Monrovia is similar, but no clue if any Monrovia-specific forms or versions of forms.

re: waiting for NVC - for K-1 visa, not need wait for NVC - is quick whip-thru, usually - 1 to 3 weeks if namechecks are ok.


But it IS good idea to call NVC, get the casefile # for Monrovia, inquire for when it left NVC on it's way to Monrovia
and then

call DOS Hotline (# in my profile) and inquire on further case status.

Since yer I-129F just got approved, you might want to contact NVC via telephone, get a Human™, give them the USCIS receipt #, and then get the Embassy Casefile # -

then let us know what the first 3 letters are?

first 3 letters are important, gives you the US Embassy location.

GUZ is Guangzhou China, for example.

Whatcha got ?

NVC open from 7:30 am till 00:00, EST, M-F, and are open now, today.

Regardless, you have some 'zones' to 'go slow' in this process -

--delay returning the Packet three set - 2 to 4 months - don't return packet 3 immediately after you receive it - simply 'stall' for 2 to 4 months.

--once interview date is set, contact IV Unit (fax/email) and ask for LATER interview date - 4 to 6 months later

--after interview day, once visa is in the passport, have up to 6 months to enter the USA.

IIRC, this is owned by Various, Inc., and they DO have other IMBRA statements for their other 'finder' websites such as KoreanFriendFinder, AsianFriendFinder, etc etc - anything dealing with 'overseas' hookups.

To hit the nail , though - you should contact SFF customer support, inquire - use this phrase -

'Please provide me with your IMBRA compliance statement, or a paragraph clearly stating why your site does not need one. If you need to escalate this request to the proper person or entity, please do so'

for I-129F - Suggest to use to name in the divorce decree. First 'Eye-ball matchup' at USCIS will be on the names in the I-129F, with any attached paperwork.

I'd use the name in the divorce decree, with an AKA listing, to the right of it.

if no space, use an attachment sheet.

if you have any copy of her 'legal name change', suggest to include it.

this is usually a 1 to 5 page simple court decree or court action document.

We have been told that she could be married but would have to return to Poland if the AOS was not completed by the time the K1 expires. We have also been told the exact opposite by someone in the same office at the same embassy. yikes- FUD ! Fear, Uncertainty, and Doubt, being spread by ppl in the US Embassy. Pay attention to US Citizens that work in the Immigration Visa Unit, ignore everyone else that works there, seriously !

she has 90 days after her POE date, ( note the expiration date on the I-94 form that she'll receive at the Customs/Immigration CheckPoint at the airport) to get married. And that's it- no other regulation covering her presence in the USA. Some people confuse 'to file AOS' within the 90 day window, but there is no Regulation that states that. Don't wait too long, aye? (too long = 2 years ) . So, she has 90 days of 'legal presence' in the USA. She must get married within those 90 days. After marriage, she has no 'residence status' until the AOS is filed, but she is still legally IN the USA, since she married you within those 90 days.

Don't forget any medical stuff, to do, for the I-693 - will be d@mn near impossible to see a civil surgeon on the day that she arrives. Review the AOS guides here (train yer eyes up, click on guides, AOS on right panel) and pay attention to the medical stuff. Seriously.

Her K-1 has not been approved, but the I-129F petition that you filed, has been approved. Cool !

Now she's eligible for apply for the K-1 visa, with the tonne of paperwork that you mentioned.

You can't file the adjustment of status on Day 1 of the USA Entry date unless, by some miracle -

you were able to 1) get a marriage license 2) get married 3) get the marriage certificate out of the courthouse and then 4) file the AOS package.

IMO, give 'all that' about 5 weeks, if you want to really rush things - as she'll need to muck about with a Civil Surgeon, as well, in the USA, prior to filing the AOS package.

You didn't say if they were deported or not (that makes huge difference )

You might want to plan for the two of you either living in Chile for many years, or the two of you moving to Australia or New Zealand, go to university there, immigrate.

At this point, I suggest to call DOS, see if any status with DOS. Sure, may be no record of anything there, but if the visa was denied, they'd have record of it @ DOS.

Other thoughts, albeit malformed -

1. EMS tracking # on the packet SHE sent 60 days ago? Got it? Look it up - whats the status?
2. EMS tracking # on THIS packet the parents received? Look it up - exactly where did it come from ?

I hate to speculate about this kind of thing, but if the documents are WHAT YOU SUBMITTED 60 days ago, is possible the packet was never officially picked up by GUZ IV unit, and EMS has returned the packet back. IF there is a cover letter - suggest, at a minimum, that yer parents GET INTO A COPY SHOP, scan it in, have the clerk at the copy shop EMAIL IT to yer lass (or to you). Copy Shops are everywhere.

oh - I did mean photocopies on the divorce papers. The trick there is to make SURE that any 'seal' or 'stamp' is visible in the copy. Must to show originals or certified copies (certification done by issuing authority, not a notary) on interview day at the US Embassy/Consulate Immigration Visa Unit.

Good Luck ! I think you have it well in hand, for now. Usually, that 'cover letter' will have 'the list' of what yer including, so yer on the right track, absolutely !

any 'co-sponser' is NOT ON THE HOOK, at all.

The I-134 is some non-binding thing, no one is 'tied to it'

IS USED, however, for EVALUATION on interview day.

The I-864, used when YOU and yer lass file for the Adjustment of Status, I-485, IS A BINDING AGREEMENT .

IMO, that wealthy husband COULD reveal all, and not go on the hook.

cash assets are fine, but assume any 'tax data' is from a joint return, so will be the friend plus the spouse's tax data (IF TAX DATA is asked for at the interview)

there's some mish-mash to sort through, who signs what - but be prepared to show 3 years of tax data.

cash assets are computed at 3 years, or 1/3 of the asset, for the petitioner/primary sponser
and I think
is 1/5 of the asset for the co-sponser

so for 18K ++, 2 ppl poverty guidelines, thats 54K ++ dollars in cash for the primary sponser/petitioner.
To say 2 years, to me, implies 2 x 18K ++, or 36K ++ dollars in cash.

check the I-864 instructions - should be covered there... GUZ IV will use the computations from the I-864 on evaluating the I-134 'data'.

FWIW, I'm not showing income tax stuff either, as all income goes to 3 corporate shells. I hadn't paid myself a salary in years, always buying stuff through one of the corporate shells. I'm not hiding anything, but moved a huge chunk of cash out, late last year , with some personal 'tax hit', to use as the 'cash asset' for the Affadavit of Support. Different situation, I know, but there it is.

1. assume the interview will be in Spain, yes? Focus on police clearance certificates from Peru and Spain, will be needed on interview day - learn how to get those.

2. co-sponsers/joint-sponsers - no problem - just make sure you have an I-134 ON YOU, and show you were student overseas (usually a letter of attestation is sufficient, some ppl also get transcripts or letter from the school bursars/registrar's office to prove up any timeline )
