morning he checked here for my post and knew about his interview before we even spoke that morning. star_smile.gif By the time he phoned to wake me he already had his medical booked and train booked. kicking.gif We are so excited! Hello All,

I just got off the phone with another really nice rep at the NVC. She told me that our letters where done today, the case should leave for the embassy tomorrow, and my husbands interview date is Oct. 22nd. London is moving right along!!

I kept telling myself to wait until tomorrow to call because that would be a week from the approval & I'm glad that I didn't!! I also verified that they had my husbands new address since he moved about 6 weeks ago. The update was sent via email just as instructed. They still had the old address on file. Since I called tonight and they just did the letters today she took the new address to update the the letter. If you've sent in an address change...lesson learned here...call them and verify that they have it.

I AM SO EXCITED!! I want to call my husband so bad but it is 2:15am there. I'll just have to hold it in until he calls to wake me in the morning.

You may want to call the NVC for direction on this. Refer to your fast approaching interview date. They should be able to confirm the mailing address for you and resend or fax the package if needed.

We had a change of address during the process, followed the guidelines to update it with them and it still didn't get updated.

You can call the same number that you phoned to make your appoinment. From what I understand they are really good at getting the information sent to the embassy. They told my husband that no news is good news. They said that they would call if they needed to see him again/had concerns.

Hi Man! I was kinda in the same situation as you are now. Heres what I did. I had an appointment in London embassy on the 12th of August! unfortunalty i didnt have the Affedevit of support! yet, so i wrote a letter to the embassy and said that I lost some relevant documents to the case, and that my fiancee is aware of that and working hard to collect all the paper and asked for an appointment in 4 weeks.

they wrote back to me 3 days letter saying that they have given me another apointment as requested! My soon to be father in law, mailed the affedevit of support straight to the embassy as mentioned in the packet 3. bcoz he does not want me to see his personal details.

My advice, just write to them again, and explain the situation to them IN DETAIL and ask for another appointment. and there should be no problem. and by the way my appointment is next week in london. wish me luck

Yes, certain past acts serve as a permanent bar for an immigrant visa (green card), included in these are (a)any controlled substance offense with some very limited exceptions (notably a single possession of less than 30 grams of marijuana), (b) just about any false claim to US citizenship.

Good luck to you and I admire your persistance but I really don't think it is going to happen.

Ditto checking with immigrate2us they deal with this a lot more than we do here. My opinion would be that she would not be granted a visitor visa given her illegal entry and overstay previously add to that being married to a US citizen.
As to obtaining a waiver for the K-3 it would not be accepted any more than a waiver for the CR-1. Although the K-3 is a non-immigrant visa it is issued for immigration purposes, sort of the same as the K-1 is non-immigrant but with the intent to immigrate.

Best bet is to consult with a good, experienced attorney but I would prepare, given your circumstances, for her to not be granted any visa.

You may or may not be able to adjust status for him from inside the US depending on how he arrived here.

K-3/Cr-1 visa's are for spouses who currently live overseas. Same for the waiver. So are you planning on him to return to the UK? Depending on how long he has been in the US illegally he will incur a ban as soon as he leaves thus the need for a waiver.
As to his prior marriages, without knowing all the details, Yes it will create a problem as it will look in USCIS's eyes that he is just trying to obtain a green card.

Personal Opinion
I would be very, very careful about this one, you may have the most wonderful, trusting relationship in the world and maybe I am wrong but his history of two prior US wives and staying illegally would make me question his motives. But this is between you and him.

Yes but since the marriage is not recognized by the US because it was never consummated the only option would be to file for a K-1, which would require an in person meeting, or to consummate the marriage which would require an in person meeting. With the K-1 there is a very slim chance of obtaining a hardship waiver. I can think of two cases in the past several years where this has been approved.

You will need to file for the CR1 visa. See the guides at the top.
He cannot just fly here and stay. If you follow the advise you mention in your post, have him fly here, meet him at customs and say you are his wife, plan on him being on the next plane back to England.
To come to the US on a non-immigrant visa or the VWP with the intent to stay is illegal and could, depending on the questions asked, lead to a charge of misrepresentation which carries a lifetime ban.

Step by step.

You need to go live in Mexico for now. You cannot come to the US on a tourist visa or border crossing pass with the intent to remain or obtain a green card. You also cannot lie on any of the paperwork, doing so could lead to a life-time ban from ever coming to the US for misrepresentation.
Your spouse needs to read the guides above for the CR-1 visa and file the appropriate paperwork which if it is approved you can apply for a visa at the embassy in Mexico.
If your visa is approved you will then come to the US (you do have to opportunity to visit if permitted while awaiting the process). After you arrive you will be mailed your green card.


Now I am confused about what the sister-in-law has to do with any of this and on what grounds she would apply for a visa. Please clarify.

I would go with the CR-1/IR-1 because......if you come with the K-3 he has to file for adjustment of status which opens you up to delays in receiving the green card. My hubby came on the K-1 and after 17 months of AP you would think his greencard would be in the bag but Noooooooooooo....it took another nine months of waiting for him to get it, I assume to them doing more background checks (like what did they have left to check, his shoe size?).
