IR-1 / CR-1 Spouse Visa Process & ProceduresWhat can your prayers do?
QUOTE (shaerbd @ Nov 8 2009, 03:02 AM) <{POST_SNAPBACK}>
What can your prayers do? I am a pragmatic person by nature. I always believed that when someone deserves something, s/he will get it no matter how many people pray for him/her. I think I deserve to pass my IR1 interview tomorrow (9th Oct). I prepared well, I am in a serious married relationship with my spouse. But what I hear nowadays, every guy aged 18-65 facing the interview at the Bangladesh embassy is getting AP. So I am in a sorry state of mind right now. I have waited three long years to get together with my wife, and I cant take it no more. And when all hope is lost, people turn to their Creator. And I hope my Creator will bless me. And I ask all of you, whoever you are, reading this post, to pray for me, for us. I know prayers alone can't do anything, but I need them more than ever now. Please, wish me the very best. Take care and bye smile.gif

did he get a slip for the denial? because if he was denied they will give him a slip saying why and what you can do there is always an appeal or further review if they suspect fraud ( they would normally return your file to USCIS and denied under INA 221G)

IR-1 / CR-1 Spouse Visa Process & ProceduresIRS TAXES UGHHHH

Yep, its that wonderful time and being in the crosshairs of a very busy and hectic schedule here I am only briefly understanding how to file for my wife and I for taxes for last year. My wife and I married in April 30th 2009 and she finally got inside the country on January 8th 2010. She is supposed to recieve her Social Security card before the end of this month, i want to clarify something with all of you professionals out there. Can i include her social security number for my taxes for last year or do I have to file to get a tax payer identification number for her even though shes getting a Social. My logic intuitively tells me that I should be fine with her social security and just file as normal - married filing jointly and online. But i just do not want to get dinged and hit with an error that says I left out the part that her social security only applies for 2010 and i need a tax ident # for last year.. Please let me know.

James

you can file head of household since your wife did not live in the country for 6 or more months in 2009 you do not need to include her on your return(that's the year you are filing for not 2010) next year you would file married filing joint or married filing separate

Ummm... I was looking through all my paperwork, and I can't find any of my receipts... I had some for the hotels that we stayed at in India as well as the wedding venue that we rented... I cant find them.... sad.gif How important are these receipts for the interview process for the K-3 visa? Will my bank account work with the day and place highlighted showing where we payed for it? Can he go and get duplicate reciepts?? anyone else had this happened? Aaaargh... I called myself being really organized... I pray that I have just put them in a very safe place that I will soon discover BEFORE we actually need them. biggrin.gif

Same happened to me on the hotel receipts. I just included a copy of my credit card bill and hi-lighted the charge. the receipt had both the hotel name and city. I received no RFE's.

By all means try to get duplicates, but if not go the way I did. Better than no receipt. If asked.........tell the truth they were misplaced in the all the traveling. Good luck

IR-1 / CR-1 Spouse Visa Process & ProceduresHow to mail

When I have all my ducks in a row and get ready to send it off, what is the correct way? Priority mail? Reg mail? Return receipt?

It depends on how fast you want the USCIS to receive your package and how much you want to spend on postage. I sent mine by Priority Mail as a Certified letter, so that I would receive a receipt. It's not necessary to send as a certified letter, because you NOA-1 is your notice of receipt.

I just purchaase a ticket from Camaguey to Miami (one way) and it was 287cuc with aeroazul. flying from havana is a bit cheaper. You can also used the airline skyking to fly out of Cuba to Maimi, but the price is the same. the purchase must be in cuba, and needed to before the carta blanca is given. I'm not sure whats the cost with the carta blanca as of now. hope this helps.

thank you for that info, I am going right before the interview with the hope that i we can get the visa and carta blanca in time for him to come home with me, but it impossible to plan cause of course you never know!! but it would be so great and also very helpful as together travel would be a dream seperately ehh not so much... any way again thanks, do you know anyone who books aeroazul or skyking from here for me?? probably well endup flying seperate but I hope not..

