Mexico, Latin & South AmericaOverstayed tourist visa in Brazil
Hi everyone,

I filed my I-129F in January 2008 and my NOA1 is dated 1/22/08. I am currently waiting for an approval. However, I would very much like to attend the interview with my fiance. The problem is: I overstayed my tourist visa by 8 months or so in 2006 & 2007 because I was living with my fiance. I'm afraid if I apply for a new visa at the Brazilian embassy in Chicago that I will be denied. I left Brazil without receiving an exit stamp, but it can easily be calculated that I overstayed by 8 months due to the entry stamp in Argentina.

Has anyone else had this problem, particularly in Brazil? If so, have you tried for another visa? I'm looking for any kind of advice or insight that I can get.

Thanks in advance.

Any Mineiros out there who've already acquired their police reports from the Secretarias de Segurança Pública? I'm wanting to know if it has to be requested in person or can it be requested by phone? Also, if it has to be requested in person, is Belo Horizonte the only location to acquire one?

My fiance has to travel quite far to Belo Horizonte so it would be nice to not have to travel so far.

Thanks in advance.

Carol

Fernanda went in person. She lived about 20 minutes from Belo Horizonte in Santa Luzia. But in your case, a phone call is worth a try.

I just noticed your interview was over a year ago so maybe it did change.

My fiance told me that he called Belo Horizonte and was told that they no longer process this document and that he has to obtain the document from his home town in MG. If your fiance was able to obtain the police report, then maybe my fiance was misinformed.

Would your fiance happen to have the telephone number and address in Belo Horizonte?

Mexico, Latin & South AmericaBeijing Olympics 2008
QUOTE (xizi @ Aug 9 2008, 09:36 AM) <{POST_SNAPBACK}>
The opening ceremony was held successfully last night in Beijing. Even though I couldn't be there in person, in stead, I could only sit in front of the TV with Mom, I felt so proud. I knew Hodgie also cared about such a big event, because he mentioned it to me during the daytime, and he asked me when the opening ceremony started. I knew I couldn't force him to watch it at the same time with me, since it was 5:00am his time. But still, I gave him e-mail with my emphasis about the Beijing Olympics.

Fortunately, he started to watch it at around 7:20pm, August 8, 2008 his time. He said:" It's incredible. When I turned the TV on, I was glued it, except for the commercials time when I could cook a little bit. I cried for the opening ceremony several times. I've never seen such a ceremony like that, ever. It's amazing. It also reminded me the ceremony of Chongqing 10 years anniversary. At that time, we were there and saw it alive.(Hodgie came to Chongqing to see me in May last year.) This time, even though we couldn't be there and see it alive, all Asians should be proud. I wish I were there."

I was deeply moved by what he said. Perhaps both of us are Asians, we can understand eastern culture better. He is right, I love Beijing Olympics Opening Ceremony. It's very Chinese and original.

Today, I went to donate blood, being company with my uncle. I only donated 200ml, while my uncle donated 300ml. It's been the second time for both of us to donate blood. Hodgie called me when I was ready to donate my blood. He has known I've experienced it in the past time. But he was still wondering why I decided to do it suddenly. Well, I actually don't have any kind of so called "reasons", it's just the responsibility on my mind. If I'm good enough physically, I want to try my best to help others.

From the blood station, I knew that there're so many people donating blood yesterday because of it's the beginning of Beijing Olympics. All of them were in a long line waiting. Some of them couldn't even donate their blood because of the increasing number of people. I was surprised. For me, I didn't think too much. It's just what I should do. I only hope that everything will go well with Beijing Olympics. No more negatives events.

Good luck to Beijing Olympics! Good luck to China, my mother country!

Though I am not Asian, last night's ceremony was very moving, inspiring and unforgettable. I teared up many times throughout and could only imagine the pride that the Chinese here in America were feeling. What would have made it perfect for me was to have been there to experience it live.

Mexico, Latin & South AmericaWhat's the fastest way to send documents to Rio?
I always used FedEx to ship to Brazil. They do not have overnight service, but they have 2nd day air. My husband lived on an island off the coast of Rio and I believe it took 2-3 days to get there because the guy had to take a boat out to the island.

