K-1 Fiance(e) Visa Process & ProceduresInterview?
usually - 'interview date set' between 2 to 8 weeks after GUZ IV logs the received P3 packet, for an interview date somewhere 4 to 12 weeks past the 'interview date set' date. At this stage, most depends on namechecks initiated by GUZ IV.

what is your 'source' at the embassy, that is telling you the 'wrong information' ?

if he's legal in Canada - then you might consider moving to Canada, becoming permanent resident there - the quality of life is much better than the USA.

If you truly wish to 'get him to USA' - then suggest you submit a new I-129F petition for a K-1 visa.

K-1 Fiance(e) Visa Process & ProceduresExpidite/ caregiver needed?

This is an incredibly ridiculous comment. I know lawyers, does that make me "qualified to speak on their behalf"? I know police officers, teachers, principles, ministers, geologists, dentists, doctors.. does that mean I'm qualified to speak on all their behalves as well?? Just because you know someone who has experience in a field does NOT mean you are qualified to speak on their behalf, it just means your chats might be interesting and you MIGHT have some interesting wisdom to impart, doesn't mean you know jack sh*t about their trade or are allowed to act high and mighty and all-knowing.

ya, 'knowing' just ain't the operative term here.

But, to Gary's Credit -

K-1 Fiance(e) Visa Process & ProceduresProcessing Timeline Changing
USCIS sent out a 'receipt notice', formletter I-797-C

On that formletter, sent to the USCitizen Petitioner -

there's a 'receipt date' and/or 'notice date'

That's the date to use for any 'forward looking' computations -

here at VJ it's called the 'NOA-1 date' in the timeline timeticks.

re: moving dates on VJ - sorry, it happens, as the calendar progresses and more and more people do not enter their timeline data.

K-1 Fiance(e) Visa Process & ProceduresCan the beneficiary be the petitioner?

I'm not with my fiancee currently, so having her sign it would be difficult. Would I be better off just not including a cover letter?

Well, the thing that's interesting, is that the I-129F and G-325A (on the USCitizen)
must have the USCitizen's signature

Suggest, when you complete all,
that you mail it off to yer USCitizen fiance,
who will then
sign stuff
and mail it off to USCIS.

K-1 Fiance(e) Visa Process & ProceduresCan petitioner apply K1 in China?
Absolutely !

Usually is some concept of 'USA Address' on the I-129F form and G-325A - but if you don't have one, ya don't have one, and IF yer living in China for the duration -

you'll need to be able to prove up 're-establishing US domicile' on interview day.

IF , on interview day at the US Consulate IV unit in Guangzhou, any Visa Officer decides that you are outside of the USA (again, on interview day)
then
you'll need to provide some proof of 're-establishing US Domicile' to yer foreign fiance, to hand over to the Visa Officer on Interview Day.

As to the G-325A on you, for initial I-129F submittal - be truthful. Ommission is a form of misrepresentation, and you don't want to be dinged for that, ever.

K-1 Fiance(e) Visa Process & ProceduresHow long does it take to receive the K1 interview date
Guangzhou schedules 'in batches' several times a month.

As for 'how long' since you just sent it back?

Expect anywhere from 2 weeks to 6 weeks to 'get scheduled', then the appointment is usually 4 weeks after 'appointment date set'.

DoS Hotline will know all, suggest to yer USCitizen Fiance to call in to DoS Hotline, get a Human™, inquire for casefile status -
see http://www.visajourn...he-nvc-and-dos/

K-1 Fiance(e) Visa Process & ProceduresK1 Interview
showing the 'uscitizen passport' on interview day isn't required, nor is it really useful.

In China, this can be a different matter, usually it 'shows' the Visa Officer that the USCitizen is IN Guangzhou, on interview day, to support the foreign applicant.

The 'one thing' , IMO, that showing the passport CAN be good for -
is to prove up (via visa stamps) that the USCitizen travelled to the foreign person's residence.

You can use a regular photocopy for that
and
usually, it's submitted with the I-129F, as part of that 'evidence of meeting' pack.

But even that, is optional, to 'show by passport stamps'.

So, I can't think of any 'good reason' to show the passport, the actual passport of the USCitizen (not any copy) on Interview Day.

If he needs to 'stress out' - wei ! Have him practice filling out the VISA FORMS (DS series) - I suggest once a week, a complete set of all, until he has about 11 inches of stacked paper. (sorry if that sounds harsh, but it can be good exercise, and maybe he won't bother you whilst he's filling out the DS forms?)

Good Luck !

K-1 Fiance(e) Visa Process & ProceduresClarification
ok - but - bear in mind -
any documents NOT in the 'list of stuff to return' in the OF-169 -

IF you 'send them' to GUZ IV, prior to interview day,

is no assurance, at all, that the documents will make it into the casefile at GUZ IV.

There's some notice floating around on the GUZ IV website about this (I think in the FAQ sections?)

so - anything on yer I-134 - she is to hand it over, on interview day.

It's up to you to get it into her hands, prior to interview day.

If you have true concerns about this, wei ! Get to Guangzhou yerself, a week prior to interview day, hang out with her in Guangzhou, be there for interview day. Then it's 'from your hands to hers' on the morning of interview day, in the 'massed line-up' outside of the Consulate Annex.

Good Luck, whatever you decide to do !

re: I think I'll scan everything and send it to the Consulate with the a cc for her with the originals
I truly hope you aren't suggesting to email 'everything' to the Consulate. It won't work.

