Some requirements have changed so don't go by what you read 100%.
COs changed since then naman but aren't much different now as they were then.
They still are god and can destroy your life with a check in a box with a ball pen if you don't have your act together.
Sad but sometimes even if you do!!

This came from the old Asawa forum.

It's best to tell the truth. you are declaring that when you sign the DS-156:

I understand that I am required to submit my visa to the United States Immigration Officer at the place where I apply to enter the United States, and that
the possession of a visa does not entitle me to enter the United States if at that time I am found to be inadmissible under the immigration laws. I further
understand that my adjustment of status to permanent resident alien is dependent upon marriage to a U.S. citizen and upon meeting all of the requirements
of the U.S. Department of Homeland Security.
I understand that any willfully false or misleading statement or willful concealment of a material fact made by me herein may subject me to permanent
exclusion from the United States and, if I am admitted to the United States, may subject me to criminal prosecution and/or deportation.
I hereby certify that I am legally free to marry and intend to marry , a U.S. citizen, within 90
days of my admission into the United States.
I do solemnly swear or affirm that all statements which appear in this application have been made by me and are true and complete to the best of my
knowledge and belief.

PhilippinesK1/K3 co sponsors USEM
QUOTE (beckypua @ Sep 25 2007, 12:59 AM) <{POST_SNAPBACK}>
Recent response to an email from USEM regarding exceptance of co sponsors for K3 visas.

This is in reply to your inquiry regarding co-sponsorships in K3
nonimmigrant visa cases.

Petitioners in K nonimmigrant visa cases are generally expected to
establish the adequacy of their own financial resources to ensure that
an alien, after admission into the United States, will not become
primarily dependent on the U.S. Government for subsistence. While our
immigration law does not disallow using a joint sponsor when the
petitioner cannot meet the minimum income requirement, co-sponsorships
in nonimmigrant visa cases are not legally bound to address the
financial needs of the applicant. The simple submission of Form I-134
by a co-sponsor is, therefore, not always sufficiently credible to
overcome the public charge provisions of Section 212(a)(4) of the INA.
In assessing the credibility of co-sponsorships, we look at the totality
of circumstances.

For information about financial sponsorship guidelines, you may visit
the U.S. Citizenship and Immigration Services (USCIS) website at
http://www.uscis.gov.

Looks good!

You may need a letter of consent from the father for your anak to immigrate.

Also it's WAY better, logistic wise, if anak accompanys you to the US unless you are planning to go back and get him.

Looks like you aren't planning to take anak to the interview as you don't have DS forms for him.
I suggest you look into doing so.
Easier now than mamaya!

when you AOS remember also to apply for Advance Parole in case it takes longer that expected for GC...
the K-2 to to be issued within one year from date K-1 is issued, so remember to allow enough time to set up an interview.

PhilippinesQuestion about child
QUOTE (Tsup2 @ Oct 7 2007, 06:39 AM) <{POST_SNAPBACK}>
My Fiance has a 3 year old son. The father is an American who abandoned her when he found out she was pregnant. The birth certificate does not list a name for the Father and is blank. I am concerned that embassy officials will want the identity of the father and require his permission for her son to leave the Philippines. He is in the United States and his whereabouts are unknown. Even if his location was known and we could contact him there is no incentive for him to assist her since if the child came to the US and paternity could be proven he would be subject to paying child support. Does the embassy require permission from Filipino fathers for their child to leave the country. Any info appreciated. Thanks

the child is in sole custody of the mother. there should not be any problem. I've been thru a similiar situation where no father is listed on the birth certificate.

Hi. We got our NOA2 October 1 and I am going to start collecting my documents for affidavit of support while waiting to get through NVC and get our manila case number.