Mexico, Latin & South AmericaUS CITIZEN WITH WIFE AND THREE KIDS IN MEXICO
Hello my name is Bryan I have a wife and three kids in Mexico I do not know how similar my story is to others I hope it's rare! trying to keep it short as possible after finally getting married in 2/11/07 in Mexico after a two year battle. I hired who I could afford and who would accept a credit card for payment http://www.ezvisa.us/ god forgive my sole I ever meet him! Me and my wife submitted all information for k3 130/129f when he sent it back to us for us to sign we found 86 mistakes! I was outraged and shocked, I was also embarrassed when I a farmer had to write a letter which took me two days, to a professional white collar dude and notify him of his mistakes he made. I wrote out the questions, then wrote what he had put, followed by what we had originally sent, as we had saved copies of everything before we mailed it to him! Surprisingly he was mad and responded with a sharp tongued letter and denied everything. After I sent him my originals and asked him to compare what his office wanted us to sign versus what we had sent, and pointed out what I believed to be intentional mistakes, such as my three years w2's I had sent, that were about 53, 58 and 61thousand for 04, 05, 06, he had put something like 76, 91 and 217 thousand how could that be a mistake. Then he admitted their were mistakes, but can you believe it, I had to fix them all! When I resubmitted the forms, this time in pdf format he said that I had made changes that were unacceptable to usics but he would go ahead and mail them anyways. I asked for my money back as I had hired him to submit all my papers to the government properly and without error and that I, nor anyone needs someone to submit papers with error's he changed is tune apologized for his, and his business’s behavior!

[three times i asked for my money back, quoting his policy from his website. I never have got my money back but each time i get a immediate change in behavior and apologies the I-129 fiasco is unbelievable]

Next thing we know he calls us franticly saying that theirs going to be a rate increase at usics and he needs to mail the papers rite away and there’s no time to mail our papers again he suggested that I allow him to make all the needed changes and to let him forge our signatures and send them out rite away my wife now 6 - 7 month’s pregnant and fearfull of all the time it would take just to get back to the point of a lawer submitting my papers i agree! God know what he put on those papers!

Finally my I 130 was mailed in April or may and I received my NOA June 20 2007 the I 129 was a nightmare but received my NOA on December 17 2007. I received a RFE for my I 130 12/19/07 my wife was married and divorced I was told by this guy at ez visa that all translations need only be done by someone other than family and they need only submit a letter stating that they are competent to do a translation. This did not prove to be true my RFE was for a certified notarized translation of the Spanish divorce decree I sent this write away certified return receipt insured with confirmation and it took uscis 30 days to say they got it can you believe it.

also I was nervous about the RFE because it was contradictory it said “ all document submitted in Spanish must accompany a certified notarized translation yet they only asked for the divorce? There were other document such as a custody decree in Spanish I called them and asked if I should have other translation redone, they said no only send what we ask for? well in a round about way they asked for both! I sent the following along with RFE

Enclosed is, Notice of action and attached paper, an exact copy of the divorce decree, a certified, notarized translation of the divorce decree along with accomplishments of translator for creditability!

If any other information is needed I will overnight it! I hope you find the enclosed translation to be both Acceptable and Creditable as I spared no expense looking for the best translator I could find, and returned the requested information as quickly as possible! Since filling I have a third child, a brand new baby boy; almost seven months old and I am eagerly awaiting the opportunity to see him and my family every day, for the rest of my life!

Thank you Petitioner- JAMES BRYAN

I don’t know if it good to send a letter but I did. I now have many question and am growing impatient as my baby boy is now 8 month’s and I have only seen him twice! What’s next, I was kind of excited after reading a little that after you receive a RFE often people say you can look forward to be reunited with your family in around thirty days. But what’s this talk of interviews, finger prints, biometrics, adam walsh how long dose this ####### take? What interviews? Where are they? Here, Mexico, both? I want to go see my wife but I don’t have much money, and I was afraid I would be approved and I would need the money to bring her here. But if she’s going to be interviewed that’s another trip to Mexico I’m not letting her go to some border town alone. So can someone explain to me where I am at rite now what should be happing next, what is referring to when people have on there time line “touched”, also on my time line it says;
“Based on timeline data, your I130 may be adjudicated as early as October 13, 2007*. “
If this date has passed by more than 10 days or your application is past due per USCIS processing times then you should consider calling the USCIS to inquire on your petition. If you have been approved please update your timeline.
Well were way past that so what dose that mean?
I have read of people entering the united states before I 130 approved?
when or if I get approved what’s next?
what if I am denied?

how do I get my wife here from Mexico I fly over we pack her bags grab the next flight to Chicago or do you have to go to the border or immigration other than the one at the airport?

I herd you can only leave by car is this true?

more question later thanks

We met 9/07, got engaged 11/07 we also have a 13 year age difference...I (female) 37 he 24. Just trying to calm my nerves.

