If your attorney is referencing a K-3 visa as a possibility, then I would question that attorney's knowledge and prior caseload of successful K-3 cases, as from 1 FEB 2010, any I-129F petition, submitted in hopes of 'getting a K-3' later, is administratively closed by NVC after USCIS approves it. see http://www.visajourn...eived-together/

pay attention between 'packet 3 received at GUZ IV' and 'packet 4 sent out' dates

as the interview date will be set , about 1 week prior to the packet 4 leaving GUZ IV mailroom.

DoS hotline will know it - so if you call

you will know before she receives the packet 4.

Coupla things to check:

--call Dos Hotline (# in my profile) - ask for case status. Also ask, specifically, if the case is in AP (Additional Processing) or not in AP.

if not in AP, then yer golden.
if IN AP, grrrrr - send off an email to the GUZ IV unit via http://guangzhou.use...t-question.html
and ask what's going on.

if no AP, keep checking the EMS Tracking portal once a day, until you see some change.

ya, it can done, but May? May 2011? This is August 2010.

So, filing in Sep 2010, fast forward 6 to 9 months, possible interview date between March to May, 2011. Whew !!!

Once a visa is issued, the visa usually has a 6 month 'expiration date' on it - must travel prior to the expiration date.

Can travel seperately? Absolutely.

In the end, pay attention to that 'visa expiration date' , issued after interview day.

For a 'timeline' of events, I think you'll be ok...
No need to worry about actual 'K-2 follow to join' type of case, where the K-2 must have a visa issued with 1 year of the K-1 holder's K-1 visa approval date - they can interview on the same day, instead.

Question - what is 'homed' to Canada ? I've no idea - I said 'homed to Montreal', which is a really nasty, evil, wicked state of being.

as to 'how long she is in the country of residence' - that's always fun, yes? If she is citizen of Germany, with plans to go to Germany, highly suggest to have interview in Germany - because IF she is 'homed' to Montreal, she will wait, much. If she's 'homed' to any other US Embassy/Consulate in Canada that handles K-1 interviews, hey - it's not so bad (you should find out which Consulate she's homed to, asap)

Regardless of 'interview in Canada'

--interview in Germany (she is German Citizen, length of residence not matter, globally)
--get police clearance certificates in Canada, prior to jump.

as I am CERTAIN she'll have a 'much better time' in Frankfurt, for interview.

lawyers and investigations - what? waiting? investigations? what ? huh ?

suggest you file this week, really, and plan on her interviewing in Germany.

Can get the address changed up once the I-129F is approved with USCIS, directly with NVC (but note the small amount o time the casefile will be at NVC).

Since she is a citizen of Germany, is no 'residency' issues for her, to return to Germany -

suggest you get the Canadian police certificates, in person and face to face, before going back to Germany.

I think you can keep the 'get married in May' timeline, if you file the I-129F this week.

Montreal is extremely lagged for immigration visa appointments.

I-134 not needed until interview day, so be certain that you have all sussed out about 3 weeks prior to interview day - WHEW ! you have some time, to study the I-134 (and I-864) instructions. The embassy does not receive it any other way except for yer lass to hand it over a counter, on interview day.

If you don't meet the poverty guidelines, you'll need to get a joint sponser / co-sponser.

So you fill one out, as the primary sponser (the petitioner is the primary sponser, regardless of income) and then yer parents will prepare an I-134 as well. Scanned versions of the I-134 containing a signature aren't acceptable, must be an original signature, suggest blue ink.

GUZ IV is really tough (when warranted) about 'communication ability' between the couple - so be sure to cover this as part of yer EOR letter (that's submitted on interview day).

the bad news, is that you need certified copies of divorce decrees on all prior divorces / annullments.

The good news is that you submit a regular PHOTOCOPY of said 'certified divorce decrees' with initial I-129F filing.
If any deceased spouse (deceased whilst married) a photocopy of the death certificate is sufficient.


Later, on interview day, these 'certified copies' must be presented.

When submitting photocopies on initial I-129F submittal, ensure that any 'seal' or 'stamp' is visible in the photocopy, else you'll get an RFE at USCIS.

re: the second marriage (ad in paper) - if common law marriage, with 'common law divorce' then you'll need a bit more documentation than just an 'ad in the paper' - but if not 'common law', if actually a divorce decree, then include the photocopy of the divorce decree in the I-129F submittal.

re: fiance's dead mother - no extra paperwork required.

Packet 4 sent to Visa Applicant (interview letter with appointment date assigned, inside)

Usually, when DoS knows of 'packet 4 sent out', DoS also knows the interview date. Not saying 'this is concurrent', at all.

USUALLY, the packet 3 is 'tagged' to be sent out, within 2 weeks of 'casefile opened'.

Casefile 'logged' is a different timetick, altogether, is prior to 'casefile opened'.

USUALLY, the IV unit in Guangzhou automatically extends the validity duration of the I-129F petition, as is 'known problems' for getting consular-bound packets out of the China Customs Warehouse.

However, even with that said, you should send off an email to the GUZ IV unit via their web portal email page ( see http://guangzhou.use...t-question.html )

Suggest also, that you call DoS Hotline, often, and check on casefile status (see http://www.visajourn...he-nvc-and-dos/ Dodi has written how to call, I've written what you can get) and then when you learn about 'packet 3 sent', can utilize the GUZ P3 shortcut over at http://www.visajourn...GUZ_P3_Shortcut

Ultimately, can request 'extension' in a cover letter sent off with the OF-169 checklist, as well, if you have any timing issues with any GUZ IV email.
