K-1 Fiance(e) Visa Process & ProceduresNOA1

Ok perhaps this is a dumb question but is there more then one NOA1 that you receive. Looking at some timelines I saw some people with 2 dates for receiving this. I have received the I-797C, Notice of Action. The notice type says receipt notice. Is this all I will get until an RFE(hopefully not) or an NOA2 or will I get a different NOA1? Any knowledge anyone might share would be greatly appreciated. Thank you in advance to all that respond.

I believe you only get one NOA1, then RFE if there is one, and then once RFE is cleared up, NOA2

I keep reading things about sending forms tothe NVC be the agent for the bennificiary? is this for both k1 and k3 or just k3?
is there any way to get the NVC to send the packet 3 or 4 whatever they send  to me?

[/quote]
OK, the NVC is nothing to do with you. As a K-1, your petition will pass through there in less than one week (not less than one week from today--it can take as much as a month for it to get TO the NVC). They do whatever they do and forward the petition to the Consulate.

Just to mention, your K1 can stay at the NVC for up to a month or more depending on how long the processing takes, I was expecting a week at the NVC because that is what everyone was saying and it ended up staying there a month, just wanted to let you know, just in case that should happen.

K-1 Fiance(e) Visa Process & Proceduresthe NOA2 Torrent--a 'what next?' lecture Please!

Yes, I realize ther is an official guide http://www.visajourn...mp;page=k1guide

But I'd like to hear from some of you veterans---what would you add (or subtract) fro that guide?

For instance----the guide says to send your Fiancee a complete copy of the 1-129E package-----but so far I don't get the impression from the what the USCIS has sent me that this necessary---

or--- send in the originals of what you sent copies of for the 129F application?
So I sent copes of my passport (an baptismal dertificate) ---so I'm suposed to send her my PASSPORT?
(and a valuable document like my baptismal cert?) and entrust these things to the notorius mail system of her country?? I don't THINK so!

Lay some wisdom on us youse veterans of this process! Please!

John, the Guides were written by 'veterans' ie people who have been through the process and laid it down for those who will come along afterward. Have you also checked the K-1 FAQ here?

The rule of thumb is that the visa applicant should be prepared to show an original of any copy that has been submitted--so that is the *general* advice.
You might get a better idea of what is next by focusing on reports from people who have used YOUR Consulate--policies and requirements vary by location.

Your beneficiary will soon receive a packet of information detailing what's required for the interview. Find out what those things are, and get them prepared. Different types of evidence are more important at one post than another, so do some background on the Consulate your sweetie will use.

I have a question though, the guides don't say exactly what is the next step...or maybe im just lame

I keep reading things about sending forms tothe NVC be the agent for the bennificiary? is this for both k1 and k3 or just k3?
is there any way to get the NVC to send the packet 3 or 4 whatever they send  to me?

my isue is that the embassy in my future is Guayaquil, Ecuador...here on VJ there is only one rcord for that embassy and it's outdated ;) I've been like a "dog on a bone" at the embassy website for the past 3 days and only find myself more confused by there bad spanglish, poor spanish (makes me wonder what they do speak) and out dated forms that are no longer accepted

Besides that, they state they want an affidavit of support but don't list which of the three available they will take.

so, sorry for the vent :innocent: do I contact the NVC?? what do I ask for?? why?? do I send them the choice of agent form?? what do they send to my fiance?? and sorry, yes this is for K1 :D

Thank very much,

P.S. after waiting 146 days for the NOA2 ... I want to try to get this ball rolling

John for K1 you don't go through the choice of agent process. Once your petition is approved it is forwarded to the NVC where it will be processed and given another case number, you should receive a letter from them stating this. Then it is forwarded to the Consulate from there. As for the documents, it does depend a whole lot on the Consulate you are dealing with, but there are some things that most everyone has to send to the beneficiary. Have you tried contacting the Consulate that you are going to be dealing with? Do they have an email address? If they do I would try contacting them and asking them what documents they require for the interview. Just as an example I am going to post what I sent to my fiance recently, but this is for the South Korea Embassy.

K-1 Fiance(e) Visa Process & ProceduresConfused by I-129F Question 18 (description portion)

Hi all (again) :-)

I'm putting the finishing touches to my supplemental letter for Question 18 on the I-129F and I must admit that I am still a little confused about what USCIS means by "describe the circumstances under which you met".

I just took the opportunity to tell OUR story, about how we met on the Lucky Lovers matching site and shared at least a hundred e-mails and dozens of phone calls getting to know each other before I finally made the trip to Moscow to meet her in person about 5 months later. I go on to describe the time that we spent together, and how I met her family, and stayed in her home during the visit. Brief mention is made of the fact that I've made 2 additional trips in the last year and a half, And of course, I give mention about our genuine love for each other and our hopes for the future. In all, it's about 1 page long.

