However, if you not submit a 'full packet' then it's simple for USCIS to deny the application. Usually, the denial comes about a few days after an adjudicator actually GETS to the casefile. There's a queue, aye? and they just 'read yer stuff' moments ago, it was yer place in the queue.

IMO, if yer still under the 2 year 'meet in person' thingie, by all means, file another I-129F, but this time, prease forrow the VisaJourney.Com K-1 Guide.

Now that the I-129F is approved, the fiance (foreign person) must apply for a K-1 visa at the Embassy. There's a packet of forms - you can study them, if you'd like, prior to the IV unit in Casa sending you stuff.

one of the things they look at is prior income, represented by a tax return of one or more years (2010,2009,2008) .
if taxable income in 2010 was an issue (deemed so by the visa officer) then i can understand the request for a co-sponser.

new medical forms as well? what's the date difference between her medical exam and the interview date? (in terms of days)

proof of domicile makes sense, as you are a recently returned USA expat.

It's a good thing they kept her passport - now 'the next thing' should be visa issuance - but she'll get some indication, somehow (postal, email, telephone) about it.

Alternatively, in a few days, YOU can call the DoS Hotline, ask for casefile status. (# in my profile, left panel, click the girls to see it) . DoS Hotline shares data with the Embassy IV unit - so if the visa has been issued, DoS Hotline will be able to tell you (but do wait a few days)

I don't see your age (8 years) an issue. I am the woman and the petitioner and I am 21 years older than my husband. We dated 21 months before marrying. Yes it was long distance online dating before we meet but we have much documented proofs and affidavits from friends and family to show this is real relationship. I am currently with him in his country and getting ready to start my filing process. We were just married May 3rd.

One thing I know is this interviewers are trained and know all the red flags of a "mail order bride/groom" marriage. I am not sweating it at all. Heck my husband is 1 year younger than my own daughter. But no worries. Stay tuned for good happy news as this journey of the immigration filing unfolds. Best to you and your wife.

Your best bet is to wait until after your approval and after your approved petition reaches the consulate where your fiancee will have her visa interview. You can contact the consulate directly, referencing the new case #you will have from the NVC (your petition will go there after it is approved by USCIS, and it will receive a new #) and give the consulate your fiancee's new address for them to send the Packet 3 to. My fiancee at the time had the same situation, he moved while we were waiting for approval, and I just contacted the consulate directly once I knew our case was there....and changed the address. smile.gif

Primary evidence is any evidence from an unbiased third party who has no interest in whether you succeed, and which the adjudicator believes is likely to be credible and authentic. For this reason, I believe the lease is good primary evidence. The question is whether it will be enough to convince the adjudicator. If there's any way an adjudicator could conclude that you could have signed the lease without actually traveling abroad then it probably wouldn't be enough. They've seen people pull all kinds of tricks to get a visa for their internet sweetheart without having to travel around the world first.

Dig out all of those boarding passes, visas, passport stamps, or whatever you've got. Have them ready in case you get an RFE. The faster you respond to the RFE, the less it will delay your petition approval.


As you say, is it credible enough for the adjudicator. There are countless sites having copies of lease agreements for public use...so it is possible to "fake" one. From what I can tell, the OP included the lease and photos...no other form of primary evidence, so it is very much up to how the adjudicator will see the petition. The other documentary proof should definitely be on hand, ready to go, in case of an RFE. Didn't I just see a thread recently where an I-129F was rejected outright for not having sufficient documentary proof of having met w/in the 2 years? I can't remember remember the particulars in that case, but I remember thinking, in that case, that they were proving their relationship and did not include proof of the meeting. I wonder why some 'overlook' this particular clause in the instructions?

Well I finally did it. After weeks of putting the I-129F packet together, I mailed it off earlier today. I have a few questions now, one of which in regards to showing proof of a relationship.

For this my fiance and I separately typed up, signed and dated a statement of how we met and our relationship up until this point. I also included various photographs dating from April 2008 when we met, photos of her and I with her parents in Germany in July 2008, her and I Christmas date 2008, Thanksgiving Dinner with my mother and grandmother November 2009, her and I in a photo dated July 2010 up until a photo of the moment I was on my knees proposing to her a month and a half ago in November. Instead of having the digital photographs printed at a CVS or a Walgreens, I pasted these photos into a word document and underneath each photo wrote the date, location and information about the photo hoping that they will see a few years of relationship captured in photos through the various hair cuts and hair colors (in her case) from through the past 2 1/2 years. As well, I also included a copy of two tenacy agreements listing both her full name and my full name as joint tenants in a flat dated March 2009 and February 2010. I didn't find it necessary to dig up old recepits and tickets and what not as I thought this proof would be sufficient.

However, I'm a bit of a worrier and would hate for anything to prolong the process. Do you folks with more know how in this matter feel I provided enough evidence or do you think they will request more evidence (ie - me having to dig up old receipts and travel tickets etc)?

