This makes me worried though... there was a time I may have overstayed by like ... 1 hour :P ,, but when I visited a few months after that.. I was approved for entry just fine..

IR-1 / CR-1 Spouse Visa Process & ProceduresCSC to TSC WHAT I'm Doing ! ! !
Are the transfers from the CSC to the TSC causing confirmed delays then?

If this is the case, USCIS should really be obliged to expedite, since they are responsible for the delay. However, unless it caused a large delay to your petition, I don't see people getting granted expedites. Expedited cases are usually only for extreme cases where spouses need to be together sooner and you must satisfy the expedite criteria.

IR-1 / CR-1 Spouse Visa Process & ProceduresCan someone sponsor them selves to USA on a CR-1 ?

Hi,
I was wondering if someone could sponsor themselves to the USA on a CR-1 visa. I can not start work until frbruary so i can not sponsor my husband to get here. If he shows that he will have a job when he gets here that is about 125% poverty line guidelines, is he able to "co-sponsor" himself?
I might have a company or two willing to do so. But because it is a family visa the company can't bea co-sponsor it has to be an individual.
Thanks!

When he arrives in the U.S, if his income is coming from the same source as it was before he immigrated, then he can help meet the income requirements on the I-864 Affidavit of Support. If the income will not come from the same source, I think you will need to find someone else willing to be a co-sponsor

IR-1 / CR-1 Spouse Visa Process & ProceduresIm going HOME
bit of a question for you Richi, something I've become slightly concerned about..

When we filed the I-130 stuff, I only wrote my permanent address (I've been there over 10 years) on my G325-A, however, for a period of about 6 months I went back and forth to a temporary address for university that I did not include on the form (Loto actually said this would be fine?? B-) ),

I am wondering if I should have included this afterall, as the DS-230 asks to list ALL PLACES lived in for at least 6 months. I realise I should probably include this other address on that form, but I was wondering if I need to mention that address for my police certificate too which I'm about to send off for.

Think this may cause any issues? I'm sure it could easily be explained and corrected.. but still...I'm a paranoid sod.

Thanks mate

IR-1 / CR-1 Spouse Visa Process & Procedureshelp with expedite

hello lovingu,

I am glad to find someone who is 100 p&t and receive all the same benefits as me, I spoke to my doctor
today she said she would write my letter stating the reasons for expedite. trying to call the CSC now to ask for
expedite. if i may ask how do you plan to show in form 864 for income and taxes , as you know we dont file taxes and all of our income is tax free. any advise will be appreciated.

You will need to call USCIS customer services and request an expedite, make sure you ask to speak to a Tier 2 representative. They will ask you what grounds you are requesting your expedite. Give them your email address if you have one. In a couple of days, you will either be emailed or mailed with a request for information from USCIS. They will ask you to fax any doctors letters for the attention of a specific officer. They will also ask for the letters to be in "layman's" terms and will ask wether the medical condition is acute or chronic, along with the prognosis. Once you have faxed the documents, you should call USCIS every week to check the status. Make sure you always speak to a Tier 2 rep.

You do NOT have to ask for intervention from a U.S senator, but you can if you wish. When we expedited, we were approved without any help from a senator.

GOOD LUCK :)

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A confusion

thats what we did mate. my wife, fil and mil live in the same house. wife did 864 and fil did 864a. wife was on disability and doesnt file taxes, so she just wrote a letter confirming her status. fil did transcripts and w2. mil didnt fill out anything.

and also copies of his bio page in his passport and front and back of driving licence to confirm id, status and address.

exactly what i wanted to hear. Thanks so much my friend.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A confusion
Thought i'd add, my mother in law is recently unemployed so no need for her to complete an I-864A, father in law meets the level of income on his own.

if someone can confirm that all we need are the IRS transcripts and his W-2s showing individual income, that would help :)
Paloma&AdamMaleUnited Kingdom2010-12-30 18:38:00
IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A confusion

Tax transcripts alone won't work in this circumstance. He should state only his own income and document it with W2 forms either as part of a complete tax return or in addition to the tax transcript.

