The fact is that there is no way to track a case because the government does not want you to track a case and does not want to be bothered with reporting to any of the hundreds of thousands of people sending visa petitions and applications. Sure, by hook and by crook you can find where something is sitting on a shelf. That is not "tracking". USCIS and NVC are not Fedex.


Seriously, sounds to me like you've not called into DOS Hotline in some time. The Humans™ at DOS Hotline have all case status from the Embassies, albeit 24 hours off. 'Case file opened' is best indication the casefile made it over. 'Packet 3 sent', for some countries, is good indication to prep that Packet 3. 'Appointment Date Set' is also another good time tick.

if the OP is trying to physically track the package movement from NVC to the Embassy IV unit, during the shipping process, ya - on that bit - I agree - is serious waste of time and energy.

But that was NOT was I was writing about, here. My apologies if any confusion about 'that'.

One 'process' you can do -

About 2 weeks after NOA-2 'notice date' -
call into NVC, get a Human™, give USCIS receipt #, receive Embassy CaseNumber, also ask them when it left NVC.

Then call DOS Hotline (# in my profile), get a Human™, and inquire (with Embassy CaseNumber) for casefile status, about once a week.

At some point, the Human™ at DOS will tell you , that the casefile was opened at the Embassy. That's a good timetick, start prepping the Packet 3 stuff when you hear about 'casefile opening'.

Does the foreign fiance have ANY appointment letter in hand, either paper via postal mail, or email ?

ALSO - suggest you call NVC on Monday, get a Human, give USCIS receipt number, they will give you the DR Casefile Number - and with the Casefile # - call in to DOS Hotline (# in my profile), get a HUMAN, and inquire for casefile status.

IF INDEED the US Embassy Interview is for the 23rd of June, well, them DoS Hotline Humans™ will know, and certainly tell you.

Those 2 phonecalls should clear up much confusion - the links I gave you contain ALL FORMS that you need, as well - you should download them, start filling them out with yer foreign fiance.

5. photos of the two of you together (she might already have these)

re: the overstay of the visa -

it's 2 'areas', IMO -

1. legal presence in Madrid, for the US Embassy to review, on interview day and
2. legal presence in Spain, by Spanish immigration authorities.

If she's there on a work visa, she might have some wiggle room - check the Spanish Immigration 'entity', see wot is published about the work visa. She might not have to do anything, ie - she's allowed to remain in Spain up to x # of days past work visa expiration date.

But don't chance this - LOOK IT UP ;)

THEN - call DOS Hotline (# in my profile), get a HUMAN™, and inquire for case status.

DOS HOTLINE will know WHEN the casefile is opened at Madrid.

NVC # is not DOS # is not the Embassy #

These 3 entities have different functions, have different info to give you.

IMO, contacting the Embassy is the most difficult part. DoS Hotline knows all about this casefile, you should call them.

Keep callling DOS Hotline (# in my profile) and ask for casefile status.

When the Embassy has the casefile, and opened it, DOS can report that status to you.

If Madrid does not send out a packet 3 - yer lass can speed things along by sending a FILLED OUT PACKET 3 to them, as soon as DOS tells you that the casefile is OPENED in Madrid. see http://madrid.usemba...grenfiance.html for all the forms that she'll need.

Based on yer NOA-2 date, I have to guess that Madrid already has the casefile.

You might want to CALL NVC, make sure it's left, and on what day (then update yer official VJ timeline at http://www.visajourn...le.php?id=84143 ) , get the NVC/Madrid Casefile #, and then call DOS Hotline, Get a HuMan™, inquire about casefile status with NVC/Madrid Casefile #.

IMO, if you do all that , today, you'll have better picture of 'dates' for her.

The end result, or one of the end results, is petition approval.

Usually - The check is cashed, a letter of receipt notification is sent out, then the casefile goes into a holding queue.

Do you have any receipt of delivery, or tracking info on the I-129F petition, from USPS or 3rd party carrier ?

2 months, IMO, is a bit long. Perhaps you've gotten caught up in the lockbox 'handover' that started in mid-May ?

I've no clue what this means -> the demand is rejected for sure they dont cash the money like that ? - are you trying to ask, if the petition is denied at USCIS, that you'd receive yer money back ?

The Embassy in Canada CAN take the fingerprints, and forward the fingerprint record TO RCMP office.

a waiver for 2nd K-1 falls under VAWA guidelines.

Many ppl in your situation 'ask for the waiver' in a letter, included with initial I-129F submittal packet.