Unfortunately, the ticket will have to be purchase in Cuba at the local havanatur office. It’s a requirement when immigrating permantely.

IR-1 / CR-1 Spouse Visa Process & ProceduresCancelling K-3, and doing CR-1, HELP!!!! before i do something stupid!
QUOTE
You don't cancel the K3. The K3 process involves filing both the I129F and the I130...

You don't cancel the K3 and start over with the CR1. I think you are confused about the process. You have already filed petitions for a K3 visa and a CR1 visa. You don't need to start a new process. YOU stated that you have only received a letter stating that your I129 was sent to NVC. What I was trying to explain to you previously is that if you want a CR1 visa and only your I129f moves forward to the embassy, you will only be able to apply for a K3. MAKE SURE YOUR I130 MOVES FORWARD AS WELL so that you will have the option of applying for a CR1 visa.

You need to ignore correspondence for the I129F which corresponds to a K3 visa. Since you have only received a letter making you aware of the I129F being forwarded, you need to at some point (maybe in a few weeks) call the service center and NVC and make certain that you I130 petition get sent to NVC.

Just ignore any 129f correspondence and focus only on the 130 petition that will allow you to apply for a CR1 visa.

I hope the process is clearer for you.

With the K3 process the I129f and I130 are linked together. Both petitions have been approved for you. Both petitions should be forwarded to NVC. But you only have a letter stating that the 129f was forwarded. At some point your I130 petiton will be forwarded to NVC as well but you need to make sure this happens.

Please make sure you are clear about the terminology you use if you attempt to write to abandon your i129f. If you say you want to abandon the K3 process you might find yourself abandoning both the 129f and 130 petition (the entire process).

The process can get confusing, maybe it is best that you just focus on making sure the I130 gets to NVC and then the embassy so that you can apply for the CR1.

You don't need to do anything else other than make sure that I130 gets forwarded to NVC so you can later apply for a CR1 visa

Thank you so much for the information, i will pass this along to anyone that is going through the same thing as me. So as said , i am just ignoring the K3, not canceling.

Thankyou

IR-1 / CR-1 Spouse Visa Process & ProceduresCancelling K-3, and doing CR-1, HELP!!!! before i do something stupid!
OK , from everyones help here , i have decided to go the CR-1 route. I originally was going for the K-3.

First off let me say , both my i 130 and 129f are approved for K-3.

So, she tells me to cancel the K-3 and to start with the CR-1. I need to write a letter to Vermont SC and state why i want to cancel the 129f, then i need to goto www.travel.state.gov and www.cbp.gov and file separately. I don't want to do something stupid here, please advice, and god bless!

Whats my next step?

(the other thing i thought was funny was she said it wasnt called CR1 it was called C1) blink.gif

My wife is applying for the CR1/K3. According to time lines, this will take almost a year to process. Can she apply for a tourist visa from the nearest embassy/consulate in China after we've filed for CR1/K3?

Would the tourist visa interview officer think that she's going to come to the US on vacation and not leave the US because she has a husband here?

Also, does anyone have experience applying for Chinese tourist visas to the US? Do Chinese tourists need to go with tour groups? Or can they roam freely?

yes

probably

if she gets a visa and is granted entry into the USA she can roam freely... the big question is will she be given a visa and allowed into the USA...

My wife did exactly that through the consulate at Shengyang. She was here for 3 months then returned to China to wait for the K-3 interview.

Hey ML, you're right-send photocopies this round! You sound like me-receipts, emails, greeting cards, etc...I'm not even sure if I mentioned that I sent greeting cards! ha! If they ask for more from me, I have nothing more! I don't know about the laser prints. I haven't seen that mentioned yet.

Are you filing next week???? Hey, great wedding pic in your profile!!!!

wow.gif OMG i think you did overdo it! lol rofl.gif