Hello,
I am 12 years older than my hubby. He's alot more mature at 26 then most American men I know at 40...lol. I wouldn't sweat it. Love knows no age difference. There will be times that you realize the age difference but for the majority of the time you will never think about it. Congrats on the engagement! Good Luck in the process! ~Rhonda~

Thank you! That does help. He just finished up school this week.

Also, does anyone know if USCIS waits until our I-130 comes up before looking at our I-129? Example: The timeline on here for CSC is showing they are looking at I-129 petitions from around Oct. 12, but the I-130's are back in July. Just trying to get an idea of what to expect..... ClockWatch2.gif

I just wanted to tell everyone hello. I have a couple (actually probably a thousand) questions. One, in your opinion, how does the consulate in Turkey compare in speed of processing/interviewing to other countries? Two, can a man still be required to do military service if he has this immigration stuff in the works?

I think the post-holidays, mid-winter, tired-of-waiting, missing-my-husband blues have set in. If I had the money, I'd book a flight right now....sighhh

Yes yes.gif I remember you telling me that Knightsbridge also told you guys that the earliest available was for Friday April 24th. What time is your fiance's medical? We have not heard anything new yet, we sent faxes (2 of them) to different UKBA offices in hopes of an expedite and we also wrote to the MP, and they have gotten back to us saying that the MP's caseworkers have been informed of the issue...don't know if it will do any good, but we have heard that doing so gets positive results.

Still sitting on edge...waiting for the passport...

Well, my fiance scheduled his medical after painstaking efforts...dealing with a GP that has been giving him the runaround routine for just one vaccine since the past 2 weeks, and dealing with the receptionist at the medical who is just downright rude and doesn't bother to listen...his medical is next Friday.

The pdf file for the medical available on the embassy's website clearly says passport is not required, as long as one brings some ID, my fiance had a hard time explaining this to the receptionist, that he does not have his passport. First the receptionist did not believe him when he said he received his packet 3 back in Feb, then she acted like he knew nothing of the passport requirements...anyway, he finally booked the appointment for next Friday, nothing was available earlier. We had delayed the medical before because we were repeatedly told that the passport was required. But it is NOT mandatory, there are ways around it, unlike the K-1 interview at the embassy, where the simple rule is: no passport, no interview.

This whole process has been a nightmare for both of us so far. Everyday we wait for the passport to come back (we have undertaken all efforts to speed it up now at this point), and now we wait until we decide on whether to reschedule the interview, and my fiance is tensed because of the medical, and then there will be Administrative Processing...
And then of course the wait for EAD and all of that for AOS

If we knew of all of this before hand, we would have definitely gone the CR-1/IR-1 route.

But still, nothing can hold us back...WE WILL GET THROUGH THIS SOON!!! yes.gif

Seriously, people. Chill out. I know the whole VJ process fries people's nerves, but trust me -- your parents/family/friends are NOT going to be denied at POE, nor do they need to bring reams of "proof" they are returning to the UK. Bring the return ticket, and if you're totally paranoid, maybe an invitation. I cannot tell you how many times my British friends/family/colleagues have been in and out of the US with NO incident and NO third degree about exactly when and where they are going to be every single day. Think of it this way -- how many idiots do you know over in the UK who have gone on holiday to Florida? Probably more than one. Did they ever complain about being turned away? Perhaps they might have moaned about having biometrics taken, or the long lines, or the sh!tty attitude of the CBP. Think about it for a second and PLEASE relax. Everything will be fine. We all know one exception to the rule, I'm sure, but that person probably said something that caused suspicion, or had something in their immigration history that raised a flag.

I am saying this because I honestly do care, and I have been on VJ long enough to see people whipping themselves and others up into a frenzy of paranoia. It's not good for you. Try to relax and enjoy the ride, especially after you've received the visa! star_smile.gif

Thanks smile.gif glad to hear we have nothing to worry about. And, of course, I know a lot of people come over for vacation purposes, but if my future in laws come over saying "we are coming to see our son" I just figured it might be a different case than "we are going to Disney..." or whatever..thanks for clearing it up though smile.gif

So the first time, when they come to meet my parents, and see my graduation, do they say they are coming to graduation? Or what? I am not as concerned about when they come for the wedding, since like you said, theres ways to show that etc...

I think the parents should be at least prepared for something - just because the heartache from possibly missing their child's wedding (or having to reschedule) would be bad.

However, they'll have a return ticket, and they ARE coming from VWP country, so probably a lot less scrutiny. Have the itinerary printed out is my vote.