My questions are:

Can anyone please help us by postinng what I should include with the affidavit of support form in a list? Also I am going to use my sister as a co sponsor, can I do this? If so, besides her filling out an affidavit of support too, what other documents she needs to include? Will it be the same as mine..like for example if I were to include pay stubs and etc..she will do the same? Thank you guys in advance and God bless.

yes, you can use your sister as a joint sponsor. copy of 2006 tax return and W-2 should be fine for your sister.

You need to show proof of having met. Do you have that documented? I would recommend that he come visit you.

Once you returned to the Philippines the initial petitioner is no longer involved.

I agree. the requirement of having met in the last two years will have been met if you have documention as proof.
his visiting you in the Philippines will give you stonger evidence of a genuine relationship when it comes time for the visa interview. I'm sure you'd also like to spend more time with him and have him meet your family.
best of luck with your visa journey.

yes you can. you should have plenty of time to go home and visit your family. you have six months to enter the USA once you been issued the K-1 Visa.
after going home, you'll need to attend CFO since you'll be departing the Philippines with a K-1 Visa. that's a requirement of the Philippine Govt.
best of luck. good.gif

My friend got her K1 visa in HK US Embassy and went backed to the Philippines to see her family before coming to the US and didn't take CFO....so far she's here already without any problem exiting from the Manila airport without attending the seminar.

sorry if I gave misinformation. i was going by the CFO website which says all Filipino Emigrants and spouses/fiance's of foreign nationals must register with CFO and attend a seminar before departing. http://www.cfo.gov.ph/

NOTE: The above is an except from most recent Packet 4, which can be obtain electronically from the USE website. Maybe just having transcripts from the IRS will cover not having the W2s. However, I would think that it would be a good practice to at least provide the minimum requested (especially if it's spelled out in black and white). If I were the CO, I would put you on AR until the W2s are provided.

I can see why there might have been offensive taken about the comments made on Filipino and American family values. there are differences between traditional Filipino and American family values, but that doesn't mean there is no sense of obiligation to the family here. economic conditions are why you see so many Filipinos sacrifice being with their families to go overseas. there might not be pressure from other family members to go overseas, it can come from the obligation felt and the desire to better the sitituation of their family.
The Op has a K-1 visa in hand. I at least give her credit for not using it if she has doubts about her relationship with the petitioner. we may not agree with her lifestyle choices or what we feel is her stringing along those involved with her. at least give her credit for trying to do the right thing.

Well said, Roy, although as far as her doing the right thing - this should not be a dilemna for her. She should tell her fiance the truth and end the relationship, IMO.

Tsup2:

HOME: Get a youtube.com account so she can watch Filipino shows/soap operas that she likes (if interested). Some folks get the Filipino Channel via cable/Direct TV/Whatever. Oh, you'll have to get deeply involved in showing her around the city and getting her out of the house. As Haole stated, if you have a home computer, be sure to have internet connection along with a webcam and microphone so that she can chat with friends and family back home and everywhere else.

FAMILY: If she has a Smart or Globe account, tell her to keep it active and check whether her family can eload her account. That way they can text her cheaply. Consider getting an international text package with your local carrier or do a cost analysis on having that versus loading the Smart or Globe account. In addition, if your family is close by, try to keep them engaged in communicating and social events with your wife.

COUPLES: Check here on VJ to see if any couples live in your area so that the wives can mingle and hopefully develope friendships. She might be shy about this so you will have to take the lead and make it happen.

HEALTH: Work out together. Talk walks together. Potentially obtain a gym membership for her or the both of you. If she likes intramual sports, check with the local parks and recreational centers for listings.

SHOPPING: Consider finding an Asian Market where she can gather known ingredients for those awesome Filipino dishes. Also consider finding some Filipino Restuarants in your area (if any exists).

SCHOOL: Another idea is for her to enroll in ESL classes, tech school, nursing school, or whatever (if she is interested).

VOLUNTEER: You might consider checking out volunteer work for her (if she is interested) at the hospital, library, schools, YMCA, and etc (well this is at least until she is able to work).

That's all for now...

Cheers!!!
