When filing the package it states that you can send a complete copy of your passport if it has a validity of 5 years. Regarding the term "validity", does this mean that you need to have had your passport for 5 years, or does this mean you need 5 more years left on your passport before it expires?



In this case its actually both! ;)
Most US passports are issued w/ a validity of 10 years, so if you've had it for 5 years, it will still be valid for 5 years. :P

Your case number should begin w/ WAC and be followed by a series of #'s.
That said, it has been a while since you've mailed your petition, you should have heard something by now. When did they cash your check? If just recently, give it a few more days and you should receive the NOA1 in the mail. If its been a while since they've cashed your check and still not hard copy NOA1, you may want to give customer service a call.

Yes, I would send the change of address as soon as you can verify the Consulate has the electronic file. Verify this by calling DOS, then email the change of address to the Consulate.

Thanks for clarifying. Such a relationship is not permitted for the purposes of marriage in some US states.

As you can see, there are many states where marriage between first cousins is not allowed, but a significant number of states allow it, so it depends on what state your cousin lives in. Conversley, as another member stated in a post above, it looks like marriage among first cousins is not allowed in the Phillipines. So marrying her there is not an option at all. Yes, consult with an attorney for further clarification and advice.

Going back to your previous question, it says on the G325A to put in your last address outside the U.S. for more than a year. So maybe you don't need to include it?

The G325A instructions ask for your residence for the last 5 years, I would say use your judgment on that.


It does say to include addresses for more than a year... but it also says the last addresses of residence for the past five years. i figured it would be regardless of where you were. and i was in london for five months during the last five years.

What address was on your driver's lisence for all this time you moved around? When you lived in the UK for 5 months did you give you your place in the US? If you had a residence in the US while you were in the UK, couldn't you have been staying there for 5 months nor living there?

Hello all,

This is just a little rant I felt the need to get out. I love the holidays as much as the next guy, but they have caused the CSC to grind to a hault. 2 weeks post-holidays and they still haven't appeared to start working.

Just when I start to feel like this week they will start working again, I realize today is MLK day, so I'm guessing they are closed. I feel like they haven't even been in the office since before Christmas.

Boooooo.

I'm not currently working or in school which is probably why this irritates me so much! Hopefully something will come along quickly to take my mind off of it a bit.

It has been a while since we have seen a good week from CSC. I've noticed noa2 usually come on Tuesday and Thursdays. You are getting close the estimated time....unless holidays add a few days to your wait time (hoping not but it did for our interview to be scheduled in my case) ...I remember it getting harder to wait the closer I was to the average time of 70-90 days. Hang in there, it will come and this part will fade into a distaqnt memory! (F)

Ok, so I went to visit Fran Jan 2. I returned yesterday Jan 11. When I got to the Miami airport I called my mom. That is when she told me that I had mail from Homeland Security. It was our approval. I got it the day I flew back!!!! I cried in the airport. Fran called me later that night and he cried, too. Thanks for all your support. Just when you think it's taking forever...it comes! Bye!!

oops..you are right....clarification- the only cure to addictively checking the USCIS website is the approval. There doesn;t seem to be a cure for VJ addiction. :lol:

thanks...got it. i'm sending him a passport photo of myself so he can see exactly how his needs to look, his fiance letter of intent, and four copies of his completed g-325a.

i hope i didn't forget anything! :( if anyone thinks of anything let me know, i won't be sending it for about 12 hours.



Though he does not need to sign the I-129F you need to have his name and address in his native language written. So unless you can write the arabic form of this info, send it for him to write also.

Also remind him to keep the outside evelope showing your address and his with stamp and date as evidence of communication for the inteview!

First stop worrying. The evidence you may have lost if the bag isn't found was all original evidence submitted to USCIS right? If the consulate wants to see originals, can yuo show a lost baggage claim from Greyhound? AND do you have more evidence to show of the on-going relationshihp besides that which you sent into USCIS for the original petition?

I'm sure the bag will turn up, but in the worse case scenarioit doesn;t, I think you are still good to go. You will need to replace the NOA2 for adjusting status and that will not be a happy check to write but if you have more eivdence you will be okay I am sure. Hopefully someone going through your consulate will offer more reassuring advice about what evidence is generally asked for.

Every now and then you hear stories on VJ where a one way ticket holder was not allowed to board the plane. It's very rare. Even within the same country there are different experiences. It must have something to do with the airline used. I've heard Royal Air Maroc insists on a round trip, Air France always asks for passport info when purchasing, Lufthansa only placed a disclaimer that it is the ticket holder's responsibility to bring valid documentation for the POE.

I spent a couple of weeks searching for an immigration law firm to help me out ... then I stumbled onto this site, read and re-read and re-re-read the FAQs, FORUMS, and GUIDES, and we have decided to tackle this process on our own. This is very exciting. Based on what I have read tho, I think I will take the $!800 I saved to hire a lawyer and instead get a gym membership to work-out the upcoming stress from all the waiting it looks I will be doing .....

So .... my very first question. I saw the notice that the I-129F Rev 5/23/06 will be accepted until 2/18/07. Since we are just starting to gather info for the initial petition, I seriously doubt we will be able to get this done by middle of next month. But the FAQ and USCIS links for the I-129F form still link to this old form ... where can I download a new post-2/18/07-acceptable I-129F form?