Can you tell us exactly what was written on the RFE ? There might be some INA/9FAM codes in there, as well. Those are important, helps to guide us with exactly 'what' you need.

you have to get a Human™.

But - that Human™ will have it. When you get the Human™, give USCIS receipt #, ask for Embassy Case # , also ask when the casefile left NVC.

USUALLY, any packet 3 files can be downloaded from the Embassy's website, as well.

But now I wonder why you say that Guz IV is hard. Needless to this, this worries me. Is there a Guz I II & III that may be better? I am honest and straight about my answers on all forms. I have nothing to hide, and I try to research so I can provide the authorities the info they require. But now I'm worried about GUZ IV.


Terribly sorry, I use acronymns too much, and it shows.

GUZ IV = US Embassy, Guangzhou, Immigration Visa Unit. GUZ is the Embassy Code for Guangzhou, as well.

re: GUZ IV being 'hard' - 9 times out of 10 - any requested evidence (submitted after interview day) is sent in via postal mail. That 1 in 10 time, is hand delivered via 'Call-In Letter', which may be given at the end of the interview. A Call-In Letter allows the visa applicant to enter the building on certain days of the week and times, and hand stuff over, in person.

Once evidence is at the GUZ IV unit, it can take an inordinate amount of time for it to get evaluated, as there's a queue already, for this re-evaluation. It's not just the evidence that was submitted, but is also a review of the totality of the case file.

Then some more time passes. IF GUZ IV kept the passport , and 'all is good', then the visa packet will be mailed out. IF the passport was not kept by GUZ IV, another call-in letter is generated, sent out, and yer fiance would have to show up at GUZ IV to drop off the passport, waiting again until the visa is printed and applied into the passport, and the visa packet mailed out.

This 'turn-around time' can vary from 2 weeks (rare) to 6 months (also rare) with 'stuff' flowing out to 18 months, even 2 years.

RARELY does GUZ IV allow for 'hand over the window'. It can happen, sure, but -
specifically for the I-134, IMO, is best to have 2 in hand, and give both to the document screener, and then let the Immigration Officer, decide, during the interview, which I-134 to use.

I think yer 'set' with the stuff you've already listed, without using additional assets. But do include all the evidence you've already listed, as it will be 'golden' in solidifying yer financial position. (Ya, I'm echoing what Push said )

You might want to have a 2nd set ready, in her hand, just in case.

'Forced to by the authorities' - without that 2nd set, IMO, could take up to 6 months extra. Forcing is painful. Not trying to scare ya, but GUZ IV is a hard place. No - I'm not saying 'better safe than sorry' - is easy thing, really, if you meet the income requirements.

W-2 income is easiest, always - so if you have any gov pension or disability, or disproportionate amount of non-taxable income - you'll need to be able to show the source and it must be continuous (for the future).

If you do go with the appraised value on the house, - you'll need an appraisal, from a licensed appraiser - and 'to generate that documentation' is never, ever, free.

if you still decide to use the house as an asset -

The 'stand up evaluation' done at GUZ IV, on interview day, is done , using the computations and requirements from the I-864. There's some clear language in the I-864 about using a house - you absolutely have to have an appraiser's appraisal document attached to the I-134. I know of no way 'around' this requirement. Not to say it doesn't exist, only that I don't know of it.

Suggest you call into NVC in another week, get the new casefile # (give them the USCIS receipt #) .

Then in another few weeks, start calling DOS, asking for case status (with the NVC Casefile #).

IMO, receiving 'that letter' from NVC is hit or miss. You might get it, you might not.

The steps are as generic as possible, as any 'status' covers all visa types - not just the K-1.

Sure, it's confusing, but for you, the thing that really matters, is that the petition was approved.

I've written a bit, here in yer topic, on what to do, how to check status, with the telephone, and what to get. You might want to 'do that', instead of letting this USCIS status portal drive ya batty.

mmmmmmmmmmmmm not the NOA-2, specifically, but an EMAIL referencing the NOA-2 .

You'll receive the NOA-2 via postal mail, soonish.

At some point, soonish, call NVC, speak with a human, give them the USCIS casefile #, they'll give you the NVC casefile # (which you'll need for the rest of the paperwork).

Once the casefile leaves NVC (which is quick, 1 to 3 weeks, if no additional namechecks) - you can call the DOS Hotline with that NVC casefile #, inquire for any current casefile status (and location).

Then another month to get the petition from USCIS to NVC to UAE.

and then 4 to 11 weeks more, for K-1 visa application processing, before any interview date.