Is this what they want to see? Or something else? I want to get this right the first time!

Thanks!!!

I think that should be more than enough, I just put a few lines about how my fiance and I met, when, and where, and mine was approved fine

First of all the guides give you a great list of what to send after you get your NOA2, you may want to look at. I am also going to post what I just recently sent my fiance, because our interview is coming up soon, hopefully this will help you, but this is for example only, you need to contact your Consulate and find out what forms they require, especially when it comes to the Affidavit of Support.

FOR EXAMPLE ONLY

• Page 1 – NOA1, NOA2, Letter from NVC and copies

• Page 2 – Updated Fiance letter of Intent dated and copies

K-1 Fiance(e) Visa Process & Proceduresforseen address for my fiance

Ok...so, question...
I-129F it asks the address where my fiance will live when he gets to the US. My plan is to rent an apartment before he gets here, which will be ours after we are married. (I currently live with my mom~I'm only 21...but I am in the process of saving and setting up an apartment...but don't yet have it.) He will stay in the apartment and I will stay with my mom until we get married. (We don't plan on waiting too long to get married but maybe like 2 weeks or something)...So, my question is...is it a bad idea to answer that question with the truth...how i am going to rent an apartment for us (for him until we get married)...I planned on writing that i didn't have the exact address yet but we will rent an apartment in my town....blah blah blah...i basically was going to explain what i just explained to you guys. or is it better to give an exact address (my parent's address) albeit no exactly the whole truth...i'd love to hear your opinions on this one. thanks!

Well, if you don't have the apartments address as of yet and you are getting ready to send off the petition, I would say you would need to use your parents address, because technically the apartment does not exist yet. right? I think USCIS is looking for an exact address on the petition. Others may have different opinions on this, this is just my opinion.

NVC will send you a letter informing you that they have rec'd your case, it has been taking awhile though for CSC to send them lately. One other thing you can do is call them directly, the NVC phone # is listed on the NVC forum. They are very very nice and helpful, it will be a big change from dealing with USCIS. The are open Mon-Fri 7:30am-12am. You need to keep in contact with them in order to find out when they have sent your petition off to the Embassy. They will give you that information over the phone.

I just got off the Phone with the National Service Center and bec they transfered my I-129-F to CSC for processing on the April 12th she just told me that I have to wait another 30 days for our approval, and i am seeing other NOA2's from may june and july being approved already and all she could say was that she was sorry and it just depends on whose desk our package lands on as to how fast we get our NOA2's. Thats BULL!! They should be better organized than that, but hey! we are dealing with our gov. need I say any more!!!     :crying: :help: :help:

Cuddlebug, I feel for you...especially since they are adjudicating a lot of July cases now. I hope you hear something soon but you may have to take some kind of action to get the ball rolling. I just wonder if some adjudicators are much slower than others and it's some kind of luck of the draw whose desk your case ends up on.

I know I shouldn't, but I'm starting to get frustrated when I see others getting approved that turned in their petitions after mine and I haven't even gotten a touch in two months. I can only imagine how you must feel. I hope things get worked out for you.

I agree with you but it seems like every action that I take I seem to get either pushed off or no answer at all.
everyone knows that you cant call the CSC and get answers, and we should have had our NOA2 by now, or at least I would have thought so. This is getting too stupid and ridiculous of how they are doing things now. It seems like nothing is in order and the sad part about it no one can give or get any more answers. If this was an election year these people would pop up out of the wood works and be begging to lend a hand to solve our problem    :help: :help:

We filed our I-129-F in March and received the NOA1 on 03/30/06 then transferred to
CSC in April. Received RFE in July, the CSC has acknowledged returned RFE, been touched 1 time on 08/11/06, and when I call the so called Service Center Customer Service they acknowledge the receipt of RFE on July 12th and we should have a decesion with in the 60 day time frame. Now I know like alot of others here I am as frustrated as we all are. I know that CSC cant get their act together, but does anyone have any idea what is going on with the CSC, does anyone have any suggestions, I have tried congressmen and senators, and no response. I sure would love some new ideas if anyone has any. We are waiting like others 161+ days so far and still counting. :crying: :(

The sad part is ITS GETTING WORSE!! NO one in gov seems to be hearing our pleas for HELP!! SO WHAT DO WE DO?

I completely sympathize with your frustrations and anger!! And I have no clue as to why CSC is processing or not-processing petitions in the order that they are ......
That said, I would definitely recommend writing a letter to your Senator asap and asking to his/her office to make an inquiry into your case and either 1) push it along, or 2) get answers.

Best of luck to you, and try to hang in there just a little longer ..... it can't possible be much longer.

Been there done that and never received any response at all. I have heard through grapevines that even the inquiries in to immigration are not being done either. This seems to be a very hot topic right now at our borders and no one wants to touch the subject or dont want to rock the boat bec someone in GOV cant make up their minds on a solution.