Double check the USCIS website for the lastest version just before you mail your petition. If 2/18/07 passes and the USCIS has not updated the form it is still valid. (I'm pretty sure!)

Remember you are not only letting USCIS know how you met in person, but it will also be read by the consulate. They usually ask how did you meet in the interview and use this information to compare what the beneficiary says.

Remember photos are secondary evidence and do not carry the same weight as primary evidence. Your passport stmp is the most importnt new information you can send it.

Did you highlight the dates on the evidence you did send it? Make notations on it o the ajudicator can make sense of everything they are looking at? Sometmes it looks like it makes sense to us, but from a stranger's point of view, it does not tell a complete story.

What did you write in your Question 18 about how you met? Did you offer evidence from that , if it was a meeting in person?

I really think that the passport stamp will be enough to add strong primary evidence.

I sent in my forms and got the notice that they had been recieved. My date is November 28th on the recipt. So far that is all i have recieved from the California center, only the initial letter with the recipt number and and saying they got it. Should i have gotten something else yet??? I was wondering because i saw that on peoples timelines it seemed like they had recieved packets and things. Maybe it hasnt been long enpugh. im new at this, but i want to make sure im doing it right. :blush:

Nope, nothing to receive until the NOA2 approval comes (unless there is a RFE before that). My NOA2 came 88 days from the date I mailed the petition. You are getting close! (F)

Thanks for the responses. Glad to know that not everyone on visa journey is a butt. I was getting a bit worried based on my first 2 replies :P Composition-wise my photos should be just fine. If I cut off half an inch from the top and a half inch from the bottom they would be perfect... but theres a stamp on the back so they would definately be able to tell that I cut them. Hmm I dunno. I'm thinking I might just take my chances.. but if anyone did get an RFE on this basis please speak up! But yeah, who the hell knows what the USCIS wants? :)



My finace's photos were slightly smaller than the US 2x2 nd we had not problems with the intitial petition. I did retake mine here insted of using the ones I took abroad just to be extra safe.

don't worry. The date the check is cashed does not impact the NOA1 date. I received the NOA1 by smail mail a week before the check cleared the bank.

Don;t worry about when the check clears- your processing order is the receipt date. The timelines on VJ are based on mailing date. Either way a slowed check clearance ro smail mail NOA1 will not slow you dwn towards the NOA2- although I knowits feels soooo good to be official!

My fiancee and i got married, two weeks ago. We got our marriage license last week. We try to get her a texas Drivers learning permit. When we went to the DMV. The lady said that she is not eligible on the basis that the I-94 must be valid for a year. Since her I-94 is valid for 90 days, we must wait for her to get a green card before she can even apply for license. Is that true?? or is there a way we can go around this?? We applied for her SSN, it went well.



Does she have a driver's license from India? Texas allows one year driving with a license from India. If you get the EAD for her, she will be able to get the license with that as well (but maybe be good for only one year- the length of the EAD)

NO! Casa will send a letter which tells him to get some of these things, but they do not mention the court paper or the celibacy letter. If he does nto bring it they will issue a 221g and have him bring it back to them so better to bring it in first time around. Those of us that have gone through Casa do not understand why they do not update the letter.

SarahandHicham started a thred in MENA about eperiences in Casa and I uploaded the letter and forms that were sent to my fiance. I posted some of my fiance's experiences too. As you get closer to the interview date PM if you need something specific explained.

Casa is no longer requiring the I134 afidavit. He will also need a court paper (in addition to the police report) and a letter of celibacy.

It's not like morocco where you can give a little money and get something done. The good news is once you have the NOA2 morocco is pretty quick with the interview. Usually 4 weeks from the time Casa recieves it (or 6 weeks from the NOA2)

I know in Morocco there are lots of stories going around about how the visa process works (or how they think it works). Tell you fiance not to listen to these stories. It took us 5 1/2 months from mailing to visa being issued. This was going through California. Vermont works faster and barring any problems with security checks you will probably have everything in order in less time than we did! Good luck!


see 2 of his friends just got their visas and he is getting nervous about some things that were done on the visa like the fact on my g325a i didput an a# and i dont have one for his i didnt put my name or anything no the g325a but he is also anxius about the fact of seeing his friends again in america its hard but he doesnt get the fact that its giong to take time for this he is worried about that fact as i am not as much bc he does enough worrying for the both of us plus if i worry thats another min out of every day i cant afford how sad is that?



awww...don;t worry. If the USCIS official finds some problem with the petition you will get a RFE and you will be able to resolve it.
You have a A#? Are you a immigrant as well? He would not have a A#- not yet anyway.

I was wondering what do people think about requiring a proof of meeting as being a Westernized, cultural phenom? I was thinking that in Eastern cultures that with arranged marriages and such that having a proof of meeting requirement would stack the cards against cultures which do not have the same romantic conception of a relationship like the States?

I think there is some truth to this. But in cultures where arranged marriages do occur and the bride and groom do not meet, their families do meet. The bride knows her furture female relatives before marriage and vice versa. USCIS does allow for an exemption, but it is a very difficult hoop to jump through.
