OK - I called this morning out of curiosity and was able to schedule for Jan 12. Consular is apparently closed the entire week before, according to the guy scheduling interviews. They opened up the entire month after the 12 though. Looks like I will have to adjust my travel plans, as I was coming back the 16th.



Oh wow! That's a change! I just tried calling myself (after reading your post), but it sounds like the Ukrainian line is broken or smth. It doesn't even take me to the machine message. Just keeps beeeping, and then says no answer wacko.gif


Never experienced that problem. It was really slow to connect today though.

JB - it only took us a couple of weeks from approval to get into the system. I called NVC to get the case number, and picked up a few days that way. Vika has scheduled the medical on December 15, just to get it done early. I will call the embassy again in this week to see where the calendar is. I don't know about December being full, because a week ago they said the latest appointment available was December 17. Your time frame looks tight to me - even if you were approved today. Post and let us know how it goes.


I realize that now as I spoke to someone from another forum and they called and got a date of Dec 19th for their interview, so we will shoot for mid January, works for me. I can control THAT. What I CAN'T control is the USCIS approving dates all over the place, so I'm hoping my time will be soon

Vika has now decided she wants us to interview early and return with me. It sounds like her parents suggested that traveling with an "old hand" like me would be easier. There is also news tht flights aill soon be curtailed because of the economy, and wants to be stranded with me, if at all laughing.gif

We visited the "free" medical complex - dating from the 1950s. Pretty grim, although the staff seemed very skilled. Lots of self medicating and holoistic stuff - the doctor spent an hour with Vika, and prescribed both antibiotics and herbs.

You need to adequately (for the consulate) demostrate he has income above the 125% level. Tax returns show that. If his 2008 retur will be ready before the interview, attach that. If he is retired, you may want to attach a statement from his retirement account or SSN letter of benefits. A bank letter is simple also, in my case I wrote the letter and gave to the bank officer to sign. Any and all proof you can provide is better, but at miimum they will expect the tax returns. More is better. In our case they did not even read the bank or employer letters, didn't look at the check stubs, and only glanced very briefly at the tax return. They gave back all my "proof" and kept only the affadavit, asked no questions at all. But remember you are givig this to someone that doesn't know you, so what would you want to see if you were them? Also, who knows if another officer is more detail oriented? So the more the merrier but you don't have to go crazy.


I agree that more is better. At our interview yesterday I was surprised that in addition to the forms and bank letter, they did check out tax return, W-2, bank statements, and pay stubs. Good Luck.

I really cannot speak to the AOS portion of the program, but I think that you might get past the USCIS portion if your explanations are very bland and the co-sponsor is strong. The criteria for a visa being met (met within past 2 years and willing to marry within 90 days of entry) are what the USCIS and embassy are looking for.

That being said, if you go on record anywhere that you have offshore income and did not file a return (and you are required to do so even if you have no tax liability - to prove that you have no liability) you will at some point probably be in deep with IRS. Especially so if you start talking anywhere about your belief that taxes are illegal or somehow not moral. Those statements are huge flags.

This is one of the rare instances where I recommend you do NOT proceed without sound legal advice. Find a tax lawyer that has a partner familiar with immigration family law.

All of the documents you mention above are just proof of income. Since you are showing some income and a cosponsor, I would include the docs as evidence the cosponsor is necessary. Just helping USCIS to connect the dots. Although not required, a brief explanation of the docs presented (as a part of the cover perhaps?) would clarify to the clerk reading exactly what they were looking at. Just a thought.

To echo the above post, the KEV# reaches Kiev electronically awhile before the paper file. Now, awhile is a variable period of time, and I was able to schedule as soon as I was aware of the KEV#. It could be that I called NVC two weeks after the file was mailed. I can't tell for sure, because I never got any email notice of approval or NOA2.