Its actually not for the wedding. The first time they are coming over just for a week or so, to meet my parents, etc. Thats in June. Then in August, they are coming for the wedding.

Anyone with experience like this? Thanks!

Now we are just waiting for everything to arrive in London and for my fiance to receive Packet 3. We were hoping he would POE around June 9th, to be able to attend my college graduation, but I am not sure that's going to be doable, looking at other people's timelines.

Also, does anyone know how it would work if he DID POE at that time, and his parents came with him? Obviously his parents would be on VWP...would this be an issue or anything?? What would they have to do that would be different than normal, if anything?

wait for him to get out of secondary! took me a couple of hours...

What does that mean? Is that the part he has to go through after the initial Border stuff? I'm more concerned about if when his parents go through, its going to be an issue that my fiance is on K1, and his parents are VWP...will it be "suspicious" or something? Do they need to bring proof of tie or anything? Thanks smile.gif

No I rang after I got the email saying we were approved. One month later we haven't received the paper NOA2 yet!

Hey Laura---keep after trying to get that NOA2 hard copy. It's real important for the AOS process because you have to submit a photocopy of it to show your legal basis for adjusting status. I've read about people who've misplaced theirs and I think it's very costly to get another. So try to make them send you one now before too much time goes by. A month is a long time, especially since you know the petition has moved on out of there. It'll be one less hoop to jump through later if you can get it.

I don't remember where, but I saw something somewhere (i thought) that said if you don't get NOA2 hardcopy within a month of the NOA2 being approved, you are supposed to call. I could be completely wrong, since I can't find where I saw this! But definitely, I would call!

Side note: At first I thought this post was in reference to me! I am not used to sharing a name with ANYONE haha. Its kinda nice smile.gif

Hi! this is my first post in this thread, but I have posted tons of other questions already! I just got NOA2 on 3/23 in an email. I was wondering how long after you got NOA2 did you start calling NVC to see if they have your case. Did you wait until you had the paper copy of NOA2? Thanks!

I started calling a couple days after NOA2 but could never get hold of someone, so I gave up and rang the embassy a couple of weeks later.

When you ring NVC you have to select the option to speak to an operator as I129F/K1 are not on the automated system.

Did you wait to get the paper copy of NOA2?

I knew about the operator thing, but thanks for the info smile.gif Its easy to forget...especially since after getting NOA2 I seem to have lost all knowledge of what to do now! haha.

No I rang after I got the email saying we were approved. One month later we haven't received the paper NOA2 yet!

oh wow. thanks smile.gif I will try calling tomorrow I think. What times were you calling that were so difficult? evening?

Thanks MonkeyJuice and Ellie-and-David!

How are things on your side, MonkeyJuice? I haven't been keeping up with the UK 2009 AOS thread blush.gif did you already file for AOS? smile.gif

Yaaay! kicking.gif kicking.gif kicking.gif there in 3 days, Ellie, I can only imagine what you are going through, even though my fiance and I are over the top organized, I am sure last minute things will turn up! Good luck! good.gif

No AOS yet. We are leaving everything to the last minute (which I'm nervous about). We get married 22nd August which is 87days after I arrived. We did this to work around family & friends so they could make it to the wedding. We may file AOS a day or 2 after the 90 days but I think that's allowed.
Tried to get my social security number yesterday but some silly woman at the SS office wouldn't let me apply without work authorisation! I may have to wait until I get my green card. wacko.gif
All part of the stressful process that is immigration. lol

We are planning to file for AOS around Sept 1! So we will be around the same time smile.gif We have until Sept 7. We get married Aug 15, but then are going to Florida for a honeymoon directly after. We have most of the forms ready to go though, so it shouldn't be a problem. We just need to do the I-864 and get someone to transcribe the medical stuff.

Hi All ....

I just wanted to wish Bob and Patricia good luck for Friday .... good.gif I hope the interview goes well for both of you!

I'm just putting the finishing touches to my packing ... my flight is at 6am tomorrow morning ....

This is such a confusing time for me. On one hand, I'm so happy to be going to Iowa to marry Steve - after three years of waiting - but on the other, I'm so sad to be leaving my family. I know everything will be fine and that they will visit us and we will visit them .... I'm just going to miss them so much .... They have been so supportive about the whole visa process - they just want me to be happy ....

Och, I'm being a silly woman again .... how can I be homesick already? I haven't even gone yet!!

Take care everyone ... I'll be back online in a few days once I've settled ....

Wishing FAST visas for all those waiting .....

Moira x

good luck at POE! let us know how it goes!