Unless your wife lives at home with her parents, he can't use the I-864a. He would provide the I-864. If they all live together, you can solve the problem with an I-864a from each parent.

this is as I thought, thanks!

So to confirm, as we will all be living in the same household, my father in law completes I-864A and includes W-2's along with the IRS transcripts which are joint with his wife?

We only require him as a co-sponsor, not his wife.

Obviously I realize my wife must still complete the I-864 as normal.

Anyways, in regards to the I-864 stuff, we're just gonna get a hold of my FILs W-2s to accompany the IRS transcripts, just to be on the safe side :)

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A confusion

I know my MIL is named on the transcripts but Im sure he files for them both on just the one. Actually they are both retired and Im sure it was his income that we used, the MIL was just named....if that makes any sense?!
So it was my FIL acted as co-sponsor he named his wife but they file jointly.

When the paperwork got to me - they were 3 thick bundles of paper - totally confusing me too!!

They are both just retired so I know he files for him and his wife.

So thats good news, you have a case number - I assume you've put your expedite request in at the NVC already? If you can, try to keep on top of it there too, now the NVC will speak to the beneficiary you can call them too and ask the status of your file at the NVC, and if the request has been forwarded to the embassy yet. If it has, you can push from both ends - the NVC and also contact the Embassy to see if they have your file yet.

Only just got assigned the NVC number yesterday mate, was abit slower than i expected! The wifey is gonna email the expedite request real soon. A late January interview would be sweet!

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A confusion
hello mate :)

Yeah there is a question on the I-864A asking for individual annual income, then below it asks for the income for the last 3 years as stated on the federal tax returns.

I have a feeling the IRS tax transcripts just combines all income together is filed jointly, which my in-laws have. I don't think it differentiates between who earns what. I have a feeling it would be safer to try and get my FIL to get us his W-2's.

And we do indeed now have our case number

I'm pretty much doing the exact same thing as you, using Father in law as co-sponsor, but did your mother in law file jointly with him? Cos I think joint tax returns is where things get more complicated

Absolutely certain--if you provide the transcripts, you need to file NOTHING else.

but how would we show what the co-sponsors individual income is ...since it will be lumped together with his wife's on the IRS tax return transcripts.

It's not that I don't believe you guys, just want to be 1000% sure, i've read lots of conflicting information.
Paloma&AdamMaleUnited Kingdom2010-12-30 11:58:00
IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A confusion
The I-864A instructions say that you not include copies of W-2's or 1099's if you provide an IRS transcript of your return(s) rather than a photocopy. We are including transcripts, but because co-sponsor files taxes jointly, we thought we still needed to include them.

Man, this stuff is confusing
Paloma&AdamMaleUnited Kingdom2010-12-30 11:49:00
IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A confusion

Sending tax transcripts means you don't need to send the W2s. If you were sending something from say turbo tax (copies) then you would need to include the W2s.

are you sure? I've read a few threads that say otherwise. Because the co-sponsor files JOINTLY with his wife, the adjusted gross income is combined together is it not? As he is the co-sponsor don't we need to show what his individual income is? This is why I thought we needed the W-2s.

The USCIS instructions say:

If you are using the income of persons in your household or dependents to qualify,
___
A separate Form I-864A for each person whose income you will use. However, an intending immigrant whose income is being used needs to complete Form I-864A only if his or her spouse and/or children are immigrating with him or her.
___
Proof of their residency in your household and relationship to you if they are not the intending immigrants or are not listed as dependents on your Federal income tax return for the most recent tax year.
___
Proof that the intending immigrant's current employment will continue from the same source if his or her income is being used.
___
A copy of their individual Federal income tax return, including W-2s and 1099s, for the most recent tax year, or evidence that they were not required to file. You may submit this information for the most recent three years.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864A confusion
Little bit confused about this,

My father in law is going to be co-sponsoring me as my wife's household member. We have his IRS tax return transcripts on the way to us from the IRS. He files his taxes jointly with his wife. Do we need to include his W-2's to show his individual income or should this information be on the tax return transcript?