You are now in the system, just waiting on the mail. I know from experience how tough it can be to wait patiently at this stage but trust me - the more you let it aggravate you the more nail biting you will do for no reason. Wait two weeks is the standard answer at Kiev, I would wait three or four days and try tactfully again. Calmly ask about scheduling, and thank the operators for their help. Showing any irritation can only hurt you IMHO. Government employees are the same everywhere I think, and these folks will not budge until your file arrives.

Yes. Go ahead and schedule medical, you only need the KEV number. In Kiev you can usually get the medical appointment on 3-4 days notice.


I'll add my comment to brother Gary's correct answer. We made our appointment way before the letter(s) arrived from NVC. Vika went to Kiev to pay the visa fee and have the medical exam a week or two before the interview, but you can do it all in 24 hours (possibly, although I wouldn't recommend it if you are on a tight schedule with tickets).

Well meeting and intent had already been adjudicated by the USCIS. Consulates are not to re-adjudicate unless they discover new information. So, the bonafides and financial is all that they really need to do in most situations.

I was able to attend the entire interview about seven weeks ago. It isn't clear to me (having been through the embassy) what part you aren't supposed to go to - because I just walked up to the window with Vika, even for the fingerprinting. At no time was I ever told to leave (or sit down in our seat five feet away) or to wait elsewhere. My presence shortened the interview to zero questions for Vika, although we saw other interviewees being asked ten minutes of questions. You should be fine going. The embassy staff were helpful and very tolerant.

I presume it was that my presence was evidence enough that we met in the past two years and that I intended to marry her. Also, they did take support info and tax returns, checked my ID etc., so the few questions they were supposed to have answered by regs were (presumably again) answered just by being there.


Sveta's interview consisted of "who helped you put together this packet of information, as it is the most organized we have seen?"... "Please go pay for the the courier.." I am not sure I know what the standard questions required by regs are....

I was not at Sveta's interview and it too consisted of zero questions... any idea what shortened hers?


I presume it was that my presence was evidence enough that we met in the past two years and that I intended to marry her. Also, they did take support info and tax returns, checked my ID etc., so the few questions they were supposed to have answered by regs were (presumably again) answered just by being there.

Do they want the police incident reports for each charge or do they want a background check from the police station? A police incident report would be a report stating what exactly happened when I was arrested, that is if the police even wrote up a report. A background check is available at the police station, which just states each arrest in any given county. It appears that they don't just give out incident reports, a subpoena is required which needs to go through court, at which point a judge would decide whether or not to release such information. I've tried calling and asking, but they won't tell me exactly what they're asking for, this is very annoying. I've already got certified copies of the dispositions, now I'm trying to get background checks and police incident reports, but they won't give out the incident reports. My convictions are in two different counties. When I went to the police station and asked for a police report they gave me a background check. I would really appreciate it if someone who was or is in a similar situation would help steer me in the right direction. I have two DUI charges and a Possession of Marijuana charge, just misdemeanors. Thanks for your help guys, and good luck with your own applications.


I have done some time as a law clerk (years ago) and will make a few suggestions here. Please take them with a grain of salt, as laws and criminal procedure do differ from city to city, and state to state. You did not, and should not, be specific here about your criminal history - but that forces me to generalize a bit. If your initial arrest report or citation or summons (what you got from the police on the scene, or delivered to your home) has specific commentary and maybe a case number on it, that should work. Submit those documents with your certified dispositions. The important thing is that a clerk at USCIS (with no legal taining) needs to be able to connect the dots between your charges and dispositions - the results should not matter. Case numbers, dates etc. will really help. You might provide a summary sheet of the cases with numbers too - kind of like an index for USCIS. On a related subject, it might help to show that your SO is aware of the history, and is OK with it. Good luck.

Viktoriya went to Kiev for her medical exam two weeks before the interview and paid the fee then. She left with me after the visa was delivered to Fedex, and wanted to have everything possible done before the day of the interview. I understood that you can pay at any Procredit Bank, but there were none in her city. Good Luck!
