I think we are going to not risk it, and just continue to meet in Russia and Europe. brokenfamily, I hear what you are saying, and hopefully they don't give us any ####### about getting married on the B2. We really didn't think we would get married on that visit, we ended up planning it in 2 weeks, she found a dress, we found a company to do the ceremony on the beach, got a cake, etc. Only my parents and kids attended, so it wasn't some huge wedding that would have taken months and months to plan. Hopefully the powers that be believe us. Thank God we didn't listen to a bad attorney who told us she should just stay in the US and apply for AOS! IR-1 / CR-1 Spouse Visa Process & Procedures	Visiting US on a B2 visa while awaiting I-130	This question is related to an earlier post I made about the J-1 visa and I-130 application. Can my Russian wife visit the US on her valid B2 Tourist Visa, which is a 2 year multi-entry visa, while she has a pending I-130 application? Some people have said she will be turned away at the airport because they will assume she is going to stay, since she will have an I-130 application pending. Other people have said as long as she shows supporting documentation that she will leave after a short stay (2-4 weeks), they will let her in. I assume such documents as return plane tickets, business obligations back in Russia, etc? We hate to risk the money and heartbreak for her to fly all the way over here and get turned around without even seeing each other, but if it isn't that likely then we want to try it. A Russian friend of hers is married to a guy in the US Army and she says she has done it a few times without being denied entry. Also, we got married here last June while she was on the same B2 visa, and she returned to Russia in July rather than trying to stay here. Doesn't this show her ability to "play by the rules" and earn us some brownie points with Immigration? (as if there are such things!). Anyone have any experience with this? Thanks! IR-1 / CR-1 Spouse Visa Process & Procedures	What if visa is refused at the embassy	Hi vopilka My wife is in the same situation. She is Rusian and came to the US on a J-1 visa that has a 2 year HRR. She returned to Russia 2 years ago yesterday, but she has left the country many times over the last 2 years for business and pleasure, including coming here last Summer for 3 months to marry me (she had a valid B1 Tourist visa). If you add up all of the time she has been out of Russia for vacations and business (Italy, France and the US) then you add an additional 5 months. We submitted the I-130 application in February and got our NOA1 on March 2. We are hoping to get our I-130 approval in the next 4 weeks. The average time to get a visa interview in Russia after I-130 approval looks to be about 5 months, which would be in November for us. So, her additional time out of Russia will be fufilled by then anyway. We would like to have an interview earlier and hope they don't count all of her travel against her, but it is a big risk to take. We are within 6-7 months now, and like someone earlier said, if they deny the visa at the interview you probably have to start the process all over. That is why we aren't going to submit our paperwork to NVC TOO quickly, because we don't want an interview before November. If we DO get a date before then, I am afraid that asking for a later interview date will put us way back in line again. Not sure how that works, but it doesn't seem worth the risk now. It's really quite simple to print out the cover letter. You go to the same sign in page that you went to when you paid the AOS and after it shows paid on the receipt, right under the part that says to click to print receipt, there is a place that will show up for you to print the cover letter for the AOS to send in your 864 packet. It usually takes 2-3 business days before it will show as Paid on the website before you can access the cover letter. Mine finally showed Paid last night and I paid for it on 10/10/09. I saved the I-130 and the I-129f packet copies until I received the NOA1 and NOA2s and sent it all to my husband. Then once I got the receipts for the AOS and the IV bill, I made copies of those and a copy of the IV packet plus copies of phone bills, text messages to his number, emails, cards, letters from my relatives and 2 big photo albums to take with him for his interview. I don't want them to say that he didn't have something they needed. Oh! Also after reading a couple of interviews, I sent him my original divorce papers from my ex-husband. I had my husband get his police certificate, military record, birth certificate with translations and send it to me. Along with the ds-230 he signed the first section and with our marriage certificate and his biographic page of his passport and 2 passport size photos, I mailed it all in to the NVC. Put a copy of all the papers in with it so that way they will give him back the originals at his interview. The NVC will dhl his originals to the embassy and send you two a letter(email) telling you where he needs to go for his medical exam and the date of the interview. Your husband can get extra certificates to take with him to the interview if he wants, in case they loose something, but the NVC suppose to send it to the embassy. Hi, First and foremost happy new year everyone We are at the final stage of the visa process at the National Visa Center and are a little puzzled. We submitted our final packages ~both I-864 (AOS) and DS230 (IV) ~~ sent separately the same day and they were delivered at the NVC on Dec. 21st according to the tracking service. When our case first arrived @ the NVC, I ( the beneficiary) emailed the NVC my choice of agent and received an email response back accordingly. We paid the IV and AOS fee with a money order and have not used the online payment services. I´ve read in this forum and noticed that once NVC approves the case the login will fail on the online payment site, but since we never used that is there any other way we will know when this case is over? . Will they email us with a notification once the case is completed or?. Any help to clear this up will be greatly appreciated. Wishing everyone a speedy process You can call the NVC and listen to the AVR to hear if they have given you a case complete too!! IR-1 / CR-1 Spouse Visa Process & Procedures	NVC MISSING DOCUMENT	AVR tell me next NVC has review you documnet and found information missimg or incomplete, we sedn you a leter on Januari 25, once this information are recive please alow 6-8 weeks for review and that you will be notifay. , so i call NVC and ask them what is wrong,and i was told what is wrong, than i ask when i will receive e mail, since AVR tell me do NVC send leter on January 25, and today is January 26, so way i did not receive e mail from NVC, the answer was ,,It has not yet been generated , you will receive email shortly,, So did anybody know when that shortly will be? When your paperwork arrived at the NVC did you call and give them your email address? I gave them our email address and all of our correspondences has been through emails. We got a RFE on our ds-230 also and I found out via the AVR also. Then a couple of days later we got the email stating exactly what was missing. I never got any notifications in the snail mail. I would think if you haven't gotten the email by this Friday, I would call and talk to the OP again. I know getting RFE stinks, it took us a whole month to get back on track from ours!! IR-1 / CR-1 Spouse Visa Process & Procedures	OMG, wrong case number!	OMG, somehow I signed up for online/cellphone updates with the wrong case number. After I got it from my husband (he doesnt have fast internet), I signed up online. Somehow I must have put an 8 instead of a 4. Today, we got a message and wanted to check online and recognized I put in the wrong number. As soon as I recognized this happened, I tried to go to the uscis site and logged in. In my portfolio I wanted to get rid of the old WAC number and put in the right one. But it always says internal error. What can I do? I didnt do this on purpose!!! Any suggestions? You should beable to go in and put in the correct WAC number. Or at least add to the wrong one!! I was able to put in 2 different case numbers when I did mine. I already have my greencard. backinthestates I can tell you from experience that Department of Revenue and Child Support will find you and they are worse than immigration. As far as the I-130 is concerned if your name is on their birth certificate or if you signed any documents saying you are the father YES you will get in a lot of trouble and Green Card revoked, but if not the mother has to take a paternity test before you would be placed on child support (take care of your kids if they are yours better to resolve without going through child support). ps. just hope she does not report you to the US Embassy in her country Edited by MsSheka, 25 August 2009 - 08:50 AM.