We ordered the longer tax "return" transcripts, not the tax "account" ones. I've seen people mentioning something called a "wage and income" transcript, is this the same as the tax return transcript?

Any clarification here would be appreciated.

There's no way around it - as a friends of mine from here had his interview just a couple of days prior to his interview. When he attended the interview, they couldnt give him an answer until they had received his medical results. Ultimately he was denied after attending a second interview - due to a medical issue.

I would recommend having the interview as soon as you have your case #. Thats what the doctors asked me for on the phone. And you also have some paperwork upon attending the medical, which is why they require it.

When I booked my medical, they were not so busy, so from the day of phoning to the day of the medical - it was about 9 days or so, thats all.

Good luck, hope it goes smoothly for your husband.

Yes, the case number the NVC assign is the one that will follow you right thru the embassy too.

Richi is right though, I am going to be be arranging my medical exam on tuesday. Best to have it done as soon as possible and get it out the way, one less thing to worry about

Hey Paloma & Adam, congrats on your expedite, such a great holiday present! Glad you guys will be together sooner xx

Our case was expedited also (different criteria) and now we're collecting all the documents for the NVC stage. Sorry to tag along on your post, but wanted to ask RichiJenny or one of the others from the UK about the medical process. We didn't realize you could schedule your physical before the consulate received your case! Do you just ring up the docs in London? How long a wait before you can be scheduled? Do they look for a case # or anything? Also, how long does it take results to get back... just wondering if hubsy could do it all in a oner by taking a week off work and travelling to London to do the physical and then have his interview (once scheduled) a few days later, or if he'd need to make a couple trips. Lots of questions, I know, but we're hoping to get more info before he books any train tix or whatever.

The medical must be done in advance of the interview. I think you you need to allow at least one week between for the medical results to arrive at the embassy.

You can book medical exam as soon as your NVC case number is assigned, which yours obviously has been.

Go here > http://photos.state....ical_letter.pdf

This explains everything you need to know about the medical exam in London :)

Quiet mate, not looking forward to getting out to the snow on the east coast either!!

The medicals not too bad, just make sure you have your jabs up to date before you go - cos they really sting you there, 30 odd quid a throw for one injection. Luckily mine was all up to date so I was all set.

Its not a totally nude exam. First you go in and have the chest x ray in a seperate room. thats ok. Then you go back in the waiting room til you're called. Then the dr calls you in. Height weight eyesite etc, then lay on the medical-bed type thing and presses on your stomach, back, pulls the curtain and tells you to strip to your undercrackers. SHE ( i know - ithought #######)! then gets you lay back on the bed, takes your blood pressure, takes a blood sample - then lifts up your undercrackers and has a look at your Jacksons.
Then its over!

hmmm doesn't sound tooo bad :P Looking on the embassy website, there's a medical questionnaire that needs doing before turning up at the medical, do you fill that out there or have it completed beforehand?

Also, Im not sure if I told you - but when you call the embassy (the expensive line) you only need to do that once to get the 'CIU' number that you need to email the embassy in future to get your questions answered quickly. Once you email them using that number, you can respond to their direct responses to your email 'conversation' style.

You dont need to do what I did and call the embassy to get the CIU number every time you want to ask a question! It becomes a little expensive.

As always, thanks a bunch! Hope you had a good xmas mate.

Yeah, we're hoping everything will be transferred straight to the embassy, sounds easier to me. Can't say i'm looking forwards to the medical, paying £200 for a nude exam isn't my idea of fun, but I guess it must be done lol

There is actually a new criteria called "Compelling medical situation" that I don't believe is on the USCIS expedite criteria webpage. We also went with "extreme emergent situation."

My wife has a myriad of health problems. I don't wish to divulge too much, but one of them is medical complication from a bone marrow transplant which was treatment for leukemia.