Specifically, the I-129F does not ask you for proof of relationship, it asks you to prove that you have met in person within 2 years of your filing the petition. For this purspose you can use airline boarding passes, passport stamps, itineraries, train tickets, atm withdrawals (in the country/city of your fiancee), hotel receipts, etc.
The lease agreement you included, while proving that you two 'met' in person, is not necessarily "primary" evidence....such as boarding passes or passport stamps would be...IMO. You've already sent the petition off...so no use stressing over it. I would still dig up those old receipts, boarding passes, and copy your passport and have it ready in case you get an RFE.

Someone told me that petitioner can enter US embassy as US citizen but dont attend the interview, some say petitioner can be called upon, so whats really the deal?????

Also if the petitioner can make it to nigeria on the interview day, is it advicable to go with the fiance to the consulate on the day of the interview, even if the petitioner is not going to be interviewed...

If you have the money and time, pls do go and be with ur fiance.

Though you might not be able to enter the interview section with your fiance, as a USC, you can wait in the citizens section of the consulate.

Also there's been a case where the beneficiary was having a difficult interview, he mentioned to the CO that his fiance is outside if he wanted some clarifications, the CO invited to USC and she explained better, a visa was granted...

For me, I'll travel to Lagos and be with my fiance on her interview date, its worth it....

One last question... You say "an appointment at the GUZ IV unit." Is an appointment for notarization required? If so, any idea how to request it before I leave for GUZ?

2. evolution of relationship letter - if you go to GUZ - the big trick is to have it notarized at GUZ during ACS appointment. The ConOff that handles that for you, is big chance is the same ConOff that will be interviewing yer lass. When at ACS, talk a bit about the petition, but usually questions are handled at ACH, not ACS. Then - give yer lass your passport, with the EOR letter folded longways inside of it , then she gives the passport to him/her, on top of the I-134 set, during the interview ...

If so, print at high res, also.

Usually, if scanned at high res, can do some hue/color shifts in photo editing software,

First - if your state has a requirement that SHE has to have a SSN for 'marriage certificate requirements'
then
you'll need to get one prior to marriage, inbetween day 15 to day 74 of the POE date.

Second, getting a SSN at any SSA office, for a K-1 visa holder, is mostly 'hit or miss', as the clerks across the window are mostly clueless on how to do an intake on a K-1 visa holder. Most can be trained (by you) to look up yer lass in the SAVE database, and forestall any silly DHS/USCIS electronic verification (which dooms you to failure on acquisition, alas).

Third - actually getting the SSN within the 'time window' becomes immediately useful, as yer able to 'add her' to the many 'things' that you need to add her to, to generate some evidence for AOS and ROC.

Fourth - coming back the 2nd time usually occurs after marriage - either before that 74th day past POE OR after having EAD or Greencard in hand - to CHANGE the name with the SSA, if she wishes to take yer last name as HER name. This part isn't required, at all.

Some people think it's perfectly fine to wait until married, before day 74 of that time window, to go in and apply in the 'married name'. In general, I would agree, but specifically, this varies widely by SSA office, based on the knowledge of the clerks across the window. Some people have gotten lucky, some people have decidedly run into the 'bevy of dolts' that permeate the 'first level clerks' group within the SSA, and been told to return after green card in hand.

so, really, if yer goal is to 'get a SSN in a married name' then you really must plan and push, if you wish to make it happen for ONE trip into the SSA office.

It's your decision, ulimately. Keep in mind, though - remember when yer talking to USCIS clerks? How clueless they were? It's about 11 times worse at most SSA offices - and it becomes more painful - as not only is it 'face to face' stupidity, but each office has a security guard that can throw you out for challenging the stupidity of an SSA clerk.

If she has no job at the time of the K-1 petition filing, then she will need a cosponsor but cosponsors are not allowed or are rarely accepted at the Manile Embassy (I believe, check the regional forums for better info).

So she may have to find a new job and wait a bit so she can show current income. Short of that, if she has enough assets, she may be able to use those to prove financial worth to be able to support you. I may be best for her to not quite her job and only stay the two weeks that she is allowed. You guys can have an engagement part later after you get the visa and before you leave for the US>

I say, go ahead and file, job or no job,
but have the job prior to interview day
and

remember - the I-134 is filed and evaluated ON interview day - so yer USCitizen fiancee has anywhere from 6 to 9 months after she returns to USA, to actually land that job and get some serious coin. It's useful to study the timeticks on a K-1 timeline for Manila, get some deep understanding of what happens/when.

For amounts - study the I-864-P document - as the VOs in Manila use that same document for evaluating income .
Sometimes, a co-sponser is allowed, no clue about the reasoning for allowing (but read the reviews here)


Instead of thinking of 'vacation time' away from job -
instead, ask yer lass to investigate
unpaid sabattical or
unpaid leave of abscence
from her job, through the HR department or the Big Boss.

IMO, having a job on returning cuts out a lot of silliness,
and an 'unpaid leave of abscence' is not so difficult to secure back at the company. Do bear in mind, though, that any unpaid leave of absence MUST BE NEGOTIATED prior to leaving.

usually - 'interview date set' between 2 to 8 weeks after GUZ IV logs the received P3 packet, for an interview date somewhere 4 to 12 weeks past the 'interview date set' date. At this stage, most depends on namechecks initiated by GUZ IV.
