ok - so the casefile is being sent back to USA, USCIS, CSC office, with some type of denial.

CSC may or may not re-adjudicate the petition. I don't know, sorry.


IF the petition is re-adjudicated,or PEGGED for re-adjudication -
then the USC Petitioner will receive some postal mail about it.

IF CSC wants 'more stuff' from the USCitizen Petitioner, CSC will inform him of the need via 'yet another postal letter'.

Turn around time? Anywhere from 2 months to 2 years. Final results? USCIS upholds the denial from US Embassy, OR they refute the denial, submitting the entire casefile, the re-adjudicated petition with recommendation to approve, back into the 'pot' - where it will show up again at the US Embassy, and you'll have another interview sometime in the next 2 years.

If I was yer USC Petitioner, I'd file a new I-129F petition this upcoming week, and address all concerns presented in the interview at the US Embassy, in the form of 'letters of attestation' to 'cover red flags', with a letter of attestation for each red flag. Near as I can determine, you have issues with 'civil documents' based on 'name discrepancies'. But that's only what you've written about, here - there may be more red flag issues to cover in any letter of attestation. When you have a moment (some homework for you) - sit down with pen and paper, and try to document the entire conversation of the interview - who said what, in what order, and when. Study that piece of paper, then try to determine what the other issues were, if any.

A 2nd-filed I-129F petition actually 'goes faster' through USCIS than the first one, most of the work has already been done. Is possible, if the casefile is prepped properly, to have 4 months between 'filing' and 'interview day'.

He'll need to include wording in the cover letter, asking for an IMBRA WAIVER, as well, as this will be the 2nd filing from him, even though it's the same person.

then make sure it's a PHOTOCOPY , a regular photocopy.

She's required to show originals on interview day, and if you send originals now, is big risk - stuff might get lost between USCIS/NVC/GUZ IV.

My fiancee, and I telephonically, had a consult with him while he was in GZ recently, and a flurry of emails after. I have not retained him, only paid for the consult. I wonder if there are new guidelines coming out of USCIS or something. Other than that??? I have no clue...

whew ! a blue slip ! that's not a denial !

Sounds like you've gotten the 'blue-slip-overcome' evidence coming in, so that's a plus.

IMO, with a rude VO, somethings wonky - so you might want to meticulously go over, with yer lass, the exact questions and answers in the interview, what the VO was doing 'when', etc etc,

write it down in narrative form.

Then study it. If you feel any snarkynes from the VO, after reading that narrative, hey ! post back here, maybe this 'blue slip' is a feint, instead, to trip up on something else. Snarkyness at GUZ IV is a bad sign, usually something else is going on, with ultimate 'intent to deny' coming in later.

Usually, these things (visa packet) are sent via EMS to either 'the' post office or the address specified in the EMS label
UNLESS
she was successful in convincing the Consular Official to hold her passport for hand delivery, pick up at the IV unit, and gave her a call in letter to pick it up.

--EMS delivers it to the address in the EMS Label
--EMS makes a tracking note in the online EMS portal

Congrats on the approval, but it ain't over till she has the visa packet in hand.

I'll suggest a coupla things, maybe (maybe...) help you to decide whether you need an attorney or not.

a. read the VJ guides. map the steps out on paper and pencil. See if anything doesn't make sense to you.
b. Read the USCIS web portal about the forms. Map out the steps on paper and pencil. See if anything doesn't make sense to you.
c. Practice filling out the forms, at least 5 times. See if anything still doesn't make sense to you.
d. Have any red flags? Practice writing up attestation letters about each red flag.

Now, after doing (with major emphasis on DOING ) all of the above, if you do NOT understand the forms and the process and potential red flags for your petition,

then I'd suggest getting a good IMMIGRATION lawyer.

ACH = American Citizens Hour

Many ppl go to ACS to get the EOR letter notarized prior to interview day. It's not required, but something to do to let the COs know yer there, actively interested in her casefile.

Some people to to ACH to discuss red flag issues prior to interview day, or go after interview day to determine why the visa was denied.

ya, it increased to 350 USD, to be paid at CITIC prior to interview day.
Will also have to pay China Post/EMS fee on interview day, between 20 to 100 RMB.
Plus any medical exam fee, prior to interview day.

hey darnel. I have a few questions about the interview.

1. The economy docuements. I will need 3 years tax returns,proof of employment,and proof of US residence ?
2. the tax returns need to be the min of 20,000 a year right?

I want to be sure I have everything she will need for the interview.
3. and the employment letter my company dos not supply it. But I know a friend of mine that typed a letter with the companies logo on it.
and had the manager sign it. will this be ok?

--mail to you/within 2 weeks --fax/same day --or you can go to local IRS office, get tax transcripts. You want the LONG VERSIONS, but if you have adjustments AFTER a tax year has passed, you want the SHORT versions IN ADDITION TO.

2. that sounds right - but study I-864-P document

3. many people prep this letter on company letterhead, get the boss to sign it, do all of the work for the boss - so the boss only needs to sign. less work for boss usually equals 'no issues with boss to sign document'. Usually. Other people put in a request to the HR department for the employment letter. If you can't get it any other way - then by all means, get some company letter head, sit down at a typewriter, and make it happen, get boss's signature when ya got the letter ready.

She checked it about 4 weeks ago and they have recived it.
and when I called the DOS they told me its already in process.
so I hope some time next week I will know the interview date.

1. write the name of the dating site , change the year - I think is 2008, not 2009. My fiancee and I first met on the internet through a dating site in October 16th 2009. to My fiancee and I first met on the internet via the XYZ website on October 16th, 2008.

2. replace After knowing each other for about 6 months. We meet in person for the first time. We met on March 31st 2009. with We spent 6 months communicating almost daily, and met in (city name), China, on March 31st, 2009

3. replace Sadly she failed the interveiw. On 02/01/10 with Sadly, she failed the interview on 02/01/2010.

4. replace I also call her everyday. with I also call her everyday, as you can observe from the call detail records provided.

that's it, for now - I don't want to get into grammatical issues with the letter, as I think that if it was grammatically correct, any VO would think it was written by a professional writer, and smell some sh|it in there, sideways... DO try to address any spelling errors, though, yes?

Since this is the '2nd time up for interview' -

I would spend much time with the EOR letter. Try to keep it under 3 pages. Cover major timeticks such as 1--trips 2--date decision made to marry 3--time spent with her parents then other areas, as well, such as 1--communication ability between you two 2--any red flags that you are overcoming with submitted evidence