If you are thinking to mail documents to the GUZ IV unit, mostly that doesn't work, either (exception - Packet 3 stuff) as GUZ IV doesn't keep stuff, and won't keep stuff, prior to interview day. SHE is required to 'hand over' much, on interview day, both to the documents pre-screener human and to the Visa Officer. They do keep stuff, submitted on interview day, after interview day...

re: police records
--for China, she can get this from the Big PSB in the city/district/province where she has her HUKUO book registration. The report that is issued covers all of China. If she is a migrant worker (city she works in, is NOT her hukuo registered city) then she'll need to either 1) get back to that city and have the PCC made there or 2) get her other family member, listed in the hukuo book, to obtain it for her at the PSB. ANY other family member that is LISTED in the Hukuo book is allowed to get this PCC on her behalf.
--for Singapore, she'll need to get the clearance. If she has a friend still in Singapore, then she can 'assign that friend' to be a proxy, acting on her behalf, to show up in person and get the report. IF SHE HAS NO FRIEND IN SINGAPORE, then it's possible to get it via postal mail request, expect a 4 to 9 week turn-around, with payment made with the submitted request.

re: affadavit of support form - if it's got a notarization block in it, that's the OLD ONE - GUZ IV is notorious for sending out older forms - they have this cr@p in storage and prefer to send it out rather than destroy it. Yup - that's for YOU to fill out, the petitioner, but it must be in the beneficiary's hands right prior to interview day - she's to hand it in ON interview day.

re: the list..
I'm assuming yer looking at the OF-169 , found at http://guangzhou.use...and_packets.htm

The only thing she's to send back IS the DS-230 Part I, and the filled out OF-169, and a filled out EMS label, and that's it. The remainder of the items on the checklist, she is to bring in on interview day.

any DS form is HER VISA APPLICATION, so when filling it out, use 'her voice' when filling it out.
--spouse - NONE for a K-1 visa
--parents - her parents
--ppl travelling with her - IF she has children that qualify, and IF they are coming in on derivative K-2 visas, you MUST list them. Parents, siblings, cousins, housemaids, do NOT qualify.

K-1 Fiance(e) Visa Process & ProceduresK-1 or K-3???

I see a lot of people, especially lately, applying for K-3, I also thought it was closed down but apparently it's a accepted now along the CR-1 at once.

Na, NVC will close the I-129F as it travels over with the I-130.

Sure, there are anomolies, but 'a lot of people' ??

One can always apply, is nothing to 'stop' this applying, but it slows down the USCIS time (2 to 11 weeks) and usually the end result is that the I-129F is administratively closed at NVC.

the sponsor is obligated to support them financially until they have worked 40 quarters or obtained U.S. citizenship.

It's correct for the I-864, though.

which, for a K-1 visa filer, may come LATER during the AOS process -
but never at Guangzhou for a K-1 visa.
DarnellMaleChina2010-10-08 17:06:00
K-1 Fiance(e) Visa Process & Procedurescosponsor
some places - yes, that's true.
also true, is that GUANGZHOU IV (where you have an interview) DOES allow co-sponsers and joint-sponsers for the I-134.

I-134 for YOU and I-134 for Joint-Sponser (that's 2 I-134 documents) are
submitted on interview day, in Guangzhou.

NEVER prior.

blank medical forms you downloaded off the GUZ IV forms site
( http://guangzhou.use...and_packets.htm )

and go back to the doctor, new blank (and double-sided) forms in hand.

K-1 Fiance(e) Visa Process & ProceduresTwo interviews and still inconclusive
good luck with them re-opening the case for re-consideration and re-adjudication - I pray all works out next week.

When a USCitizen inside an IV unit says 'denied, we're sending back to USA' - that's usually it - done, finito.

If , instead, yer dealing with 221G forms, then you have a big chance whilst the casefile is still in Italy - yer given 'direct opportunity' to 'fix all' again.

I really do hope you have a lenient CO/VO for this upcoming week - otherwise tell yer fiance to file again.

HEY ! It doesn't hurt to try, right? to give them 'more stuff with a pleading letter' for the upcoming week - it doesn't hurt to try it, at all.
DarnellMaleChina2010-09-26 15:21:00
K-1 Fiance(e) Visa Process & ProceduresTwo interviews and still inconclusive
ok - so the casefile is being sent back to USA, USCIS, CSC office, with some type of denial.

CSC may or may not re-adjudicate the petition. I don't know, sorry.

IF the petition is re-adjudicated,or PEGGED for re-adjudication -
then the USC Petitioner will receive some postal mail about it.

IF CSC wants 'more stuff' from the USCitizen Petitioner, CSC will inform him of the need via 'yet another postal letter'.

Turn around time? Anywhere from 2 months to 2 years. Final results? USCIS upholds the denial from US Embassy, OR they refute the denial, submitting the entire casefile, the re-adjudicated petition with recommendation to approve, back into the 'pot' - where it will show up again at the US Embassy, and you'll have another interview sometime in the next 2 years.

If I was yer USC Petitioner, I'd file a new I-129F petition this upcoming week, and address all concerns presented in the interview at the US Embassy, in the form of 'letters of attestation' to 'cover red flags', with a letter of attestation for each red flag. Near as I can determine, you have issues with 'civil documents' based on 'name discrepancies'. But that's only what you've written about, here - there may be more red flag issues to cover in any letter of attestation. When you have a moment (some homework for you) - sit down with pen and paper, and try to document the entire conversation of the interview - who said what, in what order, and when. Study that piece of paper, then try to determine what the other issues were, if any.

A 2nd-filed I-129F petition actually 'goes faster' through USCIS than the first one, most of the work has already been done. Is possible, if the casefile is prepped properly, to have 4 months between 'filing' and 'interview day'.

He'll need to include wording in the cover letter, asking for an IMBRA WAIVER, as well, as this will be the 2nd filing from him, even though it's the same person.

Good Luck, whatever you decide to do !
